00:01:35.000 Okay, so late last night, President Trump tweeted out that he was going to allow Emily Murphy, who is the head of the General Services Administration, to move forward with the transition for Joe Biden.
00:01:44.000 This doesn't mean he has dropped his legal challenges.
00:01:46.000 It does mean that he is not going to be, as I have suggested before, holing up in the Oval Office, snorting blow and firing machine guns through the door, A la the most fevered fantasies of the members of the media.
00:01:57.000 This was always a fantasy.
00:01:58.000 Members of the media were under the grave misimpression that President Trump was going to string barbed wire around the White House, and they were going to get the glorious image of people with uniforms and guns going in and frog-marching Trump out of the White House.
00:02:10.000 This was always wish fulfillment by Democrats.
00:02:13.000 It was always fantasy by Democrats.
00:02:15.000 And President Trump blew up that fantasy last night when he said, listen, my legal challenges are still ongoing here.
00:02:21.000 But there will be an orderly transition of power no matter what happens.
00:02:25.000 He tweeted out, Which of course is the appropriate move, right?
00:02:26.000 for her steadfast dedication and loyalty to our country.
00:02:29.000 She has been harassed, threatened and abused.
00:02:31.000 And I do not want to see this happen to her, her family or employees of GSA.
00:02:34.000 Our case strongly continues.
00:02:36.000 We'll keep up the good fight.
00:02:37.000 I believe we will prevail.
00:02:38.000 Nevertheless, in the best interest of our country, I'm recommending that Emily and her team do what needs to be done with regard to initial protocols and have told my team to do the same, which of course is the appropriate move, right?
00:02:47.000 He gets to move forward with all of his legal challenges.
00:02:50.000 This thing doesn't get voted on until December 14th.
00:02:52.000 He gets to move forward and show whatever evidence he has in court.
00:02:55.000 The cases are not going well so far, but theoretically they could reverse.
00:02:58.000 But in the meantime, he is not holding up the transition of power that is supposed to happen.
00:03:03.000 Now the way the Washington Post suggests is that Emily Murphy had done something deeply wrong by not starting the transition earlier.
00:03:09.000 The problem, of course, is that none of the states had certified their votes as of last week.
00:03:12.000 Now the states are starting to certify their votes.
00:03:14.000 The electors don't even meet until the middle of December.
00:03:17.000 So she really did not have any legal grounds to do so without the formal concession of the President of the United States in the race.
00:03:23.000 She is a person who holds a government office and she is bound by the law.
00:03:28.000 And until the president concedes, which basically makes everything else a formality, she can't start the transition.
00:03:32.000 Trump giving her permission to start the transition allows the process to go forward.
00:03:35.000 The Washington Post, of course, plays this as though she had done something deeply wrong by not unilaterally starting the transition, even though she really does not have the power legally to do so.
00:03:44.000 According to the Washington Post, Murphy, a by-the-book expert in federal procurement policy, consulted with her senior staff and her attorneys, the transition law dating to 1963 that was supposed to guide her in determining when a candidate had won, had little to offer in the current case, with the president refusing to concede and a Republican party standing by him.
00:04:00.000 Well, no, actually, it's just that the legal process Moving forward was just supposed to be that the votes get certified and none of the states had certified their votes yet.
00:04:08.000 So again, if Trump had conceded, then she would have moved the transition forward.
00:04:10.000 Now he's given her permission, and so she's moving the transition forward.
00:04:13.000 The media are trying to play this as though Trump was trying to stop her from moving the transition forward.
00:04:17.000 That's not right.
00:04:18.000 He just was not giving her the permission to move the transition forward, which was Necessary, because she doesn't have any other legal authority.
00:04:23.000 She does work for the executive branch.
00:04:25.000 She did write a letter to Joe Biden, and she said, She said she received a lot of threats.
00:04:28.000 adult life to public service. I've always strived to do what is right. Please know I came to my decision independently based on the law and available facts.
00:04:34.000 I was never directly or indirectly pressured by any executive branch official, including those who work at the White House or GSA with regard to the substance or timing of my decision.
00:04:41.000 To be clear, I did not receive any direction to delay my determination. She said she received a lot of threats. She said I always remained committed to upholding the law. Of course, it is her job to make sure that post-election resources and services are available to assist in the event of a presidential transition.
00:04:56.000 But of course, the media declaring somebody president-elect does not formally make them, by law, president-elect of the United States.
00:05:02.000 So in any case, the transition is beginning to move forward.
00:05:06.000 In the meantime, President Trump continues to move forward with his legal challenges.
00:05:10.000 That pathway continues to narrow.
00:05:12.000 Last night, the Michigan State Board of Canvassers voted to certify the state's election results.
00:05:15.000 That is a board that is made up of two Republicans and two Democrats.
00:05:20.000 One of the two Republican members of the Michigan State Canvassing Board, Aaron Van Langeveld, joined the two Democrats to vote to certify the election results.
00:05:27.000 So apparently it went 3-1.
00:05:29.000 The state's highly anticipated certification was the latest in a series of episodes over the past week that have reinforced Biden's victory, even as Trump has refused to concede.
00:05:35.000 This is according to, of course, CNN.
00:05:38.000 Also in Pennsylvania, the state Supreme Court.
00:05:42.000 Rejected the Trump campaign's effort to block the counting of certain absentee ballots, clearing the way for votes to be certified in multiple counties, including Philadelphia.
00:05:49.000 The county that includes Philadelphia did certify its vote last night and of course last week.
00:05:54.000 The Republican governor and secretary of state in Georgia certified the state's election results, although there will be another recount that is going to happen in Georgia.
00:06:01.000 As well, the Georgia secretary of state's office, according to Daily Wire, announced the additional recounts on Monday evening during a press conference.
00:06:07.000 The Trump campaign criticized Georgia's first recount, which took place over the course of last week.
00:06:11.000 and uncovered two errors worth thousands of votes each on Saturday.
00:06:15.000 The Trump campaign is legally entitled to a recount upon request with the cost of such an operation covered by Georgia state and local governments, according to Politico.
00:06:22.000 The Trump campaign is calling for some sort of re-examination of the ballots based on the signatures on the mail ballot envelopes.
00:06:29.000 That's going to be kind of difficult because originally, when you look at the mail ballot envelopes, the signatures are compared and then the envelopes are thrown away.
00:06:35.000 So it's not like that evidence still exists at this point.
00:06:38.000 Georgia's going to end up certifying the election.
00:06:41.000 Meanwhile, the Trump campaign continues to try and move forward with its own legal theory.
00:06:48.000 Rudy Giuliani spelled out that legal theory a little bit yesterday.
00:06:51.000 We'll get to that in just one moment.

00:08:29.000 Rudy Giuliani is struggling to sort of explain the legal strategy moving forward.
00:08:34.000 So obviously the Trump legal team dumped Sidney Powell the other day because Sidney Powell had been making wilder and wilder accusations about the hacking of voting machines and the suggestion was that millions of votes were switched.
00:08:45.000 Trump had won 80 million votes, not 73 million votes.
00:08:47.000 That the Dominion voting machines had actually been hacked because Smartmatic was originally a Venezuelan company.
00:08:52.000 It was a bit of an extreme theory, and then she got even more extreme, suggesting that basically candidates were paying Dominion in order to hack into the machines, or they'd been paid by Dominion to allow the hacking of the machines.
00:09:03.000 And so just a couple of days ago, the Trump campaign dumped Sidney Powell on the side of the road, and they said, we are no longer working with her.
00:09:10.000 And then she said she's still going to release a Kraken.
00:09:11.000 This time the Kraken is going to be taking steroids, as well as presumably some other form of analgesic.
00:09:16.000 So that's exciting stuff.
00:09:17.000 Rudy Giuliani was with Lou Dobbs, who's asked specifically, why did you dump Sidney Powell?
00:09:20.000 Here was his answer.
00:09:22.000 I think it's because we're pursuing two different theories.
00:09:26.000 Our theory of the case, to get to the Supreme Court, now in four places, and it's soon going to be in two others, and there'll be an overall lawsuit, is basically misconduct of the election by state officials in at least five or six different states, in which the misconduct of the election involves deprivation of constitutional rights for the president.
00:09:50.000 Okay, he then added that they still have a legal strategy.
00:09:53.000 That strategy is looking at the various voter irregularities and voter fraud cases.
00:09:57.000 The big problem, again, as it was in Pennsylvania, is going to be proving that the voter irregularities, the voter process, the voter fraud cases, that those amount to enough of a problem that state election results, as currently counted, should be overturned.
00:10:07.000 This was the problem in Pennsylvania.
00:10:09.000 Or a couple of affidavits in which people said that their ballots weren't properly counted.
00:10:12.000 The proper remedy would be to have their ballots counted, not to invalidate millions of votes.
00:10:15.000 This is what the judge in that particular case said.
00:10:17.000 They have the same problem in Michigan.
00:10:19.000 Presumably they'll have the same problem in Wisconsin, Arizona, and Nevada, wherever else they decide to file these lawsuits.
00:10:24.000 You have to show that the voter fraud and voter irregularity, the proper remedy would be to set aside the election results and instead have the state lawmakers select the electors to the electoral college.
00:10:33.000 That is the burden.
00:10:34.000 Rudy is suggesting that basically they are one good case away from turning this whole thing around.
00:10:39.000 The facts are there, we just need to get them before a trier of fact or before a court that'll be fair and we'll listen to them.
00:10:46.000 I mean, the court in Pennsylvania cut it off without listening to a single fact.
00:10:51.000 And I don't know how the judge could have concluded that the facts aren't substantial when they haven't even been presented yet.
00:10:59.000 They're really kind of... And on a motion to dismiss, you're not supposed to consider that.
00:11:07.000 Unfortunately, we haven't yet gotten a fair decision.
00:11:10.000 We will.
00:11:11.000 We've got to be a little patient.
00:11:12.000 One fair decision, one good hearing, and this will turn all around.
00:11:15.000 Okay, so the legal process continues to work.
00:11:17.000 This is why the Trump team has filed a lawsuit with the Third Circuit Court of Appeals asking for leave to amend their original complaint in that district court and then be remanded back to district courts.
00:11:27.000 It's going to go back down before it goes back up.
00:11:29.000 All of the states are going to certify by December 8th, so obviously the timeline here is quite short.
00:11:33.000 Meanwhile, there have been calls from some people, like Lynn Wood in Georgia, for Republicans in Georgia to somehow boycott the Georgia senatorial election, which is the dumbest thing I have ever heard in my entire life.
00:11:42.000 If you're a Republican in Georgia, and you're angry about President Trump's treatment, and you believe that President Trump was somehow jobbed in Georgia, Okay, I don't see how the solution is for you to boycott an election in which two Democrats could be elected.
00:11:54.000 John Ossoff, a radical progressive, and Raphael Warnock, who's an actual nut.
00:11:58.000 They could be elected, and they could theoretically, if one of them, if both of them were elected, Democrats would then have a 50-50 split in the Senate of the United States, and if Joe Biden ends up taking office on January 20th, which Right now, it appears he probably will.
00:12:11.000 If that happens, then Joe Biden ends up presiding over a Democrat-run Senate with Kamala Harris breaking the tie.
00:12:17.000 If you are a Republican in Georgia, get your ass out and vote.
00:12:19.000 Vote right now.
00:12:20.000 If you can vote right now, vote right now.
00:12:22.000 If you can vote mail-in, vote mail-in.
00:12:23.000 If you can vote early, vote early.

00:12:26.000 And you know who else is saying this?

00:12:30.000 is saying this is nuts.
00:12:31.000 He's saying, if you think that you're helping my dad somehow by not voting in the Georgia senatorial elections, you're falling for a scam.
00:12:38.000 Trump said, I'm seeing a lot of talk from people who are supposed to be on our side telling GOP voters not to go out and vote for Kelly Loeffler and David Perdue.
00:12:44.000 This is nonsense.
00:12:45.000 Ignore those people.
00:12:46.000 We need all of our people coming out to vote for Kelly and David.
00:12:48.000 Obviously, that is 100% true.
00:12:51.000 So, Raphael Warnock needs to lose.
00:12:52.000 Jon Ossoff needs to lose.
00:12:55.000 Perdue narrowly missed being re-elected in the general election.
00:12:57.000 He did beat Ossoff by a couple of points.
00:12:58.000 He got 49.8% of the vote.
00:13:01.000 He needed 50% in order to prevent the runoff.
00:13:03.000 On Friday afternoon, Vice President Pence traveled to Georgia to campaign for Loeffler and Perdue.
00:13:08.000 He called Perdue, quote, one of the greatest and staunchest allies of the MAGA agenda in the U.S.
00:13:11.000 Senate and praised Loeffler for building her own company from the ground and breaking barriers in business and sports.
00:13:16.000 Okay, the bottom line here is that Republicans cannot afford to have the Democrats running the Senate.
00:13:21.000 That's insane.
00:13:22.000 Okay, so regardless of what you think happened in the presidential election, please do not stay home in some sort of fit of pique and hand the Senate of the United States to the Democrats.
00:13:31.000 That is like the dumbest thing that you can do.
00:13:34.000 Now, the dumbest take from the media this morning has come courtesy of friends on the never-Trump left as well as the actual left.
00:13:43.000 These are people who have now suggested that because Donald Trump has allowed the GSA to move forward with some of its transitional processes, they stopped the coup.
00:13:50.000 So understand, These were people who were shouting from the rooftops that a coup was in progress, that America was in the midst of a constitutional crisis.
00:13:57.000 It was all grinding to a halt.
00:14:00.000 200 and some odd years of American history.
00:14:02.000 It was all coming apart.
00:14:04.000 250 years of American history was all going to stop because Donald Trump would refuse to leave the office and we'd have a constitutional crisis and then we'd have to deploy the A hundred and first airborne to the White House in order to read.
00:14:16.000 It'll be White House down, except it'll be Trump in the role of the baddies.
00:14:19.000 OK, that was always crazy talk.
00:14:21.000 It was crazy talk from beginning to end.
00:14:22.000 There are those of us who are saying, OK, there's a process that will play out.
00:14:25.000 Either the evidence will be presented or it will not be presented.
00:14:28.000 But we do have a legal process and Trump has a right.
00:14:30.000 to avail himself of all legal processes.
00:14:33.000 But people on the left are saying, oh, it's the end of the republic!
00:14:35.000 It's a coup!
00:14:36.000 Now, as I said all along, the reason they had to keep saying this over and over and over, despite the fact that it was pretty obvious there was a legal process and that, in fact, it is not unconstitutional, nor is it illegal for a president to avail himself of the legal process.
00:14:48.000 In fact, it's in the legal process.
00:14:50.000 Like, it's called the legal process, right?
00:14:52.000 So that is not illegal.
00:14:53.000 You file a lawsuit.
00:14:54.000 That is well within the legal process.
00:14:55.000 You don't have to concede.
00:14:56.000 That's a formality.
00:14:57.000 And that is a nicety.
00:14:58.000 You could theoretically run through it.
00:15:00.000 That's what Trump is doing.
00:15:00.000 He's not doing anything illegal.
00:15:02.000 And as I said all along, the process will play out.
00:15:04.000 But the media were fully invested in the line that the entire republic was going to come to a crushing halt because President Trump was such an evil bad man.
00:15:12.000 The reason they had to say that is because they have blown all of their credibility for years on the principle that Donald Trump is an evil, nefarious fascist.
00:15:18.000 Democracy dies in darkness.
00:15:20.000 And so what would happen if Donald Trump lost and then left?

00:15:24.000 It would completely undermine their narrative.
00:15:26.000 It would undermine the excuse they've been using for years to come out of the closet as full-scale leftists while pretending that they are still acting in objective defense of the United States from this incipient Thorn Chitler.

00:15:40.000 So how do they maintain the myth in face of the fact that President Trump has now authorized the GSA to begin transitional processes in lieu of final legal outcome?

00:15:51.000 Who is going to seize power, the reins of power?

Blinken in 2017 was still maintaining the Iran deal was absolutely fantastic. Even though Iran has spent

01:06:45.000 It's to suggest the government has at any time and for any reason the ability to tell you to put on a mask.
01:06:50.000 So by that standard, The standard that if you are walking around and you have the possibility of making anybody else sick, no matter how remote or no matter what the disease, we can tell you to put on a mask full time.

01:07:04.000 Now, my presumption has been that we're basically going to be wearing masks in close quarters until the wide adoption of the vaccine.
