00:04:31.460we see, of course, Israel, the United States, the Gulf nations, and that's the GCC, the Gulf
00:04:38.840Cooperative Council. And on the other side is the axis of resistance, the axis of resistance being
00:04:44.940this Iran, Hezbollah, Hamas conflagration that have joined together in recent years. And that's0.63
00:04:51.660exactly what Iran is trying to put out to say that they are defending their allies in Hezbollah
00:04:57.800with these attacks on Israel. Iran's ballistic missile capability degraded and yet still intact
00:05:04.540with the ability to reach out and touch someone, as we would say, in the United States military,0.90
00:05:10.060putting warheads on foreheads. And of course, going back to taxing the Iron Dome and those
00:05:15.320Patriot missile interceptor batteries. Of course, the United States Navy, it still maintains its
00:05:20.240presence in the region, as well as the East Med and just outside the Persian Gulf. The Israeli
00:05:24.880Navy also able to able to operate in the eastern Mediterranean at the same time.
00:05:32.160So the big question is, of course, President Trump, will he be able to pull this deal together?
00:05:38.660And some reporting coming out, Axios and others saying now that the president has warned Israel that if you launch further offensives against Iran,
00:05:48.860that you may be doing so alone if they are not done within the confines of the deal.
00:05:55.080So this is President Trump trying to do everything he can, use every piece of leverage,
00:05:59.540whether it be military, whether it be diplomatic, whether it be economic,
00:06:03.480to bring all sides of the warring conflict together to say,
00:06:08.240we need to find a way to get a path to peace.
00:06:11.540And that's been President Trump's goal from the very start.
00:06:14.760The deal, the 14 point plan that had been drafted, I think, two weeks ago at this point, I've called it a major win.
00:06:21.620It would be a major win if President Trump is able to get all partners to sign off on that.
00:06:27.340But just like anything else, of course, getting the various sides in the Middle East to agree to peace has always been the tallest order for any American president.
00:06:37.480But if there is an American president who could do so, who could bring together the Israelis, who can bring together the Arabs, who can bring together the Persians to at least get to a point of accommodation, that's where the United States can come in and potentially get back to a new status quo, get to a new status quo, not just for the Middle East, but of course, the Strait of Hormuz and the critical petrochemicals and the supplies coming out of there.
00:12:34.760First of all, does this look like self-defense to you?
00:12:37.580And second of all, if not, what would the appropriate charge be?
00:12:42.240Well, you know, first of all, I've been following this from the day it happened.
00:12:46.380And the minute it happened, because it was black on white violence, you knew that there
00:12:51.320would be people who would racialize it.
00:12:53.000say this is part and parcel of the broader spectrum or demographics of violence.
00:13:00.100And I said, like, until there's an element of evidence illustrating or, you know, making evidence that this was racially motivated,
00:13:06.800what it is is crime, crime between two, I say between two individuals, crime perpetrated against one individual by another.0.95
00:13:13.160It happens to be black. You can draw whatever broader, you know, consideration statistics you want from that.0.97
00:13:18.900But at the end of the day, there was nothing racially motivating this crime that we know of.
00:13:23.940So in as much as some people on, I'll call it the right, there were some people racializing it, black on white violence, you know, the 13 percent committing 52 percent of the crime, all that stuff.
00:21:29.240We're talking about the Carmelo Anthony, the latest updates.
00:21:31.760And, Viva, when we see this going on, this idea that – and so let's ask about this, this push, this shove.
00:21:38.600You know, by all accounts, it doesn't sound like it was a hard shove.
00:21:43.020It doesn't sound like he he he pushed him very hard. And even the prosecutors are making this argument that Carmelo felt a momentary fear.
00:21:54.920He was afraid for himself in the moment. He thought that something could happen, not just because of the shove, but because he felt that he was surrounded again in this this tent that he himself had put himself in.
00:22:05.380does being shoved warrant a level of force consistent with what we see here, this stabbing
00:22:14.280directly in the heart? I always qualify this. I'm a former Quebec litigator, never done criminal law
00:22:20.840in the States. Texas has what's known as imperfect self-defense, so that even if your fear of
00:22:25.700immediate bodily harm was unwarranted or irrational, it can still be argued as a mitigating factor.
00:22:31.900the bottom line is this first of all misinformation disinformation galore people
00:22:37.800initially were saying he stabbed him with a with a cleat cleaner then you hear some people saying
00:22:43.120well it wasn't abnormal to have a knife because you know you might have to cut tape when you're
00:22:47.280doing whatever my understanding he wasn't even competing he went over to the other tent and if
00:22:51.980we want to steel man this some people were suggesting he went over to the other tent because
00:22:55.600his team didn't have a tent there was a storm coming in etc etc so he was just taking refuge
00:23:00.520and they told him to leave and he you know took umbrage with that the idea that this is touch me
00:23:06.740and i get to stab you through the heart and highlighting that it's not like he punched
00:23:11.720somebody and the kid fell back and knocked his head and died that way that that happens as well0.99
00:23:16.040and then the argument is well i obviously didn't mean to kill him at all but then you unfortunately
00:23:20.140you know have to take your victim in the state that they come this is plunging a five-inch blade
00:23:25.880through his sternum into his heart with such force that it penetrates and breaks off bone
00:23:30.960from his sternum this was intended to be lethal force and for what for what could at best be
00:23:36.700described as battery if that some people sitting there oh he assaulted him he put his hands on no
00:23:41.300unwanted touching is battery in most places assault is you need to cause the person or have
00:23:46.660the intention of causing the person to fear harm and the idea that somehow people want to say this
00:23:51.260is now legitimate stand your ground defense so every time there's a shove at a track meet at a
00:23:55.280high school you have the precedent where you can stab someone to death if you think that you're
00:23:59.080defending yourself it's it's ex post facto justification an attempt to for what is nothing
00:24:05.840shy of murder and i appreciate the kid 17 years old he's not facing a capital capital murder so
00:24:11.480he can't face the death penalty and you know at 17 you can make an argument maybe not old enough
00:24:17.220to try as an adult or you know sentenced to death old enough to try as an adult old enough to sentence
00:24:21.720as an adult. This kid, by all accounts, was looking to provoke something of an antagonistic
00:24:28.320response so that he could then do what he did. And if you thought that Austin Metcalf touching
00:24:34.760his shoulder or pushing him, whatever you want to qualify it, was violent assault, then you leave
00:24:40.180and you go get the cops and you come back and you charge him with assault. I made the analogy that
00:24:44.560like had Carmelo, Carmelo Anthony, sorry, had he said, touch me and I will stab you in the heart,0.81
00:24:51.400that would have been a bona fide prosecutable threat. So how does it become self-defense when
00:24:56.000he actually does it? You know, he says, Austin, touch me, put your hand on me, I will stab you0.99
00:25:00.920in the heart. There is no realm of the universe where that would not be considered a criminal1.00
00:25:04.180threat. And somehow it's going to become magically self-defense because he actually stabbed him in
00:25:07.940the heart. It's nonsense. No. And, and in fact, I'm, I'm reading some of the transcripts now,0.98
00:25:15.280and even, even some of the defense's witnesses are coming up and saying, these are other,
00:25:19.660you know, high school, um, you know, classmates and teammates and, and folks who were there.
00:25:25.100And, uh, they asked one of the witnesses, you know, have you ever seen people go into other
00:25:29.480tents? And they said, yes. They said, okay, but have you ever done that? He said, well,
00:25:33.700Well, no, I've never done that, but, but yeah, I mean, it's just, these are the best that
00:25:38.160they can come up with to try to determine that this, that there was no provocation on
00:25:42.480the behalf of Carmelo, because if you lose the, the self-defense, which to my mind, they
00:25:48.660have not been able to demonstrate that he was in a situation that called for lethal
00:25:53.980use of force in self-defense, even under Texas law.
00:25:57.820And as such, that means it's grounds for the murder charge.
00:26:10.780He admits to having done the actus reus, the act of the crime.
00:26:14.000And now the only question is, did he, at the time, legitimately fear for his life,
00:26:18.980even if it was irrationally, and act in self-defense?
00:26:22.220If this is the new standard, I mean, you are basically giving grounds to murder people
00:26:28.100for what could at best be qualified as simple battery.
00:26:31.260and the bottom line you know him being under the other tent asked to leave all this other stuff
00:26:36.400oh he didn't have to leave austin had no authority to make him leave this is a situation that could
00:26:41.120have been escalated by going to the principal going to authorities and saying austin shoved me
00:26:46.440and i'd like to press charges and the only joke would be nobody would press charges there the
00:26:50.800bottom line they had to lie about what the video evidence showed because it doesn't show him being
00:26:55.100swarmed and jumped and beaten by four people and all of the witnesses there say it looked like he
00:27:00.120was actually provoking no we remember that as well viva gotta run where can people follow your
00:27:04.120brother viva fry on twitter and viva fry on rumble viva barneslaw.locals.com on locals
00:27:10.280all right thanks so much we'll be right back with more from our own savannah
00:27:14.800hernandez one of our best friends here on real nerca's voice
00:27:30.120Where's Jack? Where's Jack? Where is he? Jack, I want to see you. Great job, Jack. Thank you. What a job you do. You know, we have an incredible thing. We're always talking about the fake news and the bad, but we have guys and these are the guys who should be getting policemen.
00:27:50.660They found out I work for Turning Point USA.
00:27:54.060And at that point, it got very aggressive and it got very violent.
00:27:58.940I was surrounded and I had an entire family, a mother, a father, and a daughter who all took turns beating me up.
00:28:08.980Law enforcement didn't come. I realized I had to walk myself out of this mob that wanted to hurt me.
00:28:13.780And again, every single time I turned to leave, I was punched, I was pushed, I was shoved.
00:28:18.840And I ended up being slammed to the ground by a man that was double my size.
00:35:23.800They're not interested in anything other than picking up weapons and firing them.
00:35:27.580And you will see more people be targeted in such a manner
00:35:32.140if they are not dealt with properly, if they are not smashed properly.
00:35:35.240And, Seb, that's what happened to you in Minneapolis.
00:35:38.500us. That's what happened to so many other people recently. The violence that we've seen in Newark
00:35:42.300and other places where over and over the violence continues, it's not actually dying down. And I
00:35:48.900predict this summer, it's going to get worse. Oh, absolutely. Jack. And again, I was outside
00:35:54.180of the Camaro Anthony trial all last week. And what I saw were again, the seeds being planted
00:36:00.440for again, more tape, more tension, another race war, more potential riots that could happen if
00:36:07.960Carmelo Anthony is found guilty. Again, we're living in two separate realities with certain
00:36:14.300factions of America who refuse to accept the truth, who refuse to accept, again, that we are
00:36:20.020a country of law and order. And that's why as well, right, Antifa was declared a domestic
00:36:25.200terrorist organization. And it's why so many people have been calling for them to be treated
00:36:29.340as such. We wouldn't allow people to declare open loyalty to ISIS and then wear ISIS imagery in the
00:36:36.100street while attacking women and children and throwing things at the police. So I don't
00:36:39.820understand why we are allowing Antifa to do that and allowing them to continue to riot and attack
00:36:45.040our law enforcement officers in front of ICE facilities in New Jersey, in front of WLS in
00:36:50.820San Antonio. So again, you know, one of the things I talked about this weekend, Jack, was how I was
00:36:56.500hoping that the left wing after Charlie's death would say, OK, you know what? We've taken things
00:37:00.860too far. It's time to calm down and it's time to dial down the rhetoric. But no, they've only
00:37:05.360quadrupled down on everything. And again, I watched as somebody made a paper mache head
00:37:10.880of Charlie and came and reenacted his assassination in front of the young women who came to our event
00:37:17.200to talk about faith, family and values. So that's what would happen. That's what happened this
00:37:22.700weekend. And terrifying scene. I mean, I saw some of the attendees walk back into the hotel lobby
00:37:28.660sobbing and crying, Jack, because they were confronted with real evil for the first time.
00:37:33.860And they were I wouldn't say they weren't prepared for it, but I think they were they were quite jarred and shocked by it because they were really seeing it for the first time.
00:37:41.000So, you know, it kind of hit me as well.
00:37:43.660No, it's coming up on a quick break, but you're exactly right that there are some people out there who, when they haven't been out and seen this up close and personal like you have and so many others have,
00:37:54.500they don't realize how far depraved and how far low and how disgusting these people can become, how completely and utterly unhuman they are.
00:38:43.660all right folks jack so big back live human events daily real america's voice for almost
00:38:50.580savannah hernandez sav you were out there outside and inside the carmelo anthony trial where uh what
00:38:57.880can i say it sounds like sparks were flying in both cases they're both inside and outside tell
00:39:03.640us start with outside what did you see going on you know really with this this crowd that was out
00:39:09.480there. Well, Jack, just to give you guys an idea of how safe the judge is trying to keep this trial,
00:39:17.640the entire street leading up to the courthouse has been shut down. There's a curfew where nobody
00:39:22.260can be on courthouse grounds from 11 p.m. to 6 a.m. On top of that, you know, there was a strict
00:39:29.160gag order put in place and very strict media rules regarding, you know, how this entire trial
00:39:35.020could be covered. However, you have still had the Carmelo Anthony supporters who have shown up in
00:39:40.500great numbers every single day of this trial. And Jack, I have covered a lot of protests. This is my
00:39:46.420first time covering a high level trial, but I've covered a lot of protests. And this is the most
00:39:50.700aggressive and violent rhetoric I've ever heard from a protest group. Now, the first day that I
00:39:57.660got there, I went and I just tried to talk to them, right? Why are you guys here? Why is this
00:40:01.680important to you and they acted like I was trying to fight them another local reporter went up to
00:40:07.760this same group tapped one of the leaders of the chants on the shoulder and keep in mind they're
00:40:12.620chanting things like we decree Carmelo Anthony will be free we have to protect our black youth
00:40:19.120to essentially everybody in the Carmelo group stating that he is unequivocally innocent none
00:40:24.700of them are following the trial none of them are following the facts of this case but they are
00:40:28.700outside of this trial every single day, stating that Carmelo Anthony is undoubtedly without,
00:40:34.780you know, without any look into the trial, he's innocent. That is what these people believe.
00:40:41.160They've been very aggressive with the media. They will not speak to anybody that they deem
00:40:46.240unfriendly media, which is basically everyone. Last week, you did have a veteran who showed up
00:40:52.100in a wheelchair, right? He had a couple of flags flying, multiple American flags, one Confederate
00:40:57.200flag. This resulted in members of the Carmelo supporters stating that if they were close enough
00:41:02.760to him, they would push him into the grave, that he was going to be the next Metcalf, and that he
00:41:07.340was going to be pushing up daisies, and that the only good cracker is a dead cracker. So this is0.58
00:41:12.700some of the rhetoric that is happening outside of the Carmelo-Anthony trial, and it was very
00:41:18.300jarring to witness, Jack, because again, I've covered all sorts of protests, and typically you
00:41:22.700can at least have a conversation with these protesters to understand where their mindset is
00:41:26.560at. But with these guys, they will not speak to people. They will not explain why they think
00:41:32.120Carmelo is innocent. I was able to get a first interview with one of them. And I basically asked,
00:41:38.780hey, will the black community accept evidence if it shows that Carmelo Anthony actually didn't act
00:41:44.440in self-defense and that he did stab Austin Metcalf and committed a murder? Would they accept that?
00:41:50.400And this woman's basically stated that we are going to stand with ours regardless of what the
00:41:54.860evidence states. And then I was able to speak to another man who called himself a minister.
00:42:00.220And he basically stated that he was outside of the courthouse praying because what this courthouse
00:42:06.380represented was legalized racism. So a little idea of what's happening outside of the courthouse.
00:42:13.000You also have Dominique Alexander, who's been a spokesperson for this family. Let's keep in mind
00:42:18.380that he is, you know, somebody who has been at the forefront of pushing racial tensions
00:42:24.680and utilizing high profile cases like this one and twisting and distorting the facts
00:42:29.620to make it seem like Carmelo Anthony is simply being prosecuted because he's black.
00:42:36.060Well, and Sav, so you've been also covering the inside of the courtroom,
00:42:40.520wanted to give us, you know, what's your take on the latest there?
00:42:43.200I also, and I was talking with Viva Frye as well, that a number of the witnesses
00:42:46.920who have testified on behalf of the prosecution to testify against Carmelo Anthony are themselves
00:42:53.320black, including the coach, including many of his teammates. So it really doesn't seem
00:42:57.880like on the face of this, this was a a racial incident, at least from Austin Metcalf side.
00:43:05.020And of course, I would point out as well that for those protesters saying that, oh, well,
00:43:09.280he was only asked to leave because he was black, that clearly Austin Metcalf did not ask any of
00:43:14.980his black teammates to leave the tent either. Exactly, Jack. Again, you have bad actors that0.63
00:43:23.300are outside of this trial that are trying to essentially spread a fake narrative regarding
00:43:28.680what is going on with this. This has nothing to do with race, and it has everything to do with
00:43:36.400the fact that Carmelo should not have been there to begin with. Again, one of the first things that
00:43:41.760I noticed when I was inside for jury proceedings is how Carmelo Anthony shaved his head, which gave
00:43:48.740him an even more youthful appearance. I do feel that the defense is doing everything in their
00:43:53.020power to try to make him look as young and as innocent as possible in this case. Because again,
00:43:58.400you know, they've called up witnesses and it doesn't seem like they have been able to make
00:44:02.440that self-defense argument very well. You know, another thing the defense is going to try to bring
00:44:06.860up is that Texas is a stand your ground state. However, that argument has completely fallen
00:44:11.300apart. So a little idea of what it's been like inside and outside. Also, it's kind of some
00:44:18.780details that I was hearing regarding how quickly the judge wants this to be wrapped up. They're
00:44:23.820hoping to have this trial wrapped up by June 12th. I heard this from law enforcement sources on the
00:44:28.160scene, which is why we saw a Saturday proceeding. That's not typical. However, this judge really
00:44:33.960wants this to be done very quickly. And there's also what I'm hearing going to be no plan breaks
00:44:39.460before closing arguments. And the judge is also prepared to keep, you know, these trials in
00:44:44.340session until 6 p.m. every single day because they want this process moving as quickly as
00:44:49.140possible. So a little idea there from from on the ground. Well, that's that's incredible. That's
00:44:56.020that's, by the way, incredible exclusive there about pushing forward. And in fact, that would
00:45:01.120explain why they had this Saturday of testimony, which is something that, you know, having covered
00:45:05.080trials at the federal level, state level. Just I wasn't I hadn't been expecting myself. But given
00:45:10.520that time frame, that does make sense. I'm looking at the evidence to your mind is you've been in a
00:45:17.520number of incidents involving violence. You've never provoked one of them at all in your life.
00:45:23.560And yet in this instance, that's the very question that's being decided when you're looking at the
00:45:31.180different pieces of evidence that have put out the deferring narratives that have come up.
00:45:34.520Have you seen evidence that shows that Austin Metcalf provoked this provoked this situation or was it, in fact, Carmelo Anthony?
00:45:43.580You know, Jack, every single witness that's come forward to the stand has stated.
00:45:48.620And again, this is not my opinion. This is the facts.
00:45:51.740This is what the witnesses are stating, that it was Carmelo Anthony that provoked Austin Metcalf.
00:45:57.780It was Carmelo Anthony who was asked to leave 15 times.
00:46:01.640It was Carmelo Anthony that provoked Metcalf. And it's just, like I said, frustrating because you still have people outside of this courthouse that do not care about facts of the case and are trying to spin this into a racial thing.
00:46:16.440And one of the first ways they did this was by stating that this is an unfair trial because there are no Black jurors that are seated.
00:46:25.700However, let's keep in mind, there's a very heavily Hispanic and Asian population up in this northern part of Texas.
00:46:32.200So that doesn't mean that there are no minorities on the jury. It just simply means there are no Black jurors.
00:46:36.960And of course, those jurors were struck for a reason. This is how the legal process plays out.0.92
00:46:40.740However, Dominique Alexander has, again, been pushing this narrative that Carmelo Anthony is not getting a fair trial because he's black, that the legal system is racist, that he's been fighting white supremacy since day one, despite the fact that Anthony and his family were able to raise half a million dollars, despite the fact that a judge lowered his $1 million bond to $250,000 after he cited financial difficulties, and then it was found out that the family was living in an almost $1 million home.
00:47:09.160the facts of this case show that race has nothing to do with this white supremacy has nothing to do
00:47:14.680with this the facts of the case show that carmelo anthony was the aggressor and that he very much
00:47:20.100seems to be the one at fault here all of the witnesses you know their story is the same they're
00:47:24.960all corroborating one another and it really does seem like the defense is uh not having a good time
00:47:30.580in this so we will see what ends up happening um and what the verdict is later this week of course
00:47:35.860that's up to the jury jack. But from what I'm seeing, what everybody is seeing in the facts
00:47:40.260of this case, it very much seems like Carmelo Anthony was in the wrong here.
