00:23:17.000 This means the Trump White House can now withhold funding without the district court's prior approval.
00:23:22.000 But there are other injunctions that are happening in the most radical senses, especially out of New York and those districts that are so outrageous.
00:23:31.000 Senator, I know this is a serious question, and so I don't mean to put you on the spot, But is there a threshold where impeachment of federal judges would be considered?
00:23:40.000 The threshold's real high on that, and then I don't really know how much room we have in the Senate to do this.
00:23:47.000 What I would like to see, and I propose this, and actually when I was in the House, is to have a board set up, either a board that is made up of just our Supreme Court justice, that when a district judge in this case is getting overruled on constitutional authority, then at so many times they get removed or get put on probation and then eventually...
00:24:10.000 We see this all the time, that judges are making decisions based on 100% political feelings.
00:24:16.000 And that's why our judges were supposed to be appointed, so they'd be above politics.
00:24:22.000 But we find Republicans and Democrats, we judge shop all the time to try to find a judge that's going to be favorable to us.
00:24:29.000 If it would just be simply based on constitutional authority, period, and not your opinion or your political opinion, then we'd be fine with that.
00:24:36.000 But there's got to be some accountability that's brought to these judges that are appointed to a lifetime bench, because otherwise we're going to continue and it's going to just get worse.
00:24:44.000 So Congress is going to have to take a hard look at this.
00:24:47.000 The White House is going to take a hard look at this.
00:24:49.000 This should be honestly bipartisan.
00:24:51.000 If we try to do it on a partisan basis, we'll be opening a whole can of worms.
00:24:56.000 If we do this on a bipartisan basis and actually build a hold accountable, hold these judges accountable, much like our constituents are supposed to hold us accountable, then I think you'll see a lot more clarity happen in the courts.
00:25:08.000 Government justice is supposed to be really for the people.
00:25:10.000 I mean, the House is for the people.
00:25:13.000 Congress is for the people, but the courts are what holds the executive branch and the legislative branch accountable for the people.
00:25:23.000 Because it's supposed to interpret 100% our bill of rights and our constitution.
00:25:27.000 And unfortunately, you're seeing political rulings come off the bench more often than you actually see constitutional rulings.
00:25:32.000 Well, and to reiterate that point, we saw this in Brazil, and to a lesser extent in Israel, where a weaponized judiciary basically runs the entire country.
00:25:40.000 And the sovereign aren't there, and you kind of have a philosopher king ruling class, a legal oligarchy that starts to set in.
00:25:49.000 And Brazil is the best example, Israel to a lesser extent.
00:25:53.000 And so can you explain more of what your idea is, just so I understand it, of how we could prevent that?
00:25:58.000 What our ideal is, is so you use this judge that just got overruled, and you say, okay, well, this is strike one.
00:26:06.000 You just got overruled, constitutionally speaking, so you didn't interpret it correctly.
00:26:10.000 Give us your findings.
00:26:12.000 What made you decide to do this?
00:26:13.000 Have a higher court actually go over his findings and say, this is how I made the decision.
00:26:18.000 This was the opinions I came up with, and this is the opinions I based it on, either previous case law or constitutional purposes.
00:26:26.000 And if he can't explain that, how he came up with that, and it actually made sense, then he gets brought up to a higher court to say, do you get put on probation?
00:26:34.000 Strike one, strike two, or strike three before you get on probation.
00:26:36.000 If you continue down that road, then you're going to be put in.
00:26:39.000 And what I mean by probation, at that point, you'll have another court overlooking your decisions, and you're going to have to explain those decisions prior to them being made.
00:26:47.000 That's what probation would look like.
00:26:49.000 If you continue down that road, once you get on probation, then you'll be removed from the bench.
00:26:53.000 So it's the same thing as impeaching them, but it's not the impeachment has been used for political power now.
00:26:59.000 This would be the courts holding the courts accountable.
00:27:01.000 So judges holding judges accountable, much like lawyers with the Bar Association holds lawyers accountable.
00:27:06.000 Well, and just to reiterate the point, we have more than 200 district court judges.
00:27:12.000 It's not sustainable to our republic for every random district judge to think their gavel gives them the power to veto over a presidency.
00:27:21.000 That's right.
00:27:21.000 The President of the United States.
00:27:23.000 The bill to override the President of the United States, a district judge, can uphold that hearing.
00:27:28.000 That should be stopped itself.
00:27:30.000 So what level does that need to be heard at?
00:27:34.000 Is it the Supreme Court that needs to be taking up these decisions?
00:27:37.000 The problem with you having a Supreme Court decision, then there's no court to go over them.
00:27:43.000 So there is a balance that has to be made.
00:27:45.000 Honestly, I haven't even put a lot of thought in that one.
00:27:47.000 So, President Trump's team is moving at a rapid pace.
00:27:51.000 As I mentioned, the Secretary of the Treasury, Scott Besant, is in Ukraine.

00:28:00.000 But a minute and a half, Senator, your thoughts on the developing diplomacy happening between Russia, Ukraine, Israel, Gaza?
