00:00:00.000 I think sometimes it's important to do a little bit of reality check and take a little different
00:00:16.880 spin at the numbers. I'm going to do that right here because all we talk about is how unpopular
00:00:21.100 Donald Trump is. But in reality, he's basically more popular than he was at any point in term
00:00:26.860 number one and more popular than he was when he won election back in November of 2024. What are we
00:00:32.520 talking about? His net favorable rating right now comes in at minus four points. Compare that to
00:00:36.440 where he was when he won in November of 2024 when he was at minus seven points or March of 2017 when
00:00:42.940 he was at minus 10 points. So when you compare Trump against himself, he's actually closer to the apex
00:00:48.620 than he is to the bottom of the trough. And of course, that's so important because Donald Trump,
00:00:53.060 historically speaking, has had his numbers underestimated. So I think it's very important
00:00:57.860 to compare him to himself to understand he's actually more popular now than he was when he
00:01:02.040 won or certainly where he was at this point back in his first term. The bottom line is Trump is more
00:01:08.120 towards the ceiling than he is towards the floor. So when you do that, it makes my knees hurt.
00:01:12.760 So when you look at this compared to sort of historically, what does it tell you about the
00:01:18.720 percentage of folks that think the country itself with him at the helm is on the right track?
00:01:24.320 This I think is rather important because again, if the polls have historically underestimated Donald
00:01:28.500 Trump, what is a metric that might get at understanding at how popular he may actually
00:01:32.700 be? So let's take a look at the percentage of the country who say that we're on the right track.
00:01:37.140 It's actually a very high percentage when you compare it to some historical numbers. What are we
00:01:40.760 talking about? According to Marist, 45% say that we're on the right track. That's the second highest
00:01:45.200 that Marist has measured since 2009. How about NBC News? 44%. That's the highest since 2004.
00:01:52.040 The bottom line is the percentage of Americans who say we're on the right track is through the roof.
00:01:56.260 And if you were to compare it to when presidents have historically been reelected, of course,
00:01:59.820 Trump is not constitutionally eligible to run for reelection, but I think it sort of puts it in
00:02:03.420 perspective. 42% of the country says the country is on the right track when the incumbent party is
00:02:08.180 reelected. And also keep in mind, back when Kamala Harris lost and the Democrats were turned out of
00:02:13.180 power. Only about 27 to 28% of the country said the country was on the right track. The bottom line
00:02:18.080 is right now a much higher percentage of the country says we're on the right track. And finally,
00:02:22.460 Sarah Seidner, I want to put it all in the congressional generic ballot.
00:02:25.800 What about Congress? What about Congress? Because those are the folks who are up in 2026. And take a
00:02:31.100 look here. The Dems versus the Republicans on the generic congressional ballot. Back in November of
00:02:35.040 2020, when Democrats won, it was plus five Democrats, tied in November of 2022, plus one in November of
00:02:40.960 2024 when Republicans maintain control. And then you look at March of 2025. This number looks a lot
00:02:47.300 more like 2022 or 2024 when Republicans won control of Congress. The bottom line is, yes, Donald Trump's
00:02:53.400 approval rating is lower than compared to a lot of his predecessors, but it's higher than compared to
00:02:58.060 himself. A lot of folks say the country's on the right track and the generic congressional ballot looks
00:03:01.660 a heck of a lot more like when Republicans win than when Democrats win. It will be interesting to see
00:03:06.420 if any of what just happened with these leaking of the text plays into it in a later poll. But this
00:03:12.100 is very telling.

00:03:24.680 Tuesday, 25 March in the year of over 2025. Polling right there, right track, wrong track being the
00:03:31.120 key. I want to bring in Mark Mitchell. Also the policies. We've got Julie Kelly and Mike Davis here
00:03:37.320 because the second front of takedown President Trump is this judicial insurrection, but this is
00:03:43.940 based on policies of what they're coming up for. Also note to self, we finished the first hour
00:03:49.980 talking about the executive order President Trump signed today on election integrity. We're trying to
00:03:56.440 get later in this hour, Chuck Gray from the great state of Wyoming has been working on this secretary of
00:04:01.800 state. Already multiple lawsuits filed in court to stop President Trump on election integrity
00:04:08.940 about having to show an ID to show you a U.S. citizen and many other things. Already they're in court.
00:04:16.040 Mark Mitchell of Rasmussen, amazing poll out this morning. Walk me through because this, what you're
00:04:21.320 talking about in this poll and you're showing the American people favor is the foundational element
00:04:28.240 of a number of lawsuits that are coming after President Trump, including a big one in Washington,
00:04:33.220 D.C. Can you explain what your poll shows, Mark Mitchell?
00:04:37.480 Oh, I feel dirty after watching CNN because this is the same CNN. Harry Enten comes out and says,
00:04:43.140 look at that. Everybody's super happy as measured by right direction. But just a week ago with one of
00:04:48.400 their own polls, they were trying to convince everybody that no, Donald Trump's approval is plunging.
00:04:53.200 And if you listen to Rasmussen report reports way back in January, I said the number to follow this term
00:04:58.660 is not Trump approval because they've thrown everything at Trump. He's pretty much earned his 52 percent.
00:05:03.800 He's going to stay there. Guess where he is today in my polling? He's still at 52 percent.
00:05:08.420 But we saw right direction shoot up to 48 percent a month ago, the highest in our 19 years of polling.
00:05:14.240 And today our right track is 45 percent. The exact same as Marist, the exact same as NBC.
00:05:20.920 So what's interesting is they match me on right direction. But for some reason,
00:05:24.640 their Trump approval numbers are 10, 15 points to the left. Guess what?
00:05:28.500 Donald Trump's approval rating is locked in at 51, 52 percent. It's going to stay there.
00:05:33.320 But what's new is that people like what they see out of Donald Trump's presidency because he's
00:05:37.700 finally giving them what they've wanted this entire time. And that's basically a party that's not
00:05:42.160 controlled opposition that's going to go in and cut the government. Now, we've asked so many
00:05:46.960 different ways. Hang on, hang on, hang on, hang on, hang on, hang on, hang on, hang on, full stop.
00:05:52.820 Also to take on elite institutions. When I took the campaign over in mid-August of 2016,
00:06:00.320 I said the key number is right track, wrong track. After Obama's eight years of hope and change,
00:06:05.680 it was two thirds wrong track, one third right track. That number almost goes back
00:06:11.820 to when people realize what we had gotten into with the Iraq war back in 2004. From 2004 and then
00:06:19.840 2009 with the financial collapse, the American people realize something is deeply wrong with
00:06:25.540 the country and the elites are leading us down off an abyss. It's Trump that's got it back to 44,
00:06:32.220 45 percent. And he's doing big things. This is not changing like Clinton school uniforms for kids.
00:06:39.380 He is doing the biggest geo-economic, geo-strategic pivot since World War II. He is securing the
00:06:46.440 border, getting our sovereignty back, mass deportations, huge effort on the economy, bringing
00:06:51.300 hundreds of billions, hundreds of billions, almost a trillion dollars from major corporations that
00:06:56.220 have been plants here. Everything he's doing is at a scale, just like this election integrity day.
00:07:01.260 This is not a small executive order. This thing goes on for page after page after page. Mark Mitchell in
00:07:08.520 Rasmussen, tell me about some of these policies you've been tracking, because we finally have a
00:07:14.620 president that's broken through that barrier of the country being on the wrong track. People are coming
00:07:19.520 together and say, hey, I see this guy's taking on elite institutions. He's got me in the room. He's
00:07:25.180 listened to American citizens. He represents the little guy. We're making some progress, sir.
00:07:31.060 Yeah, the last time the right direction was this high was in February of 2020. And we all know what
00:07:37.820 happened the following month. So this is almost like a natural extension of the first Trump term,
00:07:42.900 leveled up, giving people finally what they want. We've asked about mass deportations.
00:07:47.440 They absolutely want it. We ask about drastic cuts to the government. We get numbers in the 60s.
00:07:52.660 And we're trying frantically to keep up with everything in the news. But we just asked about
00:07:57.140 this stuff with the Venezuelan gangs and U.S. likely voters, 64 percent support, only 26 percent
00:08:05.380 oppose deporting these gang members. Like, imagine that. Like, imagine you have some unelected judge
00:08:11.980 going out there and hampering the Trump administration in things that are obviously counter to the interests
00:08:17.500 of the voters. Well, guess what? They don't want that crap anymore. We asked about whether this
00:08:21.980 judge should be impeached or not. And it's a two to one majority. Yes. 49 percent to 24.
00:08:28.260 So overwhelmingly, they say, no, like, stop this. Stop impeding Donald Trump. We asked about the
00:08:33.940 Democrats. Do you like the way that they opposed Trump's speech? Nobody liked it. We asked if they
00:08:40.180 should cooperate with Trump or oppose him. And they say cooperate by like 20 points. And what's crazy is
00:08:46.340 the Democrats like don't they they're not getting this at all. They're in a complete civil war ripping
00:08:51.600 themselves apart. Some of the numbers I sent you just earlier today are just absolutely astounding.
00:08:56.800 You have the crazies on the Democrats side trying to wring control of the mouthpiece and shift it into
00:09:03.980 this like anti oligarchy, eat the rich kind of thing that supports violent protests. And the mainstream
00:09:09.860 media is doing the shilling for them still, I think, like carrying out these psyops. I can't
00:09:15.540 understand why you would try and convince the nation that Donald Trump's approval rating is failing.
00:09:20.100 Like last week, they were cherry picking polls like Quinnipiac and CNN. They're horrible outliers
00:09:25.980 in order to paint that narrative. But we asked Democrats like, hey, you know, Chuck Schumer just
00:09:32.140 helped kick the can. He helped sign off on this deal to increase the debt limit and avert a shutdown.
00:09:39.700 And Democrats overwhelmingly approve of that. Sixty five percent to only twenty six percent. But if
00:09:45.360 you listen to the media, it's like, well, they're ready to feed this guy into a wood chipper. They
00:09:48.760 want him to resign. They they want to pretend he never existed. And which is closer to your opinion.
00:09:54.840 Schumer is a valuable leader for Senate Senate Democrats or Senate Democrats need to get rid of
00:10:00.080 Chuck Schumer. And Democrats say he's a valuable leader. Fifty two percent to thirty three percent.

00:10:08.460 you have all these people on blue sky clicking the little like button on that AOC, on that Bernie
00:10:13.100 Sanders, you know, event they had out in that stadium. But that's not where the party should
00:10:18.680 be going. And voters are screaming for the Democrats to just back off of this thing.
00:10:24.120 Does the party need to be more moderate or does it need to be more liberal? Fifty nine percent
00:10:28.440 of the country says more moderate. Twenty seven percent says more liberal. Democrats say more moderate.
00:10:33.500 Forty nine percent to thirty eight percent. Mark, this is amazing. The numbers you've had you've
00:10:41.380 been putting up. I want to make sure we don't bear the lead for what we're covering today, which is
00:10:45.680 judicial insurrection. Please go back and tell me what the American people think on the topic of
00:10:51.380 impeachment of this judge that is trying to get in the way of President Trump as commander in chief,
00:10:56.440 sir. So what I'll say is that there is a little bit of a tricky path that has to be traced here by
00:11:04.340 by Trump. He doesn't have carte blanche to just roll ride roughshod over the judiciary. Now, we know
00:11:10.060 that they've overstepped, but voters don't necessarily know this. So should Trump just ignore
00:11:15.520 federal court injunctions he believes are unconstitutional? Only twenty seven percent of
00:11:19.740 voters say yes. Sixty percent say no. But then when you talk about the very specific policy,
00:11:25.860 like, hey, yeah, this judge just stepped in and prevented the deportation of these people.
00:11:32.840 Americans like, no, that's messed up. Impeach the guy. Forty nine percent want this particular judge,
00:11:38.740 Bozberg, impeached over this situation with the Venezuelan gang members. Forty nine percent to twenty
00:11:43.940 four percent. Now, there's a little bit of not sure is in there. The Democrats,
00:11:47.600 twenty eight percent of them say yes. Only thirty six percent say no. Republicans, though,
00:11:53.120 it's seventy four percent to fourteen independents, forty seven percent to twenty two percent. And
00:11:58.760 again, we had sixty four percent who say, yeah, I absolutely support deporting these people who
00:12:04.380 are trying to kill my children and living off the government dole. Only twenty six percent oppose
00:12:09.780 that. Even forty three percent of Democrats are like, yeah, deport these people. And so what I think
00:12:15.240 this is a message to is Congress. You have Trump here who's trying to do the right thing. He's
00:12:21.560 following his constitutional limitations. You have a judiciary that is overstepped and you have
00:12:27.180 Congress who I think by all measures can be said to have like the output's not high, right? The output
00:12:33.660 is absolutely not high. Trump came out of the gate with shock and awe and days of thunder and whatever.
00:12:38.160 And it's like a tea party right now down in down in the Republican House. You know,
00:12:43.120 they're taking breaks going down to the town halls. It's like, you know, maybe you should codify that
00:12:49.260 election thing now. Maybe it's time to wrap up those courts. I wish we had polling on that because
00:12:53.560 my understanding is this could be done by Friday. Right. And I don't know if I want to hear about
00:12:58.680 necessarily the nuclear option anymore because didn't, you know, Harry Reid sort of throw that one
00:13:03.780 under the bus just to get some judges confirmed. So I don't know. But what voters say is that this
00:13:09.820 is a potential constitutional crisis. Now, we in politics know that there's probably about 30 or 40
00:13:15.840 constitutional crises so far just in, you know, the Trump era. But we ask voters, is this current
00:13:23.500 conflict between Trump and federal judges a constitutional crisis? 57 percent say yes. 28 percent say no.
00:13:30.420 Now, they're not assigning blames, but Democrats are more likely to say yes. It's like somebody has
00:13:36.320 an obligation constitutionally to get us out of this situation. And maybe it's the Supreme Court.
00:13:41.780 Maybe it's Congress. But my advice to them would be, you know, voters are happy. They don't want this
00:13:47.020 impeded. And it's just going to upset a lot of people. Right. If the if the wheels come off of this
00:13:52.280 and it all gets stopped because of this fight over judges.

00:14:58.920 And the demographic breakdown is really fascinating in terms of the deportation plans for the TDA gang
00:15:05.880 members. You know what demographic is most supportive? Hispanics. So they understand the unique
00:15:13.040 threat that thousands of these Trande Aragua gangsters who are involved in human trafficking,
00:15:20.740 sex trafficking, obviously drug running. They have taken over certain areas of major cities.
00:15:27.380 I talked to a police officer in Chicago a few weeks ago who talked about these high end retail
00:15:35.120 burglary rings that the TDA members and other illegals are responsible for. So people I mean,
00:15:44.540 Judge Bosberg doesn't have to worry about that, right? Because he's a Beltway lifer and he's his
00:15:50.520 family is doing well. And as we know, they're connected to NGOs and other organizations specifically
00:15:58.520 tied to helping illegal immigrants. So he doesn't have to worry about these TDA members coming into
00:16:05.580 his neighborhood. Will this impact, will polling like that impact his decisions? No. But we did get
00:16:14.480 a little indication last Friday that he's very aware of the public interest and coverage of what's
00:16:19.880 happening here. He tried to backtrack a little during that hearing and certainly in his order that was
00:16:25.780 issued just a few hours before oral arguments yesterday in this case. But I know you and I talked
00:16:33.460 about this off camera. I do not see him relenting at all. If anything, after the invocation, the
00:16:40.880 government DOJ last night saying they will invoke state secret privilege to keep details of the deportation
00:16:48.180 flights away from him. I would be shocked if he gave up on this.

00:16:58.420 go and play the clip about the state invocation of the state secrets act last night by the attorney
00:17:04.360 general in the White House. Let's play it. The Trump administration is escalating its open defiance
00:17:09.080 of a federal judge in its quest to deport a Venezuelan nationals without any due process.
00:17:14.620 The New York Times reporting, quote, the Trump administration told a federal judge on Monday
00:17:19.380 night that it would not disclose any further information about two flights of Venezuelan
00:17:24.400 migrants it sent to El Salvador this month, despite a court order to turn back the planes,
00:17:29.740 declaring that doing so would jeopardize state secrets. This claim comes after the presiding
00:17:35.360 judge, James Bozberg, has spent nearly 10 days trying to get the Trump administration to answer
00:17:40.500 his questions about whether two plane loads of Venezuelan nationals were deported in direct
00:17:45.820 violation of his order to have the planes carrying them returned to the United States.
00:17:51.420 Late yesterday evening, the Justice Department doubling down on its stonewalling of Judge
00:17:55.760 Bozberg. The Times adding this, quote, the Justice Department told Judge Bozberg that giving him any
00:18:01.180 further information about the flights would undermine or impede future counterterrorism operations.
00:18:06.840 The administration has not even claimed the information at issue is classified. Instead,
00:18:12.720 it submitted statements from Marco Rubio and Kristi Noem, the secretaries of state and homeland
00:18:17.300 security, saying that sharing the information with a court would jeopardize national security and
00:18:22.840 foreign policy. These unsubstantiated claims by the Justice Department came the same day as Judge
00:18:29.000 Bozberg affirmed his order barring the Trump administration from using the Alien Enemies Act to
00:18:35.040 summarily deport Venezuelan nationals.
00:18:40.920 Menendez, who's now one of the anchors over at MSNBC, and I think she does, she's as tough as
00:18:45.860 boot leather. She's correct, is she not, Julie Kelly? This is a major escalation between the White
00:18:52.880 House now in the courts, is it not, ma'am? Oh, it absolutely is. And the administration warned
00:19:00.200 Judge Bozberg that this would be their next step if he continued to demand details, granular details,
00:19:07.500 about these flights on March 15th. When he rushed the proceedings, the ACLU, Judge Bozberg confirmed in
00:19:15.800 his order yesterday, 37-page order, talking about why he would not vacate his original temporary
00:19:23.700 restraining orders, confirming that this lawsuit was filed at 2 a.m. on Saturday, March 15th.
00:19:29.580 He got this case at 8 a.m. on Saturday, immediately reached out to both sides, the government and the
00:19:36.900 ACLU, immediately entered a temporary restraining order without even hearing from the Department of
00:19:43.260 Justice about this newly signed and published proclamation of the president invoking the Alien
00:19:50.280 Enemies Act without any input whatsoever. He immediately issued at about 9.45 a.m.
00:19:58.660 his first temporary restraining order prohibiting the deportation of these five unidentified Venezuelan
00:20:06.560 illegals that are tied to TDA. Then he rushed the process even further, did not allow the DOJ to file
00:20:14.880 any sort of brief in response to this lawsuit, set a 5 p.m. hearing on March 15th, where verbally
00:20:22.060 during that hearing, and he took a big break in between because no one was prepared, certainly the
00:20:27.980 DOJ was not prepared for this at all. And at about 6.45 p.m., he makes the verbal comment telling the
00:20:35.960 Department of Justice if there's any planes that had taken off during the hearing. 5.30 and about 5.40,
00:20:43.040 two planes left for one for El Salvador, one for Honduras, to turn those planes around. He said that
00:20:50.800 verbally. Then at 7.30, he issued another TRO, turning those five illegals into a class action
00:20:58.140 lawsuit covering any Venezuelan illegal TDA member who would be subjected to this Alien Enemies Act
00:21:06.260 proclamation, turns it into a class action lawsuit. This is how quickly Bosberg moved on Saturday.
00:21:12.120 Then entered another TRO prohibiting the government from removing any of those in the class action.
00:21:20.040 However, Steve, he did not codify the turn the planes around comment that he made verbally. And this is a
00:21:27.460 huge, a big dispute between the Department of Justice and the judge right now, that that verbal command
00:21:33.800 is not controlling, that only the two-minute orders with the temporary restraining orders are controlling.
00:21:41.600 Bosberg wants this information to catch the DOJ in a lie. He has already suggested that they have mislead the
00:21:49.060 court. He said it again during the hearing last Friday. He doesn't want this for national security purposes or
00:21:55.960 even to protect the due process rights, as he claims, of these Venezuelan illegals. No. He wants to bolster what that
00:22:03.020 MSNBC person just said that they are flagrantly violating a court order. There's no evidence of
00:22:13.320 that at all. They have already said that they were in compliance. We know that they were in compliance
00:22:18.480 because there's testimony from five Venezuelan illegals who were removed from the plane.
00:22:25.240 The ACLU has even filed that themselves. So we know that they were in compliance.
00:22:30.580 He has nefarious, sinister political reasons for wanting this granular detail and invoking state's secret
00:22:39.040 privilege. And the declarations made last night in that filing by Attorney General Pambandi, DHS Secretary
00:22:46.760 Kristi Noem, and Secretary of State Marco Rubio very strongly made their case, argued, that disclosing this,
00:22:57.040 especially to a reckless partisan judge. They didn't say that I'm saying that compromises national security
00:23:05.420 and is at risk of disclosing very careful deliberations between other countries in removing
00:23:14.100 these individuals, placing them in prisons outside of the United States. So this is the bad guy in all
00:23:23.040 this, of course, is Judge Bosworth. Now, will he relent on this? Again, I don't think so.
00:23:28.420 Well, let's, that's, hang on, hang on. That's the question. Of course, you've seen the polling
00:23:33.020 overwhelmingly by two-thirds, one-third, the American people, or two-thirds less than one-third,
00:23:38.840 the American people want this to continue. Even two to one, that without really understanding the
00:23:45.980 facts like the Warren Posse understands them, they're two to one to impeach if anybody intrudes
00:23:51.520 on the commander-in-chief, on his commander-in-chief role. The great Matt Gaetz, who's got a tremendous
00:23:57.660 feel for this, he put out a tweet last night of the state secret, said, hey, game set, it's over,
00:24:01.800 boom, shut the full shutdown. Do you agree with Gaetz, or do you think this judge keeps rolling hard,
00:24:07.780 ma'am? With all due respect to Matt Gaetz, and I like Matt Gaetz a lot, I've covered this judge for
00:24:15.760 years. I've covered all these judges. I understand the poisonous groupthink that exists in that federal
00:24:23.320 courthouse in Washington. It's not a coincidence that they are all working in lockstep together
00:24:29.580 to enter these temporary restraining orders, preliminary injunctions, overturning key elements
00:24:36.560 of executive orders. That is a sick place, okay? I've covered it. I know Matt would probably agree
00:24:43.760 that I probably understand what happens in there more so than he does. I have seen these judges in
00:24:50.840 action. They don't care if they're overturned by an appellate court. Jeb Bosberg, it appears anyway,
00:24:57.320 there's a good chance he will. I was in Tanya Chutkin's courtroom a month after the Supreme Court
00:25:03.880 reversed her immunity order. And Steve, she strutted in there like she had just won the Miss America
00:25:09.240 pageant. They don't care. They think these higher courts, especially the Supreme Court,
00:25:13.960 are illegitimate, these Democratic judges.

00:41:05.720 that piece of legislation and some others to address it because we have an Article One authority
00:41:09.480 under the Constitution to do that. We do have authority over the federal courts, as you know.
00:41:14.340 We can, we can eliminate an entire district court. We, we have power funding over the courts and all
00:41:19.400 these other things. But Desperate Times call for desperate measures and Congress is going to act.
