00:18:58.360 31st, 1960, died November 10th, 2009 by lethal injection, was an American convicted murderer
00:19:04.060 who, along with his partner and accomplice Lee Boyd Malvoe, then age 17, carried out the DC sniper attacks
00:19:08.740 of October 2002, killing 10 people.
00:19:11.640 Muhammad and Malvoe were arrested in connection with the attacks on October 24, 2002, following tips
00:19:15.180 from alert citizens, although the actions of the two individuals were classified by the media
00:19:18.840 as psychopathy, I'm sorry, attributable to serial killer characteristics.

00:20:18.960 And the FBI absolutely was involved in this investigation.
00:20:22.520 The three main agencies were the county police in this situation, the ATF, a.k.a. Bureau
00:20:27.920 of Alcohol, Tobacco, Firearms, and Explosives, and the FBI.
00:20:31.240 And they really dedicated a lot of personnel to this case.
00:20:33.420 I think over 400 agents were involved in this investigation, guys, back in 2002, because
00:20:38.080 one of, you know, obviously, number one, it was a national security thing.

00:20:41.900 And then number two, one of their own were murdered from these killers.
00:20:46.500 And another thing, too, real quick, because I was 12 years old when these shootings were

00:21:02.600 of hysteria when it came to terrorism, foreign acts, foreign individuals going ahead, attacking

00:21:14.260 It was going crazy, and everyone was terrified, guys.
00:21:17.180 The whole Northeast was terrified because they didn't know if these guys were going to be

00:21:28.080 And the thing is, too, this is prior to the age of social media, but this thing was everywhere.
00:21:33.380 And the press actually had a very, how do I say this, disturbing effect on the investigation,

00:21:40.720 But they actually impeded this case significantly in some situations and antagonized situations
00:21:45.700 where shootings happened that might have not necessarily occurred had the press just kept
00:21:50.380 their nose out of the business.
00:21:51.620 But as usual, you know, they want to go ahead, get the story, break the story, make a lot

00:31:06.340 Because when you're the chief of a county, you are considered the top law enforcement
00:31:11.360 official in that county, right?
00:31:13.740 Now, obviously you got your fed and local partners, et cetera.
00:31:16.860 But when you're the sheriff or the chief, whatever, you are looked at as the main guy, because
00:31:23.340 you're the uniform, you're the face, it's a political position, you're right under the
00:31:27.220 mayor, et cetera.
00:31:28.860 So, uh, sometimes under, uh, you know, you, you're dealing with the governor directly.
00:31:33.240 Sometimes if it's huge, so you're put under an enormous amount of pressure to give updates
00:31:39.640 on the investigation while simultaneously concealing parts of the investigation so that
00:31:44.860 the investigators can do their job.
00:31:46.540 So it's a very tricky dance guys.
00:31:48.120 Whenever you have a case that has this kind of media attention to it, where you want to
00:31:52.660 divulge enough to give, to give the audience, um, an insight as to what's going on and tell
00:31:57.980 them what to do and make them feel some sort of relief.
00:32:00.440 But at the same time, you don't want to divulge enough where it'll impact your investigators
00:32:04.820 chances of catching the bad guys.
00:32:07.740 So it's a very tough position to be in as a sheriff, man, because you are the face of
00:32:13.780 the investigative effort and all the good and the bad is going to befall you.
00:32:18.000 And this guy definitely, uh, inadvertently became an overnight celebrity because of this
00:32:22.760 case dissipate the, uh, Thursday morning.
00:32:25.820 741, I got a page that said a man had been killed on a lawnmower.
00:32:44.200 The lawnmower had exploded was how it actually came across the page.
00:32:46.980 I thought that was very unusual James Buchanan, a gardener was shot in the back and killed
00:32:56.160 whilst mowing a customer's lawn.
00:32:59.280 Um, when people call 9-1-1 on this situation, by the way, guys, they thought like he had
00:33:03.280 like got cut by the lawnmower because there was so much blood.
00:33:06.460 So they thought it was like a lawnmower accident or whatever.
00:33:08.380 So when they called 9-1-1, they were saying like, I think it's a lawnmower accident.
00:33:10.760 He might've chopped himself up or something like that.
00:33:12.600 But when police arrived on scene, they realized that he had actually been shot while he was
00:33:16.780 mowing his lawn.
00:33:17.860 And this is what caused people so much fear.
00:33:20.220 Random people doing random, you know, typical errands were getting killed out of nowhere.

01:14:05.340 And then also, you know, in the back of every mind, everyone's minds at this point, they're thinking is this a terrorist investigation?
01:14:10.940 So they're looking at it like bring the FBI in. And if it does end up being terrorism, they could come in and assist and take over from that point.
01:14:16.780 But keep in mind, this is still going to be a Montgomery County led investigation, guys, because at this point, all we got is a bunch of shootings, which murder nine out of 10 times, guys, is always going to be a state investigation, unless they're able to tie it to some other crime.

02:02:04.380 uh, warrant for him. So I've done several material witness warrants guys in the past,
02:02:09.100 and a material witness is someone that you can basically arrest, right. Or detain them because
02:02:15.180 they are the witness in a, uh, federal investigation and they need to be brought in,
02:02:20.060 uh, because they have some kind of critical testimony to provide to the case. I used to do
02:02:23.900 this often when I was an agent, where if you caught a smuggler with like, let's say 10 illegal aliens,
02:02:28.540 you needed those aliens to testify against the individual. And they wouldn't have fifth amendment
02:02:32.620 privileges because they weren't being charged for a crime. So you would hold them under material
02:02:37.100 witness warrant so that they can be in the judicial system. Why would you do that? Well,
02:02:40.700 because otherwise they would need to be deported. So the material witness affidavit
02:02:45.500 that you file gets you in a material witness warrant, and then you're able to hold those
02:02:49.180 individuals for the court. So this was very smart by the FBI. There's a chess move where they get
02:02:54.700 the arrest warrant for Muhammad because they know he's, uh, he has the firearms violations because
02:02:59.500 he shouldn't have a gun now that he has a restraining order against him. And then since
02:03:02.620 they were able to effectively tie him to Malvo, they get a material witness affidavit warrant for
02:03:08.380 Malvo because they didn't have charges on him at the time. Okay. So that was the strategy that the
02:03:13.500 FBI employed at the time to get these guys in custody. And remember guys, half the job is just
02:03:18.780 getting him in custody. So it gives you time to go ahead and form and file formal charges against them
