00:41:14.180 My office has charged Mohamed Sabri Salaman, age 45, with the commission of a hate crime under 18 U.S.C. Section 249.
00:41:27.380 When that offense includes attempted murder, the statutory maximum federal sentence is life in prison.
00:41:40.580 We will never be subjected to violence of any kind.
00:41:45.580 But our laws recognize that such violence is particularly pernicious when someone is targeted

00:41:59.580 According to our complaint, and the charges brought by DA Doherty's office, Mr. Salaman stated
00:42:06.580 that he had been planning this attack for a year.
00:42:10.580 And he acted because he hated what he called the Zionist group.
00:42:18.580 But what the charges allege that he did was to throw Molotov cocktails at a group of men and women,
00:42:28.580 some of them in their late 80s, burning them as they peacefully walked on a Sunday to draw attention to Israeli hostages held in Gaza.

01:08:24.180 I think we've all alluded to the importance of partnerships. I can tell you, as I was rushing to the scene yesterday, one of the first or second calls I made was to the special agent in charge,
01:08:33.360 because no matter what this ended up being, I knew we would need help.
01:08:37.280 And once again, the FBI, all of our state, local and federal partners have stepped up and we are.
01:08:44.100 Now, this is kind of common, guys. I will say this. You can tell that there's a bond between these different agencies,
01:08:48.140 because typically when you have smaller towns like this, the law enforcement tends to know each other, you know,
01:08:55.000 and they just have each other's like contacts always saved and they deal with each other.
01:08:59.000 Because when, especially at the federal level, because when you're like not in as big of a city, you rely a lot upon your state and local partners to help you out with operations.
01:09:08.100 So what ends up happening is people just know each other. So like when I was on the job, like there was like an ATF guy that I always would call,
01:09:14.820 a DEA guy I always would call. I would have like POCs at every single agency.
01:09:18.020 So anytime I needed something, I'll just hit them up, because a lot of the times you might not have the personnel or the manpower to get shit done.
01:09:24.420 So you can, you know, call guys from other agencies and they'll show up and they'll help out with whether it's being on surveillance,
01:09:29.900 doing a drug buy, doing a gun buy, doing a control purchase of some kind.
01:09:33.860 When you have other people from other agencies, you're able to kind of leverage that relationship to your benefit.
01:09:39.840 And this is especially important when you live in places that maybe might not come from a big field office, right?
01:09:46.000 Maybe the FBI office in Boulder has maybe 10 or 20 guys, right?
01:09:51.060 You quickly figure out that when you're trying to run operations, having only 20 or 20, 10 or 20 guys in your office is not enough to do, you know, big, large scale operations.
01:10:00.480 So using the state and locals is extremely important to get shit done.
01:10:05.120 So what ends up happening a lot of times is you end up building really strong working relationships with these different agencies of where you work from.
01:10:14.300 Absolutely. In a really good place for 24 hours.
01:10:17.380 And this is very common where the chief of police is obviously going to know who the special agent in charge is of the FBI,
01:10:23.700 because like they're the functional equivalent of each other in their given agency.
01:10:27.360 Obviously, chief of police is the top guy for them, special agent in charge is the top guy for the FBI.
01:10:31.440 You know, chief of police, right, you're overseeing everything.
01:10:33.540 Same thing with the SAC. Are they carrying cases? No.
01:10:36.280 Are they out there arresting people every day? No.
01:10:38.160 Neither of them are. They're paper pushers.

01:10:43.480 But, you know, they are the representatives and the faces of their respective agencies.

01:10:50.260 But I guarantee you Boulder, Colorado probably has what's called a case detective on this case.

01:10:57.600 And the case detective and the case agent are working together, doing the interviews together, drafting up affidavits together.
01:11:04.540 Maybe some affidavits are federal. Other ones are state.
01:11:07.820 I'm assuming that probably a lot of the warrants that they got probably are going to be state ones because the state could get shit done faster.
01:11:14.220 But I wouldn't be surprised if they were federal either, because given the magnitude of this case and the amount of precedents going, no magistrate judge is going to give you a hard time about getting a warrant signed on a terrorism case.
01:11:24.540 So but these are just some of the ways that state and locals end up working together, typically, especially in smaller communities.
01:11:31.220 This investigation, in my opinion, Michael Doherty alluded to it, but the work that I've seen in this building and out on the street in the last 24 hours is remarkable.
01:11:41.160 And every single person working on this investigation is doing their job above and beyond to bring justice to these victims, including the men that stand behind me here.

01:11:52.760 The scene, as you may know, around two in the morning, we released the scene.
01:11:57.300 So as of this time, we have no active closures in downtown Boulder.

01:12:03.440 We spent an extensive amount of time yesterday up until the early morning hours today with bomb dogs, our bomb squads, ensuring that there were no other threats in the area.

01:12:20.480 I can tell you this morning I walked down Pearl Street with members of my team.

01:12:32.100 I was heartened by the resilience of our community, the positive attitude that people had, the understanding of the inconvenience of yesterday with businesses having to close.

01:19:03.500 But what ends up happening a lot of times when you file a criminal complaint, right, is think of a criminal complaint as kind of like a holdover, right?
01:19:11.140 It allows you to begin the judicial process of getting this individual into the court system federally.
01:19:16.140 And when you arrest them on a criminal complaint, you get that arrest warrant and you go get them, you can always come back and indict later with updated charges.
01:19:26.320 So in this case, they're going to have to indict this case, okay?
01:19:29.740 And an indictment, guys, is a formal charge by a grand jury.
01:19:32.800 So you do the criminal complaint with the easiest charges you can prove readily with the probable cause that you have.
01:19:37.920 Because remember, guys, as the investigation starts off, the evidence in the beginning isn't as strong as later on.
01:19:46.560 You know, you're doing interviews, you're finding a piece of information here, you're finding a piece of information there, you're finding this here, there, blah, blah, blah.
01:19:51.880 So what you do is in the beginning of the investigation, your job is to get the information that you have compiled to the best that you can and just get kind of like a charge that you can like just get on them, right?
01:20:03.380 A simple charge that's easy to prove or probable cause for the criminal complaint.
01:20:06.840 Okay, once you have that charge established, right, and you got the guy under custody, now you can start the more meticulous process of building evidence for a more complex charge, okay?
01:20:19.780 Typically, when you arrest someone on a criminal complaint, most jurisdictions, they're going to want you to indict that individual within 14 days, roughly, okay?
01:20:26.860 So you arrest them on a criminal complaint, let's say, on Monday.
01:20:29.640 Within two Mondays, they want you to have that guy indicted by a grand jury and have actual formal charges, okay?
01:20:34.760 In that two weeks, you can go ahead and add charges to it or just formally charge them on the charge you got them on, like in this case, hate crime.
01:20:45.900 Then, as the case progresses, a month later, two months later, you could do what's called the superseding indictment.
01:20:52.020 And in that charge, and when you do the superseding indictment, that's where you add in these other more serious charges.
