00:00:49.080Well, not only do they have to refile it in Texas, but one of the things, Kitty, that's unclear is whether or not this can proceed as a class action.
00:00:57.320As originally filed, there were five plaintiffs.
00:01:01.180They then asked Judge Bosberg to certify a class, meaning a group of people similarly situated,
00:01:07.600but not necessarily people that you could individually name or who had been individually represented.
00:01:13.460Now, not only do they have to file in their place of confinement, which for some of these people may be Texas and others may not,
00:01:21.340but it's unclear whether they can sort of move together as a group.
00:01:24.840The ACLU filing a new case today in the Southern District of New York on behalf of two of those five people,
00:01:30.760who they say are no longer in Texas, but have been moved to custody in Orange County at a correctional facility here in the state of New York.
00:01:37.800If it is filed in Texas, is there any chance that it ends up going to Judge Kaczmarek?
00:01:55.980I think overall, the tenor of your question, if I understand it, is are there likely to be judges in Texas who will be favorable to the Trump administration?
00:02:07.940I would say the chances that they will encounter judges who are sympathetic to their point of view is much higher in Texas than it is in other places of the country,
00:02:16.500which is why the ACLU's decision to file here in New York while they have two plaintiffs here is somewhat of a genius move.
00:02:24.360Because, again, the court's ruling last night isn't so much about Texas.
00:02:27.700It's about you have to file in the place of confinement.
00:02:31.320If there are two people here at the time the habeas petition was filed, they are here.
00:02:36.060The Southern District of New York is the right location for that lawsuit.
00:02:38.660The Trump administration can now claim another legal win from the Supreme Court,
00:02:42.580but today's ruling is not the final say on what will happen as 16,000 probationary workers fired from the federal workforce.
00:02:50.540The nation's highest court backed the government's position and overturned a lower court ruling that ordered the employees be temporarily reinstated.
00:02:58.780CNN's Paula Reid is here now with us to explain.
00:03:01.280All right, Paula, break this ruling down for us.
00:03:03.520Rihanna, this is just the latest in a string of wins for the Trump administration from the Supreme Court.
00:03:09.340Here, the question was whether thousands of federal workers who were on probationary status,
00:03:15.340so that meant they had recently gotten their job, they didn't have all the full protections that other federal workers have,
00:03:21.160if they should remain on the payroll while the larger circumstances of their firing are litigated.
00:03:26.480Now, a lower court ruling said that they should be reinstated, put back on the payroll.
00:03:30.940But here, the Supreme Court disagreed.
00:03:33.440So this is significant, but I also want to caveat that this was a technical decision.
00:03:39.080The Supreme Court held that the unions that filed this specific lawsuit did not have what is called standing,
00:03:45.080or the right to bring this particular lawsuit.
00:03:48.460Now, while this is technical, this is still a win for the administration,
00:03:51.380but it's unclear what it means for all the probationary workers who have lost their jobs,
00:03:56.640because we've seen at least one other judge in Maryland rule that some other workers who are in probationary status needed to be reinstated.
00:04:04.240They were not covered by the specific lawsuit.
00:04:07.060But I will say that the Supreme Court has handed the administration several wins in recent days,
00:04:12.480both related to their enforcement of immigration laws, even using sort of expansive executive power,
00:04:18.960and also their efforts to cull the federal government.
00:04:21.840But this will continue to go on, this litigation, because no court has answered that final question
00:04:27.660on the merits about how these people were fired and whether it was legal.
00:04:32.160But while many of these folks are kicked off the payroll, they will likely have to go and find other jobs,
00:04:37.260which really helps the administration with their ultimate goal, which is to cull the federal government.
00:06:15.340They want to go to the friendliest courts.
00:06:16.980The Supreme Court said today—I mean, what did they really say about Trump as—because this is the one that goes to him as commander-in-chief.
00:06:26.780They said you have to file in the jurisdiction, so can the ACLU now go back and file in Texas, as MSNBC was talking about?
00:06:35.500They did rule out the possibility of this bogus thing that they're trying to make it a class
00:06:39.860so that everybody that was on the plane or everybody that went to that prison can join in this.
00:06:44.260But did they actually back Trump as commander-in-chief or just say, you went judge shopping and we're not going to allow that, sir?
00:06:53.740The president, as the commander-in-chief, has a constitutional duty to repel an invasion of our country.
00:07:00.400And the court made clear here that a D.C. activist judge, Jeb Bosberg, is not the proper judge.
00:07:07.620It's not the proper court to decide these matters.
00:07:09.720If you are one of these terrorists sent to El Salvador, you can file a habeas petition in the southern district of Texas from where those planes took off.
00:07:20.560You don't get to go pick a random Democrat activist judge in D.C. who's going to do these legal gymnastics
00:07:27.280and try to undo the president's power as commander-in-chief.
00:07:31.580So what do you think happens with this one?
00:07:35.800Do you think ACLU will try to file again and will go through this again?
00:07:39.480Or do you think they understand that the Supreme Court's kind of ruled and they don't want to deal with this nonsense?
00:08:05.560The only issue is whether they're part of Trende Aragua.
00:08:07.980And when you have Trende Aragua tattoos across your chest, that's a pretty good sign that you're part of Trende Aragua.
00:08:16.220Now, how does this tie to the one the other night where we had until midnight or they're going to be held in contempt that the guy had to be turned back over?
00:08:23.240Does that flow into this decision today from the Supreme Court about these terrorist organizations?
00:08:30.460Yeah, the Supreme Court stayed that decision.
00:08:33.020And so that those facts were better for the plaintiffs than the Trende Aragua fact.
00:08:39.200So it was pretty obvious where the Supreme Court was going to go on Trende Aragua.
00:08:44.340The American people elected President Trump to seal our border and get these dangerous illegal immigrants, including foreign terrorists, the hell out of our country.
00:08:55.980And the president is doing what he promised American voters he's going to do.
00:08:59.460And these activist judges are not going to stop him.
00:10:23.160A ruling in that lawsuit by the Associated Press against the Trump administration over the ban on access to certain parts of the White House.
00:10:31.640CNN's Brian Stelter, our media reporters here.
00:10:33.680Brian, this judge, we should note, is a Trump appointee.
00:10:39.880He says the White House ban against the AP is unconstitutional because it's a form of viewpoint discrimination.
00:10:46.060However, this judge did not immediately restore the AP's access.
00:10:49.720Associated Press reporters will not be allowed back in tomorrow necessarily.
00:10:53.740He delayed his order for one week, expecting an appeal from the White House as this case goes on.
00:10:59.300But the AP had been asking for immediate relief because this blockade was put into effect back in February by the Trump White House.
00:11:06.700This case stems from Trump telling the government to rename the Gulf of Mexico as the Gulf of America.
00:11:12.180The AP has customers around the world, including in Mexico.
00:11:14.880So it still says Gulf of Mexico, while also acknowledging Trump's order of Gulf of America.
00:11:20.660The Trump White House objected to the AP's editorial decision making.
00:11:24.340They started keeping the AP out of small press events in the Oval Office, also big press conferences, and banned the AP from Air Force One.
00:11:32.200Basically, the AP is no longer a part of the press pool.
00:11:34.900The Trump White House also took over the press pool and now chooses who's allowed in on any given day.
00:11:39.200So the AP filed suit in federal court, and this judge, Trevor McFadden, he has now ruled in the past few minutes, saying he's issuing a narrow ruling here, saying that the government offers no other plausible explanation for its treatment of the AP.
00:11:52.060The Constitution forbids viewpoint discrimination, even in a non-public forum like the Oval Office.
00:11:57.440He's saying you don't have to let everybody in, but if you're going to let some journalists in, you can't discriminate against the AP just because of their point of view.
00:12:04.380In this case, the point of view is that the Gulf of Mexico is the name known in other countries, and of course, that is true.
00:12:11.480This has been a quandary for news outlets that are fearing a slippery slope.
00:12:14.700But for now, at least today, the AP winning in court, Jake.
00:12:20.320Mike, one thing I want to bring up in your response to this is that, folks, the president's trying to do the trade deals.
00:12:27.080He's trying to do the geopolitical realignment besides the economic realignment.
00:12:58.920I don't know if this case will get upheld on appeal or not.
00:13:01.880But I like that President Trump is showing these institutions in Washington, whether they are the law firms, the media, the non-government organizations, the NGOs.
00:13:13.960He's showing them there is a new sheriff in town.
00:13:20.100And there are going to be consequences.
00:13:21.340He's learned his lessons from his first term.
00:13:25.800And he's not going to let the D.C. swamp chew him up and spit him out.
00:13:33.280Mike, on President Trump's tariffs, and particularly relating to China and really where he's throwing down hard,
00:13:39.880the Guardian's reporting that a massive lawsuits are coming, funded by the Kochs and by Leonard Leo's new operation.
00:13:48.460You started and kind of, you know, when you left the government, you did the Internet Accountability Project.
00:13:53.640You understand the tech bros and people that support them and the libertarians hate what President Trump's trying to do on the trade war and on tariffs.
00:16:25.080You would think that after this ruling today about President Trump as commander in chief,
00:16:32.420is it still your belief that he's going to proceed?
00:16:34.480I know he's asked for papers for filings.
00:16:36.580He's still going to proceed on the contempt charge about did they follow his order at 5.15 p.m. Eastern Daylight Time on Saturday afternoon?
00:16:46.520You still think he's going to go forward with that?
00:16:48.080Yes, and that's why the war room posse needs to put maximum pressure through both of their home state senators
00:16:56.640and their U.S. House rep at article3project.org, take action now to put pressure on Congress to get Jeb Bozburg to back down.
00:17:05.780Because if he holds Trump administration officials in contempt, he's going to take the judiciary over the cliff.
00:17:14.280Mike Davis, your social media also, we know where to go to Article 3.
00:17:28.000Thank you, Mike Davis, live from the White House.
00:17:31.180I'm sure that either Lawrence or Donald or Rachel Maddow or Chris Hayes, one of them will definitely respond to Mike Davis being on the White House.
00:17:42.860They melted down last week when I was over at the Justice Department.
00:17:48.280So let's do a reset on what the war against Trump, the war against MAGA, the war against President Trump's policies.
00:17:53.340If you just go back to the three lines, the number one is national security, which President Trump is redoing the entire geopolitical outlook of the United States, and particularly the weight of gravity of where our national security is going to be away from the Eurasian landmass and towards a hemispheric defense.
00:18:14.580Rahim Kassam is down with Pete Hegseth today in Panama.
00:18:20.300Rahim's going to be with him for a couple of days.
00:18:22.620We're going to look to get a report there.
00:18:25.020Also, Pete came out with a trillion dollar budget.
00:18:27.180This turns to the reconciliation of it all.
00:18:29.960You know, I can't make hiding or hair of this.
00:18:32.300I've gotten a lot of negative feedback, although people are trying to still push it.
00:18:35.900There is no vote, I don't think, scheduled tomorrow unless it wasn't until when I was getting ready for the show right beforehand.
00:18:43.340But the reconciliation right now is kind of very ill-defined because it's hard to understand what's the debt ceiling level, when's it going to kick in.
00:18:51.820And we do know Semaphore's got an incredible story up about President Trump telling senators for the first time he's open to actually raising the rate.
00:19:02.360It's called a snapback on the upper bracket.
00:19:04.580It would go, I think, from 37 percent to 39 percent.
00:19:07.540Or there's some discussion of creating a whole new class at a million dollars and above, and I think that would be at 39 or 40 percent.
00:19:14.720So there's a bunch of discussions there, but for the first time, they got confirmation that President Trump's actually been in this conversation.
00:19:21.140It's been more than some of the people working at a treasury in other places that the president's actually said that, and that's huge.
00:19:28.200So you've got this entire trade and the reorganization of the trading patterns, the trading laws, tariffs.
00:20:18.960President Trump in the trade war, the center of gravity, I mean, the weekend FT, I've held this up a couple of times for the simple reason the FT kind of got it, I think,
00:20:26.760immediately, that the center of gravity of this is China.
00:20:30.740And the reason is that the Wall Street people and the people that you see right now that are gnashing their teeth the most are the same hedge funds,
00:20:37.320the same private equity people that transferred, that really put the money up and supported the transfers of the factories.
00:20:45.340As the trade rep said today, five million high-paying manufacturing jobs.
00:20:51.060Five million high-paying manufacturing jobs followed the removal of our industrial base to China.
00:21:00.160The people yammering about this the most, the people pulling their hair out the most are the Wall Street,
00:21:04.220are the sociopathic overlords of easy money on Wall Street.
00:21:09.120And President Trump has dug in here, and particularly in China.
00:21:11.720He told people at the beginning, don't, when I put on this reciprocity, the formula, and you may not agree with the formula,
00:21:18.100but the formula is about and includes these following things, and that's why people are coming over here, South Korea, Japan, India.
00:29:13.160It helps control appetite and cravings.
00:29:15.240And it helps burn fat by converting fat into energy.
00:29:19.320Listen, if you're tired of losing weight and gaining it back, if you want to lose meaningful weight at a healthy pace, Lean was created for you.
00:29:27.680Let me get you started with 20% off when you enter Bannon20.
00:29:31.100That's B-A-N-N-O-N-20 at TakeLean.com.
00:29:58.300A former CIA, Pentagon, and White House advisor with an unmatched grasp of geopolitics and capital markets.
00:30:04.940Jim predicted Trump's Electoral College victory exactly 312 to 226, down to the actual number itself.
00:30:13.600Now he's issuing a dire warning about April 11th, a moment that could define Trump's presidency in your financial future.
00:30:22.000His latest book, Money GPT, exposes how AI is setting the stage for financial chaos, bank runs at lightning speeds, algorithm-driven crashes, and even threats to national security.
00:30:33.380Right now, war room members get a free copy of Money GPT when they sign up for Strategic Intelligence.
00:30:40.160This is Jim's flagship financial newsletter, Strategic Intelligence.
00:31:22.620This is just the only reason people have any concern at all is because the running dog for the capitalists on Wall Street in the Lords of Easy Money media continues to go on with this false narrative that prices are going to go up, stock market's going to crash, everything's going to happen over and over and over again without looking at any evidence.
00:31:40.340We put some of the strictest tariffs ever on China in 17 and 18, and prices didn't go up at all on Chinese product.
00:31:49.080This is just a false, another false narrative put out by the media.
00:31:53.100It's the same as all the lies they're told about the pandemic, all the lies they're told about the Ukraine, all the lies they're told about the Seoul election.
00:32:26.940But the reciprocity has a maximalist side where you just go and match whatever your analysis shows.
00:32:32.120He was also thinking there was tension around with President Trump to just do tiered at 20%.
00:32:36.500He did do reciprocity, which I thought was very important, to show the American people how people have abused the United States of America and American companies.
00:32:45.620And if they steal 2028, or for some reason we don't prevail, which will be them stealing it, Trump, they're going to put Trump back on trial for prison.
00:32:53.720They're going to put me back in prison.
00:32:54.880I think every day I said, hey, this thing's all or nothing.
00:32:58.160Just because we had this tremendous victory in November, October at the time, they're all partying.
00:47:50.000We haven't been able to get into it, but there's a whole lot today about Peter Navarro and Elon Musk and, you know, going in President Trump's position as a populist nationalist and what President Trump's putting forward.
00:47:59.140But I think if you look at everything, including the leak today that Semaphore's got about President Trump, the first time any Republicans ever thought in history about raising the taxes on the upper bracket or the people making over a million dollars a year.
00:48:43.060For the middle class and working class and for the entrepreneurs and maybe for some of the corporations, you do need to extend the tax cut.
00:48:52.120But then we get down to the tough, and I think Peter Schiff's going to talk about it tonight.
00:48:56.440And on this part of it, I do agree with Peter.
00:48:59.020You know, he's had 25 trillion over the next 10 years.
00:49:03.800I'm going to have to do the calculation.
00:49:04.820I think because he's done so much short-term, real short-term under Janet Yellen, and that's how third-world countries kind of do it, I think we have 10 trillion just in the next year that Scott's got to refinance.
00:49:16.500Birch Gold, the way he gets smarter in all this, and this is why we did it for you, is to go to birchgold.com slash abandon, the end of the dollar empire.
00:49:25.260Remember, all of this, even when Peter Schiff talks tonight or when you hear people talking, the greatest export we have is the dollar.
00:49:31.080Our system, the post-war system, is predicated upon that.
00:49:34.520It's not your fault that people are questioning, does that system work?
00:49:38.860They've been financially irresponsible.
00:49:41.520This is why in this reconciliation, we have to have a partner's discussion, and over the next couple of days, we're going to try to have it.
00:49:47.340It's number one, you know, can we afford, do we need and can we afford a trillion dollar defense budget, right?
00:49:53.680Don't we have a hemispheric defense now?
00:49:55.420Number two, on the discretionary income on the social programs, including Medicaid.
00:50:01.340I think there's things on Medicaid you can do, very smart understanding because the jobs don't pay what they used to pay.
00:50:10.780You just have to, you know, you have to come to that reality.
00:50:14.060It doesn't mean you can't cut, you can't make refinements and changes to Medicaid to make the number less, and also on the other social programs.
00:50:20.280I didn't say this was going to be painless.
00:50:22.400Cutting the budget is not going to be painless.
00:50:23.900We also need the doge aspect to come up.
00:50:26.960We need to see, like, the waste and the fraud now.
00:50:30.020We need to put real numbers to it, and we need to impound that money in the 2025 budget.
00:50:34.640Birchgold.com, the guys that you'll be thinking about tonight when you hear this.
00:50:38.400Birchgold, Philip Patrick, I think we're going to get Philip on tonight, but I want to delay it.
00:50:42.340Our day or two as this thing goes through, particularly midnight tonight when the Chinese, when the reciprocity kicks in.
