00:01:10.100 But according to, let's see, Vice News, now I'm kind of surprised that Vice actually wrote a detailed article.
00:01:19.700 This was written on the 17th, a few days back, based on Canadians are suing gun makers Smith & Wesson for $150 million because Americans can't.
00:01:30.100 Victims and families of victims have launched a class-action lawsuit against a gun manufacturing giant related to the Danforth mass shooting.
00:01:39.960 Victims of the mass shooting in Toronto are suing Smith & Wesson, a U.S. company that made a gun used in the attack for $150 million.
00:01:47.420 A class-action lawsuit was filed in the Ontario Provincial Court Monday.
00:01:52.140 If successful, this suit would hold Smith & Wesson responsible for gun safety, even if the weapon was stolen.

00:01:59.240 The shooting occurred the night of 22nd July 2018 at Toronto's Busy Danforth Avenue.
00:02:05.780 10-year-old Juliana Kozis and 18-year-old Reese Fallon were killed and 13 others were injured.
00:02:11.660 The shooter, 29-year-old Faisal Hussain, died by suicide via gunshot after a shootout with the police.
00:02:18.520 He had a long history of mental health issues and violent tendencies, and the handgun was used in that crime,
00:02:25.400 was made by Smith & Wesson, and was reported stolen from a Saskatchewan gun dealer in 2015.
00:02:31.640 Now, I read an article that said 2016, so keep that in perspective.
00:02:37.420 The lawsuit claims that Smith & Wesson failed to install smart technology in the weapon, which would have prevented its unauthorized use.
00:02:44.260 It was reasonably foreseeable that the defendant's handgun products, like the handgun used in Danforth shooting,
00:02:49.820 would be in the hands of unauthorized users, cause substantial harm to, or kill,
00:02:54.460 innocent third parties, the lawsuit reads.
00:02:58.300 Ken Price, whose daughter, Samantha, is a lead plaintiff in the suit, said on CP24,
00:03:04.260 why isn't there more technology that helps to secure the usage of that gun
00:03:08.120 so somebody can't arbitrarily get a hold of it and use it as a weapon of hate?
00:03:13.740 The suit refers to an historic agreement that Smith & Wesson reached the White House under then-President Bill Clinton in 2000.
00:03:19.640 It was a huge deal because it was the first time that a major gun manufacturer committed to changing the way
00:03:24.540 that guns are made and sold to improve safety.
00:03:27.660 In agreement, Smith & Wesson acknowledged the threat of stolen weapons
00:03:31.240 and said it would use technology that would limit gun use to authorized people.
00:03:37.460 An all-new gun starting in 2003, think of Touch ID, which you probably have on your phone, but on a gun.
00:03:47.400 But the American gun lobby fought back and won.
00:03:49.720 The PR blitz and boycott of the National Rifle Association nearly drove Smith & Wesson out of business.
00:03:55.340 That Clinton-era gun control agreement became toothless in 2006 under President W. Bush.
00:04:00.340 He enacted the protection of lawful commerce and arms legislation that shields gun makers from being sued for liability
00:04:06.100 that does not apply to Canadians.
00:04:08.940 That's why this suit could be a game-changer when it comes to gun control and gun safety in North America.
00:04:14.620 The suit is open to anyone who suffered physical or emotional as a result of the shooting on the Danforth.
00:04:19.680 Price's daughter, Samantha, was out with friends getting ice cream and celebrating a birthday when the gunfire began.

00:04:28.000 Samantha's been brave and fierce, and I wanted to do the right thing by her, her father said.
00:04:32.460 Well, you know, I can understand the passion and the dedication, and I can also understand where she's coming from, okay?

00:08:34.540 Uh, this was posted 21st June, uh, this past year.
00:08:39.500 So, uh, it says, uh, Dan Forrest Shooter had a lengthy history of violent thoughts, but motive remains unclear, said the Toronto Police.
00:08:46.900 Toronto Police said the man who went shooting spree in the city's Greektown neighborhood on July 2018
00:08:50.860 had a lengthy history of violent tendencies and thoughts towards himself, but the motive for the attack remains unclear.
00:08:59.260 Chief Mark Sanders went over the investigation's finding on Friday into the 2018 Dan Forrest Shooting, which left two dead and 13 injured.
00:09:08.540 Uh, police say nothing to suggest anyone else played a role in Dan Forrest Shooting.
00:09:12.080 Uh, he said earlier in that day, investigators met with families of the victims, uh, of the shooting,
00:09:17.720 and they had been in constant conversation with those affected.
00:09:21.320 Although today does not give them the closure for the losses they suffered,
00:09:24.760 it will provide some, but not all, of the answers, Saunders said, adding, uh, officers spoke to acquaintances,
00:09:30.900 employees, and family members of Hussein over the course of the investigation.
00:09:34.980 Officers responded to calls about the shooting near Dan Forrest and Logan Avenues,
00:09:38.400 10 p.m., 22nd July, 2018.
00:09:41.100 Investigators said 29-year-old Faisal Hussein walked into a busy neighborhood and began shooting.

00:09:51.080 Reese Fallon, 18, and Julianna Kozis, 10, were killed in the incident.
00:09:54.900 Saunders said Hussein died due to a self-negotiated gunshot wound to the head.
00:09:58.480 He said Hussein's history with mental health issues was first documented in 1996.
00:10:03.580 Saunders said through researching his background, a picture arose of a very troubled individual
00:10:07.280 who was clinically treated for violent acts against himself and an outward expression of violent thoughts.
00:10:13.000 Findings revealed Hussein first came into contact with Toronto Police Service in 2010
00:10:17.380 when he was transported to the hospital for a mental health evaluation
00:10:20.460 following an incident of self-harm at school.
00:10:23.560 The document said Hussein was diagnosed with antisocial personality disorder in 2010.
00:10:28.500 However, Sanders and Hussein's mental health treatment was inconsistent over the years.
00:10:33.280 With his last documented appointment with a mental health professional dating back to May 2014,
00:10:37.980 investigators said they do not believe Hussein had any connection
00:10:40.620 to hate groups or terrorist organizations that said he was not affiliated
00:10:43.960 with any radical ideologies, even though his mental health played a very, very critical role,
00:10:48.960 ladies and gentlemen.
00:10:50.100 Saunders added that Hussein did not have any criminal record.
00:10:52.460 However, he came into contact with police on three separate occasions.
00:10:58.420 Two days before July 22nd attack, Saunders said Hussein was arrested for attempting to steal ice cream,
00:11:03.700 but was subsequently released with no charges.
00:11:07.420 Saunders said that while it was clear mental health played a role in an incident,
00:11:12.520 investigators were not able to identify a clear motive for the attack.
00:11:18.140 Although we have collected all of the evidence that was available to us for this crime,
00:11:23.700 the crime where the shooter died at the scene, we may never know the answer to why, he said.
00:11:29.880 Detective Terry Brown echoed Saunders' statement,
00:11:32.020 At the end of the day, the only person who knows why he did what he did is no longer with us.
00:11:37.360 There is nothing that anybody has relayed to us, suggests us that Hussein was in crisis that day.
00:11:43.200 So when he left his home that day for the last time, that fateful time,
00:11:47.140 there was nothing that we could have learned to suggest that anyone could have foreseen
00:11:50.420 that this was going to happen in the next hour.
00:11:53.420 Okay, well, the handgun that was used was stolen from a Saskatchewan gun shop, okay?
00:12:05.020 So, and the thing is, 23rd of July, they investigated his home.
00:12:13.320 They had a search warrant where he lived with his parents.
00:12:17.080 There was multiple cell phones, laptops, and electronic devices were seized.
00:12:20.240 However, investigators said none contained information that provide any motive for his actions, right?
00:12:25.520 So, why so many cell phones? Why so many laptops, right?
00:12:32.200 Several guns and drugs were also seized, documents showed.
00:12:35.300 Hussein's family has said publicly that he suffered from depression and psychosis.
00:12:39.180 They also denounced his actions, okay?

00:12:50.240 Well, Hussein did not have a criminal record, arrested a few days before shooting,

00:13:50.460 The gun, which killed 18-year-old Reese Fallon and 10-year-old Julianna Kozis,
00:13:54.980 was stolen during a break-and-enter at a gun store in the province.

00:14:02.580 In a redacted copy of the National Firearms Database released to Global News under the Acts of Information Laws,
00:14:07.920 only one firearm meets those criteria.
00:14:10.900 It was registered by a private individual in rural Saskatchewan postal code of June 2014.
00:14:17.100 It was entered in the database as stolen in July 15th of 2016.
00:14:21.560 In the data, 24 other handguns and restricted rifles are entered as stolen on the same day in the same partial postal code.

00:14:34.620 In order for us to purchase a firearm from somebody in consignment,
00:14:38.120 or if they wanted to sell it, just basically, you know, give it away,

00:15:32.560 you can see him stop and take time to reload, too.

00:15:39.020 So, not only did he acquire an illegal firearm,
00:15:42.500 he also acquired illegal capacity, which is a big no-no.
