00:00:54.200 go to tposa.com slash reset. Well, ladies and gentlemen, welcome aboard tonight's edition of

00:01:02.360 Human Events Daily. Today is September 20th, 2022. Anno Domini. Tonight's top headlines. President

00:01:08.960 Trump's legal team has met the special master for the first time and even stated in court that they

00:01:14.900 were prepared for a criminal indictment from the Biden DOJ. We'll explain all that. Second,

00:01:19.420 a conservative teenager in North Dakota was run over and killed by a liberal adult driver after

00:01:27.300 Biden's anti-MAGA speech. Third, the Fifth Circuit Federal Court has upheld the Texas anti-censorship

00:01:35.640 tech law. We're going to break all that down. I know it's a lot. And then finally, the American

00:01:39.260 independent, quote unquote, news outlet has been exposed as a conservative smear operation run by

00:01:46.060 none other than Media Matters founder David Brock. All this and we're ahead, Human Events Daily.

00:02:01.440 You know, the old saying, a prosecutor can indict a ham sandwich if they want to. I'm just asking,

00:02:07.440 if there is such a prosecutor and they indict you, would that deter you from running for

00:02:11.720 president again? I don't think the people of the United States would stand for it. And as you know,

00:02:18.680 if a thing like that happened, I would have no prohibition against running. You know that you've

00:02:23.340 already said. I do. And that's what I want people to understand. That would not take you out of the

00:02:26.740 arena. It would not. But I think if it happened, I think you'd have problems in this country,

00:02:32.580 the likes of which perhaps we've never seen before. I don't think the people of the United States

00:02:37.560 would stand for it. What kind of problems, Mr. President? I think they'd have big problems,

00:02:42.400 big problems. I just don't think they'd stand for it. They will not. They will not sit still

00:02:46.920 and stand for this ultimate of hoaxes. So today in Brooklyn, New York, in a federal courthouse,

00:02:53.200 President Trump's legal team met with the special master the first time. Let me walk you guys through

00:02:59.000 a little bit of what all of this is, because I know heads are spinning. Here's what's going on.

00:03:04.300 This was the special master that was recommended by President Trump and his legal team because they

00:03:10.620 wanted someone to go over the documents before the FBI and the DOJ were able to continue their

00:03:16.980 investigation of this. What is this? It's a criminal investigation, and they're looking

00:03:21.840 for an indictment. They want to indict President Trump. You just heard what President Trump had to

00:03:26.500 say about the possibility of an indictment. What happened in court today? Well, very interestingly,

00:03:31.360 his lawyers positively stated that there were certain material that they didn't want to reveal

00:03:38.920 even in, right, even in this special master session, this hearing today, because if there were a

00:03:46.200 potential indictment, they wanted to keep their defenses. They didn't want to have to disclose

00:03:51.660 their defenses because then the Department of Justice would know that before an indictment even took

00:03:56.660 place. So understand, his lawyers are already, and they're doing their job, right? They're operating

00:04:02.340 from the perspective that, of course, their client, the President of the United States, Donald Trump,

00:04:07.940 might actually be indicted. The issue, though, is that the question at play here was whether or not

00:04:17.860 these documents were declassified. Are they currently classified or were they declassified?

00:04:23.220 Now, the special master, this guy Deary, came in and said, look, I need to know, were these things

00:04:29.660 declassified Raymond Deary? Were they classified or were they declassified? President Trump's lawyers

00:04:36.520 are saying, we don't want to reveal that because we might have to use that as a defense in an indictment.

00:04:42.180 But the problem then becomes, for the special master, how can he effectively review them whether or not

00:04:50.040 they're considered classified or declassified? Obviously, if they're classified, he's going to

00:04:53.880 need clearance. He's going to have to go through that process. He would be able to receive an interim

00:04:57.420 clearance just to be able to review the documents without breaking the law. The government, from their

00:05:03.060 perspective, is maintaining that the documents are classified. However, here's what's very interesting.

00:05:09.260 Biden's DOJ has filed a motion to try to stop the documents from being introduced in front of the

00:05:16.000 special master to begin with. That's over at another appellate court, the 11th Circuit Court.

00:05:20.860 Why is this? It seems just from an optics perspective, with that motion, trying to block

00:05:28.140 the special master, even from reviewing the documents in the first instance, it seems as though the

00:05:35.380 Department of Justice under Biden has something to hide. Why don't they want the special master

00:05:42.520 to view these things? Why don't they want him to see what's going on? Why don't they want him

00:05:47.620 to look at the documents, the underlying documents here, about what just this entire scam, this entire

00:05:54.380 charade is all about? You're talking about indicting a former president of the United States.

00:05:59.720 We need to do things by the book. But it sounds like that's not what they're interested in doing.

00:06:05.980 They don't even want the special master to review the documents. And why? Could it be,

00:06:10.380 could it be that the Department of Justice was less than truthful in their filings when it came to

00:06:18.000 that search warrant, the human events was the first to report, whether it came to the underlying

00:06:22.700 affidavit for the search warrant? Okay, so all of the sworn statements that were made to that other

00:06:30.520 judge, Judge Reinhardt down in Florida. There's so many questions here. But currently, what we're seeing

00:06:37.200 before us as of today, the special master wants to know, were these documents classified or not?

00:06:43.600 And if they don't hear that there was a declassification, he's going to rule that they

00:06:48.760 were in fact classified and more than likely going to rule that the FBI and DOJ can continue

00:06:55.520 their investigation of them.

00:06:57.880 If you want to know what the left's real plan is for your kids, just look at the reaction to

00:07:05.080 the work that Patriot Mobile did in multiple school districts in Texas. The left is losing

00:07:09.500 their minds. Patriot Mobile is America's only Christian conservative mobile phone provider

00:08:00.280 Donald Trump and the MAGA Republicans represent an extremism that threatens the very foundations

00:08:07.160 of our republic. There's no question that the Republican Party today is dominated, driven, and

00:08:13.580 intimidated by Donald Trump and the MAGA Republicans. MAGA Republicans do not respect the

00:08:20.220 Constitution. They do not believe in the rule of law. They do not recognize the will of the people.

00:08:26.980 They refuse to accept the results of a free election. Democracy cannot survive when one side believes

00:08:34.140 there are only two outcomes to an election. Either they win or they were cheated.

00:08:39.460 They promote authoritarian leaders and they fan the flames of political violence that are a threat

00:08:46.440 to our personal rights, to the pursuit of justice, to the rule of law, to the very soul of this

00:08:54.280 country. And they see their MAGA failure to stop a peaceful transfer of power after the 2020 election

00:09:02.020 election. As preparation for the 2022 and 2024 elections. So about one week ago, President Biden gave

00:09:12.380 that completely unhinged anti-MAGA speech where he essentially directed his supporters and his followers

00:09:24.180 towards hatred and a very specific targeting of a scapegoat group, that being MAGA Americans.

00:09:33.640 Because this is what tyrants do. This is what despots do. They can't take any responsibility for their

00:09:39.980 own failures and the failures of their regime. So what do they do? They whip up anger at a specific group

00:09:46.780 of people and they blame all their own failings on that group of people. In this case, President Biden,

00:09:55.000 he does that towards MAGA Republicans, MAGA Americans. Well, what happened next? I'll tell you what

00:10:01.900 happened next. In North Dakota, we've got the story from Inforum, a lot of local places, Postmillennial

00:10:08.620 has it up as well. A driver has admitted to intentionally killing a teenager at a North Dakota

00:10:17.380 street dance after a political dispute. 41-year-old Shannon Brandt, he was chasing an 18-year-old named

00:10:30.900 Kyler Ellingson. And Kyler Ellingson was being chased after the street dance, 2.30 in the morning,

00:10:38.620 this is way out in rural North Dakota, 120 miles northwest of Fargo, 54 miles north of Jamestown.

00:10:48.160 And Kyler, at one point, called his mother and said, can you come rescue me? Because someone's

00:10:57.160 chasing me through the city of McHenry, where the street dance has just wrapped. Can you come? Can you

00:11:03.840 get me? Can you save me? Can you save my life? By the time his mother made it there, he had been killed.

00:11:14.140 Now, what's even crazier than that, and I'm sure there's much more to that story, and we're going

00:11:21.020 to make sure that we get all of that story. Because according to Postmillennial, the driver claimed

00:11:28.260 claimed to police that the reason he targeted the 18-year-old was that Ellingson was part of a,

00:11:36.900 quote, Republican extremist group and had ordered others to come after him following a political

00:11:44.540 disagreement. Police also reported that the driver, Brandt, Shannon Brandt, was drunk.

00:11:51.460 They stated, North Dakota Highway Patrol captain stated, we don't know of any witnesses.

00:11:55.100 Why was a 41-year-old drunk at a street dance with a bunch of kids like this to begin with?

00:12:05.160 This is what's happened, okay? This is where we are in our country. The President of the United States

00:12:11.960 goes out and gives an anti-MAGA speech, says, target these people. These are the scapegoats.

00:12:19.260 These are the people that you must hate. And then what happens? They turn around,

00:12:26.040 and a liberal kills a conservative. It's the exact opposite of everything that Biden has warned

00:12:34.120 about. It's the exact opposite of what the media tells us is going to happen. They talk about QAnon.

00:12:40.900 They want to talk about all sorts of crazy stuff. But guess what? This is the type of low-level,

00:12:47.100 murderous rage that's going on not only in North Dakota. Well, now all throughout 2020,

00:12:54.320 CHAZ, the burning of cities, Washington, D.C. What's going to come next? 0.96

00:13:03.000 Freedom of speech is under attack in Texas. There is a dangerous movement by some social media

00:13:10.880 companies to silence conservative ideas and values. This is wrong, and we will not allow it in Texas.

00:13:21.300 Today, I'm about to sign a law that fights back against big tech political censorship. It prevents

00:13:29.300 social media companies from banning users based upon the user's political viewpoints. It allows Texans who

00:13:37.720 are wrongfully deplatformed or restricted to be able to file a lawsuit to get back onto that social media

00:13:45.520 site. So Texas passed a law based around the ideals of upholding the freedom of speech against the

00:13:55.320 censorship of the tech oligarchs. And for the first time that we've seen a federal court at the circuit

00:14:04.300 level, the appeals level, the fifth circuit court has sided with Texas and has upheld this law. This

00:14:12.980 is absolutely amazing. This is a landmark situation, a landmark ruling for freedom of speech within the

00:14:21.600 United States. Because what does it mean, at least in the modern era? So what it says is that according to

00:14:28.980 the First Amendment, I'll read you an actual piece of the Fifth Circuit's decision. It says,

00:14:37.780 we turn to the First Amendment's text in history, which offers no support for the platform's claimed

00:14:46.020 right to censor. Next, applying Supreme Court precedent, we hold that the section does not regulate the

00:14:53.920 platform's speech. It protects other people's speech and regulates the conduct of platforms.

00:15:00.800 Our decision is reinforced by 47 U.S. Code Section 230, which reflects Congress's judgment that the

00:15:09.200 platforms are not, quote, speaking when they host other people's speech. Our decision is still further

00:15:15.980 reinforced by the Common Carrier Doctrine, which vests the Texas legislature with the power to prevent

00:15:22.560 the platforms for discriminating against Texas users. What are they talking about here? That's

00:15:28.660 consumer protection laws. There are consumer protection laws in this country and in all the

00:15:34.160 states that protect common carriers. What does this mean? This means that the judges on this panel did not

00:15:43.300 view this as the argument of, oh, well, this is like a newspaper and you can't tell a newspaper what

00:15:48.040 they can and can't print. No, no, no, no, no, no, no. The speech is not being, all right, regulated,

00:15:55.540 or I should say the speech is not being emanated. It's not being published by the platforms. The

00:16:01.260 speech comes from the users. It's the user's speech. But the lawyers for these, and they have these,

00:16:07.920 you know, Net Circuit and all these different, Net Choice, all these different associations

00:16:12.420 representing Google, TikTok, Facebook, et cetera, trillion dollars in the tech industry. They're

00:16:17.700 all saying, no, no, no, no, no, no. We have the freedom of speech to ban whatever we want. That's

00:16:22.140 what the First Amendment doesn't say anything about that. It's about your freedom of speech. It's about

00:16:26.540 our freedom of speech as the American people. Okay. So the tech bros are losing their minds over this.

00:16:34.680 Blue check Twitter, absolutely insane. And even the libertarians, because let's just say the court,

00:16:40.400 I should say the corporate libertarians, are losing their minds. This is from Reason Magazine.

00:16:45.300 It's a terrible ruling that misreads years of First Amendment precedents, and it's increasingly

00:16:50.680 likely that the Supreme Court will have to intervene. This is regulating large social media platforms with

00:16:58.320 more than 50 million users, forbidding them from censoring any user. There may be some exceptions,

00:17:04.460 but it treats them like common carriers, ordering them against their will, against their will.

00:17:10.400 To serve as a communications platform for messages that they might find objectionable

00:17:15.300 or violate community standards. Oh my gosh, not community standards. I just, just give me a second.

00:17:22.020 I just have to think about all the community standards that are being violated right now.

00:17:26.880 The being absolutely violated, the standards of the community. We're sick of it. Guess what?

00:17:33.940 We're going to violate all the community standards now. Because the only standard that should exist

00:17:41.080 is the First Amendment and the freedom of speech in the United States. We're fighting back for it.

00:17:49.420 If you don't like what somebody says, you cannot listen to them. You can block them. You can mute them.

00:17:54.840 You can do whatever you want, but you don't have a right to censor in this country.

00:17:59.840 It's really quite ferocious. It's when a huckster takes some lies and makes them sound precocious

00:18:07.660 by saying them in Congress or a mainstream outlet. So, disinformation's origins are slightly less atrocious.

00:18:15.660 It's how you hide a little lie, it's how you hide a little lie, it's how you hide a little lie, it's how you hide a little lie,

00:18:19.920 it's how you hide a little lie, when Rudy Giuliani shared that in town from Ukraine.

00:18:23.460 Or when TikTok influencers say COVID can cause pain.

00:18:26.760 They're laundering disinfo and we really should take note

00:18:29.580 and not support their lies with our wallet, voice or vote.

00:18:32.640 Nini Yankovic, don't you guys miss her?

00:18:35.980 No trigger warnings here at Human Events Daily.

00:18:38.640 Not a single trigger warning.

00:18:40.500 And no apologies. I'm not apologizing to the RAV audience.

00:18:43.480 I'm not apologizing to the podcast audience.

00:18:45.980 No apologies anywhere.

00:18:47.820 Because the work goes on.

00:18:50.980 So, Nini Yankovic, why are we bringing her up?

00:18:52.840 Because we miss her so much. We miss her so much.

00:18:54.640 Well, NewsGuard, believe it or not,

00:18:57.540 actually broke a story out.

00:18:59.320 And it says,

00:18:59.820 Just in time for the midterms, a new entry has joined the, quote,

00:19:04.280 pink slime pseudo-news sweepstakes.

00:19:07.480 What does that mean?

00:19:08.900 A shadowy network of news sites is quietly pushing liberal,

00:19:12.700 anti-conservative propaganda in battleground states ahead of the midterm elections.

00:19:18.080 Huh? What? What does that mean?

00:19:21.220 Five new websites that launched in April of 22

00:19:24.340 that look like benign, totally politically independent state news outlets

00:19:28.480 with local stories about Pennsylvania Lakes

00:19:31.080 or the Michigan Museum of Natural History

00:19:33.020 actually shows that these sites are tied to something called

00:19:37.640 the American Independent.

00:19:40.460 And what are the sites called?

00:19:41.640 The Arizona Independent, the Michigan Independent,

00:19:44.080 the Ohio Independent,

00:19:45.500 the Pennsylvania Independent,

00:19:46.820 and the Wisconsin Independent.

00:19:48.180 They have been publishing a steady stream of partisan content

00:19:52.900 aimed at influencing voters without revealing their agenda.

00:19:57.340 Who is behind all this?

00:19:58.860 None other than left-wing operative David Brock,

00:20:03.500 the founder of Media Matters.

00:20:05.920 Long-time Clinton world operative David Brock,

00:20:09.020 yes, the latest example of mass-produced partisan news sites

00:20:13.220 masquerading as local news.

00:20:15.940 That's what NewsGuard calls pink slime journalism.

00:20:19.200 Well, hold on a second, Nina.

00:20:21.340 We're doing your job for you.

00:20:22.540 You know, we did get you fired, obviously, a couple of weeks ago,

00:20:26.580 and so you no longer work for the federal government,

00:20:28.620 but we're doing your job for you out here.

00:20:31.680 We have found your disinformation.

00:20:34.880 And it turns out that it's being pushed by none other than,

00:20:38.060 well, David Brock.

00:20:39.640 And so what NewsGuard has done now,

00:20:42.080 that if you have the NewsGuard rating system,

00:20:45.140 it actually points out that they have now a 44.5 score out of 100,

00:20:50.500 and if readers are alerted, proceed with caution,

00:20:53.060 this website fails to adhere to several basic journalistic standards.

00:20:57.160 However, NewsGuard found tons of articles

00:20:59.720 supporting liberals and criticizing conservatives.

00:21:02.520 Here's an example.

00:21:03.880 Arizona Republicans nominate racist venture capitalist Blake Masters.

00:21:08.380 Another one, Whitmer's ambitious budget prioritizes education and fixing roads.

00:21:13.940 Again, 41 Republican senators break their promise to protect veterans' health.

00:21:18.380 So again, what you can see they're obviously doing,

00:21:21.000 these are partisan headlines, okay?

00:21:23.160 And I'm not going to sit here and use this platform for human events

00:21:27.540 to advocate for one or the other,

00:21:28.960 but what I'm saying is that what they're doing,

00:21:32.360 of course, the founder of Media Matters,

00:21:35.020 the founder of American Bridge,

00:21:38.120 huge Clinton world operative,

00:21:40.680 David Brock,

00:21:41.400 he's lying to you.

00:21:42.880 He's lying by creating fake,

00:21:45.240 positive,

00:21:46.280 independent local sources

00:21:49.020 that's not.

00:21:50.200 These are partisan disinformation outlets,

00:21:53.180 and this is what they are using their money to do.

00:21:57.060 So my question is,

00:21:57.960 and I appreciate NewsGuard for doing this,

00:21:59.920 my question though is,

00:22:01.120 Nina,

00:22:01.940 Nina,

00:22:02.540 are you going to talk about David Brock or are you not?

00:22:05.160 Because maybe,

00:22:05.860 just maybe,

00:22:06.600 you guys are getting the money from the same place.

00:22:08.420 Oh, just a question.
