Day 3 of the Diddy trial is in full swing and the government is wrapping up their cross-examination of Cassie. We talk about what went down on day three of the trial and what went on behind the scenes.

00:18:30.000They showed a pic from after the altercation on March 5th, 2016.
00:18:36.000And in the photo, she had sunglasses because she claimed that she had a black underneath, though we didn't see the black eye.

00:18:46.000And then Diddy messages her, telling her to call him.
00:20:00.000Then she went to Diddy's security that day, a guy named DRock, okay?
00:20:06.000And when the prosecution asked her, why did he go to DRock's house?
00:20:09.000She claimed that she stayed there with him and his family because she got along with D-Rock.
00:20:14.000He had a family and a wife, so she went there because he was one of the few people in L.A. that she trusted, but he was one of Diddy's security guards.

00:22:17.000One guy named Ash, another dude she didn't know the name, a black guy, another dude named Islander, another dude named Tommy.
00:22:24.000Another dude that she didn't know the name, another dude named Skylar, another guy named Jake, another white guy that she didn't know the name of, a guy named Greg, a guy named Jonathan, another dude she didn't know the name of, another guy named Brian, another guy named Ben.
00:22:36.000Now, multiple of these escorts worked for either that Garen guy that I told you guys about yesterday that helped her procure the escorts, or Backpage, Craigslist, or dating websites.

00:23:26.000Like, they were strippers, but they were also escorts as well.
00:24:44.000Diddy messaged her we have to have a proper freak-off without K and that was referring to ketamine because basically when she took the ketamine she would kind of get out of it and it would make her very sick but she liked ketamine she said it was her favorite drug because it would help her disassociate better when they did the freak-offs but Diddy didn't like the way that she looked that she would behave once she was on the ketamine because I guess she just couldn't perform as well Also,

00:27:16.000And then after, and I guess that's the first instance where people found out about these freak-out videos, was this guy Sojit and DJ Wukid.

00:27:31.000And then she mentioned how after a freak-off with Diddy, they'd take IVs, they'd go get food, they had chefs that would cook for them, and they would get massages.

01:18:18.000As you guys know, Veronica Bang is one of her aliases.
01:18:22.000And she said that he's going to release the sex videos, hurt her, Kid Cudi, and he'll be out the country when it happens.
01:18:29.000So basically, he threatened her and said that not only would he hurt her and Kid Cudi, but he would hurt them, and he wouldn't be in the country, so it wouldn't be connected to him.
01:21:41.000She took a photo of September 28. On September 18, 2013, she took a photo of herself after the beating, so it happened days before.
01:21:48.000But on September 14, 2018, she stayed at her friend's host in California to recover.
01:22:02.000And she took a photo on September 14, 2018 of her face on her about that day.
01:22:08.000And Diddy told her when she sent him the photo, because she sent him a photo of her face all fucked up, he said, and she was staying at his LA house and his son was there, he said, you better not let my son see you like that.

01:22:39.000The AUSA asked her, "Hey, are these all the times you were assaulted?" And she said, "No, there were more times that she was assaulted besides the ones that we discussed in court." So, crazy stuff, Jack.
01:25:11.000As you guys remember, because I talked about this before, when Diddy allegedly held the girl up over a balcony or whatever, and the witness saw it, Cassie was the witness that saw it.
01:25:19.000And she confirmed that today on the stand, that she saw Diddy, Hold over the balcony and then he threw off to the side after that.
01:25:27.000Asian woman, probably smaller in stature.
01:26:36.000She kind of mumbled it, guys, so I don't know if that's the name of the dealer's name, but that's what it sounded like to me when I heard it.
01:26:43.000The prosecutor asked her, where did he keep the drugs?
01:26:45.000She said that he kept the drugs in a safe medicine bag, which the medicine bag was a Louis Vuitton bag that he used to keep his drugs, which I think they ended up finding one of these medicine bags, these medicine bags, you know, quote unquote, in his Louis Vuitton bag.
01:27:03.000Cassie was taking Xanax and Valium every day.
01:27:06.000She first took opiates at 19 years old for when her wisdom teeth was removed because the prosecutor asked her, was the first time she took opiates.
01:27:13.000And she used Percocet and Oxy almost every day when she was with Diddy.
01:27:17.000Her and Diddy would take opiates together.
01:27:20.000Diddy had doctors write prescriptions for them.
01:27:23.000And they would use different names and assistants.
01:27:25.000So basically, you know, as you guys know, opiates are heavily regulated in the United States, especially now.

01:29:17.000I will say that her husband was not in the courtroom because I looked over to see if he was there and he was not there during this part of the testimony which I thought was very interesting.
01:31:13.000The prosecutor asked her this question after, which is very interesting, and I know that the defense is going to hammer her on this tomorrow.
01:31:21.000They asked her if she was intimate with Diddy again after he raped her.
01:32:10.000Was like in the middle of text messages where they're fighting with each other or setting up freak offs or whatever.
01:32:17.000So obviously the prosecution has to deal with that because that text message is in there in the middle of all their evidence.
01:32:22.000So they kind of have to get in front of it and talk about it.
01:32:25.000And in this case, you know, she alleges that she got great by him in one instance.
01:32:31.000Then after the fact, she met with him and they hooked up after and it was consensual.
01:32:37.000I anticipate that the prosecution is bringing this up now, getting ahead of it, because they know that on cross, they're going to absolutely go after her on this stuff.
01:32:45.000So prosecution is kind of getting ahead of it, and you can't really avoid it.
01:32:49.000Kind of like how the defense, I told you guys yesterday, the defense kind of had to, you know, when they gave their, not yesterday, but the day before, when the defense gave their opening statements, like they kind of made it where Diddy took accountability for being violent, for being a pervert, for, you know...

01:33:07.000But the prosecution made sure to say, look, this is not a human trafficking case.
01:34:04.000And, you know, in this situation, we can kind of see glimmers here where I can see weak points where the defense is absolutely going to attack Cassie.
01:34:14.000I know they're going to definitely attack her on her seeing Diddy after the fact that she was raped.
01:34:17.000I know they're going to attack her on a text message that she sent him.
01:34:20.000I'm saying he's a good father and he's a good man and she loves him.

01:34:30.000They're going to attack her on the fact that he paid for everything and she took care of her and they went on trips and that she used drugs and that she was promiscuous and she had sex with all these men and she was having all these other relationships without Diddy.

01:37:28.000So like I told you guys before, the defense is getting, the prosecution is getting ahead of a lot of the things that the prosecution is more than likely going to attack around.

01:49:30.000He said, hey, you know, and he pulled up his report because this security guard, Officer Flores, I think he's an LAPD officer now, but back then he was a security guy for Intercontinental.
01:49:38.000He pulled up his report and said, hey, look, why didn't you put that Cassie had a black eye in your report?
01:49:43.000Why didn't you mention this other individual that was in the room?
01:49:46.000You know, why did you not mention in your report that Diddy told Cassie that she couldn't leave?
01:49:50.000But in your report, you said that Diddy told her to leave because in the report, guys, he wrote, Diddy told her to leave.
01:49:57.000But when he did his testimony, he said, Diddy, He told Cassie she couldn't leave.
01:50:02.000Now, Brian confronted him with a lot of these inconsistencies, and the officer basically said, "Well, you know, I didn't put it because I didn't think it was pertinent." He was like, "Oh, so you're going to put it in that report when it was pertinent?" Because mind you guys, the incident happened at 11 a.m. on March 5, 2016, on or about 11 a.m.
01:52:55.000He comes out, throws a fucking liquor bottle at Cassie, and smashes on the wall behind her, and he grabs her by the hair and drags her into the room.
01:53:05.000Now, the escort says that he didn't see anything, but he could hear slaps.
01:53:13.000And then he said after that, it was very hard for him to get hard-ons after that.
01:53:18.000And he said that, you know, if he couldn't get hard-ons or if he couldn't perform, Diddy would give him pep talks and all this other shit kind of funny.

01:58:02.000Now, I sat there and I waited because I knew that more than likely they still had to figure out some stuff.
01:58:07.000Because earlier in the day, they were arguing, the defense and the prosecution were arguing about the direct examination, okay?
01:58:17.000Now, the direct examination, guys, the defense intends, To attack her character, impeach her, her credibility, all this stuff, right?
01:58:27.000But since this is a case that involves sex trafficking and, you know, rape and all that other stuff, sexual assault, there's certain laws that are in place to protect victims, okay?
01:58:37.000And what the prosecution is worried about is that the defense is going to come in and they're going to not only attack her for, you know, for all the other stuff, but they're going to...

01:58:53.000This was the main focus of discussion after Cassie left and the jurors were released.
01:59:00.000Because when the jury's not there, basically the defense and the prosecution kind of argue evidence coming in, how they're going to go about things or whatever.

01:59:19.000And the prosecution was saying that this is a 412 issue, Rule 412, which, you know, 412 basically is supposed to be put in place to protect victims of sexual crimes, which let me double check this because you guys know me.
01:59:47.000So, prohibited uses, evidence offered to prove that a victim engaged in other sexual behavior, or evidence offered to prove a victim's sexual predisposition.
01:59:55.000So, basically, they're worried that the defense is going to bring up other sexual partners and other sex acts with other sexual partners.

02:01:31.000Now, I also want to mention to you guys, a lot of these exhibits are government exhibits, okay, that the defense is going to use.
02:01:37.000But the government doesn't like the fact that they're going to use these exhibits back on the government to attack her credibility and potentially link her to other men that she's having sex with and other sex acts.
02:01:47.000And they were arguing that that would violate Rule 412 of the federal criminal procedure.
