00:01:11.300 Benny, I want to come to you simply because we have been discussing this with respect to the
00:01:16.780 left and Democrats want to be the first people to take away your Second Amendment right. But yet,
00:01:22.000 ironically, it is many people who identify as Democrats or liberals that seem to be doing a
00:01:28.000 higher proportionate share of the killing. No, exactly. And Bo, I was talking to you earlier,
00:01:34.740 there was just a recent situation that went viral on social media where this staffer for a Democrat
00:01:40.540 in Wisconsin posted a video saying that the new mantra is kill your local Republicans. So
00:01:47.180 I just, I find it quite hypocritical and quite funny how the people that say guns should be
00:01:54.140 banned, guns, you know, you can't, no one should be allowed to have them, are the ones doing the
00:01:59.120 killing most of the time. You know, not, I'm not saying all, you know, this is a party versus party
00:02:03.960 thing, but it comes down to it where, okay, well, how many Republicans, you know, identify people
00:02:09.520 that identified as Republicans have publicly assassinated someone or tried to. So it's just,
00:02:14.800 I want to open that discussion because it's quite interesting. And I know Kevin has some good,
00:02:18.880 some good, you know, input on that as well. Yeah, Kevin, there's a, there's a high degree
00:02:24.280 of vitriol among the left and that vitriol has to, you know, it's one thing to be angry.
00:02:29.860 It's one thing to want to see grievances addressed in some way. It's another thing to take that to
00:02:36.180 a different level, to take that to a violent level and to kill people. So, but that's something that
00:02:41.380 has been recurrent. We've seen this now. I mean, we've seen this with the president.

00:02:49.220 unfortunately was successful. We're still putting those pieces together in the aftermath of it. But
00:02:54.680 speak to that. Sure. So quite simply, I mean, argument is the last line of defense. Okay.

00:03:18.320 charlie was a champion of the first amendment he loved debate he loved arguing with people it's like

00:04:36.560 we don't have a ton of time left, just short of five minutes, but tell me just from a legal
00:04:40.140 perspective, what you've seen thus far, just your general observations of how the court proceedings
00:04:45.060 have gone, the objectivity of the judge, how you've seen him dismiss and overrule a lot of
00:04:51.640 the defense's objections. Just give us kind of your legal assessment thus far. Yeah, just real
00:04:57.520 quick you know the judge is i think doing everything correctly here i i mean he's playing
00:05:02.340 it by the book you know one of the one of the big issues here is and it's a preliminary hearing right
00:05:07.680 this is probable cause uh you know this very very low threshold and uh you know there's all this
00:05:14.300 evidence and the defense is trying to say that there's you know a lot of it's hearsay that it's
00:05:18.660 secondhand evidence and the fact of the matter is that that utah something that's you know peculiar
00:05:24.860 to Utah's system, they have a very broad allowance in these preliminary hearings for this hearsay
00:05:30.180 evidence. So things like, you know, what information, for example, that was told to two officers who
00:05:36.400 then put that information into the police report. And the judge was letting it, for the most part,
00:05:41.760 letting it in. And that seems to me to be absolutely appropriate, you know, at this stage.
00:05:47.740 So what I'm seeing is all basically normal and par for the course.
00:05:53.040 Well, let me ask you this. In reading this NBC News article, I know they didn't have Twiggs testify today, but it says prosecutors moved to quash the subpoena for Twiggs saying they intended to use a recorded interview in which Twiggs is alleged to have told investigators that Robinson confessed to the crime, concealed the weapon, disposed of clothing and told Twiggs not to contact law enforcement.
00:06:14.940 If that gets in, what else do you need to see? I mean, I'm just, you know, I know that trials are bigger than that. But if that piece is admitted, what I mean, what case does the defense have?
00:06:27.600 Well, they don't have much of a case. And remember, it establishes two things, right? First of all, it establishes the intent element. And it also helps, I think, bolster the case for aggravated murder, which here is predicated on endangering lives at the event, but also the political element.
00:06:53.780 So, you know, to me, this this is a very crucial piece of evidence.
00:06:58.620 I do not envision a universe in which it doesn't get in.

00:07:41.460 But nobody should interpret this being lengthy to mean that in any way case – any way that the prosecution's case is weak, right?

00:08:09.680 And so going through it thoroughly, giving the defense their day in court, allowing every argument to be made while it's frustrating sometimes for us to watch helps, you know, helps shore this up and prevent any of it being tossed down the road.

00:09:37.560 the preliminary trial that's about a five-day trial
00:09:39.620 that will determine whether this will go to a jury trial.
00:09:42.280 I've got Kevin Posobiec on hand in Provo, Utah,
00:09:44.860 as well as Benny Ray Harmony in the D.C. area.

00:09:49.380 we talked about how the national media
00:09:51.200 may try to downplay some of the leftist activism
00:09:54.820 of Robinson and his partner. I'm reading from NBC News, too, as well. It says that on Monday,
00:10:03.300 I guess it was past Monday, State District Judge Tony Graff Jr. granted prosecutors motion
00:10:07.420 to quash a subpoena brought by defense attorneys to have Lance Twiggs, his partner, testify live
00:10:14.100 in Utah at the preliminary hearing on July 6th. Twiggs was living with Robinson at the time of
00:10:18.420 the killing as a romantic partner, but the court referred to him as a mister, but defense attorneys
00:10:23.300 have previously referred to him as transgender and goes by Luna. So we know that that is a
00:10:29.700 storyline that is a component of this. How does that play into the broader picture? You seem to
00:10:35.360 indicate that the mainstream media, of course, sympathizes with the left and has a leftist lens
00:10:40.100 and bias, will downplay that aspect or the leftist aspects of Robinson and Lance Twiggs?
00:10:47.500 i do i do because this is the worst case scenario right like we charlie and jack and many others
00:10:56.660 have been on record for saying like look at the crimes that are committed by antifa types
00:11:03.500 by these furry like drugged out weirdos you know on college campuses um college campuses are where
00:11:11.360 you know people's minds can be molded in one way or another and that's what
00:11:16.180 That's a thing that Charlie held so dear to his heart.

00:11:24.340 And sometimes, you know, especially classifying these places as indoctrination camps for liberal woke ideologies,

00:11:47.180 So you tie all that together, and he's doing this stuff with Lance Twiggs.
00:11:51.580 And so it is kind of interesting how they could not subpoena Lance to come
00:11:57.600 and testify one way or the other.

00:12:02.400 But, yeah, so on the left, the mainstream will say, oh, well, it's just normalized.

00:12:11.220 that's what we're up against really. And, and not just colleges, but, you know, you see it with
00:12:16.800 these anti ice protests and, and these, you know, pride parades, like they just try and do it over
00:12:23.420 and over and over just to normalize it, make it okay. And it's not okay. It's not okay.
00:12:29.020 No, it's, it's, it's not at all. And you bring up, you bring a great point, Kevin, because when
00:12:34.520 you think about the, the circumstances surrounding this and who, who, who allegedly did it, who his
00:12:40.060 partner is, was, however you're going to think of it, you know, that community can tend to be
00:12:45.560 very violent. And we've seen this. I mean, historically speaking, this is not subjective.
00:12:52.120 This is an objective reality that we have seen this community, either mental health reasons,
00:12:57.800 hormonal reasons, who knows what. But there is a faction there and that there is a psychological
00:13:02.480 component to taking a certain ideology and making that violent and making it certainly
00:13:08.580 it's something that causes murder so speak to that Kevin. Absolutely and I'd add on too that
00:13:15.380 there's there's studies that you know homosexual relationships and lesbian relationships also
00:13:21.400 correlate to a increase in domestic violence issues too so there we have that okay and you
00:13:30.160 know so we're talking about all that okay like maybe okay somebody could have the freedom to
00:13:37.300 be that way. But then when you start getting into the violence part, that becomes a problem
00:13:43.040 for society. And in this case, being able to bring a gun onto a college campus and shoot
00:13:49.680 somebody that you don't like because you don't want to talk to them because they're giving
00:13:54.080 you the truth about your circumstances. They don't like it. And Charlie said that famously
00:13:59.640 too. It's like when the conversation ends, that's when the violence starts. And that
00:14:05.280 is not what the mainstream media wants to see so therefore because this is evidence of that
00:14:11.100 happening um if you're going to try and downplay it or normalize it or write it off like oh
00:14:16.480 or or they'll just downplay hey maybe he had like uh he's an exception maybe he did have some mental
00:14:22.160 difficulties that's why he wrote those things on those bullets and you know he didn't really mean
00:14:27.780 it or something or maybe there's just not a organized movement uh you know against republicans
00:14:35.260 and conservatives and anybody who loves america um you know i saw that in minneapolis myself
00:14:42.700 with the anti-ice protesters just all kinds of very violent rhetoric and you know we're going to
00:14:51.740 see it in an uptick i mean it's kind of a tangent but towards the midterms as well um but these no
00:14:57.500 kings rally these no kings protests these indivisible protests they're they're being
00:15:03.900 funded and and they're they're organizing and they're being put on pushed pushed and donated to
00:15:10.520 by uh who lord knows who so we have all that it's it's being funded now it's like i don't know maybe
00:15:19.500 in the 60s 70s you'd have like a small community of homosexual people but now it's being actively
00:15:25.580 funded by the left and these soros types individuals okay so so the left does not want
00:15:32.300 that to be exposed. So that's why they'll downplay it. That's absolutely true. Before we
00:15:36.320 go to break, I just do want to mention that tonight we do have some special coverage from

00:16:54.820 Posobiec because Jack is in the courtroom at the trial, a preliminary hearing of Tyler Robinson
00:16:59.760 out in Provo, Utah. We hope to have Jack at some point, but we do have Kevin Posobiec along with us
00:17:05.140 as well as Benny Harmony in the DC area. You know, guys, we talked just briefly before about
00:17:09.980 the fact that there may be enough evidence hopefully presented in the case that may not
00:17:13.880 last all five days. And also the fact that the defense has been just trying to object, object,
00:17:17.660 object, and the judge has been overruling. So I do want to take a look at a SOT real quick,
00:17:21.400 sought to, which I believe the judge is talking about graphic exhibits, if we could take a look
00:17:25.260 at that. The court's thought about this issue in regards to publication of exhibits. Obviously,
00:17:32.400 the court will entertain all motions before any, but after considering it, here's the two points
00:17:40.640 that I wish to address. In regards to the exhibits, there is benefit to publication of certain
00:17:47.560 exhibits, but I also do not, and this is going to the camera operator, do not want them to be
00:17:54.400 displayed on TV. I believe it is important that the parties know that the exhibits are being
00:18:02.200 viewed by the judge in real time and in open court. However, what I will do is have the monitor
00:18:10.300 placed against that wall to reduce the possibility of it being broadcast. And so on the exhibits
00:18:19.100 that the court grants to be published in court and not going to Mr. Novak's point, not to be
00:18:25.720 given copies to, and the court is trying to be mindful that if it's shown on TV, that's essentially
00:18:34.020 giving a copy to. So Kevin and Benny, we'll start with Kevin first. This idea of graphic exhibits
00:18:40.980 that knowing, telling the public that the judge will see them, but the public will not. What's
00:18:46.700 the thought process on that, Kevin? And is that a fair line of reasoning that the judge is exhibiting
00:18:53.260 there? I think it's a fair line of reasoning. Again, we have so much evidence of video and
00:19:01.220 whatnot that's good for the judge stoney graph to be refreshed on what's being presented uh things
00:19:06.400 like the campus um even the screwdriver that was found on the rooftop was also being presented
00:19:13.180 today as well as evidence and um it's it's advantageous to him um because they want to be
00:19:20.240 as clear cut as possible and get all the high resolution photos whatever they can to be
00:19:28.520 presented here because this this is where the prosecution really shines is is bringing all
00:19:34.500 this forth um and keep in mind too this this area provo is is more red so unlike you know if this
00:19:42.480 were to have happened in salt lake city or you know philadelphia or new york city um the
00:19:48.960 prosecution would have a harder time uh compared to the defense and and uh you know we have such
00:19:54.220 a travesty of judges across the nation in so many other subjects uh today um but thankfully here in
00:20:02.420 provo this judge is more conservative and he is going to go through things uh judiciously
00:20:09.460 meticulously and also modernly which is using using uh digital digital uh formats so he can
00:20:18.740 have that. It does seem modern. It does seem a little different, but I mean, it's 2026, so we
00:20:25.000 could use, we should be using everything that we can. Yeah, no question about that. And Benny,
00:20:30.320 you know, just in terms of what you've seen from the judge thus far, do you see fairness? Do you
00:20:34.780 see objectivity? I mean, ultimately, in any trial you want, you know, the lady justice is supposed
00:20:40.320 to be blind. That's why they had the scales tipped in such a way that things should be equal and
00:20:45.560 fair. I think there's certainly an amount of public interest that this serves. People need
00:20:51.340 to be paying attention to this case. It is important that we understand the minutia of it
00:20:54.700 and understand that it is done fairly. I mean, if I'm the prosecution, I believe I would be
00:21:00.120 sitting pretty. You have a lot of very compelling evidence. At this point, what does the defense
00:21:05.060 have other than trying to object to things? I don't know really what they could even defend
00:21:09.060 at this point no absolutely and you know with watching this just this morning it kind of takes
00:21:16.080 me back to the kyle rittenhouse case if you guys remember that and you remember that judge and and
00:21:21.340 you know he was very fair to each side at least in my opinion you know he he told he told the
00:21:26.240 defense when they were being wrong he told the prosecution when they were being wrong and so
00:21:29.840 so far i really like the attitude of this judge i think he's very calm and you can tell he's really
00:21:36.620 thinking and he's really looking into this and he's taking time before he responds. And he's
00:21:41.160 making sure that he's thinking of all the parties included, you know, not just one. And so I think
00:21:46.580 that this is going to be a pretty fair trial. I really do think so. If, if this pre-trial is any,
00:21:51.860 you know, uh, you know, if we can look at that and, and, you know, if this does go to bigger,
00:22:00.280 you know, a jury trial, I think that, I think it could go, could go very well. And, you know,
00:22:05.260 like you said, I don't know what the defense has at this point. I think they're going to continue
00:22:09.160 to object and continue to find ways to try to throw the prosecution off their game. But so far,
00:22:14.540 I think this judge is great. I think he has been great since day one. You know, he said good morning
00:22:19.760 to Erica. He said good morning to Tyler Robinson. And I think he's operating very, very well for a
00:22:25.920 judge. Kevin, how do you think that the mainstream media is going to cover this? We know how Rav is
00:22:31.560 going to cover it. We have very, very, you know, I mean, it's personal, of course, for us. But it's
00:22:37.580 also there's an objectivity to it, too, which is the man was gunned down in cold blood. And what
00:22:42.780 he represented was freedom and liberty and conversation and dialogue. It's something
00:22:47.020 everyone should be interested in. But in your opinion, and what you've seen thus far, how do
00:22:51.820 you think major media outlets are going to cover it? Are they going to give it the attention that
00:22:55.960 it rightly deserves? Or do you think that they'll shelve it and sideline it for something else?
00:23:01.560 well that's a that's a great question and and it's an understatement that i mean again this is
00:23:10.220 this is a legendary figure charlie kirk here and it is personal i mean between my brother and i
00:23:18.080 and the whole rav family so it's very personal but at the same time this is part of what i learned
00:23:23.140 during the nancy guthrie investigation that i was in in tucson arizona where there's only
00:23:30.180 enough room for speculation of certain things and this is uh almost like a true crime kind of
00:23:37.500 scenario well it is but uh so the objectivity piece is crucial here and you know moving forward
00:23:47.240 we'll be able to see what is presented as evidence and what is discarded immediately that that's also
00:23:54.540 why there's the judge has that screen there but but um yeah the objectivity is that
00:24:03.820 the defense won't be able to the defense won't be able to you know continue to just object to
00:24:11.900 everything outright they all will need their own objectivity too instead of just saying oh
00:24:16.060 i don't believe that oh that's probably fake or oh what about this um it it's it's just it makes
00:24:22.540 things much more black and white okay it makes it makes the evidence be what it is you have officers
00:24:30.380 testifying to what has already been presented okay so but the mainstream media i don't know
00:24:36.460 they're going to try and dramatize it um i saw some comment um about like charlie's parents
00:24:43.500 arriving separately from erica's and like a lack of security and then you know people are trying to
00:24:49.740 talk about protests may be happening or stoke people to come here um you know they're they're
00:24:56.300 they're trying to dramatize this in any way they can to stir people up other than just hey guys
00:25:03.900 like we have the evidence we're presenting it boom here it is you know so back to my previous
00:25:08.940 point bow like i'm i'm kind of hoping that only takes a few days but you know there might there's
00:25:15.340 obviously much more that i don't know that a lot of us don't know that's going to be presented as
00:25:19.580 evidence um but yes being that it's appears to be so clear cut so far uh the me the mainstream
00:25:28.760 media they're going to try and just dramatize it or or just definitely probably get these facial
00:25:35.220 inflections in like oh what what's what's erica doing or what's jack doing or don jr what are
00:25:42.740 his parents what do they look like you know of course they're going to try and i i honestly
00:25:49.000 don't know it'll be it'll be all over the spectrum but but yeah we've become unfortunately
00:25:54.140 there's so much a lot of exaggeration it's become tabloid media you know we're looking at reactions
00:25:58.460 and expressions but bennie i want to come to you and i don't want to ask you to say anything that
00:26:03.240 you you can't say perhaps about your former employer but considering the nature of this of
00:26:08.500 the circumstances of of that led to your departure or your dismissal because of what you did i'll
00:26:13.960 pose that same question to you. How would a network like that be covering this? Or is there
00:26:19.360 going to be minimal attention upon it? Is there going to be a, some sort of bias against it?
00:26:25.700 Will they try to minimize the, the, the, the, the, the alleged assassins actions? What, I mean,
00:26:32.680 you know, you've been inside it. You saw how it was from that angle. So how do you think
00:26:36.640 outlets like that will be covering this? Well, Bo, I will say, I think your national
00:26:42.980 networks, your ABC, NBC, your Fox, your main networks, on the national level, they will be
00:26:49.720 covering it. But when it comes to the drizzle down to the local affiliates all over the country,
00:26:56.240 that I can't speak to because, you know, in my situation, what happened was, you know,
00:27:01.720 our affiliate in Illinois would not take the cut-ins from national. They would not run anything
00:27:06.980 that had to do with the assassination, you know, of Charlie.
00:27:11.200 And so I think we're going to see the typical coverage that we always see.
00:27:14.860 But remember, headlines that sell is what they're going to talk about.
00:27:19.000 So if this is a major, you know, if this brings big attention, which as I hope it's going to,
00:27:25.260 they are going to have to talk about it.

00:33:54.920 I mean, each one of those had, I mean, the one I was watching had 15,000 people just on that one stream watching this. So just imagine with all the different sources now with, you know, it being open to press, just imagine how many people's eyes are on this right now.

And the amount of people that I have talked to, Beau, specifically after I was suspended from my previous job and because of making a tribute to Charlie, so many young people reached out to me and said, I didn't know who Charlie was, but now I do.

00:34:35.120 And so I think the amount of transparency that's going to come out of this trial because of the amazing judge so far who is allowing those cameras in the courtroom.

00:35:21.480 that their monitors that are in front of the attorneys can be seen.
00:35:24.860 And to be mindful of that, I suppose, because there are certain things that our cameras
00:35:29.020 or those that are in the courtroom would be able to capture because you can see what's on someone's
00:35:33.080 screen. Have you been following that as well? Because that's something I kind of noticed that
00:35:36.240 was happening that the judge was saying. Well, it's it's an interesting technicality. I was
00:35:43.860 watching in particular the the attorneys and the teams up front, as we can all see on the live
00:35:49.700 stream, that they have laptops which have cameras on them, but the media can't have cell phones or
00:35:56.180 cameras and the live stream is can only show the backs of their heads and not the side angle or
00:36:01.940 any facial inflections that may uh occur uh you know but and then it is allowed on the side wall
00:36:09.260 so it's interesting how that will play out um but but yeah that's that's a also um one of the
00:36:17.240 striking things that the judge has allowed is for that as well um but you know so far like i said
00:36:25.140 We're talking, you know, they're going over the maps of the campus layout, where the buildings were, where Tyler Robinson was on the Loci building roof.

00:38:04.600 We have that as well. Those will be pretty substantial, but also as we were there yesterday, there's a security camera on the corner of one of the top buildings where we've seen already when Tyler, after he takes the shot, jumps off.

00:38:27.620 so that camera is still there so what we're hoping to see delivered is the footage before that of him

00:39:10.800 country has a right to a fair trial. We know that, but when you consider the fact that of,
00:39:16.000 of what the evidence seems to point to, which of course is that this man murdered Charlie Kirk in
00:39:20.700 cold blood. He's entitled to his defense. Maybe the defense is just doing the job that they're
00:39:26.400 set out to do. I often wonder how an attorney could defend someone like this. I mean, I know
00:39:31.820 it's their job, but at the same time, from a moral standpoint, it seems very, very difficult.
00:39:37.040 As you looked at the trial this far, and I've only caught bits and pieces of it, are you noticing
00:39:40.700 any body language from Tyler Robinson? Are you seeing anything that would indicate remorse,
00:39:45.120 guilt. I did. I felt like I saw him with a pen in his hand. Anything that you're noticing thus far
00:39:50.200 that sticks out to you? No, he honestly seems just very calm, which, you know, is kind of
00:39:57.160 surprising to me when when there are, you know, some of the evidence that the prosecution has
00:40:02.180 is text messages to his partner, who hopefully we are going to get to hear from. And these text
00:40:08.000 messages say, I took out Charlie Kirk. So when you have something like that and you're just sitting
00:40:13.460 there, plain faced, in the courtroom, taking notes, you know, at that point, you know what
00:40:18.040 you did. And so I don't know that we're going to see a lot of him. I remember the one picture
00:40:24.520 that was released or the one video and the defense, you know, threw a fit. But to the point
00:40:29.260 that Kevin was talking about, about the defense constantly, that they keep, you know, objecting
00:40:35.500 to every single thing. I think they realize that's what they have to do. They have to make
00:40:40.480 some sort of case and obviously with the evidence that is going to be shown they know they don't
00:40:46.200 really have a great defense and so they're going to continue to object you know you know you watch
00:40:50.480 the movies you watch all the things that's what they do they try to throw the prosecution off the
00:40:54.520 game in my opinion and I think that is they're going to continue to do that um and and it's
00:40:59.600 going to get a little annoying I mean they were literally objecting to every single thing objecting
00:41:04.180 that the pictures were not taken in the right time frame. And the prosecution used a Supreme
00:41:10.980 Court decision to say, listen, you know, we have grounds for this. And the judge is saying,
00:41:16.240 continue. So it's going to be really, really interesting to see what the defense draws up.
