00:01:58.500 uh had a break-in in his apartment around 3 30 in the morning or 20 after three or something like that

00:02:04.140 and the individual that tried to rob him was armed with a crossbow ladies and gentlemen he was armed

00:02:09.960 with a crossbow so obviously when you break into someone's house you have and you're you're armed

00:02:14.180 you have intent now as far as i know to some of the police officers i have spoken to

00:02:18.180 and to some of the lawmakers i've spoken to if you walk into anyone's home with a weapon

00:02:39.420 story is is this he broke into somebody's apartment had intent on stealing something

00:02:50.800 crossbow now the homeowner the apartment owner defend himself and apparently he cut the perpetrator

00:02:57.840 up and as far as i know the perpetrator went to toronto because of his injuries and Kawartha

00:03:03.640 Lake's police department basically charged the homeowner and not the criminal for basically screwing

00:03:11.060 them up now the debate is out there in the criminal code in Canada to my American listeners uh the

00:03:16.360 criminal code basically states that you're allowed to use force with force in a reasonable manner

00:03:20.260 right so basically the idea is that someone breaks into your house with a baseball bat

00:03:25.020 okay you're allowed to use a baseball bat too or if someone breaks into your house with a knife

00:03:29.720 you're allowed to use a knife and if someone breaks into your house with a pew pew and you have a

00:03:33.020 pew pew you're allowed to use that too but this is the catch though nine times out of ten

00:03:37.800 based on the self-defense claim the homeowner or the victim of said crime is usually charged too

00:12:52.080 jeremy mcdonald woke up and found an intruder in his home a fight ensued and the alleged intruder

00:12:58.540 identified as michael kyle breen was airlifted to a toronto hospital with serious injuries i think what

00:13:05.300 he did was justified um you know there's a lot of you know controversy going on right now the

00:13:11.840 controversy erupted after police charged both men mcdonald faces aggravated assault and assault with

00:13:17.920 a weapon charges court documents suggest a knife was involved breen faces various charges including

00:13:23.760 possession of a weapon break and enter and failing to comply with probation something is broken i know

00:13:30.240 someone breaks into my house or someone else's you're gonna fight for your life this guy has a weapon

00:13:35.920 you're going to use any any force you possibly can to to protect your family

00:13:40.680 the police which laid the charges defended their decision under canadian law individuals have the right

00:13:46.280 to defend themselves and their property however it is important to understand that these rights are

00:13:51.240 not unlimited in canada the law requires that any defensive action be proportionate to the threat

00:14:20.780 on patrols and you've had to draw your pew pew in an emergency situation okay but when you're under the

00:14:28.400 threat of someone breaking in and trying to harm you or try to mess up your night or try to steal

00:14:33.760 something from you under the threat you don't have time to worry about the proportion of the whole

00:14:39.040 thing come on people faced we really need to know the details of what happened inside that home defense

00:19:52.180 other than to say the person who broke into his home is a serial criminal well known to police

00:19:59.100 it is astonishing to me that we do not have what's called the castle doctrine here you break into

00:20:05.300 someone's home their home is their castle and you do so at your own risk for police to charge him
