00:42:37.000on Wednesday, January 29, 2025. The tragic incident occurred as the plane was making its final approach toward Reagan-Washington National Airport in Arlington, Virginia.
00:42:47.000American Airlines confirmed that 64 people were aboard the jet, 60 passengers, and four crew members, while three soldiers were aboard the military helicopter.

00:43:44.000This has marked the first major U.S. commercial crash in more than 15 years.
00:43:50.000From an aerial perspective, it is evident that Flight A-A5342 was approaching the airport from the south, descending over the scenic Potomac River.
00:43:59.000This area is known for its proximity to several iconic landmarks, such as the Pentagon, located nearby in Pentagon City.
00:44:06.000To the north, one can spot the striking dome of the United States Capitol building, a symbol of American democracy.
00:44:14.000The Potomac River, which encircles the airport and much of Arlington, Yeah, very, very congested airspace, guys.
00:44:34.000Being an air traffic controller in this area, probably a fucking nightmare.
00:44:42.000American Airlines Flight 5342, which we'll refer to as the landing flight.
00:44:47.000was on its final approach to Runway 33. At this stage, called its short final, the aircraft was mere moments from landing, flying at an altitude of about 400 feet.
00:44:57.000This is the most critical phase of landing where every second counts and pilots are laser-focused on safely bringing the plane down.
00:45:04.000At the same time, an Army Black Hawk helicopter, identified as Pac-25, was reportedly on a possible training flight.
00:45:11.000It was flying perpendicular to the flight path of Flight 5342. Following the course of the Potomac River.
00:45:19.000The Potomac River is a designated flight corridor for helicopters, and it's common to see aircraft like this operating in the area.
00:45:25.000The key difference between the two aircraft in this scenario was their operating rules.
00:45:30.000The Black Hawk helicopter, Pac-25, was flying under visual flight rules.
00:45:35.000This means it was required to rely on visual observation of its surroundings to avoid other aircraft.
00:45:40.000The landing flight 5342 was operating under instrument flight rules, which give it priority over VFR flights in controlled airspace.
00:45:49.000This system assumes that VFR aircraft will actively maintain visual separation to avoid conflicts.
00:45:55.000Moments before the collision, the air traffic control tower at Ronald Reagan Washington National Airport called PAT-25 to confirm whether they had the other aircraft in sight.
00:46:07.000At first glance, this seems like an acknowledgement that they were aware of Flight 5342's presence and were taking steps to avoid it.
00:46:15.000However, it now seems likely that Pac-25 had mistakenly identified a different aircraft, possibly a departing flight from the same airport, and believed that was the other aircraft referred to by the tower.

00:56:36.000Today is the first full day for them on the scene and they can't be divulging any facts about that.
00:56:42.000I'll say that this is probably the biggest case that NTSB has done since the Kobe Bryant crash.
00:56:49.000Guys, if you guys remember when Kobe Bryant was on a helicopter and it crashed back then, that is definitely By far, the last time they had this much press coverage.

00:57:43.000Get to the flight data recorder, which is underwater, and that is the other component to this that is so unusual, Lindsay, just the fact that this was a water emergency and that crews are not only dealing with trying to obviously recover as many of those bodies as possible, but also really try to get to the bottom of exactly what happened here, knowing that the conditions are treacherous and the initial parts of this effort and these efforts were all happening under the cloak of darkness.
00:58:15.000They also talked about what methods that they will be taking moving forward in terms of this meticulous process to try to reconstruct exactly what happened and if there was any sort of fault at all.
00:58:25.000They say that they will be looking through a series of groups, working groups.
00:58:28.000They say that there will be a structure group, a systems group, a helicopter group, given the fact that a military helicopter was involved, but also a human performance group as well.
00:58:37.000And that's interesting because I asked one of the board members, Lindsay, about that earlier today.
00:58:41.000Earlier today, Defense Secretary Pete Hegseth referenced that mistakes were made last night.
00:58:47.000And so I asked whether that meant human error or if there were some sort of mechanical failure.
00:58:52.000But of course, as I pointed out before, they did not want to get in front of any sort of preliminary findings.
00:58:57.000They did say that we should see something happen here within the next 30 days as far as their initial findings and reports.
00:59:04.000But a part of that human performance group, they say that they will take into consideration what we're having.
00:59:10.000I mean, Chad, I would say it's safe to say it was the helicopter's fault.
00:59:30.000That's why Pete Hexeth came out and said, hey, you know, it's on us because this is military.
00:59:35.000Obviously, he's the secretary of defense.
00:59:37.000As secretary of defense, he is the head honcho when it comes to the U.S. Armed Forces.
00:59:41.000So, you know, which I'll give them credit for that, for taking accountability on that.
00:59:44.000What was going on with the pilots of both the commercial regional aircraft as well as the military aircraft as well.
00:59:52.000We also heard that there were apparently recording devices on the military helicopter that could lend a hand in terms of getting to the bottom of this investigation.
01:00:02.000And there are also reports out there as well speculating about what was happening inside.
01:00:10.000of air traffic control and whether that was properly staffed or if there were other people that were needed given the types of aircraft and the amount of operations going on here at the airport during the time of the collision and so they say that they do not want to get in front of any of that at this point but they say that they will continue to update us as quickly and as thoroughly as they can and they also point out that everyone as far as next of kin has yet to be notified they are still Working to
01:00:40.000try to brief families, some of whom are still making their way to Washington, D.C., in order to get briefed as to what exactly happened here.
01:00:49.000They did say that they, in some cases, make arrangements so that family members can make their way to the collision site, in this case what would be the banks of the Potomac River.
01:00:57.000But they say that there are still people still trying to make their way here to Washington, D.C. They've yet to contact everyone as it relates to next of kin of those who may have been on board as well.
01:01:16.000We know that there was a figure skating component.
01:01:19.000Some of the top figure skaters out there from both the U.S. and from Russia.
01:01:23.000President Trump alluded to that earlier today during that press briefing and also talked about how he and the United States would be responsible for getting those remains back to Russia.
01:01:34.000He also said that there were some other passengers on board those aircraft that were from other countries.
01:01:40.000We're yet to see exactly where they are from as well.
01:01:43.000But it just goes to show just how much work is left to do as crews and all of these administration and organizations work to really try to get to the bottom of what happened.

01:01:58.000But you had mentioned the flight data recorders, the black boxes on the helicopter.
01:02:02.000Those still have yet to be recovered, but also other kinds of evidence, including debris and even cell phones.
01:02:12.000The cell phones are gonna be huge because they'll be able to see what they were doing on their phones right before the crash.
01:02:17.000Bro, if they find out that one of these guys was like surfing the web or some shit right before the crash, that's gonna be a big fucking, that's gonna be a big L, man.
01:02:38.000Sensitive as it relates to passengers' cell phones and also their personal belongings and how that could help with this investigation.
01:02:49.000But they also said that what they noticed as it relates to the fuselage of the commercial regional jet was that it was broken into three pieces.
01:03:00.000That's something that we heard from officials within the Trump administration earlier today as well as other officials who made that initial press conference here at the airport.
01:03:11.000And so they say that both the aircraft, the American Airlines aircraft, as well as the military aircraft were It flips upside down.
01:03:20.000They also talked about the challenges given the space in this investigation because of that Potomac River that I talked about.
01:03:28.000Not only is the river rushing at this current moment, but it is still cold.
01:03:32.000It did snow here recently in Washington, D.C., and so crews are working around the clock to not only gather, as you pointed out, and try to recover as many bodies as possible, but as much evidence as possible as they look to reconstruct exactly what happened here.
01:03:45.000Skyler, they were asked about whether there was any indication of whether anybody made it off of the plane.

01:03:59.000They said, and echoed the same sentiments as the D.C. Fire Chief earlier today, just given the conditions.
01:04:08.000At this point, they haven't been able to determine whether anyone was able to make it off of the aircraft.
01:04:14.000They say it was almost an instant collision and the fact that it happened the way it did, it was almost improbable, so to speak.

01:09:51.000Newly released body cam footage shows the deputy's reaction to the accident, and an internal investigation report shows he came clean before resigning.

01:10:53.000So the audio doesn't come in until just after McComer rear-ends the car, but you can tell he has something in his right hand, and that looks like a phone.
01:11:32.000So, this accident happened back in November in Sorrento, Florida, around 1.30 in the afternoon.
01:11:36.000Then, Deputy McComer hit the other car hard enough to deploy his airbag, which, of course, would leave anybody disoriented, but he gets out of the patrol car and eventually reaches down to pick up, again, his phone from the floorboard.
01:13:21.000As well as in the video, we can see that he jumped out of the car, and it doesn't appear he had his seatbelt even on.
01:13:25.000Ah, yes, we will talk about that a little bit more.
01:13:27.000So McComer had radioed into dispatch, and an investigator came out to document the scene.
01:13:31.000According to an internal report, McComer told officials that he had just finished up a phone call with another deputy when he'd seen the sedan stopped in the road for a school bus on the other side of the street with its lights flashing.
01:13:39.000He claims the brakes on his patrol car locked up.
01:13:42.000See, and that's where you fuck up because when you lie, bro, you're cooked.
01:13:48.000And, you know, I remember when I was an agent, right, on the job.
01:13:51.000If an agent got in a crash, you'd go out there and you have to obviously, you know, take a report, et cetera, and document it for the government cars.
01:13:59.000But in this case, man, he's over here saying like, oh, no, I got off the phone with another deputy.
01:14:03.000Like, bro, they're going to absolutely look into that.
01:14:05.000The fact that he hit a civilian is what makes this even worse because now he's opening up the police department to liability.
01:14:12.000And McComer also told officials that the ABS light on his dashboard had been lit up since he had some calibrations done on the speedometer.
01:14:18.000An investigator looked back at that body cam video that we were displaying you and saw that McComer was looking at something on his phone when he crashed.
01:14:26.000So we got our hands on the internal report, which details how an investigator followed up with McComer the day after the crash to ask him about the fact that you could see he was looking at something on his phone.
01:14:33.000It reads, quote, McComber is viewing a picture or a video at the time of the crash, and he was not scrolling through text messages.
01:14:59.000Upon further review, you can see D.S. McComber exit the patrol vehicle, approximately, and it gives them the time stamp there, and there is no evidence of him removing his seatbelt.
01:15:05.000He looks back into his patrol vehicle, and you can see the driver's seatbelt is latched and tied against the seat.
01:15:09.000It appears that the seatbelt was latched behind his back and not being utilized at the time of the crash.
01:15:13.000So then, the investigator follows up with McComber's usual supervisor, who told him there were no videos or photographs in the group chat between him and the other sector three members, like McComber had said.
01:15:22.000So at this point, McComer is written up for three violations of department policy.
01:15:30.000Now, the biggest one, guys, is when you're not honest, that's going to fuck you up every time.
01:15:34.000And the reason why, guys, that's the fastest way to lose your job when you work in law enforcement.
01:15:38.000Because when you lie, what ends up happening is they say, oh, well, your lack of candor, right?
01:15:44.000And when they say lack of candor, what ends up happening with that is you can't testify.
01:15:48.000And that can be used, like, if you can't testify in court.
01:15:51.000You're becoming effectively useless to prosecutors.
01:15:54.000So, the number one thing is not lying.

01:19:18.000But, I mean, now that videos are so prevalent, and that we have them so many times in court cases and investigations, workers' comp investigations, they're so prevalent, you should just assume they exist.

01:19:35.000Yeah, and talk to me about the violations, because my understanding is, even if he hadn't resigned, and we haven't even talked about what was on the phone yet, if he hadn't resigned...

01:19:52.000And just the fact that he wasn't wearing the safety belt, was looking at something on his phone, was not being honest...

01:19:59.000It would, but most police departments have a union, and there is a pretty long and in-depth policy and procedure to enable them to actually be fired.
01:20:07.000A lot of times we'll hear they're put on administrative leave during an investigation.
01:20:10.000So a full-on investigation in those processes, due process, would have a right to.
01:20:15.000So it wouldn't be simply that they did those violations and then they would turn around and say, fire him the next day.
01:20:19.000But based on what we know from this video and what has come out, and it does appear that they do have a valid reason for termination.
01:20:26.000So now we go back to the investigative report, okay?
01:20:28.000And it states, on November 12, 2024, D.S. McComber was served with his subject officer notification and given a copy of the Officer's Bill of Rights.
01:20:34.000On November 19, this detective received a copy of the Sector 3 text group messages for the date of the crash.
01:20:38.000The group's text messages contained no memes or videos, again, saying that he wasn't being honest about what he was looking at.
01:20:43.000On November 20, 2024, this detective met with D.S. McComber at the Office of Professional Standards to complete an interview.
01:20:47.000D.S. McComber was given time to review the case file prior to any questioning.
01:20:50.000D.S. McComber was read his administrative notification and he agreed to tell the truth.
01:20:53.000Real quick, Alexis, this is all the show.
01:20:54.000That he has his due process rights that are being adhered to, right?
01:20:56.000You know, he's been given notice, he's been given a copy.
01:21:17.000Because now, he has some pretty serious misconduct.
01:21:21.000McComber stated that he was on the phone with D.S. Hoffman prior to the vehicle crash, but he was on his personal phone after that phone call looking at inappropriate pictures.
01:21:27.000D.S. McComber was asked to clarify what he meant by inappropriate pictures, and he stated pornographic material like boobs or whatnot.
01:21:35.000It actually says that, like boobs or whatnot.
01:21:36.000D.S. McComber stated he was looking at images that contained nudity.
01:21:57.000Ultimately, he hits a car that was stopped for a bus.
01:21:59.000So we're at a bus stop or in a school zone.
01:22:02.000You know, he's not following, it appears, like any of the policies that he is mandated to do it and has no concern for public safety either.
01:22:08.000And what's scary is he could have killed someone.
01:22:28.000Hopefully she wasn't hurt, but I'm assuming because the airbags deployed that there was a decent amount of damage that was done to both of the cars because the deployment of the airbag does require a certain amount of force.
01:22:37.000So, at minimum, the repair of the car, more injuries that she possibly sustained or anybody else that may have been in that car.
01:22:44.000Now, in his interview, McComer continued to talk about the ABS and the traction control in the patrol car, reiterating that the lights came on after the speedometer calibrations he had just done, but...
01:22:54.000D.S. McComber, quote, stated the information in his report concerning the ABS and traction control lights being on was more of a deflection than a genuine reason for the vehicle crash.
01:23:01.000D.S. McComber stated that he had those lights come on before in his other department-issued vehicles, and there had never been a problem with the brakes before this incident.
01:23:06.000D.S. McComber advised he never tested his brakes prior to the vehicle crash that day, even though he had plenty of time and distance to do so before the vehicle crash.
01:23:13.000Well, I mean, I think it's interesting that he decided at this point that he was going to be truthful when he was going down that road of lies.
01:23:19.000You know, I think that it's possible that there was some sort of talk or agreement that he would resign and admit to his wrongdoings.
01:23:25.000I just think for him to come clean at this point...
01:23:27.000I think if he had been honest from the rip and said, yo, man, I was looking at some prongs and I was thinking about gooning, he might have been able to keep his job, Chad.
01:23:37.000He would have been the butt of the jokes for years, but he potentially could have kept his job because he was honest.

01:23:47.000And McComber, of course, knew he was being dishonest in his report because he told the investigator, DS McComber stated, that he knew he was looking at inappropriate pictures, which was the leading cause of the crash.

01:23:57.000He stated that it's called lying by omission, and he further said he knows that one all too well.
01:24:00.000I mean, I don't mean to laugh, but my gosh, what are we talking about here?
01:24:03.000And it says, DS McComber was asked about a meeting with Sergeant Walls and what they discussed.
01:24:05.000He was explicitly asked if he lied to Sergeant Walls when he said he was looking at text messages in the Sector 3 group chat, and he said, yes, sir.
01:24:11.000DS McComber further stated that he knew he was lying to Sergeant Walls during their conversation.
01:24:13.000DS McComber was asked about wearing his seatbelt during the vehicle crash, and he stated he did not.
01:24:17.000He stated he believes it more tactically sound not to be seatbelted while on patrol.
01:24:20.000He stated that it has been a standard practice to not wear a seatbelt, but he knows he should do so.
01:24:28.000According to policy and state statute.
01:24:29.000Alexis, by the way, talking about potential charges, could he be fined under Florida law for not wearing a seatbelt?
01:24:34.000He could be fined for not wearing a seatbelt also.
01:24:36.000Also, he could be charged with, you know, hindering an investigation because he's lying during an investigation, lying on, you know, public records under oath.
01:24:42.000If it was under oath when they were doing this investigation, I'm not quite sure.
01:24:45.000So there are things that he could possibly be charged with.
01:24:52.000Most internal affairs investigations, guys, you're always under oath when they ask you questions.
01:24:56.000They read your rights and they get you under oath.
01:25:00.000He's not going to be charged with them, and it was part of the agreement having to do with him resigning.
01:25:04.000Now, that being said, in Florida, ultimately, it is the state attorney and not the police that determine whether someone's going to officially be charged with a crime and what that official charge would be.
01:25:12.000But the likelihood is that this isn't going to go any further.
01:25:15.000My concern is, though, how many other times has he lied or not followed procedures previous to this incident?
01:25:20.000Because he seems to have a complete disregard.
01:25:22.000He knows he's been trained on what they are, and he doesn't care.
01:25:25.000He's pretty much doing whatever he wants to do.
01:25:28.000Are you saying that in cases of police misconduct that they're old cases that might not even be related to this, where he testified, where he investigated something, they could be reopened by defense attorneys and say, we can't trust this guy anymore.
01:25:39.000Is that something that defense attorneys could be looking at right now?
01:25:41.000I think that that going backwards probably won't go that open.
01:25:45.000I don't think it's going to be a basis necessarily to reopen because he wasn't wearing a seatbelt and he's looking at porn while driving, reopening past cases.
01:25:52.000But I do think that the credibility issue on cases going forward, which he would have to testify on, it could, the court could possibly let it in because it does go.
01:26:00.000Yeah, every case that he's ever been involved in, man, if I was defending any case that he ever made an arrest on, I would absolutely appeal.
01:26:07.000And the other thing, too, that's going to come up, guys, is this case has national recognition now.

01:26:17.000Maybe he came into a deal where he said, look, I'm going to resign.

01:29:07.000Well, in conclusion, the report states, D.S. McComber admitted to knowingly lying in his original report.

01:29:14.000D.S. McComber stated he was looking at pornographic material on his personal phone just before the vehicle crash.
01:29:17.000He further advised that he was not wearing his seatbelt during the vehicle crash, which was his standard practice.
01:29:21.000And so McComber was facing termination, instead decided to resign, and he'd been on the floor since 2021 when the sheriff had welcomed him with a photo on the department's Facebook page.
