00:01:25.000 It's great to be here with you.
00:01:27.000 So, Molly, a lot of people are scratching their head.
00:01:29.000 And, you know, we did a whole hour about the failures of Maricopa County and the machines going down and all that.
00:01:34.000 But just more broadly and generally across the country, can you help explain why the data was so off?
00:01:41.000 Not just the polling data, but people had early voting forecasts and kind of predictions.
00:01:48.000 It was all off.
00:01:49.000 How was that possible, Molly?
00:01:51.000 So the first thing I think it's important to remember is that in some sense, it wasn't off.
00:01:57.000 And that's why everybody feels so weird about what happened.
00:02:00.000 And what I mean by that is Republicans did win the generic ballot.
00:02:05.000 They did have millions more voters.
00:02:08.000 We do know that three out of four people in the country are upset with the direction of the country, that President Biden has low approval ratings, that, you know, objectively speaking, the economy is bad.
00:02:19.000 We have no border.
00:02:21.000 You know, crime is skyrocketing.
00:02:22.000 These are all real things that contribute to the confusion people feel about the end result.
00:02:28.000 And I think that while there are, you know, easily you could, usually when people name a thing that they think went wrong, they're right.
00:02:35.000 I think one thing that people really need to understand at a very high level, and I do appreciate that you get this, is that Democrats really targeted their ballot harvesting operations in key races, you know, 20, 25, 30 key house races.
00:02:51.000 They turned on their machine in those places.
00:02:55.000 And I don't mean like a physical machine.
00:02:56.000 I mean a getting the ballots into the boxes kind of machine and maybe like five Senate seats.
00:03:03.000 They didn't do all over the country.
00:03:05.000 They just knew where they were vulnerable and they focused there.
00:03:08.000 And I think that actually explains why New York saw such big gains.
00:03:12.000 You had, what, five seats flipped to the Republican?
00:03:15.000 Because Democrats really didn't turn on their machine there.
00:03:19.000 Or you look at a state like Florida, which like New York had a 17-point swing in Republicans' favor.
00:03:25.000 I think the big thing there, in addition to good candidates and slightly better election integrity laws, the Republicans have a machine in Florida that banks ballots.
00:03:36.000 They do have, they did have a good handle on how many early votes they had.
00:03:39.000 And so if Republicans want to win elections ever again, they A, should continue their efforts to return to an election day type situation.
00:03:51.000 That's just better for the country.
00:03:53.000 But until and unless they achieve that, they absolutely need to play the game according to the rules that are there, which means banking ballots early so that you don't lose the whole race two weeks before election day.
00:04:06.000 Yeah, so I guess, Molly, what we're looking at is, I mean, and it's taking us a little while to realize this, Democrats designed it.
00:04:12.000 It's the world that Mark Elias designed and we're just living in it, is that the idea of politics now is less about debates, Katie Hobbs than debate, less about candidate equality, Fetterman, just look at it.
00:04:24.000 I mean, that's ridiculous.
00:04:25.000 Less about leadership, Joe Biden stayed in his basement.
00:04:28.000 And now it's kind of this 40 to 45 day game.
00:04:33.000 It's a game now where it's basically, can you be on television relentlessly to at least get to some equilibrium with independence?
00:04:42.000 Can you have a machine to go find as many pieces of paper as possible?
00:04:46.000 I think Democrats are breaking the law when they do this, but it's awfully clandestine.
00:04:50.000 And we have evidence of that time and time again.
00:04:52.000 But let's pretend they're not.
00:04:54.000 They still have a mass ballot harvesting operation in states you can do that.
00:04:58.000 And so do Republicans and conservatives now need to realize that politics has fundamentally changed.
00:05:04.000 It really doesn't matter if you have a good message anymore.
00:05:06.000 It doesn't matter if you're able to excite people.
00:05:07.000 Your thoughts, Molly?
00:05:09.000 This is why I say the changes are bad for the country.
00:05:12.000 When you had an election day model, it was about building momentum, building cohesion, persuading people, building excitement, because whether you wanted to vote or not was actually one of the ways that democracy works.
00:05:26.000 And with this ballot harvesting operation that we've moved to, you might not even know there's an election.
00:05:32.000 You might not know who's running.
00:05:33.000 You might not know the issues, but you get enough ballot chasers put on your behind.
00:05:39.000 You're going to get your ballot in, even if you're one of the least propensity, the least informed voters out there.
00:05:45.000 It's not healthy, but it's just, again, the way it is.
00:05:48.000 Well, look, and so Democrats seek ballots, Republicans seek voters.
00:05:52.000 And there's a huge difference, right?
00:05:54.000 I mean, we go seek modeling and like, well, who's going to be able to persuade to our message?
00:05:58.000 Where they just go all in and they have drop boxes on college campuses and they're able to run up the score in ways that are probably illegal, by the way, Molly.
00:06:07.000 For example, at Arizona State University, entire sororities were bringing in boxes of ballots, of which a state it's illegal to ballot harvest.
00:06:13.000 And they say, well, we are all housemates.
00:06:16.000 I guarantee not every single person is living in that sorority house.
00:06:18.000 There's not 70 people living in that house.
00:06:21.000 Some people are probably in dorms and they're in apartments.
00:06:22.000 It doesn't matter.
00:06:23.000 No one enforces the law.
00:06:24.000 And so, Molly, here's the problem, though.
00:06:26.000 The more I talk about this, our audience is not on board.
00:06:29.000 They say, I do not want to participate in drop boxes.
00:06:32.000 I don't want to participate in early voting.
00:06:34.000 Is there going to have to be some form of a behavioral and attitudinal change if we're ever serious about winning again?
00:06:42.000 Well, I don't, I actually agree with people who say that these are bad things.
00:06:46.000 So it's very difficult for me too.
00:06:47.000 I think it's horrible for the country that we have moved to unsupervised balloting.
00:06:52.000 It's so ripe for coercion, illegality, and other problems.
00:06:57.000 It's not a good thing.
00:06:58.000 The challenge is that if you don't play according to these new rules that Democrats have spent, frankly, decades putting into place, but were able to accomplish thanks to COVID hysteria.
00:07:10.000 If you don't play according to those rules, you'll never have power ever again.
00:07:15.000 So in some of these states, like, how do you win the state legislature to reform and strengthen election integrity if you can't win the election?
00:07:24.000 What are you going to do?
00:07:25.000 So the thing is, like a lot of people oppose it, and it is true that Republicans are overwhelmingly less likely to vote early, but there are a lot of groups that are fine with it.
00:07:36.000 In fact, most people don't share our opinion that it's bad for the country.
00:07:42.000 All the election integrity stuff polls extremely well, except for unsupervised balloting, which is the big one, where people actually tend to support mass unsupervised balloting.
00:07:53.000 So I think it's a tricky message, but it's just one that needs to get through.
00:07:57.000 You would need a ground game.
00:07:58.000 And this is something that Republican leadership could provide guidance on.
00:08:02.000 You need to be banking a certain number of ballots per day.
00:08:05.000 You need to be targeting who you're getting those ballots from.
00:08:08.000 And you just need.
00:08:11.000 If you care about, if you think that you're helping the people by having power, you need to get power and you need to play according to the rules as the law has them now.
00:08:20.000 And what's nuts is that, you know, Democrats were behind their projections in Arizona.
00:08:20.000 Yeah.
00:08:25.000 And inexplicably, there was this, not inexplicably, 100, 150,000 ballot drop that happened in the course of 48 hours.
00:08:33.000 It just, it happened at a left field.
00:08:35.000 I wonder if that isn't from something else that happened this election, which is that Joe Biden had federal agencies spend taxpayer money to get involved in the ballot operation.
00:08:47.000 And one of the ways that they most emphasized this was in exploiting federal work study programs on college campuses.
00:08:57.000 And they matched it with the, you know, since fought by courts promise to pay off student debt through fear-mongering about ending unborn human lives.
00:09:10.000 Like all these things kind of worked together.
00:09:12.000 They had orders that went out to college campuses to be receptive to this federal work study scheme.
00:09:18.000 I bet that had a lot to do with Arizona, which has such a large campus population.
00:09:23.000 Yep.
00:09:24.000 And then you have also the, as you mentioned, the federal agencies even on top of that and military bases and all sorts of different types of things.
00:09:31.000 And look, the FOIA requests, when the FOIAs were actually done, it showed a bunch of blacked out pages as well regarding what exactly happened with the federal agencies becoming basically get out the vote operations.
00:09:43.000 Despite all of that, Republicans won the generic ballot and there were a lot of victories to celebrate.
00:09:49.000 But again, 2020 was the first chapter.
00:09:52.000 This is the second chapter.
00:09:53.000 And I'll tell you what, everybody, politics is dead as you know it.
00:09:57.000 Messaging and all that stuff matters on the edges and the margins.
00:10:00.000 It's now just a matter of how many human beings you can have chasing how many pieces of paper and putting them in a box.
00:10:05.000 Ready, set, go.
00:10:05.000 It's a game.
00:10:06.000 40 days.
00:10:07.000 Who can do it?
00:10:08.000 And if we're not going to play the game, we're going to keep on having some par results.

00:11:20.000 So, Molly, I think one of the other kind of struggles people have is maybe we set our expectations too high.
00:11:27.000 There is a debate on the right of the role that Dobbs played in this election.
00:11:32.000 I do believe that in certain states, especially in the state races, interestingly enough, it was actually an anchor, especially in Michigan and in Wisconsin.
00:11:42.000 In a year that otherwise should have been a very good year, we lost by five, six, or seven points when we had really good candidates.
00:11:48.000 What are your thoughts, Molly?
00:11:49.000 It's very confusing to decipher it.
00:11:51.000 I mean, you take very strong pro-life governors like Ron DeSantis, Bill Lee, Brian Kemp, Greg Abbott, who signed effectively, or, you know, who's in a state that essentially has an abortion ban, they all won their reelection.
00:12:09.000 Incumbent pro-abortion supportive governors also did well.
00:12:15.000 I think there was clear failure on the part of the Republican Party to deal with that issue.
00:12:22.000 And it's criminal because they knew it was coming.
00:12:25.000 They knew they had the leak.
00:12:27.000 They knew it was likely to be overturned.
00:12:29.000 They should have had a plan in place.
00:12:31.000 And I saw that the people who support abortion spent $391 million on targeted messaging compared to $11 million for pro-lifers.
00:12:42.000 That's just inexcusable.
00:12:45.000 And you might not win the issue.
00:12:47.000 You know, it was a big change in abortion policy and one that many people had worked very hard for and had prayed for for a very long period of time.
00:12:55.000 You can certainly get it to a draw.
00:12:57.000 And instead, Republicans kind of did this ostrich head in the sand approach of showing that not only were they weak, but they were scared to talk about it.
00:13:07.000 In fact, the vast majority of Americans support at least some protections for unborn children.
00:13:13.000 They might not want to ban all abortion, but it's like two, three quarters of the country supports a second and third trimester ban.
00:13:21.000 And instead of saying that, Republicans were just terrified and you could see the terror in their eyes.
00:13:26.000 They didn't know how to talk about it.
00:13:28.000 And it really was once again, letting down their voters, letting down their base.
00:13:32.000 And it really is inexcusable.
00:13:34.000 Yeah, I mean, I think that in certain states, if there would have just been a clear messaging of, hey, we're pro-life.
00:13:41.000 We know the country has some nuance on it and we stand for heartbeat, heartbeat, heartbeat on the state level.
00:13:46.000 I think heartbeat is very popular.
00:13:47.000 I do.
00:13:48.000 The problem, Molly, and I could say this in Arizona, because we lost a very critical state Senate race, Nancy Bartow, who's a great American, they were running ads relentlessly that they want to, Republicans want to jail doctors.
00:14:00.000 And look, I'm 100% pro-life, but most people are not.
00:14:02.000 They don't, they believe in exceptions for rape and incest.
00:14:06.000 They do.
00:14:06.000 Most people do.
00:14:08.000 And they ran that relentlessly, relentlessly, Molly.
00:14:12.000 And I think that our candidates were just unable to be able to message or to kind of, you know, navigate past that, if you will.
00:14:22.000 Yeah, well, they, it is difficult when you've got, I mean, you could spend $400 million and convince someone that, you know, someone's evil because they hate puppies.
00:14:31.000 You know, like you can do anything with $400 million.
00:14:34.000 But again, every single, every single Democrat at the national level has supported not codifying Roe, as they claim, but actually no protection for unborn children or their mothers through all nine months of pregnancy.
00:14:50.000 Some of them even support no protections after the pregnancy is over, meaning the child is born.
00:14:55.000 If you, you know, what should have been happening was help so that people could swiftly pivot to pointing out the extremism of pro-abortion Democrats, which is on the record.
00:15:06.000 They actually have voted for this multiple times.
00:15:10.000 This would have been helpful instead of just hoping the issue would go away or hoping that other issues would predominate.
00:15:16.000 But, you know, again, people can get a little too, I know, I know it's very bad.
00:15:19.000 There are particular races and Gretchen Whitmer and things like that, but there were also a lot of pro-life successes as well.

00:17:57.000 So, the president announced for his third time for his second term to try to get a second term back, I guess I could say.
00:18:07.000 What has this changed legally?
00:18:08.000 It's been such a topic of the mainstream media with all the investigations.
00:18:12.000 What is this change, if anything?
00:18:15.000 Honestly, not much.
00:18:16.000 I know that there's speculation that it will change the optics of the DOJ or the FBI in terms of putting in any additional investigations or bringing any charges, but I think that that's a very dated thought.
00:18:34.000 I think that the DOJ and the FBI that we're seeing these days don't really care, especially when it relates to Trump.
00:18:41.000 So, I honestly, nothing.
00:18:44.000 I know that it makes it politically charged that appearance if they do bring something, but that doesn't really matter.
00:18:51.000 I can tell you, you know, all of my cases are still going and are very active.
00:18:55.000 And there's been absolutely no change in direction since he announced.
00:18:59.000 Yeah, so I mean, there's a lot of these investigations that are ongoing and that are happening.
00:19:04.000 And I know a lot of people are curious about it.
00:19:08.000 So, what can we expect from the president moving forward?
00:19:10.000 What are his next steps when it comes to these legal fights?
00:19:16.000 I mean, you know, I think he's just going to take them one at a time.
00:19:19.000 I really don't think we can do anything to strategically move them along.
00:19:26.000 We have judges that are very active.
00:19:30.000 You know, obviously Letitia James' case up in New York, we have a judge who's been incredibly difficult, but we're moving right along in that.
00:19:41.000 We're trying to work with the AG, like we've always said.
00:19:44.000 You know, we're all these cases, we cooperate as much as we possibly can.
00:19:49.000 And I think he's going to continue to do so.
00:19:52.000 You know, they're on track.
00:19:54.000 Some of them have trials.
00:19:56.000 I had a trial that started a couple of weeks ago.
00:19:59.000 You know, we just really can't change our path.
00:20:01.000 And our path is to get through them, get to the bottom of them and show that they're frivolous, you know, and that's it.
00:20:07.000 That's all we can do.
00:20:09.000 Yeah.
00:20:09.000 So from a campaign standpoint, is there anything you can kind of cue us into about things he might be doing differently or reimagining his campaign for 2024?
00:20:19.000 So I can tell you the team is being, the team is strong on the campaign so far.
00:20:26.000 I am really looking forward to seeing what their leadership does.
00:20:30.000 I think that the message should be, in my opinion, and I've told him this, and I really believe that the message should be moving forward and really taking a look at how terrible our country has been in the last two years.
00:20:46.000 And I have said this before, I'll say it again.
00:20:48.000 I don't know anybody that could say that their life is better in the past two years.
00:20:51.000 And we went through a pandemic with President Trump.
00:20:55.000 So that's a lot.
00:20:56.000 I think he's got to really, he's looking at his policies and he's always been active.
00:21:00.000 You know that, Charlie.
00:21:00.000 He's so active and he's so in tune with everything that I think it's going to be obviously more formal.
00:21:06.000 There will be guardrails put up with all of the regulations that go into place.
00:21:11.000 But he's going to start to really put into place people that he trusts and move along to get people out to vote.
00:21:21.000 So we haven't really talked about the Mar-a-Lago raid in quite some time.
00:21:26.000 What can you tell us about the status update of that entire investigation, which was insane from the beginning?
00:21:34.000 What's the latest there?
00:21:36.000 I'm not on that Mar-a-Lago case.
00:21:38.000 I'm not the attorney on it.
00:21:40.000 So my knowledge is pretty much the same as yours.
00:21:42.000 We try and, you know, we compartmentalize everything.
00:21:46.000 My hands have been very full with other things.
00:21:49.000 But my understanding is they're cooperating on that and communicating with the DOJ and trying to work that out.
00:21:55.000 I mean, that's what I would assume.
00:21:57.000 Yeah, I mean, it was such an incredible overreach of power in almost every single way possible and imaginable.
00:22:06.000 Are you on the case of the subpoena from the January 6th committee in that ongoing situation?
00:22:10.000 No, no, I'm not.
00:22:12.000 Harmee Dillon is handling that case and doing a great job with it.
00:22:16.000 And I understand that they filed a motion recently because they couldn't get an agreement on terms.
00:22:23.000 You know, I think that what the J6 committee did with video depositions or interrogations and then parsing out the parts that they want and airing them was so corrupt.
00:22:35.000 You know, this is not, this is a legal issue.
00:22:38.000 This is not a soap opera.
00:22:39.000 And I think we have to make sure that we focus on the people that are still in jail, the people that have been in solitary confinement, that get an hour out a day, that many of which they haven't even had their day in court.
00:22:55.000 So I'm not saying there are people that did things wrong that day.
00:22:58.000 There were, but everybody should have their day in court.
00:23:00.000 There is no reason that you should be politicizing something like this and having individuals with families, with children suffering for what?
00:23:08.000 You know, it's just not, it's not okay at all.
00:23:12.000 So there hasn't been a lot made of kind of some illegal wins here.
00:23:16.000 The media wants to shut up President Trump.
00:23:19.000 But talk about some of the big wins that you actually can celebrate legally.
00:23:23.000 Yeah, we had some great wins.
00:23:25.000 For me, top of mind is this week we won a lawsuit against Michael Cohen.
00:23:30.000 He brought against the United States and Bill Barr and Donald Trump, of course, for First Amendment violations.
