00:03:37.000 then flew down Norfolk, boarded a V-22 Osprey, flew that out to the USS Bush, embarked for a sea power exercise in evolution,
00:03:50.140 where we were able to see everything from Navy SEALs boarding and raiding a ship, conducting a VBSS raid, as well as display of naval warfare, naval capabilities,
00:04:03.660 including CWIS, the close-in weapons system, so anti-aircraft systems that the destroyers and aircraft carriers have, as well as naval cannons, as well as tomahawks being fired.
00:04:16.940 You can see one of the tomahawks right there fired from a U.S. destroyer, an Arleigh Burke-class destroyer.
00:04:22.760 We're on the Nimitz-class USS Bush.
00:04:25.360 That is the flagship of the 10th Carrier Strike Group.
00:04:29.480 And the USS Bush also took the lead in a number of operations all around the world.

00:04:42.060 And President Trump spent the entire time right down on the flight deck himself, as well as First Lady Melania Trump,
00:04:49.080 and was honored to be able to join the flight deck with them, took this video you're seeing right now that President Trump has posted up on his own true social account.
00:04:58.040 He posted it twice, actually. I guess he liked it so much, where it's an FAA-18 Super Hornet conducting a sonic boom right in front of President Trump.
00:05:07.540 And I've got to say, you know, the entire left was telling us all weekend that President Trump was sick or something was wrong with him or he was unhealthy.
00:05:14.920 Well, he stood just feet away from an FAA-18 hitting a sonic boom, breaking the sound barrier, didn't even flinch, didn't even move a muscle.
00:05:25.760 Who just said, wanted to see the plane. He also stood just a few feet away from where an F-35 Lightning II landed right there in the tail hook.
00:05:37.800 And this thing was caught just feet away from where the President and First Lady were standing, did not skip a beat.
00:05:46.320 And you see the precision. You can see the excellence of the United States Navy and the purpose that we have sea power.
00:05:53.240 You know, we talk about it all the time. And President Trump talked about it as well as how America, as a young nation, as a young nation, needed the United States Navy to go up against who?
00:06:03.760 The British Navy with the aid, of course, of the French Navy later on.
00:06:07.660 Then we saw the British Navy come back, 1812, Spanish-American War at the end of the 1800s, when it was, of course, Commodore Dewey, George Dewey, went over to Manila and shattered the Spanish Armada, shattered the Spanish fleet.

00:06:30.140 There's a new sheriff in town, and that's the United States Navy.
00:06:34.000 And you saw that all the way up through, of course, the events of World War II, where the United States Navy once again showed that naval supremacy.

00:09:27.700 Today, we are signing an executive order aimed at reigning in this out-of-control administration.
00:09:33.580 The order establishes ice-free zones.
00:09:38.100 That means that city property and unwilling private businesses will no longer serve as staging grounds for these raids.

00:09:54.180 Will, what is going on?
00:09:56.600 That sounds like the mayor of Chicago saying that he is going to reject the authority of the federal government.
00:10:05.360 Plus, we saw everything from Portland over the weekend.
00:10:09.040 What are we facing right now?
00:10:11.860 I mean, we're facing a rebellion by the states of Oregon and the states of Illinois.
00:10:16.120 When you hear we need to rein in this out-of-control administration, you should actually be hearing we are conspiring to obstruct justice and obstruct federal law enforcement.
00:10:28.620 Because that's what's happening.
00:10:30.160 He doesn't get to rein in anybody in the federal government.
00:10:32.640 That's not the way our system works.
00:10:34.300 He must have never read the supremacy clause despite becoming the mayor of Chicago.
00:10:39.620 The likely outcome here, though, is, you know, I mean, whatever happens here, it's probably unlawful.
00:10:45.680 You can't—and the feds will just ignore it.
00:10:48.200 But if the Chicago mayor, in his wisdom, decides to try and enforce these laws and prevent federal authorities from doing their job in the city of Chicago,
00:10:56.800 the likely outcome here is that he'll be arrested for kidnapping and false imprisonment.
00:11:02.240 So, I mean, what it sounds to me like, what we're coming up towards,
00:11:06.920 and we haven't heard something so forceful yet from any of the elected officials of Portland,
00:11:11.560 but we've certainly seen court cases and rulings and police reports that sound like Portland is moving in the same direction.
00:11:20.460 Will, are we going to see a standoff between potentially the authorities, the legal authorities,
00:11:26.800 of these cities and the federal government?
00:11:30.940 We've already seen a standoff, if anything.
00:11:33.160 This is just the federal government trying to fix things.
00:11:35.360 You have to understand what the city of Portland has done and what they're doing.
00:11:39.540 You know, there aren't a huge number of law enforcement officials whose job is to protect federal property.
00:11:44.220 The service that does that is the Federal Protective Service.
00:11:46.420 They have something, a little less than 1,000 agents, and over 100 of them have been sent to Portland.
00:11:51.500 They're working 12-hour shifts, seven days a week.
00:11:53.600 They're working flat out to protect federal officials and the federal property.
00:11:58.580 They wouldn't have to do that if the Portland police were helping to protect,
00:12:01.240 but the Portland police won't do a thing in front of the office.
00:12:04.640 And not only are they not doing a thing,
00:12:06.420 they're also litigating against the federal government to try and prevent the National Guard
00:12:10.740 and to provide some relief to federal officials in front of this ICE facility.
00:12:15.240 So there's already a standoff.
00:12:16.620 There's already a confrontation now.
00:12:18.360 When it comes to the courts, they're going to lose this confrontation.
00:12:21.860 Federal authorities will prevail legally and will have the right to go there.
00:12:25.680 Then it's just a question of exactly how far do local and state authorities in Oregon want to push this rebellion?
00:12:31.320 So I want to step back here a second because you mentioned the Supremacy Clause.
00:12:38.900 And this is something where, you know, I think a lot of people, when they miss, you know, sort of Civics 101, Government 101,
00:12:46.980 you know, they sort of lose the argument.
00:12:50.420 They lose the plot because they think, oh, that's the mayor.
00:12:52.400 The mayor can do whatever they want.
00:12:53.560 They just sort of see, you know, politicians they like and politicians they don't like.
00:12:57.840 But that's actually not how it works.
00:13:00.400 By the way, I'd love to have a side note.
00:13:02.540 I'd love to have a long conversation with you about red states at some point here because mayors do not have sovereignty.
00:13:09.580 Governors have sovereignty.
00:13:10.800 Mayors do not.
00:13:11.480 But that's it.
00:13:12.040 It's a separate discussion.
00:13:13.180 We will have that discussion later because I can see that coming up.
00:13:17.200 But but walk us through just the very basics of the Supremacy Clause here.
00:13:21.580 Well, it just says that federal authority is supreme over state law.
00:13:24.680 The United States government is a government of limited and enumerated powers under our Constitution.
00:13:28.780 They don't have every power in the book.
00:13:30.760 But where they have power, they are supreme.
00:13:33.640 When state law and federal law conflict, federal law wins.
00:13:36.580 When state law enforcement and federal law enforcement conflict, federal law enforcement wins.
00:13:41.280 So this is a standard case.
00:13:43.500 You know, the state of Oregon doesn't get to tell federal authorities where they're allowed to put federal officers to protect federal property.
00:13:51.420 It's not how the law works.
00:13:53.480 And similarly, when you hear the Chicago mayor again say things like we're going to rein in the administration.
00:13:58.880 No, you're not.
00:13:59.700 You don't have the authority to do that.
00:14:01.600 You don't rein in the administration.
00:14:03.320 The administration reins you in.
00:14:05.380 It reins your city in because that's the way our system works.
00:14:08.780 If you don't like it, you can try what the South did in the Civil War.
00:14:11.340 It didn't work out too well for them.
00:14:12.560 No, and you'd think that Governor Newsom and Governor Pritzker would have remembered that conflagration or at least perhaps had heard about it at some point in their history classes.
00:14:27.300 Because, of course, that's what the entire issue was.
00:14:30.240 You know, Will, when I come down to it, so you've done a lot of commentary as well, and I know we're coming up on a little break, but we have a few minutes, on this ruling regarding the National Guard in this respect and basically a judge saying that it's not – that the government is not allowed to.
00:14:47.120 So this is something where I remember I was digging in on this, and I gave a talk on it earlier today on War Room where I said the federal government has Title X authority under the Insurrection Act to federalize the National Guard.
00:14:58.440 It's really simple.
00:14:59.560 It's right there.
00:15:00.240 It's black-letter law, and it has been so since, by the way, prior to the Civil War.
00:15:06.340 This was the Insurrection Act of 1807, and, of course, we had – even before then, we had the Whiskey Rebellion and George Washington, a sitting president of the United States, who rode into battle with Alexander Hamilton at his side to put down such an insurrection.
00:15:23.700 This is not something new.
00:15:27.280 No, and it's also not a close decision.
00:15:29.060 I think – I don't even think this is going to the Supreme Court.
00:15:31.640 I think the Ninth Circuit is going to slap what this judge in Oregon did down.
00:15:35.480 The basic reason being she's substituting her own judgment for whether federal authorities are struggling to enforce federal law for the presidents, and the president's in the position, has the information, and is elected to make the calls on when to use federal forces to reinforce and protect federal property.
00:15:54.960 It's not – it's not the place of this judge to do so.
00:15:57.800 And so she's decided, apparently, that she's the new commander-in-chief, at least with regards to federal officials in Portland.
00:16:05.940 She's wrong about that, and she's going to lose this very quickly.
00:16:09.780 And so what was the ruling specifically that you put down?
00:16:13.560 Well, first, she issued a ruling on the second that said the Oregon National Guard could not be deployed to protect this ICE facility.
00:16:21.340 Then President Trump issued an order saying he was going to move the California National Guard and the Texas National Guard to protect it because, by its terms, the order only applied to the Oregon National Guard.
00:16:31.380 The Texas governor also gave permission for his forces to be used, so that should have been very straightforward.
00:16:38.520 But she decided late last night at 10 p.m. on a Sunday night to extend her order to cover any National Guard troops being deployed to protect a federal facility in Portland.
00:16:50.100 And she did so when she probably doesn't have jurisdiction because the order is already on appeal.
00:16:56.620 And this is something that I just don't understand.
00:16:59.340 What is her basis for such a ruling?
00:17:04.100 She's saying that the president's factual findings are untethered from reality.
00:17:08.420 So her argument is that there are some factual predicates to invoke the Insurrection Act, namely, like, the difficulty of enforcing federal law or the state of rebellion.
00:17:16.600 And therefore, she made factual findings saying there is no difficulty enforcing federal law.
00:17:20.800 There is no rebellion.
00:17:21.740 Therefore, you are not allowed to invoke the act.
00:17:23.520 And so does this all really come down to, like so many of these other cases, the definition of what a rebellion is this time around?
00:17:32.120 It's that, and it's also a question of who decides.
00:17:35.520 I think that's the foundational question, right?
00:17:37.840 Of course.
00:17:39.080 There's deference that needs to be given to the executive.
00:17:41.720 They're the ones in charge of military forces.
00:17:44.540 The president's the commander-in-chief of the military.
00:17:46.800 They're the ones who have the intelligence and the information necessary.
00:17:49.760 One district judge in Oregon with four law clerks is in no position to determine when federal law is being under-enforced or when federal officials are in danger.
00:17:58.180 And they are here.
00:17:59.840 They really are.
00:18:01.580 This is like the last iteration of it where they were trying to say the president couldn't use emergency deportation orders because there was a federal judge who was arguing that we weren't under invasion, if I remember correctly.
00:18:11.760 Exactly right.
00:18:12.540 Exactly the right analogy to be making.
00:18:14.480 It's the question, again, it's not the actual facts on the ground.
00:18:18.940 The prior question is who decides who is in the position to make these determinations about whether there's an invasion, whether law is unable to be enforced.
00:18:27.020 And clearly the way our constitution is structured, those determinations are for the president.
00:18:32.500 And for the president of the United States to make those determinations, it does not, the ball does not roll uphill as it stands.
00:18:41.160 A local federal judge does not have the intelligence, the support of DHS, NCTC, all of the other factors at their disposal.
00:18:50.380 They just don't have that.
00:18:51.360 You can't just be sitting there watching CNN and Fox News.

00:21:07.760 And, Will, so you reminded me during the break that the invasion question, that was the Alien Enemies Act, right, that the administration was originally using to, you know, to remove illegal aliens in an emergency situation.
00:21:22.840 What was the status of that case?
00:21:24.240 Did they ever end up – was that adjudicated?
00:21:26.400 Yeah, and I think ultimately – the funny thing is I actually don't remember much of the outcome.
00:21:32.500 I think it got mooted effectively when Venezuela agreed to take back all the people who were subject to the Alien Enemies Act in El Salvador.
00:21:39.740 So I don't remember the exact outcome, but I don't think the administration lost.
00:21:42.380 You know, I think they'd actually – I think you're right.
00:21:45.800 I think they actually did win, though.
00:21:46.860 But, of course, we'll, you know, we'll caveat that with that.

00:21:53.420 These federal judges – and, Will, look, you were around in the first administration.

00:22:02.740 And talking about different legal strategies that could be used, the emergency fund – you know, declaring an emergency for the use of funds to build the border wall was one of your ideas that I believe the administration actually did end up adopting.
00:22:18.020 But here's a difference.
00:22:20.160 We're not seeing the administration really back down from these local, you know, district judges in federal district, but they're still, you know, they're still confined to one locality.
00:22:30.520 We are not seeing that, are we?
00:22:33.060 No, because we're on the right side of the law.
00:22:35.920 You know, there was this big meme going around, especially at the beginning of the administration when all these injunctions were coming down fast and furious, that it's the administration that's behaving lawlessly.
00:22:44.940 Look at all these injunctions.
00:22:46.460 And then now the Trump administration's on an incredible winning streak at the Supreme Court.
00:22:50.500 I think we're at 20 in a row, 20 wins in a row, unheard of.
00:22:53.980 I don't think any administration's gotten close to that.
00:22:56.280 And what it's revealed is not that the administration was behaving lawlessly, but that these lower court judges who thought they were entitled to resist the administration were behaving lawlessly.
00:23:06.040 And I think that's exactly the outcome you're going to see in this Oregon case.
00:23:10.420 I mean, I'll put this out there for people.
00:23:12.660 If anybody wants to bet on the outcome here and whether the Supreme Court's going to ultimately reverse this person, I'll give you 10 to 1 odds, right?
00:23:18.520 10 to 1 odds that this temporary return order doesn't survive because it's lawless.

00:24:05.920 But OK, for someone running for attorney general, you know, I'm sure everyone that is on the other side of you in court is certainly going to be using that from now on.
00:24:13.240 These messages, though, where he's talking about killing a political opponent, his wife and their children, desecrating their grave.
00:24:24.320 Will, do you think that he's actually going to drop out?
00:24:27.880 Because it seems like the Democrats, including Yvigny Vindman, are just driving on and continuing to re-endorse him in the face of direct murderous rhetoric.
00:24:39.760 This is a tougher line to set because he's not an officeholder.
00:24:43.700 I think there's a reasonable chance he's forced to drop out by the Democrats because they're really not going to be happy with getting drowned in ads a month before the election.
00:24:52.120 They might think that he's dragging down the entire Democratic ticket in Virginia and will ultimately bring them all down.

00:31:47.500 and the electricity prices that continue to go up and to impact working-class families.
00:31:54.420 And so, really, PA and NJ, they share one-fourth of the same border together.
00:32:01.080 And I think it's very interesting that, yes, they may, in federal elections, vote straight D,
