00:08:53.620 to explain how there is a way that the currently constituted House of Representatives
00:09:00.780 can actually undo what was done by the completely illegitimate January 6th committee.
00:09:08.000 And we cannot forget that it is inseparable.
00:09:11.820 The subpoena that Stephen K. Bannon was ordered to respond to came from an illegitimate committee.
00:09:18.960 But of course, the current House of Representatives is now controlled by Republicans.
00:09:23.900 At the time, it was controlled by Democrats.

00:09:34.000 And this is highly important.
00:09:35.720 So I'm glad to be here with your audience to explain what's going on.
00:09:39.880 Well, this is great.
00:09:40.980 And all credit, by the way, to Matt Gaetz.
00:09:43.720 He came out and really gave a lot of life to this.
00:09:47.280 Roger Stone has also been someone I know has been pulling for it.
00:09:50.500 But I haven't been walked through all the legalities and the process of it yet.
00:09:55.620 So what is the process by which the currently sitting House of Representatives can declare
00:10:01.820 the Jan 6th committee and declare those subpoenas illegitimate?
00:10:06.140 Sure.
00:10:06.900 So there are three options, Jack, in order of, you know, highest aggressiveness to least aggressiveness.
00:10:13.560 So let me start with the first.
00:10:15.800 That's the Congress, the House passing a resolution by majority vote that basically disclaims, repudiates
00:10:23.180 the Jan 6th process.
00:10:25.420 It was established in violation of law in multiple respects.
00:10:29.220 It didn't have a ranking minority member.
00:10:32.340 It did not have, therefore, a minority council who needed to get equal time in any depositions.
00:10:38.380 And the January 6th committee under Nancy Pelosi, Benny Thompson, Liz Cheney, they tried to cover
00:10:44.720 up for these defects by naming Liz Cheney the vice chair of the committee, making her kind
00:10:52.200 of an ersatz ranking minority council, a ranking minority member who could appoint a ranking
00:10:58.320 minority council.
00:10:59.440 But it doesn't work.
00:11:00.760 It didn't work.
00:11:01.520 They realized they couldn't really claim that.
00:11:03.200 They just tried to sort of pass that off for anyone who might buy that for appearances.
00:11:08.380 And so all of the depositions they conducted, all of the subpoenas they issued, Jack, all
00:11:14.280 of those are what lawyers call ultra virus.
00:11:16.920 They're all outside of the committee's authority.
00:11:19.580 And it's entirely proper for the House of Representatives under new management now to
00:11:25.520 say that fact and just pronounce that the rules of the House established for the January
00:11:31.320 6th select committee were not followed.
00:11:33.580 And for that reason, the very base act that Steve Bannon and Peter Navarro were found guilty
00:11:40.920 of in criminal contempt of Congress for disobeying is a nothing burger because, you know, you have
00:11:47.900 to have something that's proper in order to to unlawfully disobey it.
00:11:51.480 That's the starting step.
00:11:52.920 So there's a resolution that's been introduced by Representative Burleson.
00:11:56.200 And there are 24 other signatories at that to this point.
00:12:00.640 I call them the stalwart 25.
00:12:02.860 And I think that what your posse, Jack and Human Events, needs to do and anyone from War Room
00:12:10.200 Posse who's watching as well, you need to get with your representative and you need to advocate
00:12:14.560 to them that they need to sign on to this petition.
00:12:19.180 Well, OK, so this is huge.
00:12:20.740 So they sign on to the petition.
00:12:23.480 The petition goes forward.
00:12:25.140 The Jan 6th committee is then declared illegitimate.
00:12:28.340 The subpoenas then are rescinded.
00:12:30.320 So if the subpoenas are rescinded, let's say best case scenario, all this happened today.
00:12:35.760 Where does it go tomorrow?
00:12:37.280 It's not like the Bureau of Prisons just automatically says Steve Bannon doesn't have to doesn't have
00:12:41.360 to surrender.
00:12:42.000 So how does it work from that step?
00:12:43.520 So, Jack, look, you know, you can expect maximum resistance from the Biden-Garland Justice
00:12:50.820 Department, right?
00:12:51.540 We knew we know that as soon as night follows day.
00:12:55.320 So if the resolution is passed, I would expect that Steve Bannon's lawyers would immediately
00:13:00.600 present the evidence of that, an official copy, which is judicially noticeable to the D.C.
00:13:06.700 Circuit in the first instance.
00:13:08.000 That's the appellate court with jurisdiction over Steve at this point, and then to the
00:13:12.820 U.S. Supreme Court failing that, arguing that, you know, the leg of the stool that holds
00:13:18.540 all of this nonsense up, you know, this made up misdemeanor from hell that's really never
00:13:23.780 used against anyone who happens to be a Democrat.
00:13:27.400 They've flouted congressional subpoenas many times with impunity.
00:13:30.920 And then, you know, arguments need to be made that Steve definitely, in light of this, should
00:13:38.300 be able to stay out pending his appeal, pending his cert petition to the U.S. Supreme Court
00:13:44.700 asking him to take this result and his improper trial, where basically he couldn't present any
00:13:51.460 defenses of himself.
00:13:52.540 Jack, as you know, he wanted to present a defense that his lawyers had advised him that since
00:13:58.160 President Trump had invoked executive privilege, that he had a reason and he was not in willful
00:14:03.940 disobedience of a subpoena.
00:14:05.620 And they presented, prevented him from saying that.
00:14:07.900 Instead, the jury was essentially misinformed, even though it was a, you know, biased D.C.
00:14:12.200 jury, as most of them are, given their political makeup.
00:14:15.440 But they were sort of led to believe that, you know, Steve just thumbed his nose at a congressional
00:14:19.660 subpoena without more.
00:14:21.140 But that's not what he did.
00:14:22.220 He got sophisticated legal counsel.
00:14:24.320 He was advised not to show up.
00:14:26.600 And that defeats willfulness right there.
00:14:28.700 And under our criminal laws, there is no, you know, basis for reading willfully is to
00:14:34.580 have some kind of special, different meaning when you were talking about congressional subpoenas
00:14:38.860 compared to when we're talking about committing other purported types of crime.
00:14:43.580 So that would be the first step.
00:14:44.840 The resolution passes.
00:14:45.980 Then it would be put in briefing and motions practice before the D.C.
00:14:50.720 Circuit and the Supreme Court.
00:14:53.600 And the other two options, right, are that, you know, the next one is that the Blagwood
00:15:01.040 Act.
00:15:01.520 And I know you've spoken about this, the bipartisan legal advisory group, which is headed up by
00:15:08.240 Speaker Johnson.
00:15:09.000 And that group controls, so and Republicans controlled by a three to two majority, they
00:15:15.120 can file an amicus brief with the court system arguing that the, you know, the whole rug has
00:15:22.820 been pulled out from under the illegitimate January 6th committee and they can help Steve
00:15:27.320 that way.
00:15:28.360 And the last thing, which certainly can be done, is that Speaker Johnson could just write
00:15:32.980 a letter to the courts and say, this is my understanding as Speaker of the House, as informed
00:15:39.800 by my general counsel, that, you know, we now believe that these subpoenas were illegitimate
00:15:45.780 because the committee was operating in violation of the rules that even the Nancy Pelosi House
00:15:51.360 had established in the 117th Congress, Jack.
00:15:53.980 Well, and there you go.
00:15:58.240 So all of us, because this, this is kind of like, it's, it's similar and, and, you know,
00:16:02.580 folks around here know I've said a million times, I'm not an attorney, but this reminds
00:16:06.680 me of something similar to a fruit of the poison tree argument.
00:16:11.460 Yes, exactly.
00:16:13.080 You know, the, the, the fountain of error here is the fact that the January 6th committee
00:16:17.200 was established in violation of law.
00:16:20.420 Let's just start with the fact that it was supposed to have 13 members.
00:16:23.360 But Nancy Pelosi only put nine members on there.
00:16:26.460 Then second, under, you know, long established House procedures, you know, the, the majority
00:16:33.200 party doesn't get to pick the membership of the minority party, right?
00:16:37.600 The minority party picks that.
00:16:39.020 And then we have a scrum.
00:16:40.400 We have an adversary process that takes place based on, you know, the respective strength
00:16:45.620 of the two parties in, in the House or in the Senate.
00:16:48.700 And it's that which Nancy Pelosi shortcutted by saying, oh, no, no, no.
00:16:52.860 You can't put Jim Jordan.
00:16:54.400 You can't put Jim Banks on this committee.
00:16:56.480 I'm going to pick the members.

00:16:59.020 And I want Adam Kinzinger, right?
00:17:00.520 Very, very convenient people who carry a Republican label.

00:17:11.080 And so these guys had already decided to go all in with the Democrat narrative.

00:17:21.960 fights with this committee, the committee voted every single time I've ever seen in

00:17:29.740 They might have taken over preliminary votes, nine to zero.
00:17:33.180 So it had nine members every time they had to present a vote, they would say, would they
00:17:39.140 all voted for it, right?
00:17:40.160 So it was just a monolith that was handcrafted by Nancy Pelosi to reach a predetermined result.
00:17:45.900 And I also think that that's not just in violation of the traditions of the House.
00:17:49.680 It's in violation of basic due process.
00:17:52.280 If something the House does is going to turn into something that can send somebody to jail
00:17:56.240 where they lose their liberty, right, a process like that is, you know, a joke of a sham.

00:20:09.220 And that is key to the House Republicans exonerating Peter Navarro, by the way, could potentially actually spring him right now from prison and prevent Steve Bannon from having to go.

00:20:26.160 So, look, this is the biggest gem from the DOJ brief that was filed against Steve Bannon just two days ago.

00:20:36.460 It's total hypocrisy coming from the Biden administration and from the Garland Justice Department.

00:20:59.740 They're saying that Steve is making an argument for special treatment when he's the first person essentially to be jailed under this statute or to be potentially jailed after after Peter Navarro.
00:21:11.440 So in a very long time when we have, you know, Eric Holder thumbing his nose at a subpoena, we have Merrick Garland himself in recent weeks thumbing his nose at a subpoena to get access to the audio tape of Joe Biden being interviewed and deposed by special counsel Robert Herr.
00:21:30.100 I mean, the hypocrisy is so thick you can't even cut it with a knife.
00:21:34.060 And that's one of the reasons, Jack, while, you know, my group, the Center for Renewing America, is spearheading this effort to call on your member of Congress to join the resolution and to vote to pass that resolution, finding that the January 6th committee was an abomination, really, and that everything it did was legally defective and void.

00:23:46.440 It's another thing to roll up your sleeves, really be a man in the arena and to take the necessary steps to save the country. Right.

00:43:33.880 And that's because of what you just said, the overlapping demographics in many ways, there
00:43:38.580 are parts of Wisconsin, large swaths of Wisconsin that mirror Iowa far more than they mirror

00:43:48.280 And when I'm talking about demographics, I'm not just talking about white versus black
