00:07:11.880 this is a guy who's had quite a bit hanging over his head.
00:07:16.600 But now, now, he will be returned to full and absolute restoration of his rights because
00:07:26.480 of a case that was just thrown out in the Second District Court of Appeals in New York.
00:07:34.340 Ladies and gentlemen, Doug Mackey joins Human Events Daily.
00:07:37.520 He was convicted, arrested, indicted, and convicted for making a meme all the way back in 2016.
00:07:46.120 That case has finally, at long last, been dismissed.

00:07:53.720 I got to tell you, I mean, I got to ask, how does it feel?
00:07:56.220 How does it feel after all this?
00:07:58.400 It feels absolutely incredible.
00:08:01.260 Today is a day of vindication.
00:08:02.960 It's four and a half years in the making.
00:08:04.620 And this was not, this case was not overturned on some kind of technicality or even on a
00:08:11.780 constitutional nature.
00:08:13.140 The court just, the circuit court just ordered the district court to enter a judgment of
00:08:18.700 acquittal, a full acquittal, based on the fact that they did not have any evidence to
00:08:24.940 support this conviction, which confirms what we knew all along.
00:08:28.320 They brought this conviction because Joe Biden stole the election and they wanted to put a
00:08:36.220 Trump supporter on trial.
00:08:37.280 They wanted to arrest Trump supporters and make an example out of them, even though they
00:08:41.000 did not have sufficient evidence to prove that any crime was committed.
00:08:44.460 And so I want people to understand the timeline here, because this case, the tweet, you know,
00:08:52.220 the meme, the activity that they're talking about here, that took place in 2016.
00:08:56.940 But your indictment and arrest didn't come until December of 2020.
00:09:03.520 Hmm.
00:09:04.000 December of 2020.
00:09:05.180 That's kind of interesting timing, isn't it?
00:09:06.880 Absolutely.
00:09:09.640 And they didn't move this case forward.
00:09:12.800 You know, Bill Barr, love for more, hate him.
00:09:15.380 Even Bill Barr would not bring this case and put a stamp on this case.
00:09:20.820 They put a stop on this case.
00:09:21.860 And we know a little bit about this from a little bit of reporting by Reuters, if you can
00:09:25.980 believe it, that the Trump DOJ did not want to bring this case.
00:09:29.740 And they did not bring this case because they understood that there was insufficient evidence,
00:09:34.540 according to reporting from Reuters.
00:09:36.140 That did not stop Joe Biden's lackeys from making this case a priority.
00:09:40.820 I was arrested seven days after Joe Biden was inaugurated.
00:09:45.120 So your arrest comes seven.
00:09:46.780 And I want people to understand that that this was the height of the you know, at the
00:09:52.380 time, this was all about censorship.
00:09:54.000 It was the height and this this push, this massive push for censoring online voices, for
00:09:59.420 censoring censorship of political speech online, for censorship of the ability of anyone
00:10:05.660 to engage in the political process by using social media.
00:10:09.840 And the height of all of this, the extremism reporters, many of which were in the trial there
00:10:16.300 with you that actually went and visited this because they knew exactly what it was, that it was their work working in
00:10:23.140 In conjunction with the DOJ, the SPLC was all over this case from that perspective, that they wanted you to be the first of many to be a test case to say, we can start locking up Patriots for memes.
00:10:37.480 That's what's really what was going on here, wasn't it?
00:10:39.460 Absolutely.
00:10:40.460 Absolutely.
00:10:41.460 And we don't know the full extent of cooperation between the DOJ career actors of the DOJ.
00:10:47.500 Yes, these people work for Trump and they have nothing to do with Trump or anything like that.
00:10:52.140 These are career actors that have been there a long time.
00:10:54.580 They hate Trump.
00:10:55.440 And when I went on trial, you're absolutely right.
00:10:57.580 The atmosphere was so dark and so dreary and the fight was so lonely.
00:11:02.320 This was right when they were dragging Trump through the mud and he was actually, I believe, indicted during my trial, believe it or not, for the first time, the first indictment.
00:11:12.460 We don't know the extent to which the ADL and the SPLC and all of these censorship organizations were working in conjunction with the DOJ.
00:11:21.940 And we may never know.
00:11:23.400 Hopefully the truth comes out one day, but they were there in the court.
00:11:26.780 They were practically sniggering to themselves.
00:11:29.480 They were celebrating.
00:11:31.560 They were actually one of them almost got himself kicked out of the court at one point.
00:11:37.800 And now, I guess, as you know, as we all could see, there was no evidence for a conviction.
00:11:43.440 I mean, anybody with eyes to see could see it.
00:11:45.580 And people that got to know the case, even people that didn't like me or that didn't like Trump, realized that there was nothing to this case.
00:11:53.480 And the only people who supported this case were blind partisans on the Democrat side, far left activists and the DOJ.
00:12:02.560 So what does that tell you about the deep state?
00:12:05.560 No, it's very clear that this is a partnership between these individuals, these hard left organizations and elements of the Department of Justice, who I've certainly been taking aim at this whole week, really.
00:12:23.420 And by the way, there was something that you mentioned, I think it was the last time we had you on the show, where people understand that this is a federal case.
00:12:31.740 And obviously, President Trump returned to office back in January.
00:12:36.700 He had the pardon pen there.
00:12:38.060 He did the mass pardons of the J6ers.
00:12:40.380 He's done pardon after pardon.
00:12:42.360 But you actually had the opportunity to receive a pardon from President Trump, and you refused to go for that pardon.
00:12:51.220 Walk me through that process and what this means.
00:12:54.640 Yes, absolutely.
00:12:57.200 So that is true.
00:12:58.280 We had the opportunity to go to Donald Trump for a pardon, and we chose not to at the time that Trump was inaugurated.
00:13:07.360 And why was that?
00:13:08.060 We had a very strong appeal, and the vindication, I've got to tell you, is much sweeter than even a pardon.
00:13:15.560 As great as it would be to get a pardon signed by the president, which would be incredible, this vindication is even better.
00:13:22.260 However, we knew we had a strong appeal.
00:13:24.800 We knew the government's evidence was insufficient.
00:13:27.080 And not only that, we believe their prosecution was also deficient on the law.
00:13:31.760 And the Second Circuit did not rule on those matters because they don't have to.
00:13:36.820 As soon as they find a point of agreement, they throw out the conviction, and they punt on the other matters.
00:13:42.420 So we still feel like their prosecution was legally insufficient in addition to the evidence being insufficient.
00:13:50.400 And I just want to double stomp on that so people understand is that you refused.
00:13:56.940 You could have gone to the president, and I'm sure, I'm sure the president in his heart of hearts would have looked at this situation and given you a pardon.
00:14:04.600 But you didn't.
00:14:05.480 And you kept on in this fight, fighting not just for yourself because you knew that you could get out, but you didn't want them to be able to do this to anybody else.
00:14:14.440 So you stayed in this fight using money from your own pocket, going on shows, going out of places, crowdfunding money, so that you could do this for others.
00:14:24.300 That's what this ruling actually means.

00:15:17.000 And I want to reiterate this for folks out there, is that Doug was arrested, he was indicted, and he was convicted for posting a meme in 2016.
00:15:29.020 The Biden DOJ went after him, put him through all of this.
00:15:33.020 They wanted to throw him in jail for seven months over a meme.
00:15:38.120 And now that case has been overturned.
00:15:41.820 And by the way, he refused to request a pardon from President Trump so that he could get this set as settled precedent for everyone else out there, that your right to meme would be protected.

00:16:12.720 And, Doug, I do have to ask, though, on a serious note, you know, what sort of things or what sort of moves as you've been through this process?
00:16:20.160 Obviously, you've learned so much more than you did a decade ago about how all of this works.
00:16:26.220 What sort of things would you like to see from the Trump DOJ or even on the congressional side to protect this type of behavior from happening again?
00:16:36.640 Well, great question.
00:16:39.100 First of all, I think that personnel is policy.
00:16:42.100 And if you look at what the FBI did and the DOJ and specifically the EDNY did is they sat on this case for over two years because the Trump DOJ, the Trump appointees, rather, wouldn't pursue this case because they thought it was an impeachment on freedom of speech.
00:16:59.900 Not only that, they realized that the evidence was insufficient personnel is policy and something like 60 percent of the current FBI agents, unfortunately, were hired under Christopher Wray.
00:17:13.020 And I think you really need to go through each of these field offices, which is admittedly a daunting task, and clean out the people that were hired for their partisan political affiliations because they're LGBT, because they're a woman, or whatever reason they were hired, other than them being the best candidates for the job.
00:17:32.920 And we see that in my case with the lead agent, a woman named Megan Reese, who I believe is still working at the FBI in the Boston field office.
00:17:41.520 Not only that, prosecutors looked at this evidence, they saw that it was a joke, and they still felt like they wanted to bring the hammer down and try to get a conviction.
00:17:52.040 And so those individuals need to be disciplined, and the EDNY specifically is one of the worst actors out there.
00:18:00.120 They're known to be cowboy prosecutors who will bring any kind of case, knowing that a journey will go along.
00:18:06.320 Knowing that most of the district court judges, I hate to say it, are complicit, and they never get disciplined for misleading the court.
00:18:16.040 They never get disciplined.
00:18:17.280 So these prosecutors need to face discipline.
00:18:20.820 Heads really need to roll.
00:18:22.260 And the EDNY, let me remind you, they indicted President Trump's, one of his best friends, Tom Barack, who was acquitted on all charges of being a federal agent.
00:18:30.980 So the EDNY is a total cesspit, and I would encourage President Trump to go into the entire EDNY and the SDNY while he's at it and clean those offices out, clean the FBI out.
00:18:43.460 And it needs to be legislation could make clear that this statute 241 should not be used against pure lawful speech.
00:18:50.700 Well, no, it certainly shouldn't, and you're right.
00:18:54.320 This idea of cleaning house needs to be done, and I actually understand that a lot of these U.S. attorney spots, I don't know if EDNY is one of them, but a lot of U.S. attorney slots all around the country are still being left vacant.
00:19:08.480 We've got so many people that are waiting for their approval through the United States Senate, and there's a huge backlog on this.
00:19:14.980 I mean, we're seven months into the Trump administration, or, you know, six and a half, if you want to be serious, but they're pedantic.
00:19:21.960 But at the same time, they've got to go through, and this idea of what you've done, Doug, and I want to be serious about this, and I hope, and I know that there have been some dark moments here.
00:19:32.380 Obviously, on the day of your conviction, that was a dark day.
00:19:35.560 But you went through all of this, so it is now settled law for our whole country, that anyone who is getting involved in the political process, anyone who's posting online like we all do every day in this country, whether you're on the left or the right or you're on Twitch or whatever platform it is, that you have the right to engage in politics.
00:19:59.660 And that's what we've always stood for in the MAGA movement.

00:20:08.340 Just don't go after us and let us step up and actually fight on an even basis.

00:21:26.220 Well, folks, there's been another story that has been going on, and, you know, we've been covering it here and there.
00:21:34.180 We certainly made mention of it, of the horrific tragedy down in Kerrville, Texas, all of these young girls who have been killed in this flood.
00:21:45.260 All of the people who have been killed in the flood.
00:21:47.480 We understand now the death toll is over 100.
00:21:50.520 There's still, obviously, recovering people, and those operations are ongoing.
00:21:56.480 But there was an interesting post that came up on Facebook, and this came up down there in Austin, Texas, not far from Kerrville, as the crow flies.
00:22:10.400 And it was from the Austin Fire Association, and it started making the rounds last night on Twitter.
00:22:17.140 After I found it, I started looking into it some more, I started doing some more digging on this, and then I started sending it out to every single person that I knew.
00:22:28.200 And, yes, to Steve Bannon, to Charlie Kirk, to everyone, to try to get the attention, Libs at TikTok, all the rest.
00:22:34.560 People know who I know.
00:22:35.280 And to get this the attention that it deserves, that there was a situation whereby in, whereby in, the Austin Fire Association president goes up and gives this dissertation where he reveals the fact that they had deployment orders, pre-deployment orders, on July 2nd.
00:23:02.360 So I want people to understand the timeline here.
00:23:05.180 July 4th, that's when the floods hit.
00:23:07.960 That's when the rains fell.
00:23:09.520 But on July 2nd, when people in town, when people in the state of Texas knew that something was coming, the state issued down pre-deployment orders to all the surrounding areas.
00:23:20.420 Well, Austin, obviously, is a huge city compared to some of these small towns.
00:23:24.100 They've got a massive fire response force and disaster response force.
00:23:27.820 And it turns out that they have incredibly, some of the best trained rescue swimmers, what they call swift water techs, in the entire country, who specifically train for the hill country because that's exactly where these incidents have happened in the past, even in the 1980s.
00:23:45.700 There was an entire busload of campers that went down here in a very similar situation because the water rose to flash flood conditions.
00:23:53.480 But here's the problem, is that the fire chief, fire chief Joel Baker, refused the deployment.

00:25:46.640 So for those young African-American, young Latinos or people in the Asian community or the LGBT community,
00:25:54.580 they see more firefighters that look like them and have similar values for them.

00:26:07.320 He really induced me to help introduce me to the African-American community.
00:26:10.640 And this community is a whole in Austin.
00:26:12.880 But to have them to continue to do more than just deal with the youth, I mean, it's a bigger footprint.
00:26:18.380 Although youth harvest foundations in the name, but it really goes beyond the youth,
00:26:24.080 at least in my opinion, to have this opportunity to be so engaged in the community.
00:26:28.160 Being involved with the African-American Youth Parish Foundation has really given me an opportunity
00:26:32.680 to give back to the community, to give back to a community that has given me so much,

00:31:06.480 into literally running into burning buildings to try to save people, to save lives, to save

00:31:19.000 And the chaplain, by the way, when you have a situation like this where something doesn't
00:31:24.100 go right, a chaplain is someone who could be there for those men, someone for them to
00:31:29.040 be able to talk to, someone that they know, someone that they trust.
00:31:32.420 But this chaplain was fired by Fire Chief Joel Baker because of his religious, which, by
00:31:39.080 the way, it's not just a Christian belief.
00:31:40.960 It's common sense belief that trans women, or I don't even know what the right word is,
00:31:46.360 transgenders shouldn't be participating in women's sports.

00:37:39.180 When it comes to the president and when it comes to, you know, what you've done in the state general assembly there, you know, one of the issues that I think we saw it in the big, beautiful bill.
00:37:49.820 We've been talking about it here for years on this program with the issue of illegal aliens.
00:37:55.640 What are some of the things that you have on your record regarding the fight against illegal aliens?
00:38:00.340 Obviously, at the state level, it's different, but there's things that can be done and that you'd like to see, you know, carried on at the federal level.
00:38:08.600 Well, I'll tell you what I've done so far.
00:38:10.880 I've introduced several different bills, one of which got across the finish line this year.
00:38:15.840 We have taken the states giving driver's licenses to illegal immigrants and made those illegal and not recognized here in Tennessee.
00:38:26.700 And one of the Democrats argued against the bill on the floor and said, well, what do you expect them to do?
00:38:31.620 And I said to drive around the state of Tennessee because we don't want them on our roads.
00:38:36.760 The other thing is that I have been pushing very hard.
00:38:41.140 I'm the only public official really pushing for ICE cooperation agreements in all of our sheriff's departments across Tennessee.
00:38:49.400 It's called 287G.
00:38:51.420 It allows them to serve warrants inside the jail instead of releasing criminal illegal aliens and having those warrants served in our neighborhoods.
00:38:59.480 And I'm the only one pushing for that.
00:39:01.860 And it's getting done, by the way.
00:39:04.060 Sheriffs are coming on board.
00:39:06.920 I think we need more of that at the federal level.
00:39:09.620 I know we just got a bunch of that effort funded, which has been great, in the one big, beautiful bill.
00:39:16.240 But we need to make sure it's implemented and that President Trump's agenda on that is carried forward.

00:39:43.520 We've got almost a billion dollars of impact to our state from illegal aliens.
