00:04:14.360 She, of course, finishes top eight,
00:04:17.080 but guess what?
00:04:17.740 So does a boy in the girls' division.
00:04:20.400 So her, Reese is her name,
00:04:22.340 and another girl by the name of Alexa,
00:04:23.580 they decide they're not going to get on the podium.
00:04:25.420 They decide to silently protest this male competitor
00:04:29.140 and his allowance to compete in the women's division in this way.
00:04:32.840 But instead of being respected
00:04:35.100 or even just allowed to express themselves in this way,
00:04:38.760 they were publicly admonished
00:04:41.160 and reportedly removed from the track meet.
00:04:44.080 It was a total violation of their First Amendment rights,
00:04:46.360 of course, as well as the violation of Title IX,
00:04:50.840 which is federal law, by the way,
00:04:52.340 that the state of Oregon and many states,
00:04:54.900 blue states across the nation
00:04:57.000 are continuing to defiantly ignore.

00:05:50.000 has just been so incredibly impactful.

00:05:55.340 So Jessica, before we go to the girls
00:05:57.620 and get their stories and hear from them,
00:06:00.560 can you just briefly explain this new lawsuit,
00:06:03.640 the basics of it,
00:06:04.900 and what AFPI's legal argument in this case is?
00:06:08.100 Yeah, well, Riley,
00:06:09.720 we're so excited to have you on our team.
00:06:11.460 You've just been such a champion for girls sports.
00:06:14.120 And honestly, at AFPI,
00:06:15.880 in this lawsuit specifically,
00:06:17.560 you've just been so helpful.
00:06:19.120 And I know our girls feel the same way.
00:06:21.400 So America First Policy Institute,
00:06:23.180 we filed a lawsuit against the Department of Education
00:06:25.960 in Oregon for having boys and girls sports.
00:06:29.240 And our ladies here today,
00:06:31.540 they were courageous and stood up
00:06:33.480 for what they knew was right.
00:06:35.380 Title IX is now being weaponized
00:06:37.540 against them.
00:06:38.820 On top of that,
00:06:39.840 Reese is going to talk about it a little later,
00:06:41.820 but they're actually clear
00:06:42.860 First Amendment violation issues.
00:06:45.840 Our girls, they're losing access
00:06:47.360 to the podium, to the medal,
00:06:50.460 you know, to scholarships.
00:06:52.040 And now on top of that,
00:06:53.640 from this last state championship,
00:06:55.960 they're now being sidelined.
00:06:57.480 Their viewpoints are being suppressed.
00:07:00.440 And so it's so simple.
00:07:02.120 We'll get into this in more detail,
00:07:03.540 but the solution is very simple.
00:07:05.520 We need more girls to be courageous
00:07:09.140 like these three girls are.
00:07:11.260 And honestly, our leaders,
00:07:12.640 our leaders in the state,
00:07:14.380 specifically here, the state of Oregon,
00:07:16.760 we need them to be courageous
00:07:18.620 and stand up for what they know is right
00:07:20.900 and say no boys and girls sports.
00:07:23.560 It's amazing to me how often
00:07:25.400 those two things really go hand in hand.

00:07:34.000 of free speech, free expression.

00:07:58.920 and I do track and field,
00:08:01.480 specifically high jump,
00:08:03.040 and I've done it for six years now.
00:08:05.100 So I've put so much time
00:08:06.240 and effort into it
00:08:07.320 and I really just love it.
00:08:08.840 I'm going to keep competing in college.
00:08:10.720 That's my goal.
00:08:11.960 And I just want to stand up
00:08:13.020 for this issue because,

00:08:15.440 so few people are doing

00:09:09.280 for about six years as well.
00:09:11.800 And I have had three encounters
00:09:14.420 with jumping against
00:09:15.280 a biological male
00:09:16.240 just this past track season.
00:09:18.220 And I'm here to stand up
00:09:21.220 for all the girls
00:09:21.840 who don't have a say

00:09:54.200 this movement really.
00:09:56.560 We've previously dubbed it
00:09:58.200 as like project boycott
00:09:59.660 with emphasis on the word boy
00:10:01.580 of these situations,
00:10:03.480 whether it's a team sport,
00:10:05.180 whether it's an individual type sport
00:10:07.320 like track and field
00:10:08.300 where a boy is in the lane next to them
00:10:11.500 or on the court on the other team,
00:10:13.620 whatever the athletic setting is.
00:10:15.160 And you have girls
00:10:16.280 who just say,
00:10:17.180 no, like I'm not willing to do that.
00:10:19.840 Whether it's,
00:10:20.940 we saw this happen often in volleyball
00:10:23.380 and I talked to some of the girls
00:10:24.880 and they say,
00:10:25.240 look, our safety was at risk.
00:10:26.500 So I just want to ask you,
00:10:27.880 like, was this something,
00:10:29.140 number one, you anticipated
00:10:30.640 or I guess planned for
00:10:32.620 or was it kind of like
00:10:33.920 a gut instinct in the moment?
00:10:35.760 Can you describe
00:10:36.620 what the scenario was?

00:10:39.280 On the day of the meet,
00:10:41.200 it wasn't until the night before
00:10:44.200 that they had released
00:10:45.220 the heat sheets
00:10:46.060 and all of the participants
00:10:49.160 and all of the track meet
00:10:50.820 that I was going to be going to.
00:10:52.320 So I made this decision day of
00:10:55.200 because that's when I found out
00:10:56.600 that he was going to be allowed to compete.
00:10:59.420 I had prayed about it all day.
00:11:01.220 I had been so stressed the whole day.
00:11:05.580 It was beautiful out.
00:11:06.380 And I was like,
00:11:06.740 no way I'm not going to jump today.
00:11:08.240 This is such a good opportunity.
00:11:09.820 It's my senior year.
00:11:11.480 I don't even know if like
00:11:12.620 not jumping is going to do anything.
00:11:14.600 It kind of felt hopeless.
00:11:16.080 And then, you know,
00:11:17.000 I get to the meet
00:11:17.800 and there's just a,
00:11:19.060 I would say it's a weird tension.
00:11:21.080 And I was talking to Reese about it there
00:11:23.620 and it's just didn't feel like competition.
00:11:25.660 I knew it was unfair.

00:11:58.140 you had to make that decision.

00:13:10.960 I would not be getting on the podium.
00:13:12.320 So I definitely had a lot of peace with that decision.

00:13:22.680 and she was talking with me the week before
00:13:25.080 asking what I was going to do,

00:13:49.260 obviously we saw the interaction from the official.

00:14:08.320 So most of us think of the First Amendment

00:14:13.800 But here, what Reese and Alexa did,
00:14:16.220 their actions are actually them speaking.
00:14:19.500 So that's their First Amendment right.
00:14:21.120 Again, even though it's not out loud,
00:14:22.880 their action is part of their speech.

00:14:26.200 this is exactly the reason
00:14:27.680 why the First Amendment was created.
00:14:30.140 We want citizens in our nation
00:14:31.980 to be able to stand up against the government.

00:14:35.900 is the Department of Oregon's education system.
00:14:38.320 We want citizens to be able to stand up
00:14:40.280 when they think their rights

00:14:43.620 and they're allowed to speak out.

00:14:47.320 he should have let her express her viewpoint,
00:14:50.780 express her opinion by stepping down.
00:14:53.360 But instead, he got her out of the way,
00:14:55.680 told her she had to leave
00:14:57.320 or both of them had to leave.
00:14:58.760 And again, that's then the government
00:15:00.500 suppressing your First Amendment rights.

00:15:04.300 And this is kind of a question for all of you,

00:15:44.080 So I was wearing that all during warmups
00:15:46.180 and during introductions,
00:15:47.340 I wore that shirt also.
00:15:49.180 And in our lineup jumping order,
00:15:51.220 I was actually jumping right next
00:15:52.580 to this biological male.
00:15:55.100 And so they called up my name
00:15:56.540 and I stepped forward, I waved
00:15:58.000 and I like a little signal to my shirt,
00:16:00.220 like, save women's sports, you know?
00:16:02.700 And I just think it's interesting
00:16:03.940 because after that,
00:16:05.220 there's the whole,
00:16:05.960 like Jessica was talking about
00:16:07.300 the whole debate of, you know,
00:16:08.920 free speech and First Amendment rights.
00:16:11.180 Meanwhile, over here,
00:16:12.140 we have these transgender athletes
00:16:14.200 who can compete based off of their feelings
00:16:18.100 and not actual like logical reality.
00:16:22.000 You know, even before the meet,
00:16:23.180 we were in the warmup area
00:16:24.160 and Rhys and I were talking to each other.
00:16:26.360 We were excited
00:16:27.060 because we're looking around
00:16:28.040 and we don't see this athlete anywhere.
00:16:29.700 We thought he had scratched
00:16:31.100 and the official told us,
00:16:32.960 she said, okay, we have everyone here.
00:16:34.880 So we're like, he must have scratched.
00:16:36.760 He's not here.
00:16:37.640 And we turned the corner
00:16:38.680 and here he comes with a bodyguard.
00:16:41.900 And it's just insane to me
00:16:43.460 that we're protecting these people
00:16:46.800 that I don't know.
