00:19:48.220 would you go out in public and do that kind of thing but here's the thing that someone's acting

00:19:52.760 like an a-hole to you doesn't authorize you to take out a 12 inch knife and then point a gun at them

00:19:59.980 yeah they're just being an a-hole now did they steal if they stole your patch did they steal your

00:20:04.860 property sure that's petty larceny that's against the law you call the cops but the fact that they

00:20:09.860 stole a patch from you doesn't entitle you to threaten them with deadly force now if the guy in

00:20:16.240 the ball cap had been the initial aggressor in almost any way deadly force might have been authorized

00:20:28.520 against any kind of attack but what we don't see in this video is any effort of the guy in the ball

00:20:34.060 cap to use force against the guy in the wheelchair until that knife comes out and he begins digging out

00:20:40.240 the gun and then points the gun at the guy in the ball cap so the optics look terrible a physically fit

00:20:46.080 guy points a gun at a dude in a wheelchair and shoots him how could that be lawful well it can be

00:20:50.060 lawful of the guy in the wheelchairs pointing an apparent gun at you and and i do think it's also

00:20:54.380 important for the audience to kind of like understand because people will sit there and say

00:21:15.380 it's legally justified is what is in the mind of the defender in the moment and that belief has to

00:21:22.420 be genuine for example if the guy in the ball cap knew it was a fake gun well he wouldn't be

00:21:27.220 justified in shooting then but if he believes it to be a fake gun and that belief is reasonable the

00:21:32.940 gun looks real well then he's allowed to respond to it exactly as if it were a real gun and then the

00:21:37.940 question is does he have a reasonable perception he does not have to be correct justification for

00:21:44.680 self-defense does not require you to be correct it does not require perfect decision making it requires

00:21:50.180 reasonable decision making did he have a reasonable perception that he was facing an imminent threat

00:21:56.220 of unlawful deadly force harm yeah that's the question and if the answer to that is yes then his

00:22:01.420 shooting of that other dude is legally justified yeah and and it's always funny because you know people

00:22:23.920 yeah my job is to shoot to kill him but that's what they mean by stop the threat stop the record

00:22:31.920 self-defense even deadly force self-defense it doesn't technically allow you to kill someone you're

00:22:37.920 not 007 you don't have a license to kill you have legal justification to use the force necessary

00:22:44.620 to stop the threat against you now that threat is deadly in nature and it's immediately about to

00:22:50.100 occur it turns out the most effective way to stop a deadly force threat is to use deadly defensive

00:22:55.400 force but as you say your actual goal is not to kill that person it's to neutralize that person if we

00:23:02.100 imagine a world in which we have stun guns like on star trek that could neutralize people well then

00:23:07.600 that's what you would use instead of shooting people with bullets but we don't have that so instead

00:23:12.100 we have to resort to the tools we do have and those are tools that tend to cause death or serious

00:23:17.880 bodily injury to people but the death is not the goal in fact i would suggest that if you're in a

00:23:22.540 lawful self-defense shooting and you are compelled to shoot someone in lawful self-defense you actually

00:23:28.660 don't want that guy to die you want the threat to be neutralized you want whatever has to happen to

00:23:34.260 secure the safety of yourself and anyone you have a duty to protect that's the goal that's the mission

00:23:39.180 but if that guy actually dies it's worse for you it's worse for the defender because now you're

00:23:44.960 looking at a possible murder charge or a manslaughter charge if he survives well the worst you're looking

00:23:50.560 at then is aggravated battery with a firearm i mean that's bad but it's not life in prison without

00:23:55.780 possibility of early relief uh release so generally it's good for the defender if the other guy does not

00:24:02.500 die from the gunshot wound as long as that is consistent with securing your safety what about

00:24:09.120 uh potential lawsuits that that can come from you acting uh self-defense i mean that that would open

00:24:14.460 that up for you uh liability wise right you know i always so i focus on the criminal side of things

00:24:20.200 not the civil for for a very important reason my thinking is if i can keep you out of prison you can

00:24:25.800 always make more money okay so if you get sued you can always make more money right if you're in prison

00:24:30.020 it's all over you get sentenced to life in prison who cares about whatever money or toys or assets

00:24:52.460 people get convicted so what i tell people is forget about the civil thing just imagine that if you ever

00:24:58.680 have to shoot someone you are going to get convicted you're going to get sentenced to life

00:25:27.100 to harm my wife or kids i'll risk the life sentence but if you're stealing my car or insulting me

00:25:33.060 i'm not willing to risk a life sentence for that so those are not scenarios in which i'm willing to use
