00:01:37.580A possible referendum question about Alberta separation was part of a special court hearing today.
00:01:42.860At the request of Alberta's Chief Electoral Officer, a judge is now considering whether the question violates the Constitution.
00:01:50.760As Alicia Fielberg reports, experts say this is the latest obstacle in an uphill battle.
00:01:55.820While some wonder whether or not Alberta should separate from Canada,
00:02:00.460the person in charge of Alberta elections wonders whether the wording of a proposed referendum question should even be allowed on a ballot.
00:02:08.300The province's Chief Electoral Officer asked a judge to weigh in on whether or not it violates the Constitution.
00:02:14.600This is nothing more or less than an attempt at delay.
00:02:17.760From our perspective, it's an abusive process.
00:02:19.880For the first time in the history of this province, and probably in Canada,
00:02:23.700Premier and the Minister of Justice, who's a lawyer himself, have decided to direct the elections commissioner on what he should and should not do.
00:02:32.920Well, we don't think that the province is lining up on our side with this matter.
00:02:35.980They're simply saying that there's legislation in place that's clearly intended to have Albertans vote on issues of public importance.
00:02:43.700And that's why Luke Hazek has his own petition underway to ask whether Alberta should remain in Canada rather than separate.
00:02:51.160The vast majority of us want nothing to do with it.
00:02:53.740We want to focus on what's good for Canada and frankly, what's good for Canada internationally.
00:02:58.180Experts say the battle over the possible referendum questions is just a sample of the long, expensive process separation would involve.
00:03:05.400There are exit routes out of Canada, but they would be painful, protracted and unbelievably costly to the people of Alberta in ways that this province has to have a serious conversation about.

00:08:04.040Last week, the chief electoral officer announced that he's referring APP's question to the court of King's Bench in Alberta for a ruling on whether or not that question is constitutional.
00:08:17.880In any event, the chief justice assigned the case to Justice Feasby, who is one of the most knowledgeable constitutional jurists on our Superior Court bench.
00:08:27.360And that case is now going to be heard this Thursday.
00:08:30.460This Thursday, the Eva Chippyuk and Jeff Rapp have been doing amazing work.
00:08:35.080Eva worked through the night a couple nights and they got all their materials filed last Thursday night.
00:08:43.240So this Thursday, there's going to be a court hearing in Calgary where Jeff Rapp and Eva Chippyuk, on behalf of the Alberta Prosperity Project, those lawyers will be arguing that there's nothing to see here.
00:08:53.640This is just a misstep by the chief electoral officer, because how could a question, especially framed like this, potentially violate the Constitution when the Supreme Court of Canada has interpreted the Constitution as providing a mechanism for a province to hold a referendum on a clear question about independence, right?
00:09:12.460Just nonsensical. In any event, the minister of justice for the Alberta government issued a tweet saying that what the chief electoral officer was doing was bureaucratic, was not in keeping with the legislature's intention for the legislation, for the citizens initiative legislation, and that the chief electoral officer should withdraw his application to the court.
00:09:33.200And then the premier jumped in and said she agrees.
00:09:35.820I expect what will happen is the court will say there's nothing unconstitutional about this question.
00:09:40.880I didn't think the court was going to move on it as quickly as they have, so I'm very encouraged by that.
00:09:44.700What if there's some goofy ruling or there's an appeal and it goes to the Court of Appeal and off to the Supreme Court of Canada?
00:09:50.360It's open to the government of Alberta in the next legislative session in the fall, coming up in September, to amend the legislation to remove this goofy section
00:10:01.660that the chief electoral officers that the chief electoral officers relied on and to change the law because they hold the keys to the lawmaking machine.
00:10:08.920The Daniel Smith government and the majority of MLAs that form the government of Alberta, they made this law.
00:10:16.560They recently amended it. They can amend it again.
00:10:18.680So there'd be an opportunity for a legislative solution.
00:10:21.000And if there's enough mischief, then it would also be open at any time for the Daniel Smith UCP government to, through a cabinet order, say, guess what?
00:10:32.460Next spring, we're holding a referendum. And here's the question.
00:10:39.260There's little to nothing that a relevant politician can do to stop the real referendum from taking place in 2026.
00:10:45.780The question posed by the Alberta Prosperity Project is a constitutional one and therefore has much more validity than his sabotage petition.
