00:01:58.000In order for you to advance an argument, you have to have the credibility to advance that particular argument.
00:02:02.000Are you ever going to believe anyone in Biden land again when they say that Joe Biden is fit for the presidency?
00:02:07.000There's no possible way, especially when the DOJ dominated by Joe Biden is refusing to turn over the six hour tape of Joe Biden being interviewed by Special Prosecutor Robert Herr.
00:02:16.000They keep that tape away from you because they know that it will show the exact same thing that you saw in that debate.
00:02:22.000So that means you're not going to believe anyone in the Biden campaign when they say that Joe Biden is fit for the presidency.
00:02:27.000Remember, the case for Joe Biden being in the presidency is not the case for him being in the presidency today, which is a shaky case as it is.
00:02:34.000It is a case for him being in the presidency in five years, in five years, when he is 86 years old.
00:02:42.000The high likelihood is he certainly will not be sentient and he may very likely not be alive by that point.
00:02:48.000So a vote for Joe Biden is a vote for Kamala Harris and we all know it.

00:02:55.000If you thought they'd not blown out their credibility over the Russiagate hoax, or over BLM, or over the 2020 COVID coverage, they've certainly blown their credibility over the most obvious lie they have ever told.

00:03:10.000They told the lie that Bill Clinton was an upright citizen who never would shtup his employees.
00:03:15.000They told us the lie, obviously, during COVID, that you had to stay in your homes ad infinitum, indefinitely, in order to protect everybody around you.
00:03:24.000They told us the lie that if you're rioting for BLM during that lockdown, that somehow the virus was non-contagious, right?
00:03:30.000They've told lots of lies, but all of those lies remain bizarrely somewhat arguable in the public mind.
00:03:36.000The media have such extraordinary power in the American body politic that they can promote a lie, and even after the lie is debunked, they can continue to promote the lie.
00:03:43.000So for example, when Michael Brown was shot in Ferguson, Missouri, It became perfectly obvious from both the local investigation and the federal investigation that he was shot justifiably by a cop.
00:03:53.000Today, today, in 2024, a decade later, Democrats will still tell you that Michael Brown was a martyr of BLM.
00:04:00.000And there's a huge percentage of the population that still believes that nonsense.
00:04:03.000In other words, just because the lie is a lie doesn't mean that the debunking of the lie takes hold in the public imagination.
00:05:00.000That means that Joe Biden, every clip of him from here until the election that shows him doddering around, there'll be a lot of them, is going to be fodder for the American body politic.
00:05:11.000And no amount of denial, no amount of, it's cheap fakes, it's out of context, is going to make us believe that anymore because we all saw it live for 90 minutes.

00:05:38.000A recent Business Insider article keeps saying Americans are to blame for the dumpster fire economy because of our bad perception or something.
00:07:21.000Making sure that we're able to make every single solitary person eligible for what I've been able to do with the COVID, excuse me, with dealing with everything we have to do with, look, if Folks, it's right in front of your eyes.
00:07:52.000The answer is because they got completely pantsed by Joe Biden.
00:07:54.000They're angry at Joe Biden for pantsing them.
00:07:56.000They figured that they could maintain this lie and Joe Biden's behavior would not fully expose the lie until it was too late for the American people to do anything about it.
00:08:03.000Everyone in Democrat land knew that Joe Biden was diminished.
00:08:06.000The entire media knew he was diminished.
00:08:09.000Everyone in the White House knew he was diminished.
00:08:11.000But they figured, okay, we can somehow pull the wool over America's eyes.

00:08:20.000He'll barely get into the White House.
00:08:22.000And you know, that's the way that it goes.
00:08:25.000And then it turns out that he decided on his own to destroy both himself and them.
00:08:30.000He destroyed their credibility, because now they either have to pretend to be shocked, shocked that there's gambling going on here, or they have to admit they were lying all along.
00:08:37.000Either they have to say, I never knew Joe Biden was this bad.
00:08:43.000And that way, supposedly, we'll continue to believe them, that they were honest when they said he was fine, and now they're honest when they say he's not.
00:08:49.000Or, we're going to believe the alternative, which is that they were lying the entire time.
00:08:52.000So they have to act absolutely shocked.
00:08:54.000Okay, let's start from the beginning here.
00:08:56.000Because the coverage over the weekend is astonishing.
00:08:59.000The calls for Biden to leave are very real.
00:09:01.000The problem for them is there is no mechanism to replace Joe Biden on this ticket.
00:09:05.000Joe Biden would have to determine that he himself is stepping out.
00:09:09.000All of this fairytale nonsense about how the delegates at the convention are simply going to vote for somebody else despite being bound to vote for him based on state certification in the DNC.
00:09:23.000The problem with him stepping out is the person backing him up, as we'll see, is Kamala Harris, who's even worse than he is.
00:09:28.000And the problem with being anyone other than those two is that Biden-Harris campaign funds, which now amount to hundreds of millions of dollars, those are non-transferable.
00:09:36.000So if there's money in the Biden-Harris campaign, and let's say that neither of them ends up being the nominee, that money doesn't just shift over to Gretchen Whitmer or Gavin Newsom or Josh Shapiro or something.
00:09:45.000It just kind of sits there, doesn't have any place to go.
00:11:23.000The aides are attempting to get themselves off the hook.
00:11:25.000So as we're about to talk about, the Biden family, which wants Joe to remain in the race, because they have to, because the grift must go on.

00:11:38.000See, if Joe Biden is no longer president, then Jill might actually have to be elected to something so she could be president, as opposed to right now when she gets to be president without ever having been elected to anything or having been a useful person.
00:11:50.000Hunter might actually have to get a regular job as opposed to finger painting and picking up bags of cash and snorting Parmesan cheese off the carpets.
00:11:56.000His brothers, Jim and Frank, might have to go get regular jobs where they can't just refer to their brother's governmental position in order to pick up bags of cash.
00:12:04.000His sister might have to go get an actual campaign job that doesn't involve her brother.
00:12:08.000The entire Biden family has been riding the corrupt coattails of Joe Biden since the 1970s.
00:12:14.000They might have to get regular- Of course they are pushing for him to remain in the race.
00:12:26.000Because if Joe is not capable of making his own decisions, then what wife in her right mind would allow her husband to go out and humiliate himself in front of billions of people?

00:14:55.000Many felt they had never seen him collapse so dramatically.
00:14:58.000After all, Biden was a veteran of numerous debates.
00:15:00.000They did not understand why he gave an entirely different answer on the age question than the one they spent more than a week perfecting.
00:15:05.000The president did not just stumble over words.
00:15:07.000He appeared to lose his focus and often was unable to finish sentences.
00:16:00.000When the debate began on Thursday, Biden's top aides gathered in a holdroom at the CNN studios, knew immediately the president had gotten off to a rough start, stumbling on answers about the economy, ending remarks about the national debt with a gaffe.
00:16:12.000Early in the debate, Biden officials started telling reporters the president had a cold and a sore throat in an effort to explain why his voice sounded weak and raspy.
00:16:21.000Now again, Biden aides and allies had worried for months about whether he should take part in the traditional presidential debates.
00:16:26.000Some vigorously argued he should not participate, concerned he was not up to the task and Trump would dominate the encounter with his shouting and bluster.
00:16:32.000Others thought skipping a debate would make Biden look weak.
00:16:35.000The Biden campaign ultimately agreed to two debates, insisting the event would be on their terms.
00:16:39.000So again, all the talk about how this thing was rigged against Joe Biden, Joe Biden's team insisted on every term of the debate and an early date.
00:16:49.000And so that is how this thing rolled out.
00:16:51.000And that's that's the least of the leaks.
00:16:54.000And then there's this leak from Axios, which is an astonishing leak, truly an amazing leak.
00:17:00.000Biden's miscues and limitations are more familiar inside the White House.
00:17:03.000The time of day is important as to which of the two Bidens will appear.
00:17:07.000The two Bidens would be, you know, somewhat with it, and then slack-jawed, glassy-eyed, looks as though he's about to die Biden.
00:17:15.000to 4 p.m., Biden is dependably engaged, and many of his public events in front of the cameras are held within those hours.
00:17:22.000Outside of that time range or while traveling abroad, Biden is more likely to have verbal miscues and become fatigued, aides told Axios.
00:17:30.000Uh, well, good news, I guess you only have to be president for six hours a day, like one quarter of the time of the day.
00:17:36.000Probably none of our enemies will do anything outside the hours of ten to four.
00:17:41.000So long as it happens between ten and four, he can basically string together a sentence and spell the word cat if spotted the C in the T. But, outside those hours, he's basically hitting his head on the toilet and inventing the flux capacitor, this guy.

00:19:46.000The loudest public alarm about Joe Biden's mental acuity came in February with the release of special counsel Robert Herz's report, a document he produced after spending five hours interviewing the president that revealed Biden displayed significant memory problems.

00:21:52.000Both said he stumbled over his talking points at several moments, requiring Secretary of State Antony Blinken to intervene and point out the lines he should use.

00:24:11.000According to Axios, Joe Biden's close aides have carefully shielded him from people inside and outside the White House since the beginning of his presidency.
00:24:18.000The intermittent access has resulted in many current and former White House aides being shocked at the 81-year-old president's limitations at the debate on Thursday night.
00:24:26.000Current and former White House aides are feeling whiplash and now questioning whether Biden could fulfill a second term.
00:24:31.000Chandler West, the White House's Deputy Director of Photography, from January 2021 to May 2022, wrote, It's time for Joe to go.

00:24:40.000They say he has a cold or experienced a bad night, but for weeks and months in private, they've all said what we saw last night.

00:30:53.000That is no longer a sufficient rationale for why Mr. Biden should be the Democratic nominee this year.
00:30:59.000At Thursday's debate, the president needed to convince the American public he was equal to the formidable demands of the office he is seeking to hold for another term.
00:31:05.000Voters, however, cannot be expected to ignore what was instead plain to see.
00:31:08.000Mr. Biden is not the man he was four years ago.
00:31:11.000As it stands, the president is engaged in a reckless gamble.
00:31:15.000There are Democratic leaders better equipped to present clear, compelling, energetic alternatives to a second Trump presidency.
00:31:19.000There's no reason for the party to risk the stability and security of the country by forcing voters to choose between Trump's deficiencies and those of Biden.
00:31:26.000It's too big a bet to simply hope Americans will overlook or discount Mr. Biden's age and infirmity that they see with their very own eyes.

00:32:56.000That's why he spent nearly a week at Camp David with an army of advisors preparing for a debate with rules and a format that his advisors designed.

00:33:13.000By the way, Democrats are now worried that Joe Biden is going to drag down all the Senate candidates.
00:33:17.000So one of the oddities is that Democratic candidates are outpolling Biden in nearly every swing state this year.
00:33:21.000So Sherrod Brown in Ohio, he's outpolling Biden.
00:33:24.000In Pennsylvania, Bob Casey is outpolling Biden in Pennsylvania.
00:33:29.000In Arizona, the Democratic candidate for Senate, Ruben Gallego, out-polling Biden.
00:33:34.000So Biden is actually trailing every Senate candidate for the Democrats.
00:33:37.000But the problem is that if turnout's real low for the Democrats, they lose all those seats.
00:33:43.000The Wall Street Journal reports, quote, Democrats who worried about President Biden's reelect prospect, even before his uneven debate Thursday, had been pointing to a bright spot in this year's campaign.
00:33:51.000The party's Senate candidates and some vulnerable House candidates generally pull better than the weakened president.
00:33:55.000Now, those Democratic candidates and their aides are trying to sort through whether Biden's halting performance and sometimes dazed appearance have sapped the party's goals of retaining the Senate and flipping the House.
00:34:05.000Both chambers with thin majorities are in play this fall.
00:34:07.000By the way, a report from Politico this morning The Democrats in the House are now basically begging their donors.
00:34:13.000They need the House because they're not going to win the presidency.
00:34:16.000And members of the press who are probably going to vote for Joe Biden no matter what.
00:34:21.000Even they are appalled by what they saw, or at least pretending to be.
00:34:24.000So, I will give it to, listen, Bill Maher, I'm friendly with.
00:34:27.000Bill has been honest about this since the beginning, that Joe Biden is diminished, and that he expected Trump to run strong.

00:36:47.000Top members of his campaign team are lashing out at the president's Democratic critics, meeting expressions of grief, dread and fear over the debate with mockery directed at one time allies.
00:36:56.000It makes perfect sense because the Obama team has always scorned the Biden team.
00:37:00.000Okay, so we've talked about all the people who want Joe Biden out.
00:37:03.000In one second, we're going to get to all the people, particularly inside the administration and inside some Democratic halls of power, who either want Joe Biden to stay in or have resigned themselves to their fate.
00:39:03.000In any case, MSNBC, Joe Scarborough, attempting to maintain some semblance of journalistic credibility last week, basically threw Biden under the bus.
00:39:20.000So Joe Scarborough is putting witness protection for this segment because, of course, he has said that Joe should drop out.
00:39:24.000And Mika did like a 15 minute segment on just what a magnificent human, bright, ingenious, witty, incisive, insightful, acidic Joe Biden is.
00:39:37.000The very next day in North Carolina, there was Joe Biden, back to form, finding his voice, his winning smile, the vintage sparkle back in his eyes.
00:39:47.000Two appearances that were as different as, well, night and day.

00:48:48.000The anger among Democrats was made evident on Sunday when John Morgan, a top Democratic donor who's close to Biden's brother Frank, publicly blamed the advisors who managed the president's debate preparations, citing by name Ron Klain, Anita Dunn, and Bob Bauer.
00:49:00.000Biden has for too long been fooled by the value of Anita Dunn and her husband, Morgan wrote on social media.
00:49:10.000He elaborated, quote, It would be like if you took a prizefighter who's gonna have a title fight and put him in a sauna for 15 hours and then said, go fight.
00:49:16.000I believe that debate is solely on Ron Klain, Bob Bauer, and Anita Dunn.
00:49:19.000So naturally, Bauer, Dunn, they're the ones who are all leaking this to the press.
00:49:24.000A couple of Democrats pointed out family members and Morgan didn't attend the preparation sessions, so they have no idea how it went.
00:49:31.000One member of Biden's circle said no one was happy with how the debate turned out and it was human nature to look for somebody else to blame.
00:49:38.000So Biden's family is, of course, Jill leading the way, suggesting he has to stay in.
00:49:42.000And so she's treating him like a toddler.
00:49:44.000I mean, honestly, the most humiliating thing for America was was not I'm not even sure it was Joe Biden's performance.
00:49:48.000It was his wife's treatment of him after the performance, trotting him off the stage, holding his hand the way I would hold either my my now 99 year old grandmother's hand coming down from a stage or my four year old and then treating him like a four year old.

00:59:41.000At this point, the election is a referendum on Joe Biden.

00:59:49.000Okay, meanwhile, while all of this was breaking, there was big Supreme Court news on Friday, and a case called Loper v. Raimondo, so-called Chevron deference, was overruled.
00:59:59.000So, Chevron deference, there was a case, About 40 years ago, called Chevron the Natural Resources Defense Council.
01:00:07.000And basically the rule that was established by the Supreme Court is a rule about whether administrative agencies could be the adjudicators of their own interpretation of statute.
01:00:16.000So to explain, let us say that there was a rule that was passed by Congress and it was a vague rule for the EPA.
01:00:23.000Environmental Protection Agency then proceeded to wildly reinterpret the statute and then bring you up on administrative charges because very often if you violate a statute by the EPA you're not brought to like a regular court for violation of it.
01:00:36.000You're brought in front of the EPA's administrative judicial panel.
01:00:39.000And then they will adjudicate whether you owe a fine or not.
01:00:42.000So people appealed that to the courts and the Supreme Court said, well, hold on.
01:00:47.000We're not really good at interpreting like vagueness in statute.
01:00:50.000So we're going to leave it with the experts at the EPA to determine what the statute means and then to apply the statute.
01:00:55.000Now, what this set up was a real constitutional problem because effectively what it meant is that if Congress abdicated its legislative duty and passed a vague statute that was not clear and then passed it off to the executive branch, Then these unelected administrative agencies would have the power to effectively write stuff in the blanks of the statute, apply the statute judicially, and then enforce it with the executive branch.
01:01:18.000So we essentially had a dictatorship of the administrators.
01:01:23.000Effectively speaking, what it set up was a unified legislative, judicial, and executive branch all inside an unelected body of administrative officials.
01:01:31.000And the standard under Chevron's deference was that the judiciary would not sign into chat unless the administrative agency was so wildly unreasonable in its interpretation of its own authority and statute that the courts would have to step in.
01:02:18.000Article 3 of the Constitution assigns to the federal judiciary the responsibility and power to adjudicate cases and controversies, concrete disputes, with consequences for the parties involved.
01:02:27.000The framers appreciated the laws judges would necessarily apply in resolving these disputes would not always be clear, but envisioned the final interpretation of the laws would be the proper and peculiar province of the courts.
01:02:36.000In other words, not a fourth independent branch of government.
01:02:41.000The court recognized exercising independent judgment often included according due respect to executive branch interpretations of federal statutes, but that quickly started to turn into unending authority for these various administrative agencies.
01:02:57.000And so the idea here is that Chevron didn't do its job.
01:03:00.000Originally, Chevron was designed in order to allow for executive agencies to make statutes more comprehensible and more consistent.
01:03:09.000And instead, what happened is that every four years, the interpretation of the statutes would change.
01:03:13.000Whenever the president would be appointed, whenever he'd be elected, he would appoint a new administrator at the EPA, and the administrator would just flip the interpretation of the statute.
01:03:21.000Which is not the way that statutes are supposed to work.
01:03:25.000It forces back to Congress specificity in legislation, which is a good thing.
01:03:31.000The administrative branch of government is not part of the constitutional structure.
01:03:35.000It was not part of the original constitutional structure.
01:03:36.000It was a creation of the Teddy Roosevelt, Woodrow Wilson progressives in the early 20th century.
01:03:41.000It is foreign to the constitutional bargain made by the founders.
01:03:45.000It was then given outsized authority on the idea that experts were the best placed in order to both make law, judge law, and then implement law.
01:04:16.000And again, the reason that that is correct Is because, as the Supreme Court says, Chevron's presumption is misguided because agencies have no special competence in resolving statutory ambiguities.
01:04:27.000The framers anticipated courts would often confront statutory ambiguities and expected that courts would resolve them by exercising independent legal judgment.
01:04:34.000Chevron gravely erred in concluding, the inquiry is fundamentally different just because an administrative interpretation is in play.
01:04:40.000The very point of the traditional tools of statutory construction is to resolve statutory ambiguities.
01:04:44.000In other words, administrative agencies always have an interest in Expanding their own power and interpreting statutes in a way that they find friendly?
01:04:53.000The judges are supposed to not have that same sort of issue.
01:04:56.000So creating an independent branch of government, in other words, is wrong.
01:05:00.000Now, again, in reality, the Chevron ruling has been more observed in the breach than in reality.
01:05:09.000For like the last 10 years, nobody has cited Chevron deference because the courts have basically not applied it.
01:05:14.000This was just kind of the last step of putting a stake through the heart of Chevron.
01:05:19.000The Supreme Court says Chevron is unworkable.
01:05:22.000The defining feature of its framework is the identification of statutory ambiguity, but the concept of ambiguity has always evaded meaningful definition.
01:05:29.000Such an impressionistic and malleable concept cannot stand as an everyday test for allocating interpretive authority between courts and agencies.
01:05:37.000The left is freaking out about this because what they actually want is an unappointed government, a deep state, you might say, that actually sits there and interprets laws in ways that the left likes.
01:05:45.000Permanent employees of the executive branch and the administrative agencies who rule your life.
01:05:52.000If they judge wrong about what a statute means, I can now sue in federal court and no longer will there be this deference to the administrative agency's interpretation of the statutes.
01:06:02.000The other big ruling that happened on Friday Was the Supreme Court raising the bar for obstruction charges against both Donald Trump and January 6th offenders?
01:06:12.000As Reuters reports, the justices ruled 6-3 to throw out a lower court's decision that had allowed a charge of corruptly obstructing an official proceeding against defendant Joseph Fisher, a former police officer.
01:06:23.000Typically, a charge of corruptly obstructing an official proceeding, it means that you have to impair the availability or integrity of documents or other records related to an official proceeding, right?
01:06:32.000When you're obstructing, it means you're destroying documents, or it means you're hiding documents, you're not talking to the cops, or something like that.
01:06:37.000In a way that, you know, you don't have an excuse for.
01:06:39.000This is a weird decision, only because Justice Kitanji Brown Jackson actually joined the conservatives.
01:06:48.000And, meanwhile, Justice Amy Coney Barrett joined the liberals in this particular ruling.
01:06:57.000She wrote a dissent joined by Sonia Sotomayor and Elena Kagan.
01:07:02.000So, that's a potential boost, just because these obstruction charges, as we talked about at the time, are way too broad.
01:07:07.000Obstruction was never meant to apply to, there's a riot.
01:07:10.000It's weird to apply obstruction to a riot.
01:07:34.000Macron certainly is not the right in France.
01:07:36.000Marine Le Pen's national rally, according to the Wall Street Journal, notched a victory in the first round of parliamentary elections across France on Sunday, moving her party one step closer to its goal of winning control of the National Assembly and taking the reins of the government.
01:07:48.000Emmanuel Macron's pro-business party and its allies finished third with 21%, The commies, the New Popular Front, got 28%.
01:07:56.000So basically, you now have, in France, one-third of the public is so-called far-right.

01:08:04.000Far-right just means they don't like vast swaths of Muslim immigrants arriving and destroying the social integrity of France.

01:08:19.000Oddly enough, they are the pro-Israel party, so this sort of attempt to paint them as anti-Semitic?

01:08:28.000They're out in the streets celebrating by the tens of thousands with red flags, which of course, if you're a normie in France, that's not particularly a swaging of your thoughts and fears.
01:08:38.000So 33% to National Rally, 28% to the Commies, 21% to Emmanuel Macron's party.
01:08:45.000If National Rally wins a majority in the National Assembly, Macron would face the possibility of sharing power with the first, quote, far-right government since Vichy France.

01:09:54.000And by the way, if Macron sides with the communists, the next election after that is going to be a heavy swamp for the right.

01:10:47.000So, what is the biggest falsehood that people seem to believe about Sherrod Brown that you're trying to debunk in this campaign?
01:10:54.000That he's inevitable, that he's somebody that is a moderate, that he's bipartisan, that he works across party lines.
01:11:01.000As you know, he's one of the most radical senators in office today.
01:11:05.000This guy ran for office for the first time after graduating from Yale with a major in Russian studies, just after we had landed on the moon.
01:11:14.000So this is a guy who's just been around way too long.
01:11:52.000So what is the internal polling showing you right now, especially given the fact that, you know, I know it's fresh, but Joe Biden absolutely collapsed on the stage the other night.
01:12:00.000That's got to be dragging down Democratic turnout numbers.
01:12:04.000Because the reality is when you have an opponent, Sherrod Brown, who votes almost 100% of the time with Joe Biden, we're going to tie those two together.
01:12:14.000The reality is in the polling, Ben, what it shows is that about 40% of Ohio has no idea who I am.
01:12:21.000So we are down about even 15 or 16 points with Republicans.
01:12:25.000So all we have to do is point out, here's what I stand for, energy dominance, a safe and secure border, support of our allies like Israel.
01:13:22.000Consumers are the ones that dictate the pace of innovation, the direction of innovation.
01:13:27.000It's their vote with their pocketbook.
01:13:30.000That is infinitely more important than some bureaucrats, some unqualified bureaucrats vote in Washington, D.C.

01:14:53.000They know that Israel's fighting the war that we would otherwise have to fight, and that the money we give Israel is actually an investment in research and development.
