00:09:50.420 cases he does civil cases he's also the guy who's defending dave menzies uh it was actually dave
00:09:58.380 menzies is suing and the rebel news is suing the government the trudeau government because menzies was
00:10:04.760 arrested and bumped quite severely by christia freeland's bodyguards you remember that he was just
00:10:11.160 going up approaching her with a microphone trying to ask some questions in toronto and this bald
00:10:17.040 skinhead guy rcmp security detachment ran right into dave menzies and they hauled him into a paddy
00:10:27.160 wagon took him off the jail and i said at the time you know this is outrageous because i mean are any of
00:10:35.700 us safe and i wrote a column at the time because it means remedia called dave menzies a entertainment

00:12:20.220 and how other people interpreted what they said and lawrence greenspawn said today you can't blame
00:12:27.400 tamara leach or chris barber for the actions of other people you have to judge them on what they said
00:12:35.080 and what they did and they didn't block roads we heard the other day from
00:12:39.520 from diana magus the other lawyer for the freedom convoy she pointed out how chris
00:12:49.880 barber went out of his way to clear the traffic not block it he was working with the truckers
00:12:55.440 to to ensure everybody was safe and not breaking the law again and again and again this comes up in the
00:13:03.360 testimony so so i you're going to have a chance to listen to greenspawn respond to my questions but i
00:13:11.260 just want to make sure i got everything in here because he he says some extremely fascinating
00:13:18.180 things about what this trial was really about and he quoted benjamin franklin for saying that if you
00:13:25.340 don't if you're prepared to sacrifice your liberty for security you don't deserve either
00:13:32.080 or if that's what this is and he says canada has done that in the past and that's what the freedom
00:13:38.840 convoy is all about there are some canadians i think they're a minority now who think yeah crush
00:13:45.640 the freedom convoy because we didn't feel quite secure we like to feel secure we like the government
00:13:50.480 arm around our necks that's how we feel secure and greenspawn saying that's you're not secure and
00:13:58.100 you're not free and you're never going to be free the longer and if the government is allowed to set
00:14:03.020 a precedent with this case none of us are going to be free so let's listen to this interview i think
00:14:07.200 it's very good your summation that disruption is let's get to the beginning here beginning of your
00:14:14.660 summation that disruption is a fundamental component of protest yes and it seemed it seemed to me like
00:14:21.020 the the crown kept thinking that if anybody was inconvenienced in all this that that somehow was
00:14:26.260 unlawful is that is that how you were taking this well that's the the fundamental problem and it's
00:14:31.100 so what was addressed by our court of appeal in trembley and uh like i said from the beginning
00:14:36.220 in a in a battle or a contest between freedom of expression and peaceful assembly both of which
00:14:45.140 are in our charter of rights and freedoms that are constitutionally protected in a battle between
00:14:49.400 those things and uh the right to enjoyment of property which is nowhere to be found in the
00:14:55.300 constitution there is no contest freedom of expression freedom of peaceful assembly which
00:15:01.380 is what this is all about wins every time do you think the auto police services created this crisis
00:15:07.960 because you mentioned the fact that they told them to go downtown to park their cars they didn't issue
00:15:12.400 any parking violations yeah was that a real issue here oh it's a big uh it's a big issue it's it's one
00:15:18.100 of the two things that distinguishes this case from any other of the cases that are before her honor
00:15:22.740 the two things are number one they were told where to go how to get there and where to park
00:15:29.620 and they did that there's no other case out of the hundred cases that the judge had before her
00:15:35.660 where that's been the situation where the authorities have told them go over there park there and uh that's
00:15:42.980 the one thing the other thing of course is that there's justice mclean's orders in which he
00:15:47.360 specifically preserved their right to continue to peacefully assemble and uh he did that in the
00:15:54.240 middle of this demonstration so those two things are are not anywhere found in any of the previous
00:15:59.520 case law and that's why i suspect uh the judge is indicated right at the end that this is an
00:16:04.640 unprecedented situation and my last question at the very end you suggest that this is like
00:16:09.040 as benjamin franklin said people who sacrifice liberty for security and we might end up apologizing if
00:16:15.920 these two are convicted is that how you feel about you know that's it's a trade-off unfortunately that
00:16:22.720 canadians have been historically we've been prepared to trade freedoms for security we've done it over
00:16:29.360 and over and over again we did it to the italian canadians we did it to the japanese canadians we did
00:16:34.400 it to those who were arrested without any rights in uh in the war measures act in 1970 we've done it over
00:16:40.960 and over again and every time we wait a generation or two and then we apologize to those people so my
00:16:49.440 hope is that we won't be apologizing uh if for for anything uh in this circumstance perhaps we can
00:16:58.800 apologize to the people whose bank accounts were were frozen perhaps we can apologize to the people
00:17:04.160 who were arrested under an emergency measures act that should never have been invoked thank you mr

00:17:59.760 what was the point of that so it made gridlock it made traffic congestion the art the ottawa police

00:18:15.280 the secret service in the united states they were incredibly incompetent in this operation and you
00:18:20.080 remember the first chief of police and the and who resigned in the middle of this and then his deputy
00:18:27.520 you know the cue ball who looked a bit like mussolini he took over and then started threatening
00:18:33.280 everybody like we're going to put you all in jail just because we don't like what you're saying
00:18:38.240 absolute insanity but i'm going to read a couple more things from the story i filed today which i say is
00:18:45.040 not up yet but it will be soon sent in a passionate conclusion to a summation of the trial of tamara leach
00:18:50.560 and chris barber defense counsel lawrence greenspawn said it would be wrong to criminalize
00:18:55.680 their behavior meaning chris and tamara in these unique circumstances i want to recite the words
00:19:02.320 from benjamin franklin who said that those who would sacrifice essential liberty to purchase a little
00:19:08.400 temporary safety deserve neither liberty nor safety greenspawn said noting that canada has sacrificed
00:19:15.840 the liberty of other groups in history and ultimately apologized for violating constitutionally
00:19:20.720 entrenched and protected fundamental freedoms that's what he said today
00:19:30.080 he further said the crown seeks to criminalize the words and actions of leaders of a protest a
00:19:35.680 protest in which those leaders consistently urged others to be peaceful and to cooperate with police
00:19:41.760 greenspawn said the final the crown asks that those leaders be held criminally responsible for
00:19:48.800 the actions of unidentified others who were directed into the downtown core of ottawa and they were allowed
00:19:54.960 to stay for a three-week period of time without so much as a single parking ticket being issued to anyone
00:20:00.080 yeah we could have solved this with a few parking tickets but here we are day 44
00:20:05.680 of a mischief trial that should not have ever come gone to court i've said that from day one it should
00:20:11.680 never have gone to court and what what this is is a political show trial i mean yeah it's not original

00:20:24.160 greenspawn declared that this trial is about potentially denying fundamental rights in canada
00:20:28.800 and the crown's efforts to make it a con a contest between constitutionally protected fundamental
00:20:36.560 freedoms and the right to enjoyment of property there is no contest and i will take your honor
00:20:42.560 to the case law that establishes that principle greenspawn greenspawn did so later in his presentation
00:20:48.000 citing examples of rulings upholding the right to protest over any presumed right to enjoyment of property
00:20:53.200 the lawyer said any protest is designed to induce some level of disruption to make a point but causing
00:20:59.520 inconvenience does not make that protest illegal now that i think was the crux of it
00:21:07.600 so here they are this all occurred as a result of a freedom convoy that i covered at the time
00:21:27.520 and i was proud to be there covering and as i said if you watch my episode if you watch me on redacted
00:21:33.440 last night i was talking about this with clayton morris and i said i'm there fighting for their
00:21:39.440 freedom i'm i am there i'm there every day as that i can be reporting the news objectively
