00:01:27.860 And John CARP, the president of the Justice Center for Constitutional Freedoms, was there as the speaker.
00:01:39.060 He had a fantastic message about the Online Harms Act and why it's so bad, why it's so odious.
00:01:46.760 You know, and he really came down hard and heavy against this potential law, this legislation that's going to be worming its way through the House of Commons up towards the Senate.
00:02:00.920 And we have to stop this bill because it's going to put people like myself, others like me, perhaps even you.
00:02:09.180 Out of the social media network. We won't be able to talk. We won't be able to express our opinions.
00:02:17.820 This is a bad, a dangerous, a sickening bill. And it's all about total censorship.
00:02:24.700 And it's, I mean, in addition to the really stupid things about this, putting people in prison for life, for so-called hate speech, for communicating hateful language.
00:02:39.840 Ridiculous. Finding people $70,000 for doing that? Creating another layer of government, another bureaucracy to oversee this whole thing?
00:02:50.100 Having an online censorship czar? This is all foolishness, but it's part of Trudeau's plan to control our lives, to control the speech.
00:03:01.400 Especially leading up to the next election in October 2025. So we have to fight this.
00:03:07.240 I'm glad to say John Carpe is out there fighting this. That's why I went out to his town hall last night to listen to him and to see what he is doing.

00:03:31.160 But before I show you some clips from last night, I'm very happy to see that Conservative Party of Canada leader, Pierre Paulyov,
00:03:42.960 perhaps at my urging, I don't know, because I've been asking him to do this yesterday at the Canada Strong and Free Conference here in Ottawa.
00:03:52.060 He came out strongly against the Online Harms Act, especially that component of it that is essentially going to invent thought crime in Canada
00:04:03.320 and put people under house arrest for what they potentially might say, for the things that they might be thinking,
00:04:13.420 because some snitch of a neighbor doesn't like them and wants to accuse them of thought crime.
00:04:19.880 But it's all true. Listen to what Pierre had to say about this yesterday.

00:04:28.760 You know, this guy, if he read it, if he had read it, in 1984, he would have thought it was an instruction man.

00:05:10.280 I have talked to so many people south of the border, American journalists, American friends who say,
00:05:16.620 you must be kidding. This is like a parody of Justin Trudeau.
00:05:21.640 He can't really be doing this, but he is.
00:05:25.700 And we've got to fight this with all our might.
00:05:28.000 Let's listen to how John Carpe summarizes that component of this bill.
00:05:33.280 The most important things he said last night.
00:05:36.280 And he really went on at length.
00:05:38.340 And he called the thought crime component of this bill the most dangerous.
00:05:43.320 And he had some other choice words for it. Let's listen.
00:05:45.500 The act is going to change the maximum penalty for advocating for genocide, which is a criminal code offense.
00:05:54.280 It's going to be changed from five years to life in prison.
00:05:59.120 Compare that to maximum jail sentence for sexually assaulting a minor, which is 14 years.
00:06:07.360 So, in effect, we've got this legislation that's saying that to advocate for genocide, maximum penalty, life in prison,
00:06:15.620 to sexually assault a child, maximum 14 years.
00:06:20.180 So, we're not even putting murderers in jail for life.
00:06:25.260 But this law, if it becomes a law, would put people guilty of hate speech, whatever that is, in jail for life.
00:06:35.400 Let's listen more.
00:06:37.000 Advocating for genocide is worse than sexually assaulting a child, according to the mindset of this government.
00:06:44.360 The fourth and probably scariest provision is preemptive punishment of people who have not committed any crime.
00:06:52.600 And so, if this bill, C-63, passes, it's going to result in a situation where,
00:06:59.060 if I fear that you are going to commit a hate crime, hate speech, anti-Semitism, whatever,
00:07:06.820 I can file a complaint, and I can force you to appear before a provincial court judge,
00:07:11.580 and I can say that I fear that you are going to say something hateful.
00:07:15.660 And if the judge thinks that I have reasonable grounds for my fear,
00:07:19.300 he can order you under house arrest, ankle bracelet, curfew, abstain from alcohol or drugs,
00:07:26.300 provide blood or urine samples to prove that you're not taking alcohol or drugs,
00:07:30.300 confiscate your, take away your legally acquired, legally owned firearms, if you have any.
00:07:36.860 Those are the conditions the judge can impose on you,
00:07:39.480 because I fear that you might say something hateful in future.
00:07:44.120 I mean, this is terrifying, you know, that you can get these restrictions placed on you,
00:07:54.140 house arrest, curfew, because somebody else fears that you might say something hateful in future.
00:08:01.900 Now, supporters of this bill will say,
00:08:04.780 oh, you know, that'll never happen, don't worry about it,
00:08:07.800 and the judge is not going to grant that, you know, willy-nilly.
00:08:10.220 And you know what, they may be partially correct, but the process is the punishment.
00:08:15.440 Why should I be hauled to court in the first place,
00:08:18.560 based on somebody fearing that I might do something bad in the future?
00:08:22.600 That's not how our criminal law operates.
00:08:25.420 If you've committed a crime, the police is there, the ground prosecutors are there,
00:08:29.080 the judicial system is there, and, you know, we prosecute people if they have committed a crime.
00:08:35.160 You don't place somebody under house arrest because they might commit a crime in the future.

00:10:05.160 This is terrifying, Bill, because the process is the punishment.
00:10:11.520 It's exactly what Freedom Convoy organizer Tamara Leach said to me.
00:10:16.620 As she's gone through nine months of a court trial, the process is the punishment.
00:10:24.360 Even if she is declared innocent, as she should be,
00:10:29.180 she's gone through all of the financial hardship of a trial, of having to hire lawyers,
00:10:36.220 of having to travel back and forth from her home in Medicine Hat to Ottawa.
00:10:40.720 And that's what's going to happen to people accused of hate crimes.
00:10:44.980 There's going to be a legal encumbrance.
00:10:47.940 There's going to be massive dislocation in their life,
00:10:51.140 even if they are deemed to be innocent of all charges.
00:10:57.620 That's very important.
00:10:58.700 I can't emphasize that enough.
00:11:00.960 There's another reason this is an odious piece of legislation
00:11:04.200 that's designed to put a gag on your mouth because you say,
00:11:07.360 well, maybe I'm going to win the court case.
00:11:13.120 But is it worth it?
00:11:15.940 Is it worth risking being charged?
00:11:18.740 Because it puts that chill.
00:11:21.360 It's like a libel chill.
00:11:23.400 Except it's a chill on everything that might offend anybody.
00:11:28.680 Anything that could be deemed hate speech.

00:11:35.160 And don't think they're not going to apply this against political enemies,

00:11:44.800 And that's why we need to keep fighting it.
00:11:47.820 Now, I asked John specifically about what has happened in Scotland,
00:11:52.440 where they have recently passed the hate speech and good order,
00:11:58.880 public order bill, act.

00:12:04.200 And, of course, immediately there was a huge increase in complaints of hate crimes
00:12:13.840 and counterclaims, counteraccusations.
00:12:17.080 So I asked John about this.

00:12:28.260 I wonder if you have any response to what Scotland has just answered.
00:12:33.880 They have issued and passed the hate speech and public order act.
00:12:39.520 And I was speaking to my friend Neil Oliver this week about that.
00:12:43.520 And, of course, he concurs with me that this is a disaster, but the response from the public was fascinating.
00:12:49.680 They had more complaints from both sides, counteraccusations of hate speech, supposed hate crimes,
00:12:57.680 that it's already clogged up the police and potentially the courts.
00:13:02.900 Do you think this is a good omen that it might prove that this is an unworkable law?
00:13:09.820 Not just an irrational one, but an unworkable one.
00:13:13.040 And the second part of my question, do you think we have enough time before the next election, October 2025,
00:13:20.400 the next 18 months, to stop this legislation?

00:13:25.880 Well, you've partially answered your own question.
00:13:28.660 I have not followed the Scotland developments too much,
00:13:31.960 but I've heard the media reports that as soon as it came into force,
00:13:35.720 they were flooded with thousands of complaints, which is probably a good thing to clog up the wheels
00:13:41.600 because it does have a chilling effect.
00:13:44.780 It is applied selectively and politically.
00:13:47.940 And I've seen that over and over again,
00:13:50.060 where depending on who you say the thing about that is offensive,
00:13:57.640 you're going to get prosecuted or not.
00:14:00.720 The next 18 months, I mean, 18 months is a long time in politics,
00:14:04.720 but it's just important to, you know, while this is going on right now,
00:14:09.800 it's not that valuable or effective to complain about legislation once it's been proclaimed into force.
00:14:16.960 I'm not saying it can never be changed.
00:14:18.600 I mean, it can be.
00:14:20.620 But the time to be active on this is now against the Bill C-63, the Online Arms Act,
00:14:28.320 and then C-367, the Religious Defense.
00:14:34.280 There's an old French proverb,
00:14:36.660 if you don't do politics, then politics will be done unto you.
00:14:40.480 I have never heard that particular French proverb before.
00:14:48.200 If you don't do politics, politics will be done unto you.
00:14:53.600 And that's precisely where we are now.
00:14:56.780 We don't fight this legislation.
00:14:58.760 It will become law.
00:15:00.920 And once it becomes law, it's very hard to reverse the process
00:15:06.680 because it suddenly becomes a vested interest.
00:15:09.840 Look at any piece of legislation that was controversial at the time,
00:15:14.060 and it's rarely ever repealed
00:15:17.460 because it suddenly becomes a vested interest for so many people,
00:15:22.000 and it becomes a political hurdle to try to reverse it
00:15:26.180 because you're seen as reactionary.
00:15:27.980 But how is the public reacting?
00:15:32.200 I had a look at a Leger poll this morning before I did this broadcast,
00:15:35.960 and it's quite interesting.
00:15:36.820 This was conducted from March 8th to 10th,
00:15:39.540 1,527 Canadians, about the Online Harms Act.
00:15:45.080 Disturbing results, and don't ever think one poll says it all,
00:15:48.660 but even if one poll says this, I'm disturbed.
00:15:52.140 70% of respondents said they support the government's overall plan
00:15:56.080 to regulate online content.
00:15:58.660 25% said they disagreed with the move.
00:16:02.280 Now, that's a very vague and general question, of course.
00:16:04.620 Yes, everybody may think, or 75% or 70% of Canadians might think,
00:16:09.540 well, it's a good idea to regulate.
00:16:11.740 But what does regulate mean?
00:16:14.360 Only 41% of respondents said they believe the legislation
00:16:18.680 will actually create safer online platforms,
00:16:22.980 including making it safer to remove sexual abuse images.
00:16:30.560 When asked if they trust the federal government
00:16:33.040 to regulate online content in a way that protects individual free speech,
00:16:37.980 only a small minority, 10%, said they completely trust the government.
00:16:43.160 Another 33% answered they somewhat trust the government.
00:16:47.920 27% said they do not trust the government at all,
00:16:53.000 while 23% answered they barely trust the government.
00:16:56.640 And only 17% of those respondents said,
00:17:00.600 Justin Trudeau and the Liberals can be trusted.
00:17:05.140 So there's good news and bad news here.
00:17:08.340 But as usual, if you give the Canadians the questions you want them to answer
00:17:14.720 in the affirmative, they will answer it that way.
00:17:17.820 I think if we show and demonstrate how dangerous this legislation is,
00:17:25.540 and we need to work hard to educate the public right now about this,
00:17:30.880 we're going to have a massive majority of Canadians saying no.
00:17:36.660 And there's another facet to this.
00:17:39.200 John Carpe, unfortunately, wasn't entirely aware
00:17:42.220 of the ramifications of this aspect.
00:17:44.940 But I'm increasingly becoming aware of it.
00:17:48.580 And that's one of the facets of this bill.
00:17:51.240 We'll penalize, financially punish social media platforms
00:17:56.560 for material that the digital czar, the online censorship czar,
00:18:03.340 and the regulatory body deems to be hateful.
00:18:08.760 It's between 8% and 10% of their gross revenue.
00:18:13.420 So that's millions, potentially tens of millions,
00:18:18.180 in some cases perhaps hundreds of millions,
00:18:20.860 of dollars in fines.
00:18:24.320 So what do you think the reaction is going to be
00:18:27.040 from Facebook, Meta, X,
00:18:32.160 all the social media platforms that we enjoy right now?
00:18:38.140 Are they going to say to hell with Canada and its Online Harms Act
00:18:43.760 because we can't afford it?
00:18:46.360 Or we just don't want to lose that much money?
00:18:50.960 That's again the chill effect of this law.
00:18:54.580 We could lose access to internet, to social media.
