00:05:26.380911, but instead phones his wife, followed by Erica and his father, Pastor Rob McCoy of Calvary
00:05:33.820Chapel Church in Thousand Oaks, longtime pastor. And that's also in California. Now, during that
00:05:41.560phone call, we are told that he requested his father to pray. Rob McCoy told that story.
00:05:47.700It turns out, though, that Rob McCoy, his father, is not the only pastor that he phoned on that day
00:05:53.260asking for a prayer. You see, Mikey McCoy, when he arrived at UVU with Charlie, also met up with a

00:06:52.740Hibbs Jr. He is from a military family. His brother is Pastor Jack Hibbs, another senior

00:07:07.300you guys already know that I have a rather strong opinion regarding these Calvary Chapel churches
00:07:13.000and their extraordinary dedication to Israel, so I'm not going to belabor any points here.
00:07:20.000I will add that the first that I heard of Pastor Jack Hibbs, it was via Marissa Strait,
00:07:25.440the Mossad agent turned CEO of PragerU.
00:10:48.100So my brother's lived in Utah for years, and we have to make sure that this doesn't get out, but he looks like a mountain man, and he's all over the terrain.
00:13:03.080And so he contacted suddenly the night before, he says, he receives this call and Butch, the not CIA or Mossad agent, just the guy who likes the mountains, was like, hey, I want to go to the Charlie Kirk event.
00:13:18.420And that's an interesting time frame only because there was a lot happening the night before. Right. Charlie's texting donors that he has no choice but to abandon, of all things, the pro-Israel cause.
00:20:58.640is this, maybe there was a Calvary Chapel conference call. Perhaps that might fit with
00:21:06.420when he called Rob McCoy. Anyway, I digress because, you know, my opinion doesn't really
00:21:14.600matter, but it happens to be that every single person that arrived with Charlie, in my opinion,
00:21:21.940behaved in ways that simply unnerve me, given the circumstances. Terrell, prematurely announcing
00:21:27.520Charlie's death to himself. He chose to record himself rather than to call 911, selfie vid. And
00:21:34.860even after he was finished with that bizarre selfie vid, he then jumps down from the grassy
00:21:39.520knoll, not crying, he's chill, starts removing SD cards and seemingly plausibly toying around with
00:21:47.020the footage, sticking the SD card into his computer, looking around, looking shady and
00:21:52.300getting to work. Mikey, as we mentioned earlier, immediately walked away, phoned his wife first.

00:32:26.840Now, to remind you all of what junction we are at, all that has thus far taken place is the preliminary hearing, right?
00:32:34.440What that means is that the state is being given an opportunity, the prosecution is being given an opportunity to present their case for why they believe the trial should, in fact, move forward with the charges that they listed, the charges that they are seeking to bring forth.
00:32:48.720And we know that that took place, that preliminary hearing, across five days in early July.
00:32:54.020And I made it very clear to you guys that under the Utah 1102 rule, reliable hearsay is permitted at that stage.
00:33:01.580Hearsay meaning, as just one example, that's perfectly acceptable under Utah's constitution for Lance Twiggs to submit a video testimony.
00:33:11.900The prosecution, sorry, the defense is not able to cross-examine him, which seems so wild to us.
00:33:17.880But this is it's probative that Lance's lawyer is able to lead him in questioning.
00:33:24.000Normally, there would be all of these objections on the defense because you aren't allowed to ask leading questions.
00:33:29.120But for the sake of this probative hearing, everything pretty much flies, right?
00:33:33.500People not have to appear in person. It's enough.
00:33:36.840You sort of just trust the science when Officer Bagley gets up there or Officer Hull gets up there and says he was told by someone that this happened,
00:33:45.320that Tyler Robinson's vehicle pulled to the side of the road
00:34:14.500everything is evidence. And to jog your memory, there are seven charges in total that the state
00:34:21.360is seeking to bring against Tyler Robinson. Andrew Wilson did not know any of these,
00:34:26.300but the most severe and significant is the aggravated murder charge because that carries
00:34:32.220with it a death sentence. That's not first degree murder. That is aggravated murder.
00:34:37.120And it is worth noting that never in the history of Utah has there ever been an individual found
00:34:43.360guilty of aggravated murder where there was just one victim. Someone who fired just one bullet and
00:34:49.480had one victim, never. The aggravating factor is a very steep standard. And it's a steep standard
00:34:55.820for a reason, because it can't just become routine for the state to put people to death,
00:35:01.400obviously. You have to have done something that they go, oh, this is like you should be put to
00:35:06.200death. And typically to achieve that aggravating factor, you would be dealing with a circumstance
00:35:11.900where someone, and I'm giving an example here, plotted a bomb, right? Or someone who sprayed
00:35:18.220multiple bullets. There were many examples when they were listing all of the legal jurisprudence
00:35:22.780in this case, someone who sprayed multiple bullets into a crowd, demonstrating that their
00:35:27.820intention was to murder en masse. The prosecution is arguing, what they're bringing forth, their
00:35:35.400claims is that Tyler Robinson is the shooter, but they're also arguing that he only chose
00:35:41.700to fire one bullet, despite having more rounds in the chamber, that makes it very difficult
00:35:47.600to argue that he intended to commit a murder en masse, right?
00:35:52.380They also have text messages where he clearly says, I'm going, and they're alleging that
00:35:57.080these text messages are real, that I'm going to see Charlie Kirk and I have to do this
00:36:01.820because his hate is too much to negotiate, okay?
00:36:05.500Well, that sounds like he had just one target.
00:36:08.520So those arguments are what the defense is engaging with. So when they're coming up and they're filing their dismissal, they're basically saying, we're not even going to argue anything yet because just with the laws on the books, you have the ability as the magistrate to recognize that some of the charges should just be dismissed.
00:36:28.520They're defective charges right off the bat. And they're saying aggravated murder. That's defective. That's defective because without us even saying whether or not these text messages are real, whether he was we don't even have to do that legal work.
00:36:42.160We don't have to spend that money, spend that time or look at anything because this charge is so defective and their own arguments, the prosecution's arguments prove that.
00:36:51.180So what does the prosecution say to that?
00:36:52.660The prosecution is saying, well, okay, yeah,
00:36:55.000maybe Utah has no history of ever doing this
00:36:57.460and all these other states have no history of doing this,
00:36:59.540but we'd like to borrow from Pennsylvania law.
00:37:02.380This is what they're actually arguing.

00:38:11.520The second charge is for felony discharge of a firearm.
00:38:15.260The third is for obstruction of justice because the prosecution is saying that Tyler Robinson hid the firearm that was used to shoot Charlie Kirk.
00:38:24.280Then we have, again, obstruction of justice for their allegation that Tyler Robinson also hid the clothing that he wore during the shooting, even though we are told that he did wear the maroon shirt that he wore earlier that day.
00:38:38.360Number five is witness tampering for allegedly texting Lance and saying, delete this exchange.
00:38:45.900The sixth charge is also witness tampering for allegedly texting Lance and telling him not to speak to police and to lawyer up.
00:38:54.420Now, that is another charge that they are saying, just look on the books.
00:38:59.140You, the magistrate, should obviously drop this charge because if he actually did that and directed Lance Twiggs to stay silent,
00:39:07.760if police questioned him and to lawyer up.

00:44:43.520I did see recently, again, they rely on public ignorance. Most people don't go through trials. Most people are not being sued every single day. And so they are relying on public ignorance of not knowing how trials function for them to be able to spin and to lie and to present things as if they're big wins.
