00:40:38.000 Okay, that brings us to what actually happened yesterday in the preliminary hearing for Tyler Robinson, the alleged murderer of Charlie Kirk.
00:40:48.000 So it turns out that Erica and Charlie's parents have asked all evidence in court to be shown publicly.
00:40:55.000 So clearly, if they're engaging in a cover up, it's the world's weirdest cover up because they want everything.
00:40:59.000 To actually be shown publicly, which is typically not what happens when you're looking for a cover up.
00:41:05.000 According to Andrea Burkhart reporting, for 10 months, the victim's family has waited for this preliminary hearing.
00:41:10.000 Erica Kirk, the widow of Charlie Kirk and his grieving parents traveled to this courtroom for one reason.
00:41:14.000 This is their court filing to be present at these proceedings and to bear witness to the evidence concerning the death of their husband and son.
00:41:20.000 At certain points throughout the preliminary hearing, the Kirk family sat in the room while evidence was admitted but not presented for their viewing.
00:41:26.000 They were present in body that denied the very thing their presence was meant to secure, their ability to meaningfully observe the preliminary hearing.
00:41:33.000 And again, they say that they just want everybody to be able to see the evidence.
00:41:39.000 Their filing says, in the absence of transparency, speculation and conspiracy theories related to the tragic assassination of Mr. Kirk will continue to proliferate in the public domain, breeding doubt and distrust in the judicial system, which, of course, is a reference to Candace and her cronies.
00:41:54.000 Well, Tyler Robinson's defense, they thought that it would be a good time to dig at Erica Kirk and Charlie's parents.
00:42:03.000 And I want to point out to the court, Ms. Kirk has been very adept at holding press conferences at which she has revealed evidence.
00:42:11.000 She has represented that the state is her attorney.
00:42:16.000 She has access to all the evidence that the state has publicized and that the media and her own lawyer argues is already in the public domain.
00:42:27.000 So they're perfectly free to go outside this courtroom under the court's protective order.
00:42:33.000 They're free to go out and hold press conferences and announce to the world outside the courtroom what they think the evidence is.
00:42:41.000 The availability of that evidence.
00:42:43.000 But the court's role, I think, at some point is to exercise some control, move the case forward, especially when we have witness availability problems.
00:42:53.000 And so, again, what the attorneys are trying to do on the defense side are basically attack Charlie's family and suggest that something untoward has happened because they're talking about the case publicly.
00:43:01.000 Well, the evidence has been public for quite a while in this particular case. 0.73
00:43:05.000 So, Tyler Robinson's defense, one of the things you'll notice is that they're not using any of the ridiculous material that Candace Owens has tried to present to exonerate Tyler Robinson because it's Just ridiculous and specious.
00:43:15.000 Instead, what they're trying to do is suggest that the Kirk family should not be talking about this case outside of court.
00:43:21.000 But the actual presentation of evidence yesterday in court, and remember, it's a preliminary hearing.

00:43:26.000 This is just to show that there is a colorable case sufficient to overcome the possibility of reasonable doubt.
00:43:32.000 Okay, so some of the evidence that was presented was Lance Twiggs, who is the trans boyfriend of Tyler Robinson, left a note under his keyboard.
00:43:44.000 Twiggs confirms that Robinson left a note under his keyboard that admits to everything.
00:43:49.000 Do you recognize that on the screen there?
00:43:55.000 Yeah.
00:43:57.000 What do you recognize it as?
00:43:59.000 That was the note under his keyboard that he was referring to in the first text of that chain.
00:44:06.000 So, where did you find this?
00:44:08.000 On his desk, underneath his computer keyboard.
00:44:13.000 The note, by the way, read I had the opportunity to take out Charlie Kirk, and I'm going to take it.
00:44:19.000 Okay, and then again, the way this worked was it wasn't a full scale interview of Lance Twiggs.
00:44:23.000 Lance Twiggs, instead, it was about a 20 minute tape that was played of Lance Twiggs in court.
00:44:27.000 Well, in the tape, Twiggs says that he talked with Robinson the day after, and Robinson started crying and saying that he wishes he hadn't done it.
00:44:37.000 So he acted erratically.
00:44:39.000 Was he pacing?
00:44:42.000 Was he just sitting down, relaxing?
00:44:44.000 No, he was walking around a lot, and that's within the home.
00:44:48.000 Mm hmm.
00:44:51.000 And did he talk about what he had done?
00:44:55.000 I didn't go into detail.
00:44:57.000 I just asked him in person if what he said was true the night before, and he said it was.
00:45:04.000 I started crying a little bit and said he wishes he hadn't done it.
00:45:10.000 And then Twiggs said in the tape as well that Robinson said he was going to turn himself in.
00:45:14.000 Of course, you saw the tape yesterday, we showed it on the show, of him moving toward the police station to turn himself in.
00:45:23.000 And then eventually said that he would talk to his parents or turn himself over.
00:45:30.000 And when you left, was that how you left understanding that he was going to turn himself in or go to his parents' house?
00:45:37.000 Yeah.
00:45:40.000 Twiggs also testified that Tyler Robinson had asked him for a tool to engrave bullets.
00:45:46.000 This is about a month before the shooting.
00:45:49.000 The Dremel that you talked about, you said he had asked for that.

00:45:55.000 And had he told you it was to inscribe bullets?

00:45:59.000 And so did you have a Dremel then?

00:46:21.000 Okay, so Jen Faumoyna, who is a sergeant with the State Bureau of Investigation, explained the photos of Robinson's engraved bullets and what was on them.

00:46:34.000 And what position was this in in the gun?
00:46:38.000 This was the, or this is what was in the chamber.

00:47:53.000 According to Fox's Matt Finn, Tyler Robinson, the alleged murderer, was squirming when the rifle and his texts were displayed.
00:48:01.000 When they got to the point discussing the rifle that was used, Tyler Robinson was squirming, apparently uncomfortable, swinging in his chair, scratching his nose.
00:48:11.000 He looked uncomfortable with the texts that were being discussed.
00:48:16.000 Now it turns out that pretty much all of these facts were in evidence within the very first days.
