00:02:16.000 I can tell you that.
00:02:17.000 That's what I'll say.

00:02:19.000 And I am on a personal mission to see people like you, or maybe you, run the state of Arizona, because we did this whole thing today about the Arizona Department of Education is your baby racist.
00:02:28.000 I'm sure you probably saw that.
00:02:30.000 I know that's not what we're here to talk about today, but my goodness, Arizona is changing too quickly.
00:02:36.000 However, to make sure it doesn't change permanently, we must do everything we possibly can to raise awareness around HR 1, House Resolution 1.
00:02:45.000 If I'm not mistaken, this has passed the House.
00:02:47.000 Is that right, Congressman Biggs?
00:02:49.000 Yeah, last night, late, we passed it out of the House.
00:02:53.000 You should say the Democrats passed it out of the House.
00:02:55.000 No, so here's just a very technical question.
00:02:57.000 Was there any committee markup?
00:03:00.000 Or is this just completely out of somebody's pocket?
00:03:04.000 That's a good way of saying it.
00:03:06.000 Yeah, no committee.
00:03:07.000 That's a no-committee hearing.
00:03:09.000 And they just took it to the floor, right to the floor.
00:03:13.000 So you had a rules committee because every bill goes through rules, but literally, I've tried to offer 13 amendments and no go.
00:03:23.000 And others tried to offer amendments.
00:03:25.000 There's nothing procedurally, Charlie.
00:03:29.000 The Democrats have basically said, we're in power.
00:03:31.000 We're in control.
00:03:32.000 We're the majority.
00:03:34.000 We're not going to go by the normal procedure.
00:03:36.000 And this is, I tell people all the time, you really need to understand what the procedures are because what pops out of this place, whether it's through somebody's mouth or whatever, it's controlled by the procedure.
00:03:47.000 And the Democrats are controlling the procedure in a way we haven't seen in probably since the history of the country.
00:03:53.000 They are acting like they have a 70-seat majority when on best days they have a seven-seat majority.
00:04:00.000 And it's almost as if the strategy for Pelosi is, I'm going to lose the House in 2022 unless I change the way we do elections.
00:04:11.000 That's basically her viewpoint.
00:04:14.000 Would you agree with that?
00:04:16.000 Oh, absolutely.
00:04:17.000 This bill is designed to solidify the Democrats as the majority party, not only as the majority party, but to make us a unitary party state.
00:04:27.000 And they'll let us win 150 to 165 seats.
00:04:31.000 They don't care because redistricting might do that.
00:04:34.000 And so they'll say, that's fine, but we'll never ever give up power again.
00:04:39.000 And they make elections irrelevant that way.
00:04:42.000 So go through the specifics of the bill.
00:04:44.000 We talked about this in another episode of our podcast, from automatic voter registration of all people, not citizens, but all people.
00:04:51.000 So illegals very well could be registered to vote.
00:04:53.000 And they go through the DMV database, the Federal Bureau of Prisons database, basically the most widesweeping voter registration program ever.
00:05:02.000 And it doesn't stop there.
00:05:04.000 It goes from allowing vote harvesting in all states, right?
00:05:07.000 Ballot harvesting.
00:05:08.000 It goes to attacks on the First Amendment, banning state voter ID laws.
00:05:13.000 I mean, Andy, walk us through this.
00:05:16.000 Yeah, so what is particularly egregious is they've basically codified every way that in the past, both right and left has said is dangerous to election integrity.
00:05:30.000 So here's, you covered it.
00:05:31.000 So let me just be a little bit more specific.
00:05:33.000 So when we talk about mail-in ballots, every state must allow mail-in ballots to everybody.
00:05:42.000 So the way that works, you're exactly right.
00:05:44.000 They're going through databases and they're going to pull people up and they're going to say, whether it's the federal prison database, Social Security, any kind of federal welfare database is going to be analyzed and the states are going to do it.
00:06:00.000 And what that does, that means we have no idea how many people are really legitimate, whether they're alive or not, because what's insidious about two things insidious, no voter registration, no voter registration.
00:06:13.000 And also, so that's what makes it really bad.
00:06:15.000 But here's the other thing.
00:06:17.000 We're not going to let you clean up your rolls.
00:06:19.000 We're going to put speed sticks in a way so you can't clean your voter rolls because we want everybody there.
00:06:24.000 So that means I'll continue to get maybe two, three ballots or more because I have, you know, I have a place here or there, whatever.
00:06:33.000 People were going to get those.
00:06:34.000 And when I say that, I don't, I'm not getting two or three, but I mean, that's what'll happen.
00:06:38.000 People who have multiple homes, people who get some kind of state benefit or federal benefit, who's calling that?
00:06:46.000 Who's cleaning it up?
00:06:47.000 Nobody.
00:06:48.000 And so when you start adding that to ballot harvesting, which Charlie, in the past, we have seen ballot harvesting when it was legal in Arizona.
00:06:57.000 We've seen it actually change elections.
00:06:59.000 A lot of people don't know what that means.
00:07:00.000 Here's what it means.
00:07:02.000 You get a paid political operative who's going out and just picking up all the ballots that he or she possibly can.
00:07:11.000 And then they turn around and they're going to take them in and vote them, vote those ballots.
00:07:15.000 And since you don't have a voter ID, we don't know anybody, if any of those people are legitimate or if they voluntarily gave those to you.
00:07:22.000 We don't know anything about those ballots.
00:07:25.000 It makes it very easy to have fraud.
00:07:28.000 And if we don't control our elections, the bad guys always win.
00:07:33.000 Bad guys always win.
00:07:34.000 And so, I mean, this bill just gets worse the more we learn about it.
00:07:38.000 And it just roared through the House.
00:07:41.000 I mean, it goes to requiring states to allow felons the ability to vote.
00:07:47.000 And it just keeps going.
00:07:49.000 I want to ask specifically about Arizona as a little bit of a side note from HR1, and I'm going to get back to HR1.
00:07:54.000 We get thousands of emails of people asking about what's the status of an audit of Maricopa County.
00:08:01.000 Can you just comment on that?
00:08:02.000 Because that is a primary concern of our listeners.
00:08:05.000 Yeah, so I won't get to all the history here, but last week, a judge said that the Senate's subpoena was valid so they can have access to all the ballots and records and the machines to conduct an audit.
00:08:22.000 The state Senate president is trying to implement that now.
00:08:27.000 The county has been, in my opinion, less than cooperative along the way.
00:08:33.000 But I'm told, I have been told that they're going to have an actual independent forensic audit.
00:08:40.000 And so that an independent forensic audit means that it's not going to be somebody selected by the people who oversee the election, number one, number two.
00:08:49.000 These are forensic.
00:08:50.000 So they are looking to see if there's any kind of misconduct that happened in it.
00:08:54.000 They're not just doing a recount.
00:08:55.000 And that's kind of what the last audit was.
00:08:56.000 It was just, oh, we saw this many votes for Joe Schmo in the sample, and it looks like it was right.
00:09:06.000 That is a recount.
00:09:07.000 That's not an audit.
00:09:08.000 An audit will go through and say, well, every ballot was supposed to be folded.
00:09:12.000 Were these ballots folded?
00:09:14.000 Do these ballots weigh the proper weight?
00:09:16.000 Is there any indication that some of these may have been pre-printed or and where did they come from?
00:09:21.000 It is a total forensic audit.
00:09:24.000 It's overdue.
00:09:25.000 And I think it will be the first independent forensic audit in the country when they complete it.
00:09:33.000 And so that has been approved by the legislature.
00:09:35.000 Is that right?
00:09:36.000 Or is that the governor need to sign it?
00:09:41.000 They just have to implement it, Charlie.
00:09:43.000 Right now, they just have to implement it.
00:09:44.000 And they're trying to figure out, I mean, you've got the county's trying to deliver all this stuff.
00:09:51.000 The state wasn't ready for it because it kind of rolled through at the last minute, but they're trying to get it all together so they can proceed.
00:09:59.000 It really won't take that long once they actually engage in the audit itself.
00:10:03.000 So now HR1 is in front of the Senate.
00:10:07.000 And the way things used to work in the House, or the way that things worked when you were in the majority, is you guys went out of your way to try to build bipartisan consensus.
00:10:17.000 You went out of your way to try to entertain the wishes of Democrats.
00:10:21.000 It always worked that way, but you guys still went out about your way to do that.
00:10:26.000 So now it's in front of the Senate.
00:10:29.000 Arizona's own Kirsten Cinema, I have been applauding, at least for defending the filibuster, because that might be one of the few things that could actually stop this bill.
00:10:39.000 Is that correct?
00:10:41.000 Yeah, that's right.
00:10:42.000 So what that means, so for people who don't know what that means, is right now in the Senate, unless there's some kind of special rule, it takes 60 votes to pass a piece of legislation.
00:10:54.000 And so they would need 60 votes on HR1 that said you have to have 10 Republicans crossed, basically.
00:11:01.000 And right now, I've been talking to some Senate colleagues, and Mitch McConnell said it publicly.
00:11:07.000 The Senate colleagues confirmed this.
00:11:08.000 He is doing all he can to make sure that he keeps all Republicans a no vote on that.
00:11:14.000 It is such a horrific.
00:11:16.000 I think even Collins and Murkowski won't vote for this.
00:11:18.000 Yeah, I think that even though.
00:11:20.000 And so therefore, in order to get to cloture, they would need to break the filibuster, but they would still need 50 votes, right?
00:11:30.000 And does it look like Senator Sinema is going to do that to break the filibuster for that?
00:11:38.000 I don't believe she will.
00:11:40.000 I haven't spoken to her.
00:11:42.000 She's going to do what she's going to do.
00:11:44.000 So I'm not sure.
00:11:46.000 But she and Manchin in the past have said that they are going to resist these, the anti-filibuster movement, if you will.
00:11:56.000 And I, I mean, I'll say I think she deserves credit for that.
00:11:59.000 And I don't know.
00:12:00.000 She does.
00:12:00.000 Absolutely.
00:12:01.000 Yeah.
00:12:01.000 Mark Kelly, I don't know what he's doing, but she's becoming a very hated person to the Democrat Party.
00:12:07.000 And I mean, this bill is so bad.
00:12:09.000 I'm willing to applaud and congratulate anyone for standing up against, even on a process thing, to not allow something like this to actually ensue.

00:15:07.000 And, you know, you were someone that was courageous in talking about election integrity, talking about ballot process, talking about signature verification.
00:15:14.000 This does the opposite.
00:15:16.000 This goes in the reverse, where we really, if we did nothing, it would be better than this.
00:15:22.000 So what are the specific measures we should be doing in Arizona and Georgia?
00:15:27.000 I'm talking about offensive measures to fix the way we do elections.
00:15:31.000 I love the audit.
00:15:32.000 I think it's great.
00:15:33.000 But, you know, Andy, when I see that it took us a week and a half to count ballots in Arizona, I'm ashamed of that.
00:15:40.000 When I hear about people's voting location changes and ballot issues and all of that, what are the specific action steps so we can restore people's faith in our elections?
00:15:52.000 Well, I think there's a number of things we can do, Charlie.
00:15:55.000 Number one, one of the first things I would do is I would disaggregate the voting centers and get back to precinct voting.
00:16:01.000 And I would actually make the precincts smaller.
00:16:03.000 Right now, precincts are pretty good sized.
00:16:05.000 But when you say we're going to aggregate voting centers, so you have lots of different precincts that can go.
00:16:10.000 And then you say they can go anywhere they want.
00:16:13.000 You get rid of the natural check.
00:16:13.000 Guess what?
00:16:15.000 So a lot of times when you have precincts, it's your neighbor who sits there and say, Charlie, oh, hey, Charlie, how are you doing?
00:16:21.000 Good to see you.
00:16:21.000 Back here to vote again.
00:16:23.000 We need to stop that.
00:16:25.000 I mean, we need to get back to that because this aggregation into one place really gets rid of some of those checks.
00:16:32.000 So that would be step number one and two with that.
00:16:36.000 The next thing is, I think you need to get back to limiting your absentee ballot to people who really are going to be out of the country, whether it's military ballots, people who are disabled or have health problems or who really have to apply for it every time.
00:16:51.000 So the Pebble, the permanent early ballot, early voting list, that can be a problem.
00:16:57.000 I mean, I'm on there.
00:16:57.000 I like it.
00:16:59.000 Maybe it's not as clean as we would like.
00:17:01.000 I guess a third thing that you would do is you would say, we're going to make sure that we make it easier to clean up those voter lists in Arizona.
00:17:09.000 And one of the measures that I was trying to get put in this bill is you have to clean it up within 90 days.
00:17:15.000 You have to always get rid of the registrations of people who have died or moved.
00:17:21.000 You got to clean that up within 90 days.
00:17:23.000 Why?
00:17:24.000 Because those are the ballots that can just be floating around and voted by people.
00:17:28.000 So those are some immediate things you should do.
00:17:30.000 I tell you some other things that they ought to do.
00:17:33.000 I think you're right.
00:17:35.000 It's terrible that we're counting ballots a week, two weeks after.
00:17:40.000 As a guy who went through a close election one time, I can tell you, it is murderous to sit there just waiting for a long time to find it if you want.
00:17:48.000 And then you go through the recount period, which is another two weeks.
00:17:51.000 So they need to design this.
00:17:53.000 The Constitution says election day.
00:17:56.000 It doesn't say election month.
00:17:58.000 And we got to clean that up.
00:18:00.000 And then I guess maybe one more thing that we could do that would really be helpful is we need to make sure that we are conducting an audit, not necessarily a recount, but an actual forensic audit and making sure that those go.
00:18:16.000 I mean, I thought Arizona did a fairly decent job before this last election, but I will tell you that a National Rating Service put us kind of like right in the middle of the pack to the lower half.
00:18:28.000 So it tells me that there's a lot of things we can really do to make this better.
00:18:32.000 And we should.
00:18:34.000 And one other thing, I got to say this.
00:18:38.000 You can't allow the presidential electors to be on autopilot anymore.
00:18:43.000 The state legislature is supposed to determine the manner.
00:18:47.000 And they did, but they put it on autopilot.
00:18:50.000 So it really was like the Secretary of State and the governor.
00:18:53.000 And so if there were ever any question, the legislature has to get back into special session.
00:18:58.000 Well, they can't get in back into special session.
00:19:00.000 Why?
00:19:01.000 Why couldn't they?
00:19:02.000 I never understood that.
00:19:03.000 Well, because it takes two-thirds votes to get back into special session in Arizona under the Arizona Constitution.
00:19:10.000 And it's too close.
00:19:11.000 So you had 16 in the Senate and you had 31 in the House.
00:19:16.000 So it just weren't enough to get to two-thirds.
00:19:17.000 The Democrats were never going to go back in.
00:19:19.000 The only other way you get in is if the governor wants to go in.
00:19:21.000 In this instance, the governor didn't really want to go in.
00:19:24.000 Why?
00:19:25.000 I think because he understood that he might lose some, maybe some, I don't know.
00:19:29.000 You'll have to ask him, but maybe thought he was going to lose some of this executive authority that came out with regard to the COVID stuff.
00:19:35.000 But the point is, no more autopilot to certification of your electors.
00:19:41.000 The legislature should have to come back in together, hear the presentation before they, and then vote to certify and then hand it over to the governor at that point to make the official certification.
00:19:55.000 No more autopilot.
00:19:56.000 That's what happened this last time.
00:19:57.000 It didn't work out real well.
00:19:59.000 Totally.
00:20:00.000 Yeah.
00:20:00.000 I couldn't understand for the life of me why the governor didn't call a special session.
00:20:04.000 A special session very well could have addressed a lot of these matters in November or December, especially when it came to the electors.
00:20:12.000 No, that's exactly right.
00:20:13.000 So there's two ways to get in a special session.
00:20:15.000 It's either two-thirds or the governor calls you in.
00:20:18.000 And if they would have called in early, and this is one of the things I said was necessary.
00:20:22.000 I said, you need a special session of the legislature, number one.
00:20:25.000 Number two, you should start your independent forensic audit immediately.
00:20:30.000 We would have been done by the 1st of December for sure.
00:20:34.000 Guess what?
00:20:35.000 If there were no problems, we would have put it to bed.
00:20:37.000 If there were some problems, we would have known.
00:20:39.000 We could have tried to rectify those, and we would have been ready by the December 14th timeframe.
00:20:45.000 But we didn't do that.
00:20:47.000 That's a crying shame.
00:20:48.000 So, Congressman, I know you have a tight schedule to keep, and I want to thank you for coming on, but I want to end with just talking about Arizona.
00:20:55.000 Arizona is where we're doing our broadcast from right now.
00:20:58.000 We employ a lot of people here.
00:20:59.000 I did a whole segment.
00:21:00.000 I did a whole hour around the Arizona Department of Education and around the direction of Arizona.
00:21:05.000 They just legalized weed, raised taxes, two Democrat senators, electors to buy it in people piling out.
00:21:11.000 And I said on the broadcast, if Arizona does not get their act together, we're done.
00:21:16.000 We're going to Florida and we'll take our jobs with us and we're going to do it quickly.
00:21:20.000 And I wish that wasn't the case because I love this state.
00:21:23.000 But I fled Illinois for a reason and I feel like we're recreating it here.
00:21:28.000 Can you comment on the state of affairs in Arizona?
00:21:31.000 Why are we trending in this direction where critical race theory is being taught in our schools, where we're legalizing weed?
00:21:37.000 Help us make sense of all this.
00:21:40.000 Well, Charlie, I don't blame you.
00:21:42.000 By the way, you're not the first person that I've talked to since the election that has talked about the taxes and the weed and all the other things that have caused such enormous problems for our state.
00:21:53.000 We begin to look like Californian.
00:21:55.000 And I would say that's part of our problem.
00:21:57.000 We've had so many people come in from California.
00:22:00.000 Charlie, I will go speak to businesses that relocate, and I will thank them for coming.
00:22:05.000 I tell them, this is why you're here.
00:22:07.000 Lower taxes, fewer regulations, better infrastructure.
00:22:11.000 You can feel free.
00:22:12.000 It's cheaper cost of living.
00:22:15.000 Please don't vote to turn us into California.
00:22:17.000 They all kind of chuckle and titter.
00:22:20.000 And then a few of them get it.
00:22:22.000 A few of them get it.
00:22:23.000 They say, oh, my gosh, you may be right.
00:22:25.000 But not enough of them get it.
00:22:27.000 So the voters are constantly coming here from California and turning us into California.

00:22:51.000 And just eight years ago, Charlie, we had a super majority of Republicans in the House and the Senate in this state.

00:23:03.000 Now, we're going to have to ratchet this back.

00:23:12.000 We need the Independent Redistricting Commission to give us a fairer set of districts.

00:23:34.000 But we need to make sure that we're solidly 6'4 going ahead in that.

00:23:55.000 That's how much Mark Kelly spent, $97 million against Martha McSally.
