00:00:00.000 On Monday morning, New York Daily News race-centric columnist Sean King posited a new change to the Constitution to oust Donald Trump.
00:00:06.000 He tweeted, quote,
00:00:15.000 And then he also tweeted, What other ways exist for the American people to legally oust an unethical president?
00:00:20.000 Impeachment only?
00:00:22.000 We have long since crossed a point where real Donald Trump is so dishonest, so unethical, that it is truly dangerous for our democracy.
00:00:28.000 In layman's terms, what would it take for the USA to pass a constitutional amendment for a president recall like California has for governor?
00:00:37.000 Apparently, Sean King was too busy tweeting to read the Constitution.
00:00:40.000 You know, the document that answers this exact question many, many times.
00:00:44.000 Impeachment is the only constitutional way of ousting a sitting president, of course, unless Trump is declared mentally unfit for office under the 25th Amendment by the VP and a majority of cabinet officers, or of such other body as Congress provides by law.
00:00:55.000 But our constitutional system was designed to avoid the instabilities of parliamentary democracy, with its constant votes of no confidence, its constant elections, its shifting governmental powers.
00:01:05.000 As for revisions of the Constitution, the Constitution also sets out how amendments work, but that would require, you know, actually reading things.
00:01:12.000 It would also require Donald Trump to do something so bizarre that VP Pence or House Republicans had no choice but to initiate Trump's ouster.
00:01:19.000 He hasn't.
00:01:20.000 The left's hysteria right now is so over the top, they can't even wait for Trump to implode for him to become unfit in their eyes.
00:01:25.000 He was unfit the day he won.
00:01:27.000 Here's the truth.
00:01:28.000 Trump's Twitter feed is not a threat to the Republic.
00:01:31.000 His rhetoric may not be good for civil discourse, but
00:01:33.000 That's nothing new.
00:01:34.000 President Obama spent the last eight years undermining civic discourse in a far more sophisticated way than Trump does with his 140-character blasts.
00:01:41.000 And Obama undermined faith in the government far more than Trump has, which is how Trump was able to sweep into the White House on the back of popular discontent.
00:01:48.000 The left can keep dreaming that Trump will just disappear, or they can deal with reality.
00:01:52.000 So long as they do the former, Trump will keep winning.
00:01:54.000 It looks like Trump's winning streak will probably continue on that basis.
00:01:57.000 But just as importantly, the left's lack of care about basic civics is one of the reasons politics breaks down.
00:02:03.000 Our system is actually pretty durable.
00:02:04.000 The founders created it that way.
00:02:06.000 But the left doesn't care about the system, which is why the executive branch continues to accrue power.
00:02:10.000 Civic ignorance leads to populism that favors powerful demagogues.

00:04:12.000 Donald Trump tweets lots of stuff.
00:04:14.000 And the stuff that he tweets is usually coming straight out of his butt, okay?
00:04:18.000 Donald Trump just sees stuff on TV and then he tweets it.
00:04:20.000 And that's not the end of the world.
00:04:21.000 It doesn't mean he's a bad president.
00:04:23.000 It doesn't mean he will be a bad president.
00:04:24.000 It means that he uses Twitter as some sort of diarrheic format for him to just spew out his thoughts.
00:04:29.000 And sometimes that's actually really useful because his thoughts are useful.
00:04:32.000 And sometimes his thoughts are not.
00:04:34.000 But to pretend that every tweet, and this is what the media is doing, to pretend that every tweet that Donald Trump sent is some sort of reflection of internal Donald Trump administration policy or reflects the best available intelligence.

00:04:47.000 So here's what happens.
00:04:47.000 Donald Trump sends a series of tweets on Saturday morning.
00:04:50.000 He's all mad because he saw a story in Breitbart that was basically a synopsis of all of the various actions taken by the Obama administration and the DOJ in the run-up to the election.
00:05:01.000 And after the election, with regards to sort of the deep state going after Donald Trump, and here's what he tweeted.
00:05:06.000 He tweeted, And then he tweets, let me find the exact text, because it's hard to see here a little bit.
00:05:09.000 He says,
00:05:32.000 I bet a good lawyer can make a great case out of the fact that President Obama was tapping my phones in October, just prior to election.
00:05:37.000 He said, how low has President Obama gone to tap two Ps, my phone, during the very sacred election process?
00:05:42.000 This is Nixon Watergate, bad or sick guy.
00:05:45.000 And so he tweets all this out, and everybody loses their mind, right?
00:05:48.000 And then, like an hour and a half later, he tweets out, Arnold Schwarzenegger isn't voluntarily leaving The Apprentice.
00:05:52.000 He was fired by his bad, pathetic ratings, not by me.
00:05:55.000 Sad end to great show.
00:05:57.000 The reason I add that last tweet is because this is how Donald Trump tweets, gang.
00:06:01.000 Okay, just get used to it.
00:06:02.000 Donald Trump is not tweeting the best available intel available from his intel community.
00:06:06.000 He's not tweeting government secrets.
00:06:08.000 He's tweeting whatever comes into his head, which I kind of like in some ways because it means we know what he's thinking.
00:06:13.000 And in some ways I think, well, he's the president, he probably shouldn't be doing that.
00:06:16.000 But this raises a bunch of questions, so everybody loses their mind.
00:06:19.000 So we'll answer the first question first.
00:06:21.000 The first question is, is Donald Trump correct?
00:06:24.000 Is, in fact, did Obama order him to be surveilled?
00:06:28.000 Did Obama order his wires to be tapped?
00:06:30.000 So, that specific charge is wildly overblown.
00:06:34.000 That specific charge is wildly overblown.
00:06:36.000 Marco Rubio was on one of the TV shows and he says that he's not sure exactly what Trump is talking about here.
00:06:41.000 President Trump made this very serious allegation.
00:06:43.000 You're on the Senate Intelligence Committee.
00:06:45.000 Do you have any evidence at all to suggest that President Trump is stating something factual here?
00:06:51.000 By that you mean the tweet yesterday about the President Obama?
00:06:55.000 Yes.
00:06:56.000 Yeah, so obviously I have no... I'm not sure what it is he is talking about.
00:07:00.000 Perhaps the President has information that is not yet available to us or to the public.
00:07:05.000 And if it's true, obviously we're going to find out very quickly.
00:07:08.000 And if it isn't, then obviously he'll have to explain what he meant by it.
00:07:11.000 So I don't...
00:07:13.000 I'm not sure what the genesis of that statement was.
00:07:16.000 Okay, so not a ringing defense from Senator Marco Rubio.
00:07:18.000 Then, Martha Raddatz has on Sarah Huckabee Sanders, who's another one of these spokespeople for the president.
00:07:24.000 She is not good at her job.
00:07:25.000 Here's Martha Raddatz grilling her over Trump's tweets.
00:07:28.000 Sounds like the White House is really doubling down on what President Trump says happened.
00:07:34.000 As we should, Martha.
00:07:34.000 If this happened, once again, this would be the greatest abuse of power and overreach that's probably ever occurred in the executive branch.
00:07:43.000 It's something that certainly deserves to be looked at.
00:07:45.000 But what about the accusation?
00:07:46.000 You just keep saying, if, if, if the President of the United States said it was a fact,
00:07:53.000 He didn't say, I read a story in Breitbart or the New York Times or wherever else.
00:07:59.000 He said, just found out that Obama had my wires tapped in Trump Tower.
00:08:05.000 That's not an if.
00:08:07.000 Look, I will let the President speak for himself, but in terms of where we are in the White House, our ask... You're his spokesperson.
00:08:16.000 And I'm speaking about it right now.
00:08:18.000 But you're backing off of it.
00:08:20.000 You're backing off of what President Trump said.
00:08:21.000 How am I backing off of it while I'm saying that I think that this happened and I think that the American people have a right to know?
00:08:26.000 And I think that we should get definitive answers.
00:08:29.000 I think we need to put out hard facts that show that this happened.
00:08:33.000 I think we need to- well, then do it.
00:08:36.000 And this is the problem.
00:08:36.000 Okay, so James Comey, who's now- the left loves James Comey.
00:08:39.000 So basically, James Comey just bounces around between being loved by various political parties.
00:08:43.000 When he says that Hillary didn't commit a crime, then he's the best FBI director ever, according to the left.
00:08:47.000 Then, he says that we've reopened the investigation into Hillary's email, and he is the worst person ever!
00:08:52.000 And then, a week later, he says, well, we closed that, and then he says, oh, well, I guess he's okay.
00:08:56.000 And now he's ripping on Trump, saying that this never happened, that Obama never ordered the DOJ to wiretap Trump, and suddenly he's everybody's friend again.
00:09:03.000 Everybody looooves James Comey, right?
00:09:06.000 He's just the best!
00:09:07.000 Everybody loves James Comey.
00:09:09.000 And then, you know, and then you have people responding to James Comey, saying, so here's Kellyanne... Here's a White House spokeswoman, it's again Sarah Huckabee Sanders, this morning, saying that Trump doesn't believe Comey when Comey says that Obama didn't wiretap him.
00:09:23.000 ...asked by Sarah Huckabee Sanders, spokesperson for the president.
00:09:26.000 Sarah, thank you for joining us this morning.
00:09:28.000 So we now know that the FBI director has told the Justice Department that President Trump's explosive claims are inaccurate.
00:09:35.000 Does President Trump accept the FBI director's denial?
00:09:39.000 You know, I don't think he does, George.
00:09:40.000 I think he firmly believes that this is a storyline that has been reported pretty widely by quite a few outlets.
00:09:48.000 The wiretapping has been discussed in the New York Times, BBC, Fox News, and we believe that it should be looked at by the House Intelligence Committee.
00:09:55.000 Sarah, I have got to stop you right there.
00:09:57.000 Every single article you just mentioned does not back up the President's claim that President Obama had him wiretapped.
00:10:04.000 Not a single one of those articles backs that up.
00:10:07.000 So what is the President's evidence?
00:10:09.000 It does back up the fact that the administration was wiretapping American citizens.
00:10:15.000 There was a wide reporting suggesting that his administration, whether it was directly ordered by this president specifically, his administration could have done that.
00:10:24.000 Okay, so there's a lot of wiggle room here now.
00:10:26.000 I'm going to get to the wiggle room in a second and the fact of what actually happened here, but...
00:10:30.000 But here's the reality of what basically happened.
00:10:32.000 Donald Trump read some reports.
00:10:34.000 He then did a very summarized version of those reports that was not quite accurate, and then the media blew up with it.
00:10:40.000 And so every scandal basically follows this pattern.
00:10:43.000 Every scandal basically follows this pattern for the left, okay?
00:10:47.000 Donald Trump tweets something.
00:10:48.000 It is not accurate, but it has a connection to reality, right?
00:10:51.000 This is how Trump operates.
00:10:53.000 He says something that's not quite accurate, but it has a connection to reality.
00:10:56.000 The left goes, that's false, and it has no connection to reality.
00:10:59.000 And then the right says, no, but it does have a connection to reality.
00:11:02.000 And then the left says, you're all liars.
00:11:04.000 It's fake news.
00:11:05.000 And the right goes, but it's not fake news because you know what?
00:11:07.000 Obama was involved.
00:11:09.000 His administration was involved in asking FISA courts for wiretaps on people related to the Trump campaign.
00:11:14.000 And then we just repeat the cycle.
00:11:15.000 So basically you end up with one side saying everything Trump ever said is a lie, and the other side saying everything Trump ever said was true, when the truth is that Trump says really silly things on Twitter all the time that are summaries of a reality that is a little exaggerated, and then the left says nothing he ever says is true, which is also really silly and really stupid.
00:11:32.000 So basically, it's a bunch of stupid people hitting each other with clubs.
00:11:34.000 That's basically the news today.
00:11:36.000 And is this the end of the republic?
00:11:38.000 Is this crazy?
00:11:38.000 No, it's not.
00:11:39.000 But the media are treating it like it's the end of the republic.
00:11:41.000 Look at Mika Brzezinski just losing her ever-loving mind over this.

00:12:22.000 Did you think that you were talking to the king of accuracy, Donald Trump?
00:12:26.000 Who did you think you were yucking it up with this entire time, Mika?
00:12:30.000 Unbelievable!
00:12:31.000 Okay, so, now we're actually going to get to the facts.
00:12:32.000 So, when I say that what Trump tweeted is not true, but it has a tenuous relation to reality, that is accurate.
00:12:38.000 There is no evidence that Barack Obama directly ordered a wiretap of Trump Tower and Donald Trump particularly.
00:12:44.000 Okay, that is not true.
00:12:45.000 Here is what is true.
00:12:47.000 Okay, National Review.
00:12:48.000 To summarize, this is Andrew McCarthy.
00:12:50.000 To summarize,
00:12:51.000 Reporting indicates that prior to 2016, the Obama Justice Department and FBI considered a criminal investigation of Trump associates, and perhaps Trump himself, based on concerns about connections to Russian financial institutions.
00:13:02.000 Preliminary poking around indicated that there was nothing criminal involved.
00:13:05.000 But rather than shut the case down, the Obama Justice Department converted it into a national security investigation under the FISA Act.
00:13:13.000 Okay, FISA allows the government, if it gets court permission, to conduct electronic surveillance, which could include wiretapping, monitoring of email, and the like, against those it alleges are agents of a foreign power.
00:13:22.000 FISA applications and the evidence garnered from them are classified.
00:13:26.000 We would not know about any of this unless someone had leaked classified information to the media, which is a felony.
00:13:30.000 James Barrett over at Daily Wire, he says, According to multiple reports during the 2016 campaign, the Obama administration allegedly submitted two requests with the FISA court targeting Trump or those associated with him.
00:13:41.000 The first, submitted in June 2016, was reportedly a request to monitor several of Trump's associates.
00:13:46.000 The request was denied.
00:13:47.000 The Obama administration then allegedly submitted a second FISA request in October focused on the computer server in Trump Tower.
00:13:54.000 Which they suspected had some connections to Russian banks.
00:13:57.000 That request was granted, but nothing was found.
00:13:59.000 And then there were some reports that the wiretaps of that computer continued nonetheless.
00:14:04.000 Heat Street reported something similar on the issue.
00:14:07.000 So, we really don't know the extent of the wiretaps.
00:14:09.000 We know that the FISA court refused one application and granted another, or at least that's the report.
00:14:16.000 We also don't know whether those wiretaps were trained at Trump's associates.
00:14:21.000 They weren't trained at Trump himself by any of these reports.
00:14:23.000 None of these reports say Trump himself was tapped.
00:14:24.000 So we also don't know if the information is being gathered because we were wiretapping Russian sources and we caught Mike Flynn on the line talking with the Russians.
00:14:31.000 So in other words, there's a lot of information that the intelligence community was concerned with the connections between Trump and Russia.
00:14:38.000 But the idea that Obama himself was dictating from top down that this is the case, that you have to follow Trump and you have to dig all this up,
00:14:45.000 Not any evidence of that, but by the same token, can you trust any of the people who are saying that?
00:14:51.000 This is my biggest problem.
00:14:52.000 My biggest problem with all of this is that the left keeps saying stuff like, what's the big crisis here?
00:14:56.000 Let's just stop there for a second.
00:14:57.000 What is the big crisis here?

00:16:55.000 But what they're saying is this undermines the foundations of democracy.

00:17:08.000 All of the people who are currently denying that anything happened from Obama, all of those people can't be trusted.
00:17:13.000 So, for example, James Clapper was the Director of National Intelligence under President Obama.
00:17:18.000 And here is James Clapper talking about how he ordered no wiretap of the Trump campaign.
00:17:23.000 This idea that maybe President Obama ordered an illegal wiretap of his offices.
00:17:28.000 If something like that happened, would this be something you would be aware of?
00:17:32.000 I would certainly hope so.
00:17:35.000 Obviously I can't speak officially anymore, but I will say that for the part of the national security apparatus that I oversaw as DNI, there was no such wiretap activity mounted against the President-elect at the time as a candidate or against his campaign.
00:17:54.000 I can't speak for other Title III authorized entities in the government or a state or local entity.
00:18:02.000 I was just going to say, if the FBI, for instance, had a FISA court order of some sort for a surveillance, would that be information you would know or not know?

00:18:14.000 So he's saying none of this ever happened, this is all nonsense.
00:18:17.000 Okay, I would believe him except for the fact that here's what James Clapper had to say in 2013 in front of Congress under oath.
00:18:23.000 So, what I wanted to see is if you could give me a yes or no answer to the question, does the NSA collect any type of data at all on millions or hundreds of millions of Americans?

00:18:39.000 It does not?
00:18:42.000 Not wittingly.
00:18:44.000 There are cases where they could inadvertently, perhaps, collect, but not wittingly.
00:18:50.000 Okay, that is called perjury, what you just saw there.
00:18:53.000 And that guy is out there on TV telling you that you ought to believe him now.
00:18:56.000 James Comey is saying you ought to believe him now.
00:18:57.000 Really?
00:18:58.000 Which version of Comey did we believe during the election?
00:19:01.000 The pro-Hillary version or the anti-Hillary version?
00:19:03.000 Nobody knew.
00:19:04.000 Okay, here is the reality.
00:19:05.000 A lot of this is based, what Trump is basing this on, is Mark Levin did a good job on Friday of laying out all of the various attempts by the Obama administration to basically surveil members of the Trump campaign.
00:19:18.000 Here's Mark Levin doing the same thing yesterday on Fox News and explaining the case.
00:19:23.000 And it's a pretty solid case, what Levin says here.

00:20:17.000 This isn't me.
00:20:18.000 They say the first FISA request, sources say named Trump, was denied back in June, denied by the court.
00:20:25.000 But the second... ...out earlier, all these facts are publicly reported, publicly available, and we don't, excuse me, know what's true.
00:20:32.000 And what's not true at this point.
00:20:34.000 So, again, let me lay out the chain of events here.
00:20:37.000 Donald Trump tweets something that isn't true but has a connection to reality.
00:20:40.000 The left says it has no connection with reality.
00:20:42.000 The right says, wait, no, it has some connection with reality.
00:20:45.000 Plus, he's making a bigger point, and the bigger point is true.
00:20:47.000 And the left goes, the bigger point isn't true and it has no connection to reality.
00:20:52.000 Okay, many things can be true at once.
00:20:54.000 The Obama administration could not be trusted.
00:20:56.000 The Obama administration clearly had information on Trump and Russia, or wanted to gather information on Trump and Russia, and now they're saying they can't even find any real connection.
00:21:07.000 They were pushing this story, I mean it was being leaked out at the time almost, and so the fact that they're saying now that nothing ever went on that was illicit is not trustworthy.
00:21:17.000 So when people say Trump is the one who's quashing the public trust, no.
