00:01:48.000 And they especially want the third branch of government, Article 3 of the United States Constitution, the Supreme Court, to act in absolute lockstep harmony with the administrative state.

00:02:05.000 You want the borders wide open?
00:02:07.000 You want to have the military go totally trans?
00:02:09.000 You'll find enough legislators to kind of just turn a blind eye.
00:02:12.000 The executive branch is the administrative state, that fourth branch of government.
00:02:16.000 But the Supreme Court, largely thanks to President Donald Trump, by the way, President Donald Trump winning the 2016 election, giving us Amy Coney Barrett, Neil Gorsuch, and Brett Kavanaugh running the table.
00:02:28.000 Three Supreme Court justices that have largely done a great job.
00:02:32.000 I mean, there's been some decisions I don't like, but it's been a great job.
00:02:35.000 Has changed the game.
00:02:36.000 Now, all of a sudden, there is a counterbalance to this non-stop blitzkrieg on our freedoms and liberties brought to you by the unchecked fourth branch of government.
00:02:48.000 You see the Supreme Court striking down Roe versus Wade, reconsidering the Chevron decision, reconsidering the Lemon decision.
00:02:56.000 They're restoring the Constitution as the bedrock authority for the American government, and the left doesn't like that.
00:03:04.000 You see, the left, they have pathological ambitions and means, but they also have some petty and personal ones as well.
00:03:10.000 And there is an all-out campaign, an all-out assault against one of the most honorable individuals ever to serve in the United States government, ever to be in a position of authority and leadership.
00:03:22.000 Someone that our children should learn about, someone that grew up in absolute poverty and ascended to a seat on the U.S. Supreme Court.
00:03:30.000 He's been maligned and smeared and attacked in every possible direction.
00:03:34.000 And it's a man who they believe never should have been on the U.S. Supreme Court.
00:03:39.000 And by the way, he is now by far, with the death of Antonin Scalia, which happened, boy, when did that happen?
00:03:45.000 That happened seven years ago almost.
00:03:46.000 Geez, that was January, February 2016, if I remember correctly.
00:03:50.000 He is by far the most conservative member on the U.S. Supreme Court.
00:03:54.000 Him and Alito.
00:03:55.000 I mean, you read their opinions like, whoa, that's something else.
00:03:59.000 That is just unbelievable.
00:04:01.000 And you look at Clarence Thomas, he says Dobbs is just the beginning.
00:04:04.000 I mean, they want to go after other decisions.
00:04:07.000 They want to go against the Obergefeld case, which you're not even allowed to say that, the same-sex marriage case that overturned states' rights and individual initiative on a state level.
00:04:17.000 The left has hated Clarence Thomas since the moment George H.W. Bush, to his credit, nominated him to go to the U.S. Supreme Court.
00:04:25.000 Now, remember, Supreme Court hearings used to not be very contentious.
00:04:29.000 Used to be 98-nothing and 72-10, kind of boring, you know, okay, great, passer-by.
00:04:36.000 But then the Democrats decided to cross the Rubicon.
00:04:39.000 The Democrats decided to derail one of President Ronald Reagan's nominees, the great Robert Bork.
00:04:48.000 Robert Bork should have been on the U.S. Supreme Court.
00:04:50.000 He was an unbelievable writer.
00:04:53.000 He knew the Constitution through and through, but they went after him and they went after him very, very hard.
00:05:01.000 They not just condemned him, they mocked him.
00:05:03.000 They made him seem like a radical, which he wasn't.
00:05:05.000 He was a thoughtful, reasonable person.
00:05:08.000 And the term borking, a nominee, was born.
00:05:12.000 That you could derail a nomination.
00:05:14.000 And they tried to do this to Kavanaugh, by the way, and they were unsuccessful.
00:05:17.000 And basically, they were able to consolidate 58 Democrats to 42 Republicans to reject a Supreme Court nominee, the first of which in over 50 years to be rejected by the U.S. Senate.
00:05:32.000 Joe Biden was the instrumental person.
00:05:36.000 He was the chairman of the Senate Judiciary Committee and derailed Robert Bork's attempt to go on the U.S. Supreme Court.

00:05:48.000 As a nationally known jurist and legal scholar, Robert Bork was a mainstay of conservative jurisprudence for more than half a century.
00:05:56.000 Those views fueled a titanic struggle over his 1987 nomination to the U.S. Supreme Court, a fight that became a seminal moment in altering the process for all future nominees.
00:06:08.000 Bork's Supreme Court confirmation hearings unfolded in September 1987 and heralded a historic struggle over the ideological composition of the federal courts.
00:06:18.000 The judge's responsibility is to discern how the framers' values, defined in the context of the world they knew, apply in the world we know.
00:06:30.000 Brilliant.
00:06:30.000 I mean, Ted Kennedy, who was an evil person, how many times can you say Chappaquittick was involved?
00:06:38.000 Joe Biden was involved.
00:06:39.000 This same cabal.
00:06:40.000 It's like they never go away.
00:06:44.000 Bork was unbelievably thoughtful, but they got rid of him.
00:06:47.000 And they thought, oh, wow, they saw we now have a blueprint.
00:06:50.000 We can now execute a fundamental transformation of the country by now politicizing Supreme Court hearings.

00:06:59.000 George H.W. Bush, who came after, obviously Ronald Reagan, had a Supreme Court opening.
00:07:04.000 By the way, just really quick note: instead of Robert Bork, we got Anthony Kennedy, who was good on some decisions and just terror, just beyond awful on other decisions.
00:07:12.000 For example, Planned Parenthood v. Casey was one of the just one of the most confusing Supreme Court decisions in the history of American jurisprudence.
00:07:22.000 I mean, it was basically Anthony Kennedy and Planned Parenthood v. V. Casey being like, well, you can have your own truth and you can make up your own existence.
00:07:29.000 It was just nonsense.
00:07:30.000 So they wanted to bork Clarence Thomas in order to get another Anthony Kennedy.
00:07:35.000 Clarence Thomas, being a black man, a true conservative, they said, no, no, there is no way we're going to allow this guy.
00:07:43.000 And he was young at the time and he still has a lot of energy, a lot of vitality.
00:07:47.000 They wanted to derail him.
00:07:48.000 They wanted to use the Bork playbook to go after Clarence Thomas.
00:07:53.000 They wanted to use the Bork blueprints to try to keep the court in their image.
00:08:02.000 They went after Clarence Thomas through a series of fake and false accusations through a left-wing activist by the name of Anita Hill.
00:08:09.000 They tried everything they possibly could.
00:08:10.000 And Clarence Thomas, this is why they hate him.
00:08:12.000 He's very similar to Donald Trump in this regard and very similar to a lot of the heroes of the last couple decades, like Rush Limbaugh and Tucker Carlson.
00:08:20.000 He punched back against the media.
00:08:22.000 Clarence Thomas, by the way, the Clarence Thomas hearings is what radicalized Andrew Breitbart.
00:08:27.000 People forget that.
00:08:28.000 They forget that Andrew Breitbart was a left-wing liberal until he started listening to the Clarence Thomas hearings.
00:08:34.000 He said, this is totally unfair.
00:08:35.000 They're going after this guy in a terrible way.
00:08:37.000 And Clarence Thomas laid it down.
00:08:39.000 Clarence Thomas said, you are not going to come after me.
00:08:42.000 And he used a race card against the Democrats, Justice Thomas, saying this is a high-tech lynching, one of the most articulate, beautiful, persuasive, and powerful pieces of testimony in the history of America.

00:12:33.000 But Clarence Thomas is number one.

00:13:43.000 If anyone could tell you about institutional systemic racism, it's probably the black guy on the U.S. Supreme Court.

00:14:00.000 Remember last summer, the assassination attempt against Brett Kavanaugh, the repeated threats on hand to relocate Supreme Court justices.
00:14:10.000 They're doing everything they possibly can to shake the fiber of the third branch of government because the Supreme Court is the only part of government they do not have complete control of.

00:14:23.000 The only part of government, the only part of the federal government, they control the CIA, the FBI, Department of Justice, the EPA, the Department of Interior, Department of Labor, Department of Education.
00:14:32.000 They control the Marines.
00:14:34.000 They control the Senate.
00:14:36.000 They technically don't control the House, but they control parts of the House of Representatives.
00:14:40.000 But they control, because it's 50-50, the legislative branch.
00:14:44.000 They control everything, that third branch of government, which has the power to say, nope, unconstitutional, reverse this, it drives them nuts.
00:14:52.000 And a lot of them blame Clarence Thomas for this.
00:14:55.000 This is the inside baseball thing that you're not going to hear on your nightly news because the Supreme Court's a very deliberative body, way more than the Senate.
00:15:04.000 So the way the Supreme Court works is it's very clubby.
00:15:07.000 And by the way, it should work this way.
00:15:09.000 This is one of the things that the founders actually still have in place, unlike the mess that is the legislative branch.
00:15:16.000 But the reason that the Supreme Court works is that they hear a case, right?
00:15:20.000 They'll hear a case.
00:15:22.000 It could be, you know, the Chevron case.
00:15:24.000 It could be the Lemon case.
00:15:26.000 It could be Roe versus Wade.
00:15:28.000 And then they have a big table.
00:15:30.000 No clerks allowed.
00:15:32.000 And it's just nine people.

00:15:37.000 And they have coffee and then they talk.

00:15:40.000 One of the reasons they hate Clarence Thomas is that he's unbelievably charming because he's a great person.

00:15:48.000 And they're attacking him for being a generous, good person, for basically helping out his nephew to go to college through a friend of his in Dallas.

00:16:01.000 So he's in this private room, nine people, and maybe he's able to win over John Roberts a little bit more.
00:16:10.000 Maybe he's able to de-radicalize Sodomayor and Kagan.

00:16:17.000 But they hate Clarence Thomas because this is what's important.
00:16:21.000 He took the philosophical tradition from Scalia and continued it and carries it forward.
00:16:30.000 You see, Clarence Thomas has not done the John Roberts thing where he gets flimsy and goes to the middle.
00:16:37.000 Clarence Thomas is actually holding down the conservative opinion.
00:16:41.000 They look to him as a thought leader, and they should.
00:16:44.000 The guy is objectively brilliant.
00:16:46.000 So Amy Coney Barrett and Brett Kavanaugh and Neil Gorsuch come on.
00:16:51.000 He's almost like the godfather of the originalist viewpoint.
00:16:55.000 The guy's so well read.

00:16:57.000 This is one of the reasons why the left hates him is because he impacts those dialogues and those discussions in those private nine-person, and they can't control that.

00:18:14.000 So their accusations, the big one that they are throwing at Clarence Thomas, is all about payments.
00:18:24.000 Okay, so ProPublica has a hit piece against Clarence Thomas.
00:18:29.000 It's all about tuition payments.
00:18:31.000 This whole thing is super bizarre.
00:18:33.000 So Clarence Thomas, being a good Christian, a very devout Catholic, by the way, fostered his grandnephew, Mark, taking custody of him and essentially raising him from the age of 10.
00:18:45.000 As part of that, he sent them to Hidden Lake Academy, a boarding school in Georgia.
00:18:51.000 Dallas-based Republican donor and a good man, Harlan Crowe, paid for two years of tuition at that school.
00:18:58.000 And once again, the complaint is that Thomas did not report this as a gift.
00:19:01.000 That's just nonsense.
00:19:02.000 It's well known that Harlan Crowe and Clarence Thomas are very good friends.
00:19:05.000 Harlan Crowe, for anyone that knows this, he's an incredible collector.
00:19:11.000 He loves American history and he has a friendship with Clarence Thomas.
00:19:13.000 Are you not allowed to have friends if you're on the Supreme Court?
00:19:16.000 The only statement Thomas has made is that he and his wife are very close friends with the Crows.
00:19:21.000 That's well known.
00:19:22.000 And then his understanding was that he wasn't required to report any of these things.
00:19:26.000 And on both points, he's correct.
00:19:28.000 There's no evidence of any bribery or corruption.
00:19:32.000 But they're coming after him hard.
00:19:35.000 They want criminal investigations.
00:19:37.000 They want indictments.
00:19:39.000 They want the whole thing.
00:19:40.000 Mika Brzezinski on payments to Clarence Thomas's wife, because then it somehow involves something around Ginny Thomas.
00:19:48.000 They're going after the entire family, everybody.

00:19:51.000 We're going to talk now about the new reporting on payments to the wife of Supreme Court Justice Clarence Thomas.
00:19:58.000 Citing documents, it reviewed the Washington Post reports that conservative judicial activist Leonard Leo paid Ginny Thomas tens of thousands of dollars for consulting work, but gave specific instructions that her name be left off the paperwork.
00:20:17.000 The same year, the nonprofit, the Judicial Education Project, filed a brief to the Supreme Court challenging a landmark civil rights law aimed at protecting minority voters.
00:20:29.000 That's the real key, isn't it?
00:20:31.000 They don't like how he votes.
00:20:33.000 They don't like his decisions.
00:20:34.000 They don't like his opinions.
00:20:36.000 You see, one of the reasons they hate Clarence Thomas so much is they thought over a period of time with all of these nonsense attacks, he would moderate his positions.
00:20:48.000 They thought that Clarence Thomas would become like John Roberts, kind of vanilla, squishy in the middle.
00:20:54.000 They're coming after him because he's effective and he's persuasive.
00:20:58.000 And his clerks are actually going on to make a massive impact.
00:21:02.000 They view him as somebody who never should have been there in the first place.
00:21:08.000 I think we underestimate the power of scoring political animosity.
00:21:18.000 Joe Biden was defeated in the confirmation of Clarence Thomas.
00:21:23.000 And Joe Biden and his allies, they don't forget, they look at the judicial branch as striking down his vaccine mandate, striking down ruling by fiat, and they want to find somebody to blame.
00:21:37.000 The New York Times has come out regarding these accusations, saying enforcement actions for any failure to comply with the disclosure law have another constraint.
00:21:45.000 There's generally a four-year statute of limitations for civil actions under federal law.
00:21:50.000 The tuition payments fall outside that window.
00:21:52.000 In his statement, Mr. Palloetta indicated that Mr. Crowe has paid for Mr. Mark Martin's tuition at the Randolph Macon Academy in Virginia in the 2006-2007 academic year.

00:22:05.000 The accusation is that Clarence Thomas had a friend be generous towards a person in need that was not his son.
00:22:15.000 That's the accusation.
00:22:17.000 You're too generous, Clarence Thomas.

00:26:39.000 All the protesting outside of the Supreme Court was illegal, and none of those people were arrested.

00:27:22.000 The Chevron decision, by the way, it could be a death blow to the unchecked, unaccountable power that the progressives put into this fourth branch of government.
