I could just tell you guys what was happening. And so much has happened since I've been off air. It's only been two weeks. I could be telling you anything. I love the live chat right now. The people that are guessing. One person has already guessed, is guessing I'm already pregnant again. But I did have a baby in the past two weeks. Also, somebody tried to kill me in case you missed that.

Whatever that means. The baby is mine. And of course, yay, dropped a new song while I was gone. And that is putting it mildly. And I'm very disappointed in how catchy the tune is. Really, I find myself just humming along.

00:04:25.380 His cases got overturned, which I'm glad to hear, because looking through this case has made me lose faith in the judicial process of America.

00:04:35.560 That's why this case matters, because I just gave birth to my third son and I just cannot imagine a scenario where the media can just effectively execute a hoax and nobody cares about the facts of the case.

00:04:51.320 They care about women crying on the stand and they go, oh, well, put him in prison.
00:04:56.000 But for those of you who have been locked into this series, it's in my view and in the view now of the appellate judges who overturned his prosecution was indeed a media hoax.
00:05:08.080 Harvey was essentially hanged because somebody had to pay for the hashtag Me Too.

00:05:37.540 But I'm going to very briefly run you through the absurdity of the New York cases that initially put him into prison before telling you the most absurd story ever about his trial in Los Angeles.

00:05:54.520 Every time I look through the facts of this case and realize that he says, I don't know this person.
00:06:00.880 And then the woman says, no, I don't know him either.
00:06:03.940 And yet somehow he gets convicted.

00:06:07.880 But let's start with the spark notes here from New York.

00:06:13.700 But Miriam Halei, also known as Mimi, is the individual that put Harvey away for 20 years.
00:06:21.840 The best way to quickly remember her story, which I want to be clear, I do not believe Mimi at all.
00:06:27.800 I do not believe her even one percent.
00:06:29.860 I'm always honest with you.
00:06:31.340 I've looked into this case.
00:06:33.400 Essentially, the story that she tells is kind of like that viral Super Bowl meme of the artist The Weeknd, you know, where he looks like he has no idea where he's going.

00:06:44.420 And I'll tell you why it is best remembered that way.
00:06:47.480 In short, Mimi met Harvey at the Cannes Film Festival.
00:06:52.500 She went up to his hotel at that time.
00:06:56.240 She claimed to be horrified by him already having made a pass at her.
00:07:00.600 And she was so horrified by what happened at the Cannes Film Festival that, and the emails reveal this, she immediately thereafter reaches out to his office, the Weinstein Company, and secures herself an internship at his company, working as a production assistant for Project Runway.
00:07:17.100 She was so horrified at what happened in Cannes that at the end of that internship, she decides to meet up with him at the Mercer Hotel to catch up.
00:07:25.500 She then heads down to his office to meet with someone else there.
00:07:29.680 And after seeing him, agrees for him to drive her back to her apartment in New York City.
00:07:35.420 And to be clear, his assistant was in the car with him at that time.
00:07:38.960 Now, she tells the story that that's when he marked where she lived, because obviously, if you're Harvey Weinstein, it would make sense that rather than inviting her somewhere, you're just going to figure out where she lives by dropping her off at home and then barge into her apartment later that evening.
00:07:54.240 And that's what she says happened.
00:07:56.180 He barged into her apartment.
00:07:58.140 Well, first, he rang the doorbell and she opened.
00:08:01.400 She had to obviously physically open the door, which the court transcripts show.
00:08:06.020 But then once he gets in through that door and in through a second secure door, which she doesn't really remember how he did that, he then instantly knew which apartment was hers.
00:08:17.400 He just took a lucky guess.
00:08:18.980 He was wandering around the apartment and somehow figured out on the floor which exact apartment was hers.
00:08:28.000 She's unclear on the details.
00:08:29.200 She's iffy on the details.
00:08:30.400 What you find when you read these court transcripts is that when these young women get into a hiccup, when they come across a hiccup and they can't really explain why something makes no sense, they just start crying harder.

00:08:44.920 They're overcome with emotion suddenly when something they say makes no sense.
00:08:50.800 OK, now you would think after that she would have gone to the police.
00:08:55.780 Of course, that's not what happened.
00:08:57.580 Just a few days beyond there, she alleges that he again and she was so upset with herself, got into a predicament where Harvey again assaulted her this time in a hotel room, which was his.
00:09:10.980 So she went into his hotel room upon invite and she says she was going, you know, to address him about what had happened earlier, but instead was assaulted again.
00:09:22.260 And after that assault, Mimi, like all the women involved, magically get tickets and red carpet premiere events.
00:09:30.100 Harvey is able to pay for their flights, sometimes to Los Angeles, sometimes to London.
00:09:35.440 Mimi keeps up this relationship with Harvey Weinstein spanning years, by the way.

00:09:41.160 And it is shown via the emails that she ends emails, Harvey XOXO, love Mimi.

00:09:59.060 And in this one, she's asking him or telling him that her cat needs feeding.

00:10:44.400 alleged assaults and when they can't explain why they would do that.

00:10:51.320 Jessica Mann, of course, is the second young woman who put Harvey into prison for just a
00:10:56.860 couple of years, this time for actual rape.
00:10:59.480 And you'll recall that I've had correspondences with Jessica Mann since she did a whole series
00:11:05.660 on her Instagram about me picking up this Harvey story when I said, I'm happy to host
00:11:11.200 you on this podcast to tell your story.
00:11:13.620 She suddenly didn't want to do that.
00:11:15.420 And maybe it's because and as I said to her, your emails are quite telling.
00:11:19.340 If you think that she said, oh, you agree that there's more that could be added that's
00:11:23.420 off email.
00:11:23.980 I'm like, sure, present it to me and I will present it to the public.

00:11:29.100 I'm just looking at the facts.
00:11:30.740 And factually speaking, Jessica Mann, after her alleged assault, had her friends testify
00:11:37.740 against her, who were at breakfast with her and Harvey the morning after, who said she
00:11:43.740 was in great spirits.
00:11:44.600 Not only was she in great spirits after her alleged assault by Harvey, but she changed
00:11:51.340 her flight so that she could stay with Harvey an additional night.
00:11:55.140 She was supposed to fly out with her friend who testified against her.
00:11:58.720 She was in town with her friend who testified against her.
00:12:02.580 They were going to see Wicked together on his dime.
00:12:06.240 She was staying in his hotel room and he testified that she seemed to be in great form, in such
00:12:11.880 great form after her alleged assault that she changed her flight to stay with Harvey.
00:12:17.020 That seems like a strange thing to do after you are raped or sexually assaulted.

00:12:23.380 I'm just putting the pieces together that are common sense.
00:12:25.740 And nobody sent Harvey more emails than Jessica Mann, more loving emails.
00:12:30.200 Her friends testified that she said he was like a mentor.
00:12:33.440 She wrote an email to her boyfriend years later that Harvey reminded her of her father,
00:12:39.640 that she perceived him as a mentor.
00:12:42.520 According to her, she loved Harvey, according to her emails, so much so that she took her
00:12:49.720 mother to meet Harvey.
00:12:51.960 That is, to me, the craziest part of a Jessica Mann case.
00:12:54.800 I don't care what you want to tell me about how women deal with things, OK?
00:12:59.280 To try to convince me that you would survive a rape and then months later, years later,
00:13:07.400 take your mom to meet your rapist willfully.

00:13:59.320 I could be wrong here, but I think Jessica Mann would be the, potentially, first person
00:14:06.920 ever to introduce their mother to their alleged rapist after their rape and to carry on this
00:14:17.300 relationship, which went on for years.
00:14:19.160 Again, these young women were not like 19 years old when we say young women, okay?
00:14:24.860 27 years old, 28 years old, going until they're 30 years old.
00:14:29.200 This is not Cassie meeting Diddy when she was 19 years old.
00:14:33.140 These are fully formed women, and in my view, they knew exactly what they were doing.
00:14:38.460 So what's happening right now is he is being retried in New York because, as I told you,
00:14:42.740 the appellate judges looked at the case and said, this is crazy.
00:14:45.560 I don't understand what happened here.
00:14:47.360 Why did you allow all of this to take place in the courtroom?
00:14:50.420 Why did you allow witnesses to testify to his character, which had nothing to do with the

00:14:58.180 You let people sit down and say, oh, he was really mean to me in third grade.
00:15:01.400 I'm being hyperbolic here, but they did allow people to testify.

00:15:06.180 What does it have to do with anything that's taking place here?

00:15:10.900 And so they overturned the case.
00:15:12.280 The reason they allowed so many people to contribute to essentially just denigrating his character
00:15:17.540 was because on the basis of the facts, if anybody objectively looked at the many emails
00:15:22.580 that these women wrote to Harvey after their alleged sexual assaults, they would just
00:15:29.300 conclude that this was all very much consensual, which is what Harvey contended.
00:15:34.300 He contended that, yes, I had relations with these women.
00:15:37.360 Yes, I was cheating on my wife.
00:15:39.180 But these relations were consensual.
00:15:41.480 And to these women, these relations were clearly transactional, right?
00:15:43.960 They were willing to do whatever with Harvey until they received tickets and they wanted
00:15:52.140 to receive tickets to L.A.
00:15:53.280 They wanted to take their friends to red carpet events.
00:15:56.400 And I think in the back of their minds, they thought they were going to be transformed into
00:16:00.500 the next Angelina Jolie.
00:16:02.440 They were satisfied with those transactions until their careers completely plummeted and
00:16:08.620 they didn't become the next big movie star.
00:16:11.240 They didn't become the next Halle Berry, so to speak.
00:16:14.740 And so what is quite telling, however, is the Los Angeles case, because, as I said, the craziest
00:16:23.040 case of all was when Harvey said, I don't know this person.
00:16:27.200 This literally never happened.
00:16:29.740 It is the only time that he had pivoted from his earlier points of saying it was consensual
00:16:34.620 and said, I wasn't even there.
00:16:37.160 I have no idea what you're talking about.
00:16:38.840 And still, they managed to convict him in Los Angeles.
00:16:42.340 Before I tell you about that woman who was able to make that happen through a lot of
00:16:48.160 tears, I do want to read you this exchange from the transcripts of Harvey and Mimi Halei,
00:16:54.780 his first accuser that took place just a couple of days ago because it really shows you their
00:16:59.400 mindset.
00:17:00.340 He is outwardly asking Mimi, his lawyer is asking her, why didn't you tell the press when
00:17:05.140 you went on these press tours and you cried and you said what happened?
00:17:08.160 Why didn't you tell them about your many correspondences with Harvey Weinstein?
00:17:13.460 We can take a look at this transcript.
00:17:17.140 He is asking, and Skylar, I'm going to take them to the bottom of page 733.
00:17:22.720 He says, but you didn't mention, again, this is the lawyer questioning her, cross-examining
00:17:26.660 her.
00:17:27.340 You didn't mention on any of those press appearances that you had an encounter with Mr.
00:17:32.320 Weinstein in the Tribeca Grand Hotel a week later after the July 10th incident, right?

00:17:40.700 You did not mention that Mr. Weinstein paid for your flight to Los Angeles.

00:19:23.160 at least pushed back at her during these press conferences and says, hey, what about this

00:24:50.560 The judge sentenced Harvey to 16 years for forcible rape, forcible oral copulation and
00:24:58.140 penetration by a foreign object.
00:25:01.060 OK, like I said, this was nothing like the others.
00:25:05.700 All of these allegations were just absurd.
00:25:08.200 And I should mention, by the way, that even if all of it had happened, which I do not believe,
00:25:16.200 then that would follow a long line of allegations of abuse that were made by Evgenia, because
00:25:22.580 before her 2013 assault, which she claimed happened from Harvey Weinstein, she had claimed,
00:25:28.520 according to a former boyfriend of hers, that six years earlier in 2007, she was assaulted
00:25:35.080 by a boyfriend, which left her hospitalized.
00:25:38.440 She claimed that she suffered PTSD since that incident.
00:25:42.040 She claimed in 2010 that the owner of the Tuscan football club dragged her by her hair and beat
00:25:49.060 her and then bought her a new Bentley.
00:25:52.160 She claimed in 2011 that to friends of hers that there was a powerful man in Moscow named
00:26:01.000 Arthur, who put her up in a suite at the Ritz Hotel in Moscow and then dragged her into the
00:26:07.260 bathroom, grabbed her by her hair at the airport and assaulted her.
00:26:12.720 And she had also made previous claims against the father of her child that he similarly dragged
00:26:20.100 her by her hair and sexually assaulted her.
00:26:22.760 And most recently, she had made an allegation that on a trip to Russia, she was assaulted again
00:26:30.100 by someone who pointed a gun and dragged her by her hair.
00:26:34.080 So this kind of repeat allegation of her being dragged by her hair.
00:26:38.740 I find it to be very interesting and very compelling.
00:26:41.660 Now, when it comes to her allegations about what Harvey Weinstein did to her in particular,
00:26:47.020 the story takes place in 2013 and she was in town in Los Angeles for the Italian Film Festival.
00:26:58.560 She testified that she was raped by Harvey at the Mr. C's hotel after she attended the
00:27:06.700 LA Italian Film Festival and she was attending as a VIP guest.
00:27:10.380 She told the jury that Weinstein just suddenly showed up to her hotel room completely unannounced
00:27:16.480 that he loudly banged on the door that he came in and he assaulted her.
00:27:21.320 And she said she has no idea how Harvey knew where she was staying that night.
00:27:26.060 And she described him as a stranger, a stranger that he had that she'd only met briefly prior
00:27:32.160 to him storming into her hotel room.

00:28:44.080 Again, he maintains that this just never happened and she can't answer how or why it happened.

00:29:20.860 She used an alias, Leonore Leonore, which I believe is her daughter's name or one of her
00:29:26.640 daughter's names.
00:29:27.660 So this is another one of these things where we're supposed to believe that Harvey just
00:29:30.900 has incredible radar that you could see him at an event and he will just know where you
00:29:35.460 live and he will wander through the hallways of even a hotel that you're staying at until
00:29:40.300 he breaks into your hotel room or actually knocks on the door of your hotel room and then
00:29:45.660 you let him in.
00:29:46.400 And then he says, I'm Harvey.
00:29:47.980 I'm Harvey Weinstein.
00:29:49.180 OK, now, while testifying about this incident, Evgenia made a reference to what Harvey forced
00:29:56.120 her to do this very dramatic rape scene.
00:29:59.280 And oddly, she referenced Harvey's testicles as a part of the story.
00:30:04.780 Now, for those of you who have been following the series, you know that that's not possible
00:30:09.200 because Harvey doesn't have any testicles.
00:30:12.160 He got gangrene in the 1990s and had to have them sewn into his thighs.
00:30:19.160 But don't worry, once this mistake was made, Evgenia had a reason for why, oh, Russian is
00:30:24.580 my first language.

00:31:00.480 So the rape that she alleges happened took place on February 6th, took place, pardon,
00:31:07.940 on February 17th, 2013.
00:31:11.340 Leading up to that, she was messaging with the person who was throwing on this event,
00:31:15.920 this Italian festival.

00:32:03.360 What she was doing on the day leading up to this alleged assault that Harvey says he wasn't

00:32:11.460 And like I said, the judge said, we just will not allow the jury to see these explicit sexual

00:32:19.380 Harvey's team believed that she was out with Pascal that night.
00:32:22.720 And that would certainly make sense.
00:32:25.420 They definitely do not believe that she was at Mr. C's hotel.
00:32:28.280 And I'll tell you why.
00:32:29.320 And this is really the craziest part of the story.
00:32:31.440 So Alan Jackson, who was Harvey's attorney, upon cross-examination, specifically asked
00:32:37.360 Evgenia if she stayed at Mr. C's hotel following the alleged rape.

00:32:44.000 Like, did you stay in the hotel?
00:32:45.100 Did you burst out of the room?
00:32:46.740 And she said, yes, she stayed place.
00:32:48.500 She stayed at the hotel.
00:32:49.500 He also asked her if she recalled hearing a loud fire alarm going off in the hotel that
00:32:54.920 night of her alleged rape.
00:32:56.720 She says it happened in the wee hours, so like around 12.45 a.m., maybe right after midnight.
00:33:03.460 And she seemed very confused by the question of whether or not she heard an alarm.
00:33:08.060 She said she did not recall hearing a fire alarm that night.
00:33:11.200 At that moment in the courtroom, Weinstein's attorney shot back.

00:34:38.560 the New York Times published the first story regarding the Harvey Weinstein allegations.

00:35:05.740 Now, in case you're thinking, OK, she sounds guilty as sin, and I'm not believing that Harvey
00:35:11.300 Weinstein was even there that night and she doesn't remember the alarm.

00:35:16.120 Well, you'd be wrong because she has an explanation for why she waited four and a half years.
00:35:21.700 And here's what she told ABC News.

00:35:58.420 And on January 6th of 2020, Los Angeles County prosecutors charged Weinstein with rape and

00:36:14.100 She enjoyed her time out in L.A. after that.
00:36:16.920 She also went to Malibu after that, which we'll do a deep dive in a timeline when he goes back for his retrial in Los Angeles.
00:36:25.120 But she wasn't motivated to do anything about this rape until her daughter had some assault happen to her.
