00:17:36.700 robinson's gun excuse me the bullet fragments found during charlie's autopsy were 30 caliber
00:17:44.000 the bullets found in tyler robinson's gun were 30 out 6 the gun found on the ground was a mauser 98
00:17:52.560 was tyler robinson's gun it's grandfather's gun originally and now they're matching those
00:17:58.880 fragments they also found a casing i believe it was inside the gun with the um with the markings
00:18:05.720 from the firing pin on it, matched to the gun, and then .30 caliber fragments found

00:18:50.900 We have the article out at the Post Millennial, and the ATF report was part of a motion that was, it was included in a motion that was filed by the defense on January 9th.
00:19:01.520 The exhibits included in the report include one Mauser Model 98 .30-06 Springfield caliber rifle bearing serial number 8863 with an optical accessory.
00:19:14.120 It also included were .30-06 Springfield caliber cartridges and a case, as well as one bullet jacket fragment and four lead fragments.

00:19:30.740 The report states that the Exhibit 1, the rifle, was test fired and found to be in operable condition.
00:19:36.460 It also states that one 30-06 Springfield caliber cartridge case, which was identified as Exhibit 2, bears Remington headstamp, as did the other cartridges.

00:26:02.700 can understand the frustration when we look at this ATF report with Tyler Robinson and
00:26:06.540 the bullet, this initial preliminary report that's come out. And Libby, I want to just
00:26:11.100 double check that report, even though it's just, you know, we've just gotten this information
00:26:18.840 yesterday, when was that report actually done? When was it conducted? That report was done in
00:26:23.460 the fall. That report was done months and months and months ago. And it revealed that the bullet
00:26:30.160 that was the fragment that was recovered from Charlie Kirk during the autopsy, and I'm no
00:26:35.040 firearms expert here, but I read the report. It reveals that it was .30 caliber and that the gun
00:26:41.280 was also .30 caliber, if I understand my terminology correctly. And so that was-
00:26:48.120 Can we have, so you said, wait, I just want to, before you go off on, on the rest, I just want
00:26:51.960 to be clear. This report was conducted this week or this report was conducted on September 17th.
00:26:57.220 It was conducted September 17th. It was in the, it was right after Charlie was killed.
00:27:01.980 So, so this information, I want to be clear on this, this information, even though it is new
00:27:06.380 to the public, cause I want to talk about the, the, the provenance of the information that even
00:27:11.000 though this information is new to the public, it's not necessarily new to the prosecutors and
00:27:15.840 the defense team. This is information that they would have received the minute that they started
00:27:20.800 in on the case. The report's completed. They've gotten it. And presumably they've received more
00:27:26.600 information as well that has yet to make it to light. So here we are saying, and I know that
00:27:33.200 there were questions about the ballistics in this case, and rightfully so. It's perfectly fine. You
00:27:37.220 should always ask questions. But now that the report is out, now the evidence is out, we can
00:27:41.720 now see what the prosecution and the defense team have been seeing since september 17th so
00:27:48.840 it's this understanding that even though it seems new to us it's actually been known inside the
00:27:55.800 system internally all the way back since september of last year only seven days after charlie died
00:28:02.440 i think that's important isn't it yeah i think that's important as well and it also speaks to
00:28:07.520 what information the defense has, what information the prosecution has that they are using to build
00:28:13.980 their respective cases. And most of the information has been, you know, that we have seen come through
00:28:20.300 has all been released to, you know, within the court system to both parties in the fall. And so
00:28:26.600 that is definitely what's been going on here. So when we hear the defense saying that they need
00:28:31.660 to delay because they haven't reviewed the evidence, they've had the evidence for a very
00:28:36.060 long time. And when we see people saying, you know, nothing has been submitted into evidence,
00:28:40.200 that's because the trial has not yet begun. And we have not gotten to the point yet where
00:28:44.260 evidence is submitted to the court in order to, you know, prosecute the case. So, yeah,
00:28:50.520 this has been going on for a long time. They have the information that they need. They are building
00:28:54.920 their cases respectively with the information that they've had since the fall. And that's
00:28:59.740 something that we saw in the prosecution's motion, the state's motion against the delay
00:29:04.480 that the defense has asked for. They have said, you know, you've had this evidence for a long
00:29:09.580 time. You've had all the materials and all the reports just like we have. So it's time to press
00:29:14.100 on. That's exactly right. And so Libby, just logically speaking, right? So, you know, people
00:29:22.660 said, okay, so there's a 30-06 casing that was found inside the rifle. There's the other 30-06
00:29:28.720 bullets and casings which were found inside the magazine, inside that chamber of the rifle.
00:29:34.480 uh, there were fragments found in the autopsy of 30 caliber bullet, but that was not able to be
00:29:43.400 conclusively tied directly to Tyler Robinson's rifle. What does that mean? Libby.
00:29:49.220 Um, I think what that means is that it hasn't been fully tested. There are other tests that
00:29:54.780 can be done to make sure that those two pieces match, but it also seems true that the 30 caliber
00:30:02.440 bullet came from a 30 caliber gun and that, you know, I, I'm not a firearms expert at all,
00:30:08.620 but those two things are true. So there's every indication that it would have come from this gun
00:30:15.120 and there are additional tests that can be done. Well, so Libby, let's, let's just use,
00:30:21.120 let's just use our logic and reasoning here that, so, okay, we can't, we can't say, or they haven't
00:30:27.900 been able to say, and one of the reasons, by the way, and I explained this to Vita Duffy last week
00:30:32.040 was the fragments are just too small to match to that specific rifle. It's like saying, because
00:30:38.280 the, because the way it's identified is through the barrel, the rifling of the barrel, unique
00:30:42.240 characteristics to each barrel, um, that would be produced. If you fired another round through
00:30:46.160 the barrel, you would check those markings up against the markings of the bullet and then see
00:30:49.560 if they were a match kind of like fingerprint matching. And when we have this situation,
00:30:55.420 it's like, it's kind of like having a partial fingerprint where you say, well, we can tell
00:30:59.080 that it's similar, but we can't go all the way down the road of saying that it is a 100 percent
00:31:05.780 match. And so and that is because of the degraded fragmentation of the bullet itself. But they could
00:31:13.060 they can tell, though, that if you constituted it or reconstituted it together, it would be
00:31:17.840 a 30 caliber bullet. But when I say use our logic and reasoning, Libby.
00:31:23.360 is there any other evidence of a 30 caliber style rifle anywhere in the vicinity of charlie kirk on
00:31:33.020 that day yes or no no this this was the one this was the one it was a robinson family rifle this
00:31:40.240 is the one that they found this is the one that was used you know from what they understand and
00:31:45.420 there were no other rifles found at the scene this was really it it does look to me like the
00:31:52.220 defense's opportunity to say that robinson was not the guilty party here it that's definitely
00:31:58.540 closing right there their window of opportunity to do that i believe is closing the defense

00:33:17.220 gets scheduled after that but may 18th looks to be when we start to get into the meat of it
00:33:21.880 and so libby walk us through just real quickly tomorrow we have a hearing in the tyler robinson
00:33:29.140 case as well this is one that you and i have really been focusing on this has to do with
00:33:34.400 cameras in the courtroom. Tell us about that. Yeah, so Judge Tony Graff is going to have to
00:33:39.900 finally decide whether or not he's going to allow cameras and digital media in the courtroom
00:33:45.780 to record what's going on in this case. That includes live streamers, and that includes,
00:33:51.940 you know, camera people who are taking photographs or video. And he's going to have to decide if he's
00:33:57.000 going to allow that. The defense has been opposed to that, and they are opposed because they don't
00:34:01.700 like what the press has written about their client since Charlie Kirk was murdered. The media also
00:34:08.340 has an attorney, so that media attorney will also be speaking about the necessity of transparency
00:34:14.680 and truth in this case. I think that's exactly what we need to get into. Libby Edmonds, where
00:34:22.720 can people go to get access not only to this report, but all of the reports? Because I know
00:34:27.920 that the post-millennial is releasing so many of them. And Libby, just by the way, as a thought

00:35:39.840 i look through this report you know there's these questions so they've recovered the intact bullets
00:35:47.780 bullets that were not fired, right?
00:35:49.280 Those are in the chamber of the rifle and, or excuse me, those were in the, in the magazine
00:35:53.920 well.
00:35:54.920 Then we see as well the, the spent casing, which is recovered in the chamber.
00:36:01.500 The fragments were recovered during the autopsy and because they fragmented, they aren't able
00:36:09.980 to be specifically matched to this rifle.
00:36:12.920 So, Tom, when when we see all this, you know, there's this question of, are is this bullet the same bullet from those, you know, from that rifle?
00:36:20.860 Because, you know, this is going to be a key question in the trial.
00:36:25.300 Now, as far as we know, it's the only gun or rifle that was found at the scene.
00:36:30.580 We know that this was an individual who there's lots of other evidence about.
00:36:35.480 But but just from a ballistics perspective, is it you know, what would you say the odds are that this was fired by that you would find a gun in this condition that you would find the specific 30 out six cartridges and and jackets in this condition with the with the etchings on them?
00:36:54.120 But then somehow that also not be the gun that fired the shot.

00:37:02.820 And I'd say it's beyond any reasonable doubt. Let's just say that, right? I mean, it's beyond any doubt. And look, to me, I'm troubled by the fact that there are people who claim to be serious, that the round that killed Charlie did not come from that rifle, and that Robinson was not the guy on the roof.
00:37:25.480 um i i think it's very troubling just in general but i mean this is one of those things where
00:37:30.680 it's pretty obvious what happened here so um i i just have a hard time i just even even i i get
00:37:38.400 you know you know take take the opinion out of it right it's it's just what just from an odds
00:37:44.420 perspective as a as a you know as an expert marksman i think you had an e right yeah i've
00:37:50.400 had a little bit i've done a little bit of shooting in my day a little bit a little got
00:37:53.700 right extra marksman yeah i mean just what are the odds that you'd find a rifle in that condition
00:37:58.560 and then you'd find a fragmented bullet in that condition and um that and that wouldn't be the
00:38:05.260 it wouldn't be it it's next to impossible i mean what was there another shooter just uh feet away
00:38:12.440 who fired the exact same type of round and that robinson was a patsy or something not but just
00:38:18.120 like the the simple forensics and the ballistics report i mean that's enough right there look if
00:38:22.760 it turns out that Robinson had a, you know, he had his 30 odd six, you know, rifle, a hunting
00:38:28.880 rifle, and then Charlie had been killed with a nine millimeter pistol round. Okay. That would be
00:38:34.400 some sort of doubt, I suppose, obviously wouldn't be, but that just simply not what happened.
00:38:39.380 So it's, it, to me, it's just, it's so painfully obvious and frankly, really unfortunate that these
00:38:47.100 types of, you know, look, I, I, I don't blame the defense. Let me ask you from a ballistic
00:38:52.740 From a ballistic's perspective, and obviously I have lots of emotions about this one as well, there's no question.
00:38:59.420 But from a ballistic's perspective, do bullets always do the same thing when fired?
00:39:05.460 Do bullets always travel in the exact same pattern, in the exact same way, just like they do on the range in real life?
00:39:13.120 Is that something that you can always perform a test again and again and again?
00:39:17.420 No, it's never consistent.
00:39:18.680 And I think that's a great point because there's so many variables when you're dealing with a piece of metal or lead that's going, oh, my God, fast at various conditions, various densities of a bullet that has, you know, like it's not every bullet is perfectly uniform all the time.
00:39:34.780 It's close enough, but, you know, with different wind condition, how it strikes and just the angle of the strike, like, look, when rounds impact things, they do very strange things in a manner that is not scientifically predictable.
00:39:48.680 So it's just like, yeah, is there, is there a certain phrase that you might hear in, in the
00:39:53.480 community that, uh, that captures this? Yeah. Bullets do weird things. Well, let's do weird
00:39:58.620 things. And it's, and so the idea that, that, you know, in this case that it did fragment
00:40:04.800 and those fragments, which of course came out during the autopsy, um, will play a significant
00:40:10.900 role in that autopsy. Um, you know, is that something that you would see as consistent
00:40:16.620 with the firing of a .30-06.
00:40:19.360 Yeah, absolutely.
00:40:21.100 100%.
00:40:21.580 And the thing is, I mean, the fact that it's obviously very clearly
00:40:25.260 came from the rifle in question, it's very clear, you know.
00:40:30.260 So, yeah, bullets do strange things, absolutely.
00:40:33.260 They do weird things when they enter the body,
00:40:35.380 when they hit a metal target, when they hit wooden targets.
00:40:38.400 They all do all sorts of strange things.
00:40:40.560 But at the end of the day, look, we know the type of bullet that killed Charlie,
00:40:44.920 and we we have the rifle where it came from where it was recovered everything there it's it's it's
00:40:52.120 pretty pretty open shut case as far as i'm concerned so well and and that's but but you
00:40:58.380 know i i want to i think it's important to go through the evidence and to prosecute the evidence
00:41:03.620 at the same level that it's going to face of the scrutiny at the trial right right and so that's
00:41:09.860 why we look at these things and as an investigator you have to say okay you know what else what other
00:41:14.660 right? What else, what other? And if you look at it and you say, okay, well, I know that it was
00:41:21.580 a 30 caliber round. I know I've got this rifle. I don't have any other rifles around. I, you know,
00:41:27.920 I have this spent casing that is inside the round, you know, inside the chamber. I have all these
00:41:33.940 other rounds. We know that one shot was fired. I find a rifle that always one shot fired. I mean,
00:41:38.940 again, Tom, what I'm, what I'm talking about here is, you know, you're just, you're just
00:41:42.860 ratcheting up the probability over and over and over that this is the rifle yeah i mean let's just
00:41:49.920 say for instance yeah that's absolutely the rifle now for let's say tyler robinson hadn't turned
00:41:54.420 himself in which by the way he turned himself in right and he's not done that and let's let's say
00:41:59.740 the killer was still at large then we might not know who the killer was but we know the murder
00:42:05.900 weapon so i mean we already have it it's right there it's all well and then tom you know right
00:42:12.360 and tom as as you say we you know having the weapon you know there are you know there then
00:42:17.620 these things called and i know that through eod work that you've done and i'm certainly when i
00:42:22.840 was attached to you to your unit um you know there's these things called fingerprints that
00:42:27.580 can then be lifted from that rifle and uh touch dna in many cases that can be lifted and then
00:42:34.240 And further investigation can be done to that piece of evidence to be able to tie a certain person or, you know, in the past, a terrorist group or other group, a military unit, whatever it may be, to that specific item.
00:42:51.480 And so these are the steps that you would then take if you can't get an exact match.
00:42:55.400 You say, well, let's see what fingerprints are on this.

00:47:24.440 We have been searching, though, and we knew that we received what we call, you know, in the intel community, it's the indications and warnings, right, that, hey, we think that the Iranians might have been able to lay a dozen or so mines before we took out all their major mine layers and most of their mine inventory.
00:47:43.980 However, you could still put a few speedboats with, you know, two, three, four mines on them in the middle of the night and just kick them over the side.
00:47:51.060 So that's what we suspect happened. It's what we call indiscriminate mining and that they did so in the main traffic separation scheme, which is like the main part of the strait where most merchant traffic goes through.
00:48:02.500 So we killed all their mine layers, took out all their inventory, but they still might have gotten a few through.
