00:05:00.780 idea to protest this event, which is, I'm just going to use my opinion, a horrible thing to do.

00:05:12.480 that the show could go on. My question is, do we have the ability when a protest is rooted in hatred

00:05:19.120 to ticket people and shut this down? How does it work?

00:05:23.140 Well, the police heard what the mayor said, and they literally arrested that man later. His name was

00:05:29.260 Derek Reimer, he's a Christian pastor, and the police literally arrested him because the mayor had a

00:05:37.240 fit that they didn't. So are you surprised that of all the police forces in Canada or frankly around

00:05:44.360 the world, and we have gone to court against police in Toronto, in Montreal, in foreign countries like

00:05:53.000 Australia? We're even suing the RCMP right now. None of those police forces have dared to try to raid us

00:06:01.060 except the crooked cops and Calgary police. Let me show you what arrived in our email box a couple

00:06:08.700 weeks ago, and then I'll give you the latest and tell you why I'm asking for your help. Here's what

00:06:13.660 we received out of the blue. Like I say, it was a secret hearing we weren't invited to. It's called

00:06:21.160 a production order to Rebel News. Whereas I am satisfied by information on oath of Bradley Milne,

00:06:30.900 a peace officer and sworn member of the Calgary Police Service, I have reasonable grounds to believe

00:06:35.960 that the following offenses have been committed. Sexual assault, assault, unlawful confinement,

00:06:40.940 mischief, theft under $5,000, here and after referred to as the offenses, and that the following

00:06:48.380 documents and or data is in the possession or control of Rebel News or their designate relating

00:06:53.640 to incidents at or near Western Canada High School on May 17th, audio recordings, video recordings,

00:07:01.480 and photographs, and are in your possession or control of which will afford evidence respecting

00:07:07.040 the commission of defenses. Therefore, you are hereby ordered to produce a document that is a

00:07:12.900 true copy of said documents or data that are in your possession or control, and B, the document must

00:07:18.880 be produced to, in a readable and usable form, to Bradley Milne. No later than 30 days from the date

00:07:26.340 that this order is served. This order is subject to the following conditions. You have the right to apply

00:07:31.280 to revoke or vary this order. If you contravene this order without lawful excuse, you may be subject

00:07:35.920 to a fine, to imprisonment, or both. Signed, Justice E.J. Tolpanin, Justice of the Alberta Court of Justice.

00:07:47.420 So we received that in the email. That's quite an email to wake up to. Now, obviously, we're against

00:07:56.320 crimes, especially the crimes listed there. But we don't have any secret recordings. We recorded the

00:08:02.940 events in question, and we published them. In fact, we published almost half an hour of footage.

00:09:23.040 over there. Now, you might notice that the police were there. They were there, and they saw everything.

00:09:29.820 They chose not to film the criminals or the criminal suspects because they were too busy abusing

00:09:37.160 the conservatives in the crowd. That's what they do in Calgary. They go after Christian clergy, 0.95

00:09:42.520 especially. So the police were there, and they could have videoed everything. We videoed everything,

00:09:47.320 and we published nearly half an hour of it. But this cop is demanding that we hand over everything.

00:09:55.300 And he's saying that if we don't do it, well, the judge gave him an order saying we could literally be

00:10:00.420 imprisoned. But we don't do that. See, when we go to cover the news, it's critically important that

00:10:08.220 everyone know we're there on our own accord. We're not there as agents of the police. We're not there

00:10:16.040 as snitches or narcs or feds. Now, by the way, I happen to agree with the police in this case

00:10:21.980 that crimes were committed. We showed you that in the footage that we published to the world.

00:10:26.680 We just happen to believe that the police ought not to be able to raid news organizations,

00:10:32.340 whether it's real journalists like us at Rebel News or even government journalists at the CBC.

00:10:37.840 Even those government journalists have enough self-respect to fight back and say to police,

00:10:42.300 no, no, you can't have our work because we are not agents of the state. It's not like we're a

00:10:47.480 closed-circuit TV security camera. We're journalists. We do not work for anyone other than our own

00:10:53.400 viewers and our own consciences. And as I said, we've already published 25 minutes of the crime scene.

00:11:01.080 It makes me think that perhaps this cop actually isn't interested in the crime, but rather finding

00:11:08.740 evidence that the Christian pastors and the other Christian activists here, that they should be

00:11:14.700 charged too. What I've learned over the last few years is that politicians lie, health officials lie,

00:11:21.820 and yes, even the police lie. The police told the judge they wanted the footage for a certain

00:11:29.780 reason, but do you trust that they're not going to actually use our footage for other reasons, like to

00:11:35.600 lay charges against the conservative students or other conservatives there? I don't. But more to the

00:11:41.220 point, I don't work for the Calgary police, and yet they're demanding that we fork over our footage

00:11:46.680 or go to jail. Well, no thanks. We've got a better idea. Here's the letter that our lawyer,

00:11:54.280 Sarah Miller, sent to the Calgary police. Let me read it to you. And by the way, you can find all of

00:11:59.700 these documents at our website, defendrebelnews.com. So here's a letter that our lawyer sent back to the

00:12:06.720 cops about a week ago. Bradley Milne, Calgary Police Service. Dear Constable Milne, we've been

00:12:14.220 retained by Rebel News in response to the production order, which you obtained from the Honorable Justice

00:12:19.020 E.J. Tolpanen on August 2nd. We write first to advise that the production order fails to comply

00:12:25.820 with the criminal code and that the purported service of Rebel News by email fails to comply

00:12:31.320 with the code and Alberta rules of court. As you know, you obtain the production order pursuant to

00:12:37.440 section 487.014 of the code, and it is constrained by section 488. An order under any sections

00:12:46.360 knows that the application relates to a journalist's communications or an object document or data

00:12:53.440 relating to or in the possession of a journalist. They shall make the application to a judge of a

00:12:58.760 superior court of criminal jurisdiction. As you likely understand, the Honorable Justice E.J.

00:13:05.660 Tolpanen is not a judge of a superior court and therefore lacks jurisdiction to issue a production

00:13:10.520 order for journalist communications, documents, or data. Further, pursuant to section 488.013 of the

00:13:17.820 code, a production order for a journalist communications has a different legal test and

00:13:22.740 higher threshold to satisfy. Finally, the court may consider the integrity of journalistic activities

00:13:28.680 and freedom of the press from undue government interference when deciding an application of

00:13:34.080 this nature. Due to non-compliance with the code, as outlined above, we write to ask you

00:13:40.540 to apply to revoke the production order. We take the position that it would be the most efficient use

00:13:47.420 of judicial resources if you apply to Justice Tolpanen to revoke the production order, but as time is of

00:13:52.820 the essence, we have instructions to apply to the court of King's bench to have the production order

00:13:57.340 quashed by a King's bench justice for lack of jurisdiction and will be taking steps to do so

00:14:02.820 immediately. So I think that's pretty plain language, but let me translate it into English

00:14:08.020 from legalese. This cop went to the wrong court. He went to a junior court, let's say, as opposed to

00:14:16.040 the superior court. Well, the junior court doesn't have the power to give such a production order.

00:14:21.400 It's a serious matter reserved for the court in Alberta called the court of King's bench,

00:14:25.860 and a different judge has to do it to a different legal standard. This cop got it wrong, and the judge

00:14:33.080 got it wrong, and so it's illegal. But our lawyer continues because she's pretty smart. Here's what

00:14:38.600 she had to say in the next paragraph. In addition, we put the Calgary Police Service on notice that

00:14:43.500 Rebel News requests notice of any further application that the Calgary Police Service

00:14:47.580 may take, may make to the superior court and request that its counsel be present at the

00:14:53.860 application. Failing notice to us of any further application, we will rely on this correspondence

00:14:58.640 should any further action be required on Rebel News' part to apply to vary or revoke a future production

00:15:04.360 order. At minimum, we expect you to fulfill your duty of candor to the court to let the application

00:15:10.360 justice know of our request for notice and representation. The court may then want to give Rebel News notice of the

00:15:15.760 application or appoint a special advocate for Rebel News pursuant to Section 488 of the code.

00:15:22.080 That means that we want to be there. We have the right, and we have a special right as journalists,

00:15:29.460 to be there in the courtroom when some cop says, yeah, I think I'm going to grab their footage, judge.

00:15:35.480 And we're saying to the cop that we want to be there. And even if this cop goes to the court

00:15:40.960 sneakily by himself again, he'd bloody well better tell the judge that we wanted to be there.

00:15:47.280 And if he doesn't tell that to the judge, we're going to show this letter to the judge

00:15:52.340 showing what a sneaky little weasel this guy is. And here's the last point made by our lawyer,

00:15:58.100 and it's sort of my favorite in a way.

00:16:00.040 Finally, it appears that the only attempt to serve the production order was by email to

00:16:05.320 legal at rebelnews.ca. Email services insufficient under the code or the rules. To our knowledge,

00:16:11.800 the production order was never properly served, and we take the position that even if the production

00:16:15.680 order was issued by the appropriate level of court, which of course it was not, the deadline

00:16:20.660 under paragraph 2b of the production order has not begun to run. We look forward to hearing from you

00:16:25.700 at your earliest convenience. So that was sent over a week ago, and the cop has not replied.

00:16:32.820 So what we have here is a cop who saw 25 minutes of our coverage of a crime being committed,

00:16:40.680 but he wants anything we have that we haven't published. But he's not willing to invite us to

00:16:47.840 the court. He's not willing to have us in court when he orders for it. He's not going to the right

00:16:52.580 court, and he didn't even serve the order on us correctly. I think we got a better lawyer, don't

00:16:57.540 you? Well, we didn't hear back, so we applied to a court. Let me read very briefly. I know I've

00:17:04.920 read a lot of legalese to you, but we went ahead and applied at the proper court, the court of King's

00:17:11.940 Bench, where we're going to ask the real grown-up judge, the big judge, to smack down this smaller

00:17:19.180 court that was acting outside the law. And no offense to the smaller court, they just don't

00:17:24.360 have the authority to do that. It would be like the mayor of Calgary declaring war on a foreign 0.55

00:17:29.400 country. You just don't have the power to do so. No offense. So here's what we applied to the

00:17:34.900 court of King's Bench to say. You can see it's called an originating application. The applicant is

00:17:42.360 us, Rebel News, and the respondents are the Calgary Police Service and the government in general. And

00:17:49.540 we are demanding that we go to court on September 19th at 10 a.m. in Calgary in front of whatever

00:17:57.200 judge there is. And the basis of the claim you can see is, number one, the originating application

00:18:03.340 is brought pursuant to the Alberta rules of court. We seek to declare void the production order authorized

00:18:10.460 by the Alberta Court of Justice. We're a federally registered corporation. We're a media organization.

00:18:17.300 And on or about August 2nd, Constable Milne applied to the Alberta Court of Justice seeking authorization

00:18:23.760 of a production order. And he got it. And it purports to compel Rebel News to provide this cop with audio

00:18:31.980 recordings, video recordings, and photographs. Of course, as Point Six says, he has not served the

00:18:37.460 production order on us. And basically, it puts in official lawsuit form the complaints that we put

00:18:44.040 to the officer himself. Skip down to paragraph 14. Rebel News seeks the following. A stay of the

00:18:52.220 production order. An order quashing and setting aside and declaring void the order. Costs on a solicitor-client

00:19:00.740 basis. If this cop is dragging us through all of this because he doesn't even know how to properly

00:19:06.240 seize documents, he should have to pay our bill. And such further and other relief as this honorable

00:19:12.020 court may deem just. So we are headed to court on September 19th. As you can see, we wrote to the

00:19:20.940 cops and we filed this lawsuit over a week ago. And they have not yet responded in any meaningful way.

00:19:29.600 Today, I asked our lawyer to nudge the other side. For example, given how plainly illegal

00:19:36.020 their production order is, will they consent to having it revoked instead of making us go to

00:19:42.020 court to fight for that. So far, they have refused to do so. We've asked them to share with us the

00:19:48.160 secret information they presented to the judge a month ago to get their sneaky production order.

00:19:54.100 So far, they have failed to do so. There's no guessing why they failed to do so. They are on a guided

00:20:02.020 missile attack at Rebel News. We have fought with police around the country. Right now, we have

00:20:09.020 lawsuits against at least three police forces in Canada alone. And that's just how it is when you're

00:20:15.080 in the journalism business and police rough up your staff. One of the worst days of our entire existence

00:20:21.240 of Rebel News was when the RCMP shot our reporter Alexa Lavoie on the leg with a riot gun. Remember

00:24:59.320 Now, I've spoken with our lawyer as recently as yesterday, and she tells me that we have

00:25:05.420 so far incurred $9,000 in legal fees.

00:25:09.420 I know that sounds astonishing, but we had to do the research on the law, write back to

00:25:14.020 the cops, prepare the application, and we have to get ready for that court case on September 0.98

00:25:24.820 legally wrong, although we'd said, let's not waste the court's time, those fools at the

00:25:29.460 Calgary Police Force have a different mission.

00:25:35.040 So I think we're actually going to have to go to court on September 19th.
