00:00:15.080 As usual, Blake's own evidence is going to backfire on herself.
00:00:19.980 Yeah, we Flossom Talk.
00:00:24.640 Hi and welcome to Flossom Talk.
00:00:26.240 I'm Siash di Flo, a journalist, Hollywood truth teller,
00:00:28.740 and your voice of reason in a town built on delusion.
00:00:33.040 First of all, a big thank you to my friend James Scanlon
00:00:36.740 who painted this oil painting for Flossom Talk for my studio.
00:00:41.620 I really, really think it's so cool
00:00:43.420 and it really represents everything that my channel stands for.
00:00:47.140 The greatness and the greed in the town built on delusion.
00:00:51.640 And I think it's so cool that James has been a part of Hollywood himself
00:00:54.520 for so many years.
00:00:55.480 He was the director of motion capture for Titanic and The Matrix
00:01:00.280 and he's had his artwork shown all over town
00:01:02.880 and in TV shows such as Better Things and The Starter Wife.
00:01:07.960 If you're interested to check out more of his artwork,
00:01:09.780 you can go to his Instagram page.
00:01:11.860 It's James Scanlon Artist.
00:01:14.480 I will leave a link below where you can also order this in print for yourself
00:01:18.980 if you want that or you can look at some of his other cool stuff.
00:01:22.700 Yes, so thank you, James.
00:01:24.560 Anyways, let's get into all the crazy madness today.
00:01:28.120 So as I mentioned yesterday in my episode with just a screenshot
00:01:31.140 because this thing happened after I recorded yesterday,
00:01:35.060 Blake Lively is required to submit a CD to the court by tomorrow.
00:01:44.080 As we've learned last time, the court can't handle audio files,
00:01:48.180 which I find so insane.
00:01:50.680 So she has to give them a CD.
00:01:52.000 So what is this recording?
00:01:53.980 I'll get into that in this episode because we have some clues here.
00:01:57.900 And I think, as usual, Blake's own evidence is going to backfire on herself.
00:02:03.480 Also big day today because today is the deadline for Blake's team
00:02:07.260 to respond to Justin Baldoni's motion for summary judgment.
00:02:12.320 She hasn't filed yet.
00:02:13.760 I'm sure she's going to file two minutes to midnight.
00:02:16.260 That's what they usually do.
00:02:17.580 I'm sure it's going to be a huge document with a bunch of attachments and more evidence.
00:02:24.040 So yeah, stay tuned for that.
00:02:25.460 We're going to probably get into that tomorrow.
00:02:27.480 Also big news today.
00:02:28.700 Andy from Popcorn Planet's motion to quash his subpoena was denied.
00:02:35.040 The judge in Florida said you are not a journalist.
00:02:38.940 So you you shouldn't have any journalist privilege here.
00:02:42.460 So the judge ruled that Popcorn Planet has to basically hand over all communications he had
00:02:49.880 in regards to Blake Lively.
00:02:52.660 What does this really mean?
00:02:54.260 I think this is actually going to backfire on Blake Lively and I'll get into that as well.
00:02:59.720 Another filing today.
00:03:01.260 The Wayfair Party has responded to the New York Times.
00:03:04.940 Remember New York Times sued Wayfair because they want them to pay their legal bills
00:03:09.760 for fighting their lawsuits.
00:03:12.760 So now the Wayfair Party has responded.
00:03:15.300 I also wanted to go into some of the biggest cracks in Blake Lively's lawsuit in this episode.
00:03:20.620 What is the major thing here that she is missing that makes me believe that she has no chance
00:03:28.920 to win this lawsuit?
00:03:30.660 Okay, so let's get into it.
00:03:31.920 So tomorrow Blake Lively has to give this recording to the court, to the clerk down there,
00:03:38.200 and he has to burn some copies and give to reporters or content creators who come down
00:03:42.740 there and ask for them.
00:03:43.660 So I'm sure we're going to have that recording as soon as it hits the court because there are
00:03:48.100 some really amazing people out there that are making sure that the truth is coming out
00:03:53.060 in real time.
00:03:54.300 So this recording is filed by Blake Lively in hopes to, of course, help herself.
00:04:00.120 This was filed in accordance to her spoiltation motion, meaning that she wanted to punish the
00:04:07.400 Wayfair parties because she believed that they had deleted evidence on purpose.
00:04:13.180 And what doesn't make sense to me here is that Blake Lively filed this and then sealed
00:04:18.780 this recording.
00:04:20.060 Why would you seal something that helps you?
00:04:22.880 If this would benefit Blake in any way, she would have used this recording already.
00:04:29.320 She didn't.
00:04:30.520 And now the judge probably thinks that this is contradicting some of the things that she's
00:04:35.940 claiming.
00:04:36.720 Otherwise, it wouldn't make that much sense for the judge to actually say, hey, this recording
00:04:41.500 needs to be out there.
00:04:42.360 Remember, he said the same thing with the Steve Starowicz recording.
00:04:45.320 He was the one who said transparency here.
00:04:47.740 The public deserves to know.
00:04:49.680 So what I think we can expect from this evidence now, and I think we've seen so many examples
00:04:54.200 of this now that Blake is using and filing evidence that is really hurting herself because
00:05:00.080 she doesn't have anything.
00:05:01.560 She's trying to twist the truth around and use evidence that really supports Baldoni and
00:05:07.040 not her.
00:05:08.140 And we've seen that with so many of the text messages and emails, all this evidence.
00:05:12.360 That she's claiming that is supporting her case.
00:05:15.400 And most of the time it's doing the opposite.
00:05:17.700 And I think that's what we're going to see here.
00:05:20.040 I can't wait to listen to this recorded.
00:05:22.140 And of course, as soon as I get it, I will create a video around it and I will report
00:05:26.080 on it and I will keep you updated.
00:05:28.240 Okay, so let's get into Andy's motion that was denied.
00:05:32.020 I was really shocked by this.
00:05:34.180 Apparently, the judge in Florida where he fought the subpoena believes that he is not
00:05:40.020 a journalist because he is on YouTube.
00:05:42.960 They said that he hasn't proven that he's a journalist and he's not working in ways,
00:05:49.440 in editorial ways.
00:05:50.920 And that's why he cannot claim reporter privilege.
00:05:55.520 So they say that he has to give up all his communications with Blake Lively's team.
00:06:03.420 And I know Andy has spoken about this on his channel, that he has reached out to both the
00:06:09.640 Wayfair parties and Blake Lively's team to ask for comments.
00:06:14.000 That's what a reporter does.
00:06:16.420 That's supposed to be your job to actually do balanced reporting.
00:06:20.580 So you are contacting both sides to give both sides the opportunity to respond.
00:06:26.820 But we know that Andy's been working on this documentary and that's probably one of the
00:06:32.260 reasons that they're after him here.
00:06:34.860 And in that documentary, he's been looking for sources.
00:06:37.740 I can imagine as you do in a documentary, I'm a part of this documentary.
00:06:41.840 He reached out to me to get me to participate.
00:06:45.300 And I'm sure he reached out to both parties to try to get people for his documentary.
00:06:50.740 Andy has already dropped a press release about this.
00:06:53.980 And he's saying that this ruling is a chilling attack on independent journalism.
00:06:59.160 It suggests that unless you work for a newspaper or legacy media corporation, you have no right
00:07:04.760 to protect your sources.
00:07:06.700 That is not only wrong, it endangers every whistleblower, content creator, podcaster, and independent
00:07:14.160 reporter working today.
00:07:16.500 So true.
00:07:18.120 And that's why this is so important.
00:07:20.060 And that's why it's so important that everyone gives a lot of attention to this because it hurts
00:07:25.560 everyone.
00:07:26.360 If a big celebrity or a powerful person can go after critics on the internet, any critic,
00:07:36.140 and say that, hey, here's a subpoena, you have to give me all your sources.
00:07:40.260 And if you don't, if you want to fight it, you're probably stuck with bills worth, you know,
00:07:45.300 up to $50,000, $100,000.
00:07:47.780 And that's the reality here.
00:07:49.540 And that's why this is so scary.
00:07:51.260 And he says here as well that he is planning to appeal this to the 11th Circuit.
00:07:56.040 I don't know how long that's going to take, but it's going to be like another headache,
00:08:00.220 more hassle for him.
00:08:01.860 I think they gave him a deadline here of December 17th to give up all this information.
00:08:08.880 I don't know what they think they're going to find here because what they're looking for
00:08:13.420 is content creators or journalists who've been paid by Wayfarer to support their
00:08:21.160 narrative.
00:08:22.280 And as you know, they haven't found any evidence of that.
00:08:25.680 So all they're going to find here is a content creator slash journalist doing his job, doing
00:08:33.560 his due diligence of contacting sources before he's reporting on something.
00:08:38.040 And what is that going to do for Blake Lively's case when they find out that's what he's been
00:08:42.980 up to?
00:08:43.920 It's just going to harm her case because then again, there is no evidence of a smear campaign.
00:08:51.160 And now it seems like Andy is their last hope here to prove that Wayfarer parties were
00:08:58.300 collaborating with journalists or content creators.
00:09:02.040 Because as you know, so far they have found zero evidence of that.
00:09:06.520 And they have, as you know, subpoenaed over 107 content creators trying to find evidence.
00:09:13.980 So again, this is just going to work against her.
00:09:17.000 When she finds this information, she is saying that this information was withheld from the
00:09:23.180 Wayfarer parties and Melissa Nathan and I think Brian Friedman, who are the two people
00:09:27.720 that they, I think they're accusing him of talking to.
00:09:30.040 And the funny thing is, he didn't start communicating with that side, as far as I know, until the
00:09:36.220 lawsuit was filed.
00:09:38.040 So then they're saying, oh, you smeared her after she sued them for smearing.
00:09:42.960 I mean, it doesn't make any sense.
00:09:44.240 There's no logic to what Blake is accusing people of, as you know.
00:09:48.900 So if I'm going to be honest, the reason why I didn't contact anyone from Blake's team
00:09:53.300 or Justin's team was because I wanted to just have a completely clean slate, because I was
00:09:58.900 already dragged into this drama through the New York Times article, where they strongly
00:10:03.880 insinuated that I was working with his team.
00:10:06.740 So that's why I never reached out to anyone.
00:10:10.120 But I do completely understand why Andy did that.
00:10:14.700 It wouldn't make him a good reporter if he didn't.
00:10:17.660 So congrats to Blake's legal team for subpoenaing evidence that will weaken her case.
00:10:24.900 Talking about all of this, we have to get back to the core of her claims, which I was
00:10:31.860 looking at again today, because someone sent me this interview where Jack Tapper from CNN
00:10:37.380 is interviewing Michael Gottlieb, which is one of Blake's main attorneys.
00:10:41.940 And thank you, Marlene, by the way, for sending me that interview.
00:10:44.660 I remember I spoke about it when this happened.
00:10:46.660 It was just after Justin's lawsuit was dismissed by the judge and Blake's team went on a victory
00:10:54.660 lap and said, you know, the claims were baseless, blah, blah, blah.
00:10:57.720 It had nothing to do with that.
00:10:59.620 The judge didn't even look at the facts in the lawsuit because he just said, you know,
00:11:04.600 she has privilege because she filed the CRD complaints and this was about SH.
00:11:10.500 So she has privilege.
00:11:11.480 So you can't sue her.
00:11:12.780 So it was just a technical reason for that dismissal.
00:11:15.980 It was nothing about what he said and accused her of and Ryan Reynolds of and Leslie Sloan of
00:11:21.920 wasn't true.
00:11:23.320 That's what they said, of course, in the media.
00:11:25.980 And in this segment on CNN, when Jake Tapper is interviewing Michael Gottlieb, he says himself
00:11:32.020 as a reporter, there was a very orchestrated campaign against her.
00:11:37.580 And one of the things that's so fascinating and also disturbing about this case is how much
00:11:42.520 the Internet plays a role with people trying to get out information to smear.
00:11:50.680 And there was a very orchestrated campaign to smear Blake Lively and Ryan Reynolds to a lesser extent.
00:11:57.020 Those are the words that Jake Tapper is using here.
00:12:01.240 So he is claiming this to be true without having any evidence.
00:12:06.940 Talk about doing due diligence here.
00:12:09.040 Anyways, so here comes the really interesting aspect to me of this entire case.
00:12:14.000 And this is where I think that Blake is definitely going to lose her credibility with the court.
00:12:20.600 Because you have to remember that Blake filed these 17 points because she was upset about
00:12:28.260 things that the Wayfair parties did on the set.
00:12:30.920 Yeah, you know, they showed her a video of a woman after she gave birth.
00:12:34.560 And they said that and Justin said that her beanie was sexy.
00:12:37.500 Things like that.
00:12:38.260 That wasn't allowed anymore, including Justin not allowed to cry anymore.
00:12:42.320 That was also one of the things that were mentioned in those 17 points.
00:12:45.300 So after the Wayfair parties signed these points because Blake Lively was blackmailing them,
00:12:52.320 saying that she refused to come back and shoot the movie unless they signed these documents.
00:12:57.100 So they did.
00:12:58.200 She said that after they signed these documents, there were no more incidents.
00:13:04.020 She said nothing more happened after this.
00:13:07.940 So this is in the beginning of January.
00:13:10.840 Then she's claiming that the Wayfair parties waited over six months before they retaliated
00:13:20.800 against her.
00:13:22.080 And they chose a moment where they would sabotage their own hard work, their own movie to do
00:13:31.680 this retaliation campaign against her.
00:13:34.420 Where is the logic in that?
00:13:36.740 If they were going to retaliate against her for speaking out and for making these 17 points,
00:13:44.020 why did they wait until the most vulnerable moment for themselves to do that?
00:13:50.720 Also, of course, we have to keep in mind the reason why all of this backlash happened against
00:13:56.320 the around the release of the movie was because Blake was out there doing press and it backfired
00:14:02.640 on her.
00:14:03.240 And also, to me, there is a lack of motive here.
00:14:07.200 What was supposed to be the motivation from the Wayfair parties and Justin Baldoni to retaliate
00:14:13.660 against her?
00:14:14.920 There were no financial gain in doing that.
00:14:17.960 The only reason would be revenge.
00:14:21.740 Why would they spend all this time and money just for revenge?
00:14:26.000 They needed Blake to be in a good light so they could sell movie tickets.
00:14:30.720 A smear campaign wouldn't only hurt Blake, it would definitely hurt themselves as well.
00:14:36.820 Yeah, there's no logic here.
00:14:38.400 And I think when you present this for a jury saying that why would they wait so long to
00:14:42.600 retaliate against her?
00:14:44.300 And I think what happened here is that Blake was so devastated after all this bad press and
00:14:48.300 she was like, how can we blame this on someone else?
00:14:50.820 And the lawyers were like, well, you could blame it on them, but you can't sue someone
00:14:54.560 just for defaming you.
00:14:55.880 That's too weak.
00:14:56.840 And a lawyer said, well, it's not illegal to plant negative stories about someone.
00:15:00.600 As you know, you've done it yourself, Blake.
00:15:02.380 And then they went through some different scenarios here.
00:15:04.760 Okay, how can we sue them for a smear campaign?
00:15:08.800 And the lawyers probably said, well, did something inappropriate happen on set?
00:15:12.440 Is there anything we can use there?
00:15:14.420 And Blake was like, yes, Justin said that my beanie was sexy.
00:15:17.980 And then he said that Jenny Slate's pants were sexy.
00:15:20.440 And the lawyers were like, yes, that's perfect.
00:15:23.440 We can use that.
00:15:24.300 Anything else?
00:15:25.580 Yes, I was shown a video after a woman gave birth and I thought it was something else.
00:15:30.160 And they're like, oh my God, this is great.
00:15:32.340 And then she said, yeah, in this intimate scene where we were dancing, Justin was biting
00:15:37.480 my lip and he was being really inappropriate.
00:15:40.640 I hope they didn't record that with audio, by the way.
00:15:44.140 I don't think they did.
00:15:45.240 So let's go for that one too.
00:15:46.900 And her attorneys were like, yes, this is great.
00:15:49.760 This is real SH.
00:15:51.740 Let's use this.
00:15:52.780 And now we can sue them for the retaliation.
00:15:55.580 Anyway, that's what I think happened here.
00:15:57.920 Okay, and then, of course, we have to talk about the New York Times as well, because now
00:16:01.140 the Wayfair Studio has officially answered the lawsuit that they filed against them because
00:16:07.580 they want the Wayfair parties to pay for their legal fees.
00:16:12.320 So the Times here is claiming anti-slap.
00:16:15.740 And they say that the Wayfair studios only sued them to punish journalism.
00:16:21.500 And the Wayfair parties say, no, we're not trying to silence anyone here.
00:16:26.300 We are just demanding accountability because they know, and I know, because I was in that
00:16:32.640 article.
00:16:33.140 We know that they did not report on the truth here.
00:16:38.740 We know that they cherry-picked, and we know they didn't do their due diligence.
00:16:43.100 And they have not taken any responsibility for that reporting that they based on purely
00:16:48.500 one-sided information coming from Blake and her team.
00:16:52.280 I actually feel like my story here is quite important in this case.
00:16:57.080 I don't know why they're not mentioning it, but the fact that they accused me of being
00:17:02.180 a part of the smear campaign without even reaching out to me and to ask me if it was
00:17:08.060 true.
00:17:08.960 I think that says a lot about this entire piece that they did and how sloppy it was.
00:17:14.840 But of course, the New York Times is never going to admit fault because that's going to
00:17:19.560 cost them money and credibility.
00:17:21.060 So they just have to stick with this.
00:17:23.120 I wonder what's happening in their internal meetings here, if Megan Thewey is just still
00:17:28.940 saying, well, I believe Blake, I believe everything she told me.
00:17:32.640 We know when they are publishing a story like this, it's not like they didn't go through the
00:17:37.960 legal system, the internal legal system at the New York Times before they did that.
00:17:42.620 So I wonder who didn't do their job here.
00:17:45.580 And I think that the public deserves to know how they reported on these text messages.
00:17:51.620 Did they see all the text messages themselves?
00:17:55.560 Did they cherry pick which ones they wanted in the article?
00:17:59.560 Or were they fed these illegally obtained text messages from Jennifer Abel's phone?
00:18:07.900 Did they just receive the already cherry picked text messages that would support Blake's
00:18:15.040 narrative?
00:18:15.900 Either one of those options are terrible because either they knew what they were doing or they
00:18:21.320 were just ignorant of what they were doing.
00:18:23.300 Anyway, that's it for me today, you guys.
00:18:25.380 I hope you enjoy this episode.
00:18:26.940 More news coming out later this week.
00:18:29.280 It's all last minute.
00:18:30.560 Always.
00:18:31.240 I hate that.
00:18:31.900 I feel like, oh, today is the deadline for this thing.
00:18:34.440 And then it doesn't show up until midnight.
00:18:36.600 So stay tuned.
00:18:37.900 Tomorrow we will see Blake's response to Justin's summary judgment.
00:18:42.460 And also this recording, which I'm sure they're going to wait until the last minute as well.
00:18:48.400 But I promise I will report on everything as usual.
00:18:52.800 So yes, thanks for watching, you guys.
00:18:54.300 And please subscribe if you haven't.
00:18:56.100 And hit the notification bell so you never miss an episode of Flossom Talk.
