00:40:50.620 be able to get a glimpse of Sean Diddy Combs as he was released. But again, that news coming down
00:40:55.220 that he will not be released on bail for now. Let's bring in ABC News legal contributor Bernarda
00:41:00.620 Villalona. And Bernarda, we know that this case was not technically about domestic violence. At
00:41:06.840 least those were not the charges against Combs. But of course, there was that now infamous video
00:41:12.280 from the hotel surveillance that showed him physically assaulting Cassie Ventura. Is it
00:41:17.720 possible that any of that evidence came down to what the judge was considering in terms of his
00:41:23.160 release back to the public on bail? 100 percent. Absolutely. You have to think that this judge is
00:41:30.720 in a unique position that he heard all of the testimony, all of the evidence that was provided
00:41:36.380 through this seven week trial. He also knows of evidence that wasn't submitted before this jury.
00:41:41.800 So he took into account what he actually heard. He took into account that it's no longer that Sean
00:41:47.540 Combs is accused of transportation to engage in prostitution. But now that he has been convicted
00:41:52.980 by a jury of his peers, he took into account that his ability to flee and not return for sentencing,
00:41:59.600 as well as that he's a danger to the community and also to victims. Remember that. Yeah. You know,
00:42:06.800 a lot of the testimony, guys, you know, they you know, he was beating Cassie's ass, right? Mia. There
00:42:16.140 were three witnesses that he got into physical altercations with Mia, Cassie and his Jane woman,
00:42:22.080 who I think is 50s baby mom. Cassie Ventura's attorney, Doug Wigdor, submitted a letter to this court
00:42:30.060 requesting that Sean Combs remains in custody because he is a danger to society. So taking all
00:42:36.820 of that into account, in addition to what his potential sentence would be, does give us a cue
00:42:42.300 cue into what he will actually sentence him to? While it's a mandatory of 10 years on each of this
00:42:48.340 count, these counts, there is a sensitive. He's not going to get 10. He doesn't have a criminal
00:42:52.660 history. Well, this is what I predict. I think he's going to get chapped probably somewhere between
00:42:58.020 between two to seven years. That's what I think he's going to get. He's going to get between two to
00:43:05.680 seven years. I know that's a wide range and they'll probably let it run concurrently, which means
00:43:09.640 they'll let the two counts. Like when he's in there serving the time for one count, the other
00:43:15.780 one is going to run concurrently, which means he won't have to do, you know, the 14 years. If let's
00:43:21.260 say he gets seven years for each one, he won't do 14. Instead, he'll do, you know, seven for both.
00:43:28.260 Right. Because it's running concurrently. That's right. That's what I predict. He'll get somewhere
00:43:32.080 between two to seven years running concurrently. Crime guidelines and the prosecution is claiming that
00:43:38.860 it's about 51 months to 63 months while the defense is saying. Okay. So there you go.
00:43:44.520 51 months to 61 months. Wait, hold on. Let me rewind that real quick. That's.
00:43:50.220 Prosecution is claiming that it's about 51 months to six. Okay. So 50 months is going to be. Yeah.

00:44:04.860 years is what the prosecution is saying. The defense is saying 21 months to 20. Okay. 21 months is less
00:44:10.020 than two years. Um, seven months and Sean. One months to 63 months while the defense is saying 21
00:44:19.340 months to 27 months and Sean. Okay. So about two years. So government's pushing for four to five,
00:44:27.900 four to five defense wants, you know, one and a half to two, two-ish.
00:44:33.380 Sean Collins has only been in custody for 10 months.
00:44:36.340 And also keep in mind, yes. So he's going to get a good amount of time served yet. He's been in jail now
00:44:40.920 since September. Right. So, um, the time that he's been in jail, it's all going to be time served. So
00:44:47.460 honestly, him not getting bail, isn't the worst because it might get to the point where by the
00:44:54.080 time he gets sentenced, he'll have a few more months to go and he'll be released.
00:44:59.980 Bernardo. Thank you. We are just getting this information from the U S district judge here
00:45:05.420 citing Combs domestic violence as part of that justification for continued detention.
00:45:11.740 Do I miss chat? Do I miss? I told y'all that, um, that he got denied his part because he was
00:45:18.200 beating their asses. Called it a propensity for violence. This is also a quote here of the judge
00:45:23.540 saying it is impossible for the defendant to demonstrate that he poses no danger to the
00:45:29.080 community. Again, that as part of this decision, not to grant him bail, to deny bail to Sean Diddy
00:45:35.140 Combs. I want to go to our ABC news legal contributor, Brian Buckmeyer. Brian, you've been watching this
00:45:40.020 case very closely. You've been inside the courtroom at times. So now that bail has been denied, Brian,
00:45:46.160 what are the next steps? So the next steps would be sentencing. And between today and whatever the
00:45:53.080 sentencing date is, and we're waiting to hear what that is, Sean Combs will be visited by someone from
00:45:58.280 the probation department. And they'll interview him, speak with Sean Combs, family members, anyone else
00:46:03.620 that they may be directed to, and they'll create what's called a PSI or pre-sentencing
00:46:08.520 investigation. That information will be given to both the attorneys as well as the judge,
00:46:14.660 and will help guide them in terms of a sentencing. Now, Bernard had pointed out...
00:46:18.320 Someone in the chat said, what happened to the gun charges? See, guys, I look at the chat because
00:46:21.940 you guys ask good questions in there. You guys give good conversation things. The gun charges. So as you
00:46:28.160 guys know, when they raided his house, they found an AR-15 with the serial number scratched off.
00:46:31.780 I'm surprised the feds didn't indict him on that because that is a crime. You don't get that much
00:46:37.320 time for it, but it is a crime. So I'm surprised they didn't hit him with it. I think the reason
00:46:40.940 why they did that was because they wanted to keep the evidence clean with, you know, making it all
00:46:45.680 about sex trafficking and RICO versus, you know, bringing in a scratched off firearm, which is a
00:46:50.040 completely different offense, different pattern of facts, et cetera, versus with the RICO and the
00:46:54.600 sex trafficking, you can kind of, you can put it all together, you know, with one theme, so to speak.
00:47:01.360 pointed out the sentencing guidelines that both parties have put forward, the defense saying that
00:47:07.220 the sentence should be anywhere from 21 to 27 months, the government saying anywhere from 51
00:47:12.000 to 63 months, but that PSI will provide what they believe the sentencing guidelines will be.
00:47:17.540 And then either side will try to argue, come sentencing, that there are either aggravating
00:47:21.920 circumstances, the government will oppose those to go higher or mitigating circumstances to go lower.
00:47:26.840 And that's where we'll find a sentence. And of course, the potential of what's called victim impact
00:47:30.360 statements, people who will testify or give testimony about the sentence.
00:47:34.200 Oh, yeah, yeah. So they're going to, yeah, I forgot about that, that they got fucking,
00:47:38.400 they're going to bring the victims in to give victim impact statements. And that's going to
00:47:43.700 absolutely weigh on the judge's, you know, decision on how he's going to charge it.
00:47:49.360 Of Sean Combs.
00:47:50.600 Brian Buckmeyer, thank you. I want to go back to Aaron Katursky. Aaron, we know that that sentencing
00:47:54.520 hearing scheduled for the fall. Sean Diddy Combs has already been in custody for about nine months
00:48:01.580 now, and he's also facing dozens of civil lawsuits. What more does he have ahead of him
00:48:08.080 before that hearing? We know, I think it's on October 3rd.
00:48:13.360 October 3rd at 10 a.m. is when Sean Combs is going to be sentenced for his conviction on two counts
00:48:20.400 of transportation for the purposes of prostitution. Each of those counts carries a maximum penalty
00:48:26.620 of up to 10 years.
00:48:28.300 Al Boyce says, would you say this is a big fat L for the feds? I think it's a huge win for Diddy.
00:48:33.560 Brian Steele now has two RICO cases, he'd be under his belt. Yes and no. And I'll talk about it here

00:48:43.700 Prosecutors pointed out in their letter to the judge, his total exposure is 20 years in prison.
00:48:50.180 And the judge today, Whit, said that Combs' propensity for violence was starkly depicted
00:48:56.420 on that 2016 hotel security camera footage. That may well factor into the judge's sentencing
00:49:03.860 decisions. In the meantime, Sean Combs will continue to be incarcerated at MDC in Brooklyn,
00:49:10.220 the federal jail in Brooklyn, where he's been since his arrest. This is at least the third,
00:49:16.580 possibly even the fourth time that bail has been denied. And he will have to fight those civil
00:49:22.040 lawsuits, at least at the outset from behind bars. With Aaron Kaczorski, thank you and the entire team.
00:49:27.760 Again, the judge denied Sean Combs bail following that split verdict earlier today when the jury
00:49:32.960 acquitted him of the most serious charges of racketeering and conspiracy and sex trafficking.
00:49:38.040 But the jury did find him guilty on those two counts of transportation to engage in prostitution.

00:51:11.860 family can sign onto the bond. Again, they were proposing $1 million. He should be released
00:51:16.960 today. And their proposal was that Sean Combs could walk out of the courtroom and that his
00:51:22.000 travel be limited to Florida, Los Angeles, and New York City, whereas the government opposed
00:51:27.420 that application. Maureen Comey making these arguments on behalf of the prosecution.
00:51:30.780 Maureen Comey is the lead AUSA on this case, as you guys know, James Comey's daughter.
00:51:35.680 The government was saying that Mark Agnifilo was really kind of downplaying Sean.

01:00:27.280 the what happens now part of it, when Sean Combs is sentenced, how likely is it that he goes to
01:00:32.280 federal prison on these two counts? That's the $64,000 question right now, isn't it? I mean,
01:00:38.860 these counts do carry with it the possibility. He's 100% going to go to jail. That's not even
01:00:43.620 a question. He's a hundred. He's going to get time served, but he's probably, I think he's going to
01:00:47.080 get, like I said before, between two to seven years, he's going to probably have roughly a year
01:00:52.240 plus of served time by the time he gets sentenced. So he'll probably be in jail for another 24 to 36
01:00:58.500 months. That's my estimate. If prison time, it wouldn't be unheard of for someone to go to prison
01:01:03.980 on these types of charges. However, he has no criminal record. He has no criminal past that
01:01:08.800 he's been convicted of. But one of the things the government said when the bail argument first
01:01:13.360 reared its head, and again, we'll hear more about that later on, is there was continued criminal
01:01:18.380 conduct even after the charges took place. So this isn't someone who has lived a law-abiding lifestyle
01:01:26.440 for everything but for these cases. I mean, as you mentioned a little while ago, when he was arrested,
01:01:31.420 he had drugs on him. There was post-charge conduct, excuse me. So there's all sorts of
01:01:37.480 things that the government can rely on to say, hey, look, he was found guilty of these two offenses.
01:01:42.080 They are federal offenses. He was found guilty beyond a reasonable doubt. They carry with it the
01:01:46.540 possibility of federal prison. And for somebody like this, who has flouted the law, he should go to
01:01:52.260 federal prison. His lawyers obviously will argue in the other direction. But again, I think it's possible
01:01:57.680 that he goes to prison. I don't think he's going to max out. I don't think it's going to be a
01:02:01.120 10-year federal prison sentence. But it's possible that the judge decides that not staying at the
01:02:06.680 MDCC is enough, and he actually needs to go to a federal facility somewhere else in the country.
