00:03:17.000 I think Trump shut up the naysayers, earning 51%.

00:03:31.000 And I'll wrap it up with, I'm sure you've seen, I've got the headline on CFP, but Drudge is going with that American research group there at New Hampshire polling, showing Trump and Nikki Haley tied at 40-40.

00:03:49.000 The only positive of that, Kane, is that it keeps Nikki Haley further away from Trump's orbit, right?

00:04:41.000 I firmly believe it will not be Nikki Haley, but the actual America First Base would lose their mind.
00:04:48.000 You would have people who would not, I think it would actually keep people from the polls, keep part of his base from voting if he chose Nikki Haley.
00:04:58.000 Yeah, it just, I would love to see that be completely and totally dismissed altogether.
00:05:04.000 I mean, I think you would lose 10 to 15% across the board, 10 to 15% across the board.
00:05:08.000 Tyler and I were saying on our chat on election night, we in good faith, we don't know if we could do our ballot chasing thing.
00:05:14.000 I don't know in good faith if I could work and vote for Nikki Haley being, I say that as someone who loves Trump, but she is, she is worse than George W. Bush.

00:06:16.000 What I hear on my site is the Vake, Ben Carson, and some people are still pushing DeSantis.

00:06:29.000 And so any of these other names, Sarah Huckabee, Sanders, you know, any of those being floated out?

00:06:34.000 But so you think Vivek and Ben Carson are the two frontrunners right now?
00:06:39.000 It's so hard to read these tea leaves, Charlie, as you know, and that's what we try to do.
00:06:43.000 But Trump certainly seems very, very happy with Vivek.
00:06:47.000 And when you look at his rhetorical, I mean, he and Kerry Lake are the two greatest communicators in American politics, bar none, either side right now.
00:06:56.000 And to be able to add someone like that to your ticket has to be appealing to Trump.
00:07:00.000 And he was very careful.
00:07:02.000 He never criticized the Vake until the last two or three days when he was upset about those t-shirts.
00:07:07.000 But Vivek sort of quickly bent the knee.
00:07:10.000 He dropped out right after the race.
00:07:11.000 As I think, you know, ultimately, I think Nikki and Ronnie should have dropped out as well.
00:07:17.000 But of course, that's not going to happen with all the money behind them.
00:07:20.000 But those other names, Sarah Huckabee, people like her.
00:07:23.000 It wouldn't hurt his candidacy, but I don't think it would really motivate people.

00:07:30.000 Same, that's, I have the same reaction to Elise Stefanik, like, eh, meh, you know, decent choice.

00:07:40.000 So, yeah, so the, so it's, there's going to be some suspense and that'll, you know, hopefully Trump won't make us wait until the convention in July.

00:07:52.000 So, so, Kane, let's talk about the curious case of Ron DeSantis.

00:07:56.000 So, the Philadelphia Eagles lost by 23 points on the road to the Buccaneers.
00:08:00.000 Could you imagine if the Eagles go out to the press conference after the game, they say, you know, we've earned our ticket out of Tampa Bay.
00:08:06.000 And even though we lost by 23 points, you know, we really have done a great job and we're going to continue.
00:08:12.000 I have a lot of respect for Ron DeSantis as a governor of Florida.
00:08:16.000 I will say that once.
00:08:17.000 I'll say it again.
00:08:18.000 He's been an excellent governor.
00:08:19.000 And as a presidential candidate, he has been unbelievably disappointing and maddening.
00:08:25.000 Kane, talk about how the hundreds of millions of dollars, and in his case, about $120 million that we know of, I think it's even more than that.
00:08:33.000 That $120 million could have been better allocated for the general.
00:08:38.000 And what do we have to show for it?
00:08:41.000 We have a whole lot of nothing.
00:08:43.000 We have a whole lot of nothing and two candidates who have no chance extending it to New Hampshire.

00:08:52.000 Yeah, I'm sure the Eagles owner would have loved Siriani showing up after the press conference.

00:08:59.000 We started 10 and one, but we're not going to talk about how we lost six out of our last seven.

00:09:06.000 These people, you know, you got to it with your point at the end about the 120 million.
00:09:12.000 What that money could have done to help to help Republicans win, to help Trump win in seven swing states and in reality, about 10 swing counties.
00:09:23.000 As you and I have talked in multiple, in multiple appearances that I've made, this race is coming down to a few states and a few counties in each state and putting money on the ground, grassroots, like Turning Point did, $5 million to Scott Pressler for Wisconsin, the RNC and these billionaires and Ken Griffin and Larry Ellison from Oracle.
00:09:47.000 They, you know, all the money they wasted on Tim Scott, for heaven's sakes, and all of these other candidates, that's $100 million that could have, that could have been building the most intense growd game.
00:10:00.000 We could have done it better than Mark Zuckerberg and his and his operation and those and those vans in Wisconsin, which, by the way, during the last week, I'm sure you saw that, were announced that those were illegal, the ones that they used in racing that were paid for by Zuckerberg.

00:10:19.000 And I blame Rona McDaniel not getting together with these billionaires and the donors and facing the reality that Trump has had this race for three months.

00:11:54.000 Jack Smith is looming over the entire presidential race.
00:11:57.000 It's a sleeping giant case, though, that could upend the prosecution of Trump.
00:12:03.000 The Supreme Court has been asked to consider a case that doesn't mention the former president, but could invalidate half of the January 6th charges against him.
00:12:10.000 Kane, walk us through this.
00:12:11.000 Yeah, it's nothing, you know, to the dedicated listeners to the Charlie Kirk show, it's nothing new.
00:12:17.000 But what it is, is Matthew Graves and the January 6th prosecutors included this charge, obstruction of an official proceeding, and they included it in over 300 J6 cases.
00:12:31.000 Those 300 people are already in prison and they're serving time on that case.
00:12:37.000 Well, one of the defendants decided to take it to the Supreme Court because the whole point of this statue, this obstruction of an official proceeding, it related to paperwork.
00:12:49.000 This had to do with Enron.
00:12:51.000 This was an Enron statute created by Congress specifically for financial crimes, for destroying documents.
00:12:58.000 That's what it all evolved out of.
00:12:59.000 And somehow now it's been twisted by Matthew Graves and the J6 prosecuting team.
00:13:05.000 They've twisted it to say that attempting, you know, January 6th was an attempt to obstruct an official proceeding.
00:13:13.000 So the Supreme Court will decide this case.
00:13:16.000 It specifically doesn't have anything to do with Trump, the case that's been brought before them, except that two of the four charges that Jack Smith has filed against President Trump in the DC case, two of the four are related to that obstruction of a criminal, of an official proceeding.
00:13:35.000 So if the fact that the Supreme Court decided to take it up, Politico basically admits in that article that it's not a good sign for Jack Smith, that the fact that the Supreme Court has agreed to rule on this case probably means they're going to overrule the D.C. appeals court and say that this charge is completely unrelated to January 6th.
00:14:00.000 So what is the effect that that will have?
00:14:02.000 That's what Politico focused on.
00:14:04.000 It's a timing thing.
00:14:06.000 The Supreme Court isn't going to decide on this Fisher case probably until June.
00:14:10.000 Well, Jack Smith was set to get started on March 24th.
00:14:15.000 So they sort of lay the odds on whether Judge Chutkin will postpone or sort of delay that trial until we get a hearing, or excuse me, until we get a ruling from the Supreme Court.
00:14:27.000 Because imagine if it does start in March 24th, Trump could already be convicted when the Supreme Court would rule in June that those charges need to be thrown out.
00:14:39.000 So there's a whole mess and it's just creating a whole bunch of indecision.
00:14:43.000 But the bottom line, and I'll throw it back to you, the bottom line is Politico is admitting that the Supreme Court is likely to throw out that charge.
00:14:52.000 That will help 300 J6 defendants.
00:14:55.000 It will help President Trump and it will be a very bad day for Jack Smith.
00:14:59.000 The Daily Beast, and it's the front page of citizenfreepress.com, the Daily Beast of all places has an article, quote, why we can't just shrug off the Fannie Willis scandal.

00:15:10.000 The DA prosecuting Trump prolonged an investigation to justify a hefty salary for a romantic partner.
00:15:16.000 That is a genuine conflict of interest that would require her dismissal by Andrew Fleischman.
00:15:21.000 This is a big, big thing.
00:15:22.000 Andrew Fleischman is a criminal offense lawyer in Atlanta, along with trial and personal injury work.
00:15:27.000 Fleischman specializes in representing the wrongfully or unfairly convicted left-winger.

00:15:32.000 That's actually why I put those two purple headlines back at the top of CFP, because that was such an important story from last night.
00:15:41.000 What he's saying is essentially going along with what Jonathan Churley has said, which is that this behavior with this very strict laws that Georgia has on conflict of interest for judges, it's almost impossible that she will not be removed from the case.
00:15:57.000 So that's a huge admission from the left, from Fleischman, that Fannie Willis is likely to be removed.
00:16:03.000 However, he says that it is not necessarily likely that she will be charged.
00:16:08.000 And we've got, I'll throw in really quick.
00:16:11.000 Governor Kemp headed off to Davos without opening a criminal investigation into Fanny Willis.
00:16:17.000 He can fire her.
00:16:19.000 He has full ability to fire her.
00:16:21.000 He could if he wants.

00:16:24.000 He and he wouldn't, he wouldn't, he might get sued for it, but he would probably win.

00:18:20.000 Rosemary, you were the first person to report on this alleged border deal.
00:18:26.000 Tell us the story of how you came across this information directly from Senator Lankford's office.
00:18:32.000 So Senator Lankford has obviously been doing all this negotiating behind closed doors.
00:18:36.000 He's the only Republican in the room.
00:18:38.000 And then he goes out and he briefs other Republican senators on what they've agreed to.
00:18:44.000 There is no text for this deal yet.
00:18:46.000 So I am still very hopeful that this can all be erased.
00:18:50.000 But I spoke with one of the senators he briefed and got that person's notes.
00:19:00.000 And I have a whole lot more faith in that senator than I do in Senator Lankford.
00:19:07.000 And so I went public with what was in those notes.
00:19:11.000 And I have not had any pushback.
00:19:13.000 Nobody has said directly to me, including Senator Langford, this is not in there.
00:19:19.000 This provision is not in there or that provision is not in there.
00:19:22.000 So, you know, obviously this, the graphic that Fox News did has gone all over the internet and nobody has pushed back.
00:19:31.000 So I'm very confident in the provisions that those provisions were in fact agreed to by Senator Lankford and the Democrats in the room.
00:19:40.000 And I hope that they come out.
00:19:43.000 I sincerely do.
00:19:44.000 I hope he walks away from this deal.

00:19:45.000 And Senator Langford hasn't denied it, but he sent out a little snarky, sarcastic tweet saying that a lie goes around the world before the truth has time to put its pants on, something of that sarcastic, snarky variation.
00:20:00.000 But he hasn't flat out denied it.
00:20:02.000 So Rosemary, let's go through the specifics.
00:20:05.000 What are the specifics?
00:20:06.000 What are the border deal?
00:20:10.000 So again, I don't know all of the contours of this.
00:20:13.000 And, you know, that would be interesting to see.
00:20:16.000 But what I have been told, the two most egregious provisions are, number one, that illegal aliens will get immediate work permits as soon as they're released from custody.
00:20:29.000 Right now, if you come into the country and say you want to claim asylum, you have to wait 180 days after you file your asylum application before you get a work permit.
00:20:38.000 This erases that and says basically on day one, you can apply for your work permit.
00:20:42.000 You get your work permit, you get released into the country.
00:20:46.000 And so this is essentially saying we're going to continue catch and release and we're going to give you an immediate work permit.
00:20:51.000 So that actually incentivizes more illegal immigration.
00:20:56.000 Of course it does.
00:20:57.000 Of course.
00:20:58.000 Yeah.
00:20:59.000 I mean, that's what they're coming for.
00:21:01.000 The other truly egregious provision is this idea of they're creating a new expulsion authority.
00:21:09.000 And it only kicks in if the seven day average of encounters at the border is 5,000 per day.
00:21:19.000 So it's okay if 4,999 illegal aliens come across that border every day, 365 days a year.
00:21:29.000 But if the seven day average goes over 5,000 per day, then an expulsion authority kicks in so that we can basically expel illegal aliens, which we should be able to do under current law anyway.
00:21:45.000 It's just insane.
00:21:46.000 It's like it's, you know, the states like California that are saying it's okay if you shoplift under $1,000 or whatever it is.
00:21:53.000 Yes.
00:21:53.000 You're essentially legalizing that limit.
00:21:56.000 You're saying it's fine to shoplift less than that.
00:21:59.000 We're doing the same thing with this plan with illegal immigration.
00:22:02.000 And it's absurd.
00:22:03.000 If you add up 5,000 times 365, it's 1.8 million over 1.8 million.
00:22:09.000 And maybe I'm reading too much into this.
00:22:10.000 This was my initial reaction, though, is that if they acknowledge they can get it down to 5,000, then they acknowledge that they can cut it in half.
00:22:19.000 So they're telling you we have complete control of the border is what they're telling you.
00:22:26.000 We just don't want to do it.

00:24:40.000 The way that we've articulated on the show is that Mitch McConnell selected a red state senator because they think that they're immune to any sort of political check and balance.
00:24:51.000 He's six years out from an election, so his term goes out till January 2029 because they think voters are stupid and they forget.

00:25:01.000 But he calls himself a Christian.
00:25:04.000 He talks all about biblical values.

00:25:18.000 I will say he has actually come a long way from his days in the House on immigration.

00:25:34.000 He's taken several trips to the border, and I think that has opened his eyes to some degree.

00:25:40.000 And this happens every few years in the Senate.
00:25:43.000 It's always in the Senate, it seems.
00:25:45.000 Some member of Congress, a Republican, gets in their mind that they're smarter than everyone else and they know the solution.
00:25:53.000 And all it will take is for them to sit down with the Democrats and talk about it.
00:25:57.000 And they can come up with a compromise that will work.
00:26:02.000 It never happens.
00:26:04.000 There are always, I mean, immigration is such a complicated issue.
00:26:07.000 I've been doing this for 30 years now, and there is still more to learn every day.
00:26:13.000 But they don't see the unintended consequences of the things that they're agreeing to.
00:26:21.000 And I'll tell you, the Democrats do see them.
00:26:23.000 The Democrats and Democratic staffers run circles around Republicans when it comes to setting out immigration law because the Democratic staffers usually come from places like ALA and other law groups that have been doing this for years.

00:26:43.000 I can't, you know, I think he's got himself into a position where it's hard for him to back out, but he needs to back out.

00:28:01.000 And the donor class is obviously giving money.
00:28:05.000 So, there's a competing interest there.
00:28:08.000 But the fact is that all of these millions of illegal aliens who are coming across the border and all of the millions more who would come across under Senator Langford's plan, they're not going to be hurting the elites.

00:28:24.000 They're going to be increasing housing prices because there's going to be more competition.
00:28:28.000 They're going to be increasing competition for all sorts of resources.
