00:01:20.680 a lot of conservatives and libertarians across the country

00:01:24.860 is the newly passed hate crime laws.

00:01:28.800 Now, these laws impose minimum jail sentences between 12 months,

00:01:34.140 I understand, for less serious hate crimes.

00:01:36.300 It's saying such as giving the Nazi salute, wild,

00:01:40.160 and six years for those found guilty of terrorism offences.

00:01:44.600 Our next guest, tonight's guest's colleague, John Ruddick,

00:01:47.920 who is more informed about the New South Wales legislation

00:01:52.140 that's currently before the Parliament.

00:01:54.260 Tonight, we have the man himself, Craig Kelly,

00:01:57.520 who has been quite vocal about these new hate crime laws,

00:02:01.460 about the laws themselves and what some of those,

00:02:05.700 I guess, conservative parties that have either voted for or abstained.

00:02:11.220 What we'll do is let's start with unpacking the actual legislation.

00:02:33.360 Yeah, absolutely.

00:02:34.200 Look, I'm somebody that in the last, what is it, 16 or 17 months now,

00:02:40.780 have been attacked viciously, personally, and also, you know, my community.

00:02:49.600 But I look at laws like this and I do not trust the government.

00:02:53.080 I do not think that they're really there to defend me or protect me.

00:02:58.000 And these laws, you know, they feel like a bit of an excuse for a power grab.

00:03:04.440 Let me understand from your perspective,

00:03:06.120 somebody that's really studied the legislation, what is it?

00:03:11.900 What are these hate crime laws?

00:03:13.560 Yeah, look, firstly, we already have laws against inciting violence.

00:03:19.040 We already have Section 18C for better or for worse.

00:03:23.760 For worse, I would argue, but yeah.

00:03:25.600 Now, we had, firstly, I agree with you 100% there.

00:03:29.440 I remember I was elected with Tony Abbott in 2013.

00:03:32.980 And one of the promises was to repeal that legislation,

00:03:35.480 which the Liberal Party squibbed on.

00:03:37.660 But that's another story.

00:03:39.420 Look, we saw that situation up here in Sydney where you had,

00:03:43.500 after those horrific events we saw there at that rock concert

00:03:46.900 or that concert there in Israel,

00:03:49.900 that we had people on the streets of Sydney calling it gas the Jews.

00:03:54.300 Now, that's incitement to violence.

00:03:56.260 Those people should have been arrested.

00:03:57.860 But the police came up with some excuse for no action.

00:04:01.140 So the laws we have to protect against these things already exist.

00:04:06.780 Now, my great concern with this legislation,

00:04:09.240 it goes way above about defining what is a hate crime.

00:04:13.500 Everyone's, no one likes to see what's a hate crime.

00:04:16.140 But it's dependent on what you define it as.

00:04:18.500 And when you look through the wording of that legislation,

00:04:21.200 it gives such a broad brush.

00:04:23.680 It doesn't only protect religious groups or, you know,

00:04:27.480 groups based on their nationality or groups on their sexuality or disability,

00:04:32.520 okay, which we can argue there.

00:04:34.520 And we don't want to see those people discriminated against.

00:04:37.040 But it also extends, one of the protected groups

00:04:39.640 is groups by their political opinion.

00:04:41.560 Now, that simply should not be in that legislation.

00:04:46.260 You've also got the provisions of, it's not just about violence.

00:04:49.640 I should have said against physical violence,

00:04:53.020 but they've included to force and or violence.

00:04:56.480 And that broadens like, where does force come into?

00:04:59.880 There's moral force.

00:05:02.640 There's all types of force that you can apply.

00:05:05.400 Now, Senator Canavan actually moved an amendment

00:05:07.780 to try and fix that, to try and take it out,

00:05:10.840 to ensure it referred to physical force.

00:05:12.660 But that was taken out.

00:05:14.440 And then you've got the provision, again,

00:05:16.520 that this is seven years in jail.

00:05:18.680 And in some of the provisions,

00:05:20.120 they've taken away the discretion of the courts.

00:05:22.460 Now, where you have something like this,

00:05:25.620 that there can be such a wide range of circumstances,

00:05:28.860 from the most innocent breach of the law

00:05:33.540 to someone that's really doing it in an evil type of manner.

00:05:38.940 And yet the discretion about what the sentence should be

00:05:41.860 is taken out of the judge's hands.

00:05:44.660 And then you have the Labor Party that have on there,

00:05:47.340 it's always been a thing of the Labor Party,

00:05:49.000 we do not support mandatory sentences.

00:05:50.440 In fact, it's in their national platform.

00:05:53.580 But because they thought they needed to look tough

00:05:55.520 on this legislation,

00:05:57.040 they ditched that and voted for mandatory sentencing

00:06:00.020 for the judges.

00:06:01.320 So, again, it's another restriction

00:06:05.320 on free speech in this country.

00:06:07.820 We've seen it where they tried to get

00:06:09.580 that missing disinformation bill through Parliament.

00:06:12.300 We've seen it now with the digital ID bill

00:06:15.900 and where you're going to have to,

00:06:17.120 everyone next year, I mean, next year,

00:06:18.440 the E-Safety Commissioner is busily working out

00:06:20.960 how she's going to do this,

00:06:21.860 where every Australian is going to need 0.90

00:06:24.320 to have some form of digital ID

00:06:25.880 to log onto their social media account

00:06:27.940 to prove they're over 16.

00:06:29.480 So with all these provisions going against free speech,

00:06:32.780 to me, the best way to tackle the issue

00:06:34.660 of anti-Semitism is with more free speech,

00:06:39.020 more debate, more open debate.

00:06:41.680 You are not going to fix these issues

00:06:43.040 by sort of brushing them under the rug

00:06:45.000 and allowing them to fester.

00:06:46.560 Bring them out in the open.

00:07:34.200 you know, Jewish lives matter more than free speech.

00:07:37.480 And, you know, nobody pointing out

00:07:40.060 that it was not actually written by a Jew.

00:07:43.320 But it just feeds that conspiracy

00:07:47.400 that somehow, you know,

00:07:49.620 the Jewish community as a whole

00:07:52.560 is fighting to take away people's freedom

00:07:56.420 to either criticize even the conflict

00:08:00.960 between Israel and Hamas,

00:08:03.300 or even the right to be racist.

00:08:06.460 People have that right.

00:08:09.800 And, but more importantly,

00:08:11.980 the Jews just want to take away the freedom 1.00

00:08:15.900 when that's just not the truth.
