00:01:23.660 Daniel Penny, a Marine veteran, is out on $100,000 bond after an arraignment this morning.
00:01:28.860 He did not enter a plea.
00:01:30.920 Prosecutors say they are seeking a grand jury indictment.
00:01:34.040 His lawyers say Penny stepped in to protect himself and other passengers from Jordan Neely,
00:01:39.260 who they say was aggressively threatening passengers, and Penny never intended to harm him.

00:01:46.400 So, as you can see, I am now firmly ensconced in the Human Events Daily chair, back from a couple of weeks on the road,

00:02:18.800 And so, today I wanted to do a show all about the death of the right to self-defense in America.
00:02:26.560 And I wanted to go through a couple of cases that we've seen in the headlines right now
00:02:31.560 that are extremely hot, as well as go through and explain some of the cases that we've seen in the past
00:02:37.080 that brought us to this moment.
00:02:40.820 Basically, here's what's going on.
00:02:42.600 The left for years in the U.S. had wanted to ban guns
00:02:48.280 and wanted to take away the ability of the right to self-defense for anybody.
00:02:54.620 However, because they kept losing elections, because opinions never really went with them on this issue,
00:03:00.340 they couldn't get to the point where they could actually ban guns.
00:03:02.780 So, what did they do instead?
00:03:05.240 Well, they got to the point, and I'm not saying, obviously, there wasn't a gun used in all these cases,
00:03:08.460 but this is part and parcel, so let me explain.
00:03:11.580 Because they couldn't get rid of guns, they said they're going to get rid of the right to self-defense.
00:03:19.120 So, whether or not you use a gun is immaterial to them.
00:03:23.340 They're going to take away your ability to use a gun to defend yourself, to defend your home,
00:03:28.180 to defend your family, to defend others,
00:03:29.780 and they're going to take away the right of you to physically defend yourself or defend others.
00:03:36.180 That's what we're seeing go on now and play out in these cases,
00:03:39.260 whether it be New York City, New York, whether it be Austin, Texas,
00:03:43.160 whether it be anywhere in the country, Kenosha, Wisconsin, obviously.
00:03:47.060 They are taking away this right because they know that in order to fully destabilize a country,
00:03:54.720 you have to enable criminals.
00:03:58.160 You have to enable the criminal element in society.
00:04:01.500 The element that Marx even referred to as the Lumpen Proles.
00:04:06.200 The Lumpen Proles.
00:04:08.080 This was something that even Karl Marx himself said that there is a class that is beyond,
00:04:14.060 you know, the aristocracy and the working class.
00:04:17.280 There is an underclass of criminals, people who, for lack of a better term,
00:04:23.820 belong in institutional facilities, whether that be prison, whether that be mental health.
00:04:32.020 That's a judgment call.
00:04:33.420 But the point of the matter is there's always going to be a certain class that should be,
00:04:39.280 shall we say, otherwise observed and best kept away from polite and public society.
00:04:48.200 And certainly, as we can see, that Jordan Neely, even I don't even have to say this.
00:04:53.960 Jordan Neely was on lists from social workers as being in the top what they called it,
00:04:59.080 the top 50 in New York City of people that were not, that they already knew shouldn't be
00:05:08.000 in contact with anyone in public.
00:05:11.100 They knew this.
00:05:12.320 And of course, the New York Times, Vice, they're freaking out.
00:05:14.320 There's a Daniel Penny, Daniel Penny.
00:05:16.300 How can the right, they're treating him like Kyle Rittenhouse.
00:05:18.940 They're supporting, that's right, we are supporting him.
00:05:20.480 And Tim Pool, my boy Tim Pool, came around.
00:05:23.620 Originally, he was saying, don't donate to Penny.
00:05:25.940 Now Tim's in.
00:05:27.560 And Tim went in big.

00:07:32.780 deliberation and a month since that murder conviction, all leading to this moment.
00:07:38.380 The state did ask that Perry get at least 25 years behind bars.
00:07:42.980 Perry's attorneys say, though, this is not the end for him.
00:07:46.260 We will appeal this verdict.
00:07:49.840 While we respect the court greatly, we can't agree that Daniel Perry received a fair trial.
00:07:57.060 Everyone is completely devastated.
00:07:59.340 The Travis County District Attorney feels as if justice has been served.
00:08:02.760 Our criminal justice system is not perfect.
00:08:07.440 But in this case, it worked exactly as it should.
00:08:10.680 The appeals process is expected to take over a year.
00:08:13.820 And Perry's attorneys say they are planning on sending any information that they think will
00:08:17.520 help Perry to the board of pardons and paroles.
00:08:21.200 Remember, they are currently reviewing his case.
00:08:23.600 Now, the Daniel Perry case.
00:08:26.060 This was a case that actually took place all the way back in the summer of 2020 during the
00:08:32.620 George Floyd riots.
00:08:35.020 And believe it or not, this one actually happened before the Kyle Rittenhouse case.
00:08:39.820 Uh, the Kyle Rittenhouse incident took place in Kenosha, Wisconsin.
00:08:43.360 Now, originally we had planned to have Daniel Perry's lawyer on today.
00:08:49.200 And unfortunately he was not able to join us because he was called into court this morning.

00:08:58.620 But I wanted to give everyone an update on that case specifically.
00:09:02.880 Daniel Perry, that same U.S.
00:09:05.840 Army sergeant, again, who drew his firearm after being stopped by a crowd, a mob of BLM
00:09:18.040 rioters, activists, anarchists in the middle of the road in Austin, Texas, stopped his car
00:09:27.780 after making a legal turn on a right turn only lane that he was in to traffic that night
00:09:36.960 was surrounded.
00:09:38.380 He had people pounding on his vehicle and then ultimately, tragically, unfortunately,
00:09:45.980 he had an individual named Garrett Foster, who was a crazed pro BLM gunman who was open
00:09:54.760 carrying an AR, excuse me, an AK-47 in the middle of the street, blocking traffic, completely
00:10:02.860 illegal, by the way, who then threatened him with his AK-47, tons of ammo on him at the
00:10:11.860 time, and that even local media admitted he gestured, gestured to Daniel Perry with his
00:10:23.740 AK-47, gestured.
00:10:27.660 Yeah, if you gesture at someone with a loaded AK-47, that's called you're threatening someone
00:10:34.100 with your rifle.
00:10:36.080 And so Daniel Perry took steps to defend himself, pulled the trigger and fired, killing Garrett
00:10:43.920 Foster, then sped away.
00:10:45.300 He was just sentenced to 25 years in jail.
00:10:53.020 And as we currently record this, he is in prison right now.
00:10:59.360 And his lawyers are working very hard to get him out of there.
00:11:04.600 Now, he was an army veteran, drove Uber on the side to make some extra money.
00:11:08.540 35 years old, 25 years in prison for this.
00:11:18.220 And this is Texas, mind you, Texas.
00:11:19.940 Now, keep in mind, Austin, extremely blue jurisdiction right there in the heart of Texas, which we know
00:11:27.660 is a red state.
00:11:28.400 So the situation that we're looking into, Governor Abbott has stated that he intends to pardon
00:11:37.640 Daniel Perry.
00:11:39.000 But we need to understand that the way the pardon process works in Texas is different than it
00:11:44.280 works in other states.
00:11:45.100 In other states or at the federal level, the governor can unilaterally pardon someone.
00:11:49.840 The president can unilaterally pardon someone.
00:11:52.280 And the pardon power, at least at the federal level, is considered a plenary power of the
00:11:57.820 president under the U.S. Constitution.
00:12:00.100 What does that mean?
00:12:01.880 That means it is absolute.
00:12:04.360 That means that it cannot be overturned by the president, can't be overturned by the Supreme
00:12:08.800 Court, et cetera, et cetera.
00:12:10.120 However, in Texas, the way it works is that the parole board has to recommend a pardon to
00:12:17.840 the governor, and then the governor is able to decide yes or no.
00:12:21.580 Abbott has already stated that he will say yes.
00:12:24.260 So as we are waiting for this parole board to deliver their report to Abbott, Perry's
00:12:30.600 not waiting.
00:12:31.580 He's already behind bars.
00:12:33.200 So what's the deal, Texas?
00:12:35.000 Are you going to get involved?
00:12:36.800 Because I see people donating millions and millions of dollars to Daniel Perry as, excuse
00:12:42.040 me, Daniel Penny, I keep doing that, Daniel Penny as they should.
00:12:46.220 But what about Daniel Perry?
00:12:49.020 We're not going to forget this case.
00:12:50.640 We're not going to forget the fact that he is behind bars for defending himself.
00:12:55.000 And look at this.
00:12:56.140 Both cases, the people involved were veterans.
00:13:01.140 Where's the veterans community on this?
00:13:04.000 Where are all the, you know, the base?
00:13:06.320 Oh, I'm a vet.
00:13:07.200 I'm going to stand down.

00:13:11.820 Both of these guys, Penny and Perry, Marine Penny, and then Sergeant Perry down in Austin,

00:16:00.080 where a vigilante and his gun brought terror this past weekend.
00:16:03.860 The victims were four teenagers.
00:16:05.540 Eyewitness News has been on top of this story from the very start of it.
00:16:08.500 And tonight, we have team coverage as police press their search for the vigilante.
00:16:11.980 We begin with Milton Lewis, who spent this day riding with people
00:16:15.120 who trust their lives to the subways every day.
00:16:17.880 I think he did right.

00:16:22.880 I think what he did was completely wrong.

00:16:33.220 Bernhard Goetz left New Hampshire this morning at 9.30.
00:16:36.440 He arrived here in New York this afternoon and was driven straight to Central Booking,
00:16:41.020 where the press was waiting behind barricades.
00:16:43.640 The security was tight.
00:16:45.400 The crowds were sparse.
00:16:47.140 What do you think about the fact that he's come back to New York?
00:16:49.260 Do you feel he's coming back as a criminal?
00:16:50.820 I think he's a good man.
00:16:51.720 I think he's a good man.
00:16:52.640 He wants to show the public, look, I did it and I'll pay the price.
00:16:55.920 But I had to defend my life at that instance, in that moment.
00:16:58.900 So, Bernie Goetz.
00:17:01.660 Now, a lot of people might know that name, but some people might not.
00:17:07.540 When we were doing the pre-planning for this show, we found that, you know, I was asking
00:17:11.820 people around it just randomly.
00:17:13.220 And some people said, yeah, I've heard of Bernie Goetz.
00:17:14.720 And other people said, no, not really.
00:17:16.360 So, who was Bernie Goetz?
00:17:18.200 Bernie Goetz was a guy who came out in the 1980s and was, he had been mugged a couple
00:17:25.720 of times in the past.
00:17:26.980 He bought a gun for protection and basically had that on him on the subway in New York in
00:17:37.560 the 1980s.
00:17:38.220 Keep in mind, this is pre-Giuliani, New York.
00:17:40.800 He was then attempted to be mugged again by four individuals, and he was able to defend
00:17:51.240 himself against all four of them with his firearm.
00:17:54.860 Did not kill any of the assailants, by the way.
00:17:57.200 They all lived.
00:17:58.500 He was then brought up on charges of four counts of attempted murder, four counts of assault,
00:18:05.040 reckless endangerment, third degree criminal possession of a weapon, and fourth degree criminal
00:18:09.140 possession of a weapon.
00:18:09.960 He was found guilty of possession of a weapon, criminal possession of a weapon, but not guilty
00:18:18.480 on all other charges, not guilty on all other charges.
00:18:24.720 And so that was the verdict.
00:18:26.380 He did end up serving eight months, but he was found not guilty of murder because of this,
00:18:33.440 because they found that he had a legal right to self-defense.
00:18:35.940 That was New York in the 1980s.
00:18:37.860 We all know what happened about a decade later.
00:18:41.080 Rudy Giuliani gets elected mayor.
00:18:43.420 His pro-social, I would say, pro-social anti-crime policies, also known as the broken crime theory,
00:18:51.120 excuse me, broken windows theory, really set the standard for what New York turned into in
00:18:57.160 the later 90s, throughout the 2000s, as just being this incredible hub once again of new
00:19:04.720 business turned Times Square into almost like an amusement park.
00:19:08.680 It was so nice.
00:19:09.380 And it's only been since the recent five, four or five years that New York City has gotten
00:19:16.780 so bad again and gone completely down the tube.
00:19:19.900 So that's 1984.
00:19:21.020 Then let's also remember what George Zimmerman and Trayvon Martin.
00:19:24.860 Of course, we remember this from the Obama administration, Barack Obama saying that Trayvon
00:19:30.060 Martin could have been my son.
00:19:33.960 Trayvon Martin attacked George Zimmerman.
00:19:37.560 George Zimmerman had been looking out for potential burglar in the area, neighborhood watch situation.
00:19:42.800 That was in the Orlando, Florida area, 2012.
00:19:46.840 Zimmerman defended himself when Martin attacked him.
00:19:49.560 He was ultimately acquitted.
00:19:51.700 Michael Brown and police officer Daniel Wilson, Ferguson, Missouri, 2014.
00:19:57.500 Michael Brown at the time had been referred to as the gentle giant.
00:20:00.560 Between those two incidents, by the way, Trayvon Martin in 2014, that led to the birth of Black Lives
00:20:07.840 Matter, which really led to George Floyd, which led to the Floyd riots, the Floyd riots, which
00:20:14.320 sparked, of course, the case of Kyle Rittenhouse, which then took place in Kenosha, Wisconsin
00:20:20.000 in 2020.
00:20:21.120 And I would say also took what sparked the Daniel Perry case that we also saw in Austin, Texas.
00:20:26.600 And then most recently, the case that's still ongoing.
00:20:31.440 So this is a case that hasn't even been concluded yet.
00:20:33.940 But that, of course, was the case of Andrew Lester and Ralph Yarl in Kansas City, Missouri,
00:20:39.400 just a couple of weeks ago, where we saw Andrew Lester was an old man at home in the dead of
00:20:46.560 night.
00:20:46.820 He said that he was woken up by a an individual, a large man from all he could see, again, from
00:20:54.120 his perspective, who was trying to get into his house.
00:20:58.340 We later found out that it was a case of a mistaken address.
00:21:03.640 And Ralph Yarl was trying to open this guy's door, but it turned out that he wasn't trying
00:21:08.260 to break in.
00:21:09.340 He was trying to open the door because he thought that's where his brother or his two brothers
00:21:13.400 were and he was trying to pick them up.
00:21:15.020 So, again, a case that is still currently on the books and currently working its way through
00:21:20.920 the legal process in Missouri.
00:21:23.120 And so when we look at all these cases, Bernie Getz, George Zimmerman, Michael Brown, Kyle
00:21:28.960 Rittenhouse, and we're still literally the jury's still out and Andrew Lester, we understand
00:21:33.740 that these were cases that in each of these instances.
00:21:37.560 Now, when someone's killed, should they be brought to trial?
00:21:41.220 Right.
00:21:41.400 That's a great example.
00:21:43.000 And I do think it makes sense in a lot of cases when someone is killed that you want
00:21:48.880 there to be a public inquiry.
00:21:50.660 Of course, there needs to be an investigation.
00:21:52.260 But when you look at some of these, when you look at Kyle Rittenhouse, for example,
00:21:57.680 we had video from day one of that case.
00:22:02.200 We knew what was going on with Perry and with Penny.
00:22:05.680 In these cases, it's all on video.
00:22:08.120 This is the biggest difference between a lot of these cases as to what's happening now versus
00:22:12.620 Ferguson versus George Zimmerman versus Bernie Getz.
00:22:17.120 Actually, in the Lester case, believe it or not, even though that is a current case,
00:22:20.180 it is not on video because although there were video cameras on the property, they were later
00:22:27.100 determined to be non-functional or the hard drive wasn't hooked up or something.
00:22:30.960 So we didn't actually in the police department tried to get video out of them and said, you
00:22:34.920 know, the cameras were just kind of for show, sort of a security precaution.
00:22:38.220 And so we have video of these cases now.
00:22:41.100 So the Kyle Rittenhouse case never should have been brought because we have it on video.
00:22:43.960 The Penny case never should have been brought because, again, we can see on video this was
