00:01:53.760 of the iceberg. It gets absolutely insane from here. A federal court justice has halted the deportation
00:02:01.200 of a non-binary American in a ruling that criticized Ottawa's immigration department for not properly
00:02:07.760 considering the situation of LGBTQ Americans since US President Donald Trump took office. I'm sorry,
00:02:14.880 that is patently insane that we have a judge in Canada arguing that Canada's immigration department
00:02:23.840 is too strict. It is too strict on the rules and it's not being compassionate enough.
00:02:28.400 We are a country that brought in 17,500 criminals over the last decade. People who had criminal records
00:02:35.760 that we overlooked and allowed them to enter the country as either permanent residents or on other visas.

00:02:47.440 the law who's non-binary was not allowed to stay because something something Donald Trump.

00:03:11.680 setting. Immigration lawyers have been inundated with inquiries from LGBTQ Americans about how to
00:03:19.440 emigrate to Canada since Mr. Trump took office, with many who have Canadian parents and grandparents
00:03:24.880 applying for Canadian citizenships. What are they talking about? By the way, I do not believe them for a
00:03:33.680 second when they say they've been inundated with emails. They've probably gotten two emails. You are
00:03:40.320 histrionic if you think as somebody in the LGBTQ community that you are unsafe in the United States.
00:03:48.320 But this person is backed up by the Canadian government. They've been putting out these ridiculous
00:03:54.800 warnings to gay and trans Canadians not to go to the US or go with extreme caution because of things like
00:04:02.480 Ron DeSantis passing a bill where you can't teach gender theory in the classroom.
00:04:06.560 You know, men can't compete in women's sports. Men can't go into women's prisons by identifying as
00:04:12.400 a woman. This is stuff, and the article is going to get to it, that apparently makes it unsafe for not
00:04:17.760 only gay Canadians, trans Canadians to go down to the US, but even for gay and trans people in the US to
00:04:24.400 stay there. They must flee to Canada and they must be allowed to break immigration law. This person could just
00:04:30.960 go over the border every six months and then come back over. But apparently even that is too much of
00:04:35.440 a risk. Somebody from the state of Minnesota run by pro-trans governor Tim Walz. The man is borderline
00:04:44.080 a trans activist, and he is the governor of the state, a Democrat who was the vice presidential pick
00:04:49.600 for Kamala Harris' presidential ticket. Yes, this person is at risk by returning.
00:04:55.760 So let's go down here at the next line. Adrian Smith of Smith Immigration Law, a Toronto firm
00:05:05.120 specializing in LGBTQ immigration, said the federal court justice stopped their client's removal from
00:05:11.440 Canada in part because an immigration officer had failed to consider recent evidence about the
00:05:17.440 conditions in the US for trans and non-binary individuals when assessing the risk of being returned.
00:05:23.360 Had failed to consider recent evidence. What evidence? They can say that Trump is like, I guess,
00:05:31.040 not a trans activist in his demeanor towards the law, you know, like most people aren't. That's not
00:05:36.720 evidence that you cannot remain in the United States. But the article goes on in this one paragraph
00:05:42.960 that's absolutely side-splittingly hilarious. It starts off saying,
00:05:47.120 Justice Julie Blackhawk, the first indigenous woman appointed to the federal court, I don't know why
00:05:53.200 they needed to mention that, but apparently it was relevant, said the immigration officer who carried
00:05:58.480 out Meeks Jenkel's pre-removal risk assessment approach was, quote, flawed and unreasonable,
00:06:05.040 unquote, and relied on outdated briefing material that, quote, does not address current conditions for
00:06:10.640 LGBTQ, non-binary, and transgender persons, unquote, in the US. And no, that was not me stuttering when I
00:06:18.240 was reading that paragraph. That is actually what it says. It is not saying Ms. Jenkels, it is Mx Jenkels.
00:06:29.280 This is why I say it feels like a Monty Python skit that I am reading. It feels like Monty Python and the
00:06:35.600 Holy Grail's knights who say me, but it's me. So we have me Jenkels being allowed to stay in Canada
00:06:43.680 because an immigration officer didn't, I guess, detect that there is a risk of that if she goes back
00:06:51.360 to the United States that Donald Trump's going to try and throw her through a plate glass window,
00:06:55.040 that someone's going to physically attack her for being non-binary in the United States,
00:07:01.280 in a blue state, presumably from a blue city. It's so tiring. Again, this is the publication
00:07:09.200 that intellectual liberals read. Okay, moving on to the next line here. Quote, the officer failed to
00:07:17.360 consider recent evidence of the conditions that may have supported a reasonable fear of persecution,
00:07:22.240 unquote, she said in her ruling, saying that Mx Jenkels deportation must be delayed. People facing
00:07:29.520 deportation from Canada can request a pre-removal risk assessment by immigration, refugee, and
00:07:34.800 citizenship Canada before being sent back. They are generally allowed to stay if they are deemed
00:07:39.520 to be at real risk of persecution or serious harm if they are deported. And as we read more into this
00:07:45.520 article, you'll find out there's no risk at all. The judge is just such a left-wing activist that they
00:07:52.560 probably wanted the headline. They wanted to seem as progressive as humanly possible, so they are
00:07:57.840 letting this person stay in Canada on illegitimate grounds when, again, you can just go over the
00:08:02.640 border and then go back. You are allowed to go from one side of the border to the other every six months
00:08:08.240 in order to actually be allowed to stay in the country. I've done that before, having been in the
00:08:13.120 U.S. for a while, and then just going back over the border so I wouldn't run out of time and
00:08:17.200 you know they penalize you for overstaying uh your you know your uh your allowance to be there on a
00:08:23.360 on a normal trip. But here okay here's the next line again. Mix Jenkel who came to Ontario in 2022
00:08:31.760 as a visitor represented themselves at the risk assessment and was denied the right to remain in
00:08:37.520 Canada. Okay so they were given a proper hearing and then they were denied because their application is
00:08:43.120 absolutely ridiculous. Uh but the article goes on to say they were due to be deported after failing
00:08:48.560 to get the required documentation to stay in Canada with their partner a social media influencer
00:08:53.760 whom they are now engaged to marry. If you're failing to be able to get the proper documentation to stay
00:08:59.280 in Canada you suck at this because it is so easy to stay in Canada based on how wrecked our current
00:09:04.800 immigration system is. But again the article goes on to say Mix Jenkel told the Globe and Mail
00:09:15.200 that the current climate in the U.S. is quote unquote scary and that being non-binary there
00:09:20.080 they are afraid of persecution if they return. So who could guess why this person was denied
00:09:25.680 by the immigration officer when their claim is that they're scared of feeling afraid if they return.
00:09:31.280 They're not saying that they will actually suffer persecution they've ever had a real legitimate
00:09:36.480 threat against them for being non-binary in the United States. They are just saying that it is scary
00:09:43.040 for them because they are afraid which really just feels like they have bought into a lot of left-wing
00:09:49.680 propaganda that they are at risk and so they are they are scared because of propaganda that is not
00:09:55.040 true it's not real that doesn't reflect reality. Again JD Vance, Pam Bondi, Kash Patel, any other
00:10:02.400 Trump official is not going to go after this person. All of the current laws do not put trans or non-binary
00:10:09.120 people at risk. It basically you know usually protects women's spaces, it tries to protect women's
00:10:14.160 sports, it tries to have a real representation of somebody on official documentation that on your birth
00:10:20.480 certificate, on your passport, on your driver's license. It must say what you actually biologically
00:10:26.080 are because it's helpful information for like the police if they ever need to be able to find you for
00:10:32.400 something and it says male when you're in fact female or female when you are in fact male. They're
00:10:37.200 trying to get a good description of you and that's not really self-representation is not helpful for them
00:10:42.400 when they need it to be able to find a missing person or find someone who's a suspect for a crime.
00:10:47.280 But moving on they say they said more people should be paying attention to the erosion of
00:10:54.560 trans and non-binary people's rights in the U.S. quote I also fear not being able to travel to see my
00:11:00.320 family as most of my family lives in the south which has already been deemed unsafe for transgender
00:11:06.160 people to travel and I know that no matter what I do I look trans. People read me that way no matter
00:11:12.160 the gender expression I portray unquote and this is going back to the Canadian government and other
00:11:17.840 governments saying that you can't travel to Florida because Governor Ron DeSantis has passed legislation

00:11:30.320 sensible stuff you can now not travel to Miami Beach as a gay trans or non-binary person because apparently

00:11:52.960 significant trans populations yes you're unsafe in Miami Beach Florida in Miami in general you by the

00:12:10.480 terms of racism the south in the united states these days is the least racist place it is the least likely

00:12:25.200 mix jenkel said that they came out as gender fluid non-binary to their friends and on social media in
00:12:33.920 2015 when they were 14 and to their mother a year later their gender marker was changed in the school
00:12:39.920 system while in high school and they took testosterone as a 15 and 16 year old however their father objected to
00:12:46.160 them taking hormones as a minor and it was dropped abruptly they started hormone therapy again at age 18.
00:12:52.160 well either good for the father good for the father or wanting to defend their child from taking life
00:12:59.840 altering body altering hormones when they were not an adult yet and really shouldn't be making that type
00:13:06.080 of a decision if this is being included as like the persecution that's going on in the south that's

00:15:28.960 has stopped issuing passports and identify and identity cards with an ex-gender marker to transgender
00:15:34.560 and non-binary americans because it's not biologically accurate and the u.s government is not in the
00:15:41.360 business of affirmation they are in fact in the business of cold bureaucracy cold bureaucratic
00:15:48.560 efficiency they are trying to do things not to affirm you but to accurately describe you because
00:15:55.040 they need that for official documents or when they are deciding again what prison you're going to go into

00:16:16.240 longer travel to alberta because alberta premier daniel smith is rightfully implementing a lot of the
00:16:22.400 policies that have been implemented in the u.s you know in favor of parental rights against allowing men
00:16:28.800 into women's sports all stuff like that which is apparently so scary that you can't even travel back
00:16:34.240 to the u.s so apparently this person's at risk even within canada this person has to make sure to
00:16:39.600 avoid ever visiting calgary oh my goodness we're almost done here mr trump has also abolished the
00:16:46.640 u.s government's diversity equity and inclusion departments and has taken steps to exclude
00:16:51.040 transgender people from the u.s military well apparently now nobody who is diverse can go to the
00:16:56.560 u.s because they don't have a federal dei department canadian lgbtq rights advocate activist
00:17:03.440 or advocate jemma hickey has heard from transgender americans who have had their passports shredded or
00:17:09.520 confiscated since trump took office and others who have been too afraid to renew their identity documents
00:17:15.840 why why was it shredded it's almost like the passport is now inaccurate they have not had their
00:17:20.960 passport seized and like in qatar are not allowed to like leave the country they just need to get a
00:17:27.440 new passport within like a month that accurately portrays who they are if anything someone should

00:17:45.600 edicts on trans and non-binary people in her ruling on mixed jenkel's case quote i really applaud the
00:17:51.600 move by the judge and i think it's precedent setting they said well there is so much chaos coming out of
00:17:57.360 the white house and i think it's on purpose this ruling from the judge will force people to pause and
00:18:02.320 reflect uh just how dangerous it is for marginalized people there sarah mikhail from also from smith
00:18:09.200 immigration law in toronto said the judgment is quote a really exciting precedent to see
00:18:13.600 quote what we are seeing here is an important determination from the judiciary that this isn't
00:18:19.760 business as usual and what's happened in january with the inauguration and the chance in uh the
00:18:26.080 change in administration has amounted to a difference in conditions to the safety posed to trans and
00:18:31.280 non-binary individuals and that there is led to a uh deterioration miss mikhail said this quote or
00:18:40.400 quote this is an acknowledgement that these changes are serious and that this is something that has
00:18:45.120 a material effect on trans and non-binary individuals ircc declined to comment as the matter is before the court
00:18:56.000 yeah i could see why the immigration department doesn't want to talk about this because it's
