Summary

Peter Lavak is a criminal barrister from Sydney who has spent the last 30 years fighting anti-Semitism in the Jewish community. 00:01:34.040 I've prosecuted and defended in over 100 murder trials, not only in Sydney, but also in Hong Kong,
00:01:41.080 where I worked for 18 years. First eight years, a Crown Prosecutor, locking up tried gangsters and killers.
00:01:48.920 Then I switched to private practice, and for 10 years, I was defending tried gangsters and killers.

00:04:48.260 I was born in Prague, Czechoslovakia, just after the war.
00:04:51.880 Czech, I'm Czech.
00:04:52.860 And Dad was, during the war, he was arrested by the Gestapo because he was suspected of being involved in the Czech underground,
00:05:02.940 the resistance movement against the Nazis.
00:05:05.560 He was also suspected of being involved with the wife of a high-ranking German officer.
00:05:12.340 Dad was a bit of a player back in the day.
00:05:14.620 And when they finally released him, it left a lot of mental scars.
00:05:19.280 And then after the Russians came in, the Nazis were defeated.
00:05:24.060 The Russians came in, and in a lot of ways, they were worse than the Nazis.
00:05:28.640 Dad was, again, hauled in for pretty savage interrogation by the Russian secret police
00:05:36.260 because they perceived intellectuals and professionals to be a threat to the communist regime.
00:05:43.640 Dad was a lawyer, so he was perceived to be a threat.
00:05:47.880 So they brought him in for some pretty rough treatment.
00:05:51.140 And when he was finally released, Dad decided it was time to get the hell out of there.
00:05:55.700 So we hired people, smugglers, to get the whole family out.
00:06:00.660 Mum and Dad went first across the Austrian border.
00:06:04.760 Then they hired more people, smugglers, to get me and my young brother out with our grandparents.

00:06:13.460 There was a party of 30 refugees, half a dozen heavily armed people, smugglers.

00:06:51.400 The leader of our party motioned for us all to get down in the tall grass to avoid detection.

00:07:01.980 The leader of our group stood up, pulled out his revolver, pointed, and shot him right in the face, in front of my eyes.

00:07:36.160 Well, eventually, after we got across to Austria, after a couple of months, we ended up in Australia as refugees, and we settled in Sydney, and I grew up in Australia.

00:07:52.840 Now, you've obviously grown up with appreciation and love for this country.

00:07:59.280 A lot of the time, and is that because of the life, why do you have such love for Australia after, you know, obviously, you came here as a refugee, and not all refugees today love Australia as much as you do.
00:08:13.200 So what was it about your experience that made you love it?
00:08:15.900 Well, mate, I love the freedom, the democracy, the ability to get ahead in life, the ability to follow your dreams and your opportunities, which a lot of countries don't have.
00:08:29.280 And Australia's been very good to me.

00:08:36.200 I was a wrestling champion, bodybuilder, surfski champion.
00:08:40.380 I hold a world record for paddling a surfski across the South China Sea from Hong Kong to the Philippines, 1,000 kilometers.
00:08:48.840 We raised $100,000 for Hong Kong orphans doing that.
00:08:53.420 So I've always had a love of sport, physical fitness.

00:09:07.480 I was able to study law, and I'm now practicing law as a high-profile criminal barrister.

00:09:28.380 You say your family escaped from, I guess, the communists at the time.

00:09:36.040 But you worked for many years in Hong Kong.
00:09:38.280 When did you leave Hong Kong?
00:09:39.300 Okay, I left Hong Kong in 2003.

00:09:44.920 That was after the handover to Communist China, the People's Republic of China.
00:09:51.300 Hong Kong was fantastic when I was there.
00:09:53.980 It was the best 18 years of my life.
00:09:56.660 And it all started to change in 1997 when the PRC, People's Republic of China, took it over from the Brits.

00:10:11.100 I hung in for another six years, but I could see the writing on the wall.
00:10:15.820 China promised that the system would remain the same for 50 years, but it didn't.

00:10:28.400 Yeah, because I actually covered the big protests in 2018, 2019, which were quashed by essentially the COVID pandemic, which seemed very convenient for the Communist Party.

00:10:49.100 It's essentially, it's part of China now, which is super sad because even in 2018, 2019, where you saw most of the country out on the streets, there was one protest where there was, they say, I think it was two, what's the population?
00:11:06.920 I'm trying to remember, because I remember it was like one in four, but so it was a quarter of the population was literally out on the streets at this one protest.
00:11:13.320 And it was the most peaceful protest ever.
00:11:15.340 They didn't want to be part of communist China.
00:11:18.080 Was that what you experienced when you were there in those 18 years?
00:11:21.040 Yes, yes.
00:11:21.780 Mate, the Hong Kong Chinese love democracy.
00:11:24.240 And what happened with crackdowns, mate, they started arresting protesters who were holding up signs, pro-democracy placards.
00:11:35.940 They were arresting them, and they were arrested, dragged through the courts and locked up.
00:11:40.840 So what the protesters then did, they were holding up placards that were blank, completely blank, as a symbol of their activism for pro-democracy.
00:11:50.020 The cops started arresting them for holding up blank placards.
00:11:54.920 Those people were arrested and locked up, and they have now completely crushed any remnants of rebellion against the Chinese government.

00:12:06.640 The place has never been the same, and I will never go back.
00:12:09.840 And I think that's like a warning that we should, that the West should heed is, you know, if you don't stand up to the communists, to China, to Russia, to Iran, to North Korea,
00:12:25.080 if you don't stand up to these authoritarian dictatorships, they're going to take over, they're going to spread, because that's really their wish.

00:13:40.360 Tell me, so in your experience, it's a fascinating story, I didn't know it, about how your family got here to Australia and your experience there escaping the commies.
00:13:52.540 You said you, did I hear you correctly, you had a brother with you when you escaped?
00:13:56.360 Yeah, yeah, yeah.
00:13:58.040 I had a little brother, he came with me.
00:14:00.240 I was five years old, he was only three.
00:14:03.180 He was on my grandfather's shoulders for the whole journey, and sadly, he's now dead.

00:16:41.100 Initially, I thought it was a badly bungled, botched investigation by the cops.
00:16:46.540 But once I started looking into it, I realised, no, it wasn't badly bungled and botched.

00:22:54.860 I went there with my personal assistant and a number of members of the Jewish community to vigorously oppose a motion that was put forward by the Greens,
00:23:07.700 which would have effectively allowed pro-Hamas, anti-Semitic, pro-terrorist thugs to spew vitriol and hatred on the beautiful beaches of Manly,
00:23:19.840 the peaceful streets of Manly, which is right in my front yard where I live, and I will not allow that to happen.
00:23:27.760 So what was the motion exactly?
00:23:29.920 The motion, the motion basically, I haven't got the details, but the motion would have given the green light to pro-Palestinian demonstrators
00:23:40.060 to come to Manly and protest with their flags and scream abuse and vitriol, as they have been doing at Hyde Park,
00:23:49.280 as they did on the Opera House stairs, as they've been doing regularly in Melbourne.
