00:03:52.400So let's get right into it, man. So we're going to today we're going to talk about our girl, Ghislaine Maxwell.
00:03:59.500So let's get the quick little background on her. Let's pull up the Wikipedia page that everyone likes to criticize me for using, which Wikipedia, guys, this isn't a college essay.
00:04:06.480All right. Wikipedia is actually very accurate. All right. Because it's monitored.
00:04:10.880But anyway, we got Ghislaine Noel Marion Maxwell. That's her full name. Born December 25th, 1961.
00:04:16.740Born Christmas Day is a British British former socialite and convicted sex offender.
00:04:22.600She was found guilty in 2021 of a child sex trafficking and other offenses of connection with the financier and convicted sex offender Jeffrey Epstein, who we know passed away, guys.
00:04:31.300And did he kill himself? Well, we talked about that a little bit on the last podcast.
00:04:35.060You guys go to check it out. Born in France.
00:04:37.740Maxwell was raised in Oxford in the 1980s.
00:04:39.520She attended Beloyal College, Oxford, then became a prominent member of London's social scene.
00:04:45.040She worked for her father, Robert Maxwell, until his death in 1991.
00:04:47.600And when she moved to New York City, where she continued living as a socialite and had a relationship with Epstein.
00:06:00.680So following sex trafficking allegations being brought by prosecutors against Epstein in July 2019, the organization announced cessation of operations the same month.
00:06:12.160Maxwell naturalized U.S. citizen retains both French and British citizenship.
00:06:15.980On July 2nd, 2020, Maxwell is arrested and charged by the federal government of the United States with the crimes of enticement of minors and sex trafficking of underage girls, which we're going to read through that indictment, guys.
00:06:25.540Don't worry. And then she was denied bail as a flight risk with the judge expressing concerns regarding her completely opaque finances.
00:06:32.540Finances are her skill at living, living in hiding and the fact that France does not extradite its citizens.
00:06:39.580On December 29, 2021, she was convicted on five out of six counts, including one sex trafficking of a minor.
00:06:46.400She faced a second criminal trial for two charges of lying under oath about Epstein's abuse of underage girls, which we're going to break that down as well, guys.
00:10:38.980Ghislaine Maxwell charged in Manhattan Federal Court, and this is July 2nd, by the way, guys, 2020, charged in Manhattan Federal Court for conspiring with Jeffrey Epstein to sexually abuse a minor.
00:10:49.940So, this is right after she got arrested, okay?
00:10:51.720Maxwell is alleged to have facilitated, participated in acts of abuse, additionally charged with perjury in connection with 2016 depositions.
00:12:47.960William Aswina Jr., the assistant director in charge of the New York Field Office of the Federal Bureau of Investigation.
00:12:52.560And Dermot Shea, commissioner of the New York City Police Department, NYPD, announced that Ghislaine Maxwell was arrested this morning and charged with enticing a minor to travel to engage in criminal sexual activity, transporting a minor with intent to engage in criminal sexual activity, conspiracy to commit both of those offenses, and perjury in connection with a sworn deposition.
00:13:14.860The indictment unsealed today alleges that between at least in or about 1994 through 1997, Maxwell and co-conspirator Jeffrey Epstein exploited girls as young as 14, including by enticing them to travel and transporting them for the purpose of engaging in illegal sex acts.
00:13:32.880And that right there, guys, is what made the case federal.
00:13:35.680Anytime you travel and affect interstate commerce, feds are coming in, baby.
00:13:40.480Again, as alleged, knowing that Epstein had a preference for young girls, Maxwell played a critical role in the grooming and abuse of minor victims that took place in locations including New York, Florida, and New Mexico.
00:13:54.120In addition, as alleged, Maxwell made several false statements and sworn depositions in 2016.
00:13:59.320Maxwell is expected to be presented this afternoon in federal court in New Hampshire.
00:14:04.680This case is assigned to U.S. District Judge Allison J. Nathan.
00:14:07.360Now, you guys are probably wondering, what the fuck is she doing in New Hampshire?
00:14:10.480That's where the feds caught her, guys.
00:14:12.000She was hiding out in a huge estate out there.
00:14:49.640So that's how they were able to find her in New Hampshire.
00:14:54.620And then anytime you get caught in another state, and I'll say this real quick, anytime you get caught in another state, guys, pretty much you're going to, since it's federal, there's no extradition or none of this bullshit.
00:15:25.400So I think U.S. Attorney Audrey Strauss said, as alleged, Ghislaine Maxwell facilitated, aided, and participated in acts of sexual abuse of minors.
00:15:34.840Maxwell enticed minor girls, got them to trust her, and then delivered them into the trap that she and Jeffrey Epstein had set.
00:15:42.400She pretended to be a woman they could trust all the while she was setting them up to be abused sexually by Epstein and, in some cases, Maxwell herself.
00:15:51.540Today, after many years, Ghislaine Maxwell finally stands charge for her role in these crimes.
00:15:57.640You know, the U.S. Attorney and them, they always want to give a statement after, you know, a big arrest like this.
00:16:02.920And then, you know, obviously the director is going to say something.
00:16:05.360FBI Assistant Director William F. Sweeney Jr. said, preserving the innocence of children is among the most important responsibilities we carry as adults.
00:16:14.660Like Epstein, Ms. Maxwell chose to blatantly disregard the law and her responsibility as an adult using whatever means she had at her disposal to lure vulnerable youth into behavior they should never have been exposed to, creating the potential –

00:16:41.600We know the quest for justice has been met with great disappointment for the victims and that reliving these events is traumatic.
00:16:49.740The example set by the women involved has been a powerful one.
00:16:53.300They preserved against the rich and connected, and they did so without a badge, a gun, or a subpoena, and they stood together.

00:51:38.960I mean, she's going to beat the case because, you know, I think something like some of the FBI agents involved in the case did some stupid shit, whatever it is, but I was like, no, bro, when it comes to sex trafficking, they're going to use the full force of the U.S. government against her.

00:52:18.040So, now, we're going to go ahead and pull up this news article here, all right, and we're going to read through this, and then I'm actually going to take you guys through the actual court documents.

00:52:40.300So, Ghislaine Maxwell juror to be questioned under oath by a trial judge.
00:52:45.940New York, Ghislaine Maxwell, trial juror who indicated during jury selection that he'd never been a sexual abuse victim will be questioned by the trial judge in court after demands for a new trial by a defense attorney sprouted from his public claims that he'd influence fellow jurors by revealing he was a sex, a child sex assault victim.
00:53:08.860U.S. District Judge Allison J. Nathan said in a written order Thursday she'll question the juror March 8th at a public court hearing.
00:53:17.640She also said she rejected requests by Maxwell's attorneys that she immediately order a new trial and that she questioned other jurors after a second one reportedly revealed during deliberations having suffered a childhood sexual attack.
00:53:45.920I'll break it down for you guys here in a second.
00:53:47.560Let's get through this article and I'll explain.
00:53:48.900A copy of the first juror's questionnaire answers filed publicly Thursday showed a man identified in court papers only as juror 50 checked the no box to a question asking if he or a friend or family member had ever been the victim of sexual assault, sexual abuse, or sexual harassment.
00:54:10.140The question said, it includes actual or attempted sexual assault or other unwanted sexual advance, including by a stranger, acquaintance, supervisor, teacher, or family member.
00:54:20.460The juror's questionnaire was attached in exhibit to the newly unsealed January 19th request for a new trial by Maxwell's lawyers.
00:54:27.580They noted that all other jurors also said they were not victims of sexual abuse, assault, or harassment.
00:54:33.240Truthful answers from juror 50 would have led the court and other parties to probe much more deeply into his biases and prejudices, both known and unknown.
00:54:43.200Had that happened, the record shows that he would have been removed as a potential juror, the lawyers wrote.
00:54:50.440Maxwell's lawyers said that the juror answered other questions falsely, including one asking whether he'd ever been a crime victim.
00:54:58.700In a February 2nd submission, unsealed Thursday, prosecutors said there was substantial reason to believe that any inaccuracy by a juror was an honest mistake and not a deliberate falsehood.
00:59:00.060Obviously, we are very disappointed with the verdict.
00:59:03.160Jurors rejected the defense argument of a vindictive prosecution aimed at delivering Maxwell to the victims deprived of justice from Epstein.
00:59:10.560The jurors did accept the parallel testimony of victims that Maxwell coaxed them into giving massages to Epstein, which turned sexual.
00:59:18.640As for whether Maxwell might now cooperate and hand over names, former federal prosecutor Doug Byrne says not likely, since Maxwell is seen as the epicenter of the criminal enterprise.
00:59:29.060You know, it's almost analogous to, you know, a supplier of narcotics and a consumer.
00:59:35.560If there's going to be any cooperation, it'll be the defense seeking it.
00:59:38.860So, I'm not sure they're going to be granted that opportunity.
00:59:42.400Now, a sentencing date has yet to be set.
00:59:44.640Maxwell faces a maximum of 40 years in prison.
00:59:47.220Legal experts tell us that she will likely get much less, but will still spend decades behind bars.
00:59:51.840And, Laurie, she is currently 60 years old.

01:00:14.340In interviews with news outlets after the trial, the juror said he revealed to fellow jurors during deliberations that, like some Epstein victims, he'd been sexually abused as a child.
01:00:22.180And he said he convinced other jurors that a victim's imperfect memory of sex abuse doesn't mean it didn't happen.
01:00:29.260So, let me explain the gravity of this situation, guys.
01:00:36.640So, as you guys know, not many cases go to trial.
01:00:40.460So, when a case does go to trial, you have to give the defendant, and I think this is based off the Sixth Amendment, an impartial fair trial judged by their peers.
01:00:52.460And to be impartial, you need to be able to look at the crime objectively without your feelings.
01:01:08.040So, anytime you do jury selection, guys, you need to ask questions of the jurors about their background, what they do for work, their personal experience.
01:01:19.480And then, depending on the crime, you're going to ask them certain questions based on the crime that is going to go to trial.
01:01:27.700With crimes like this, right, sex crimes, they ask a fuckton of questions about the victim's background, have you ever been abused, et cetera, because they know that it is going to affect their ability to be what?
01:01:42.920So, this juror knows that he's about to be on the jury for one of the biggest sex cases, sex crime cases, in the United States next to R. Kelly, all right?
01:01:58.180And that's going to be a pivotal part of the questions asked in the juror questionnaire.
01:02:05.380Have you been a victim of any type of sex crime?
01:02:07.980And if he had said yes in those questionnaires, I'm going to keep it a thousand with you guys, the lawyers would have got rid of him.
01:02:15.620They would not have let him sit on the jury, okay?
01:02:21.740Now, when it comes to federal, the judge asked the questions.
01:02:25.060However, the AUSA and the prosecutor are there.
01:02:28.820And basically, guys, what jury selection really is is – it's not even jury selection.
01:02:33.340It's more about, like, jury elimination.
01:02:34.720They eliminate jurors that are not – that they feel will not be impartial based on the juror's background.
01:02:43.420Like, me, I would be a terrible juror.
01:02:45.320They will never allow me to be a juror because I'm former law enforcement.
01:02:47.900They're going to be like, no, you're always going to go on the prosecution side.
01:02:51.040So, the defense, nine out of ten times, is going to kick me out.
01:02:54.260They're not going to let me be a juror, okay?
01:02:56.120So, that's the job of jury selection is to put an impartial jury there judged by 12 of your peers.
01:03:06.540So, clearly, this guy not only lied on the juror questionnaire, he was a victim of a sex crime which affects his ability to be impartial.
01:03:16.820And then, on top of that, he convinced the other jurors during deliberation that – to believe the victims because Ghislaine's team had brought in an expert witness that basically was able to show that their recollection was not all there, okay?
01:03:37.820Because, remember, guys, that Ghislaine's team, their job was to make sure that they could show that the victims – this was a money grab and that Epstein was the real guy.

01:22:29.600This was unfair and prejudicial to Ms. Maxwell, and it all would have been avoided if juror number 50 had told the truth during voir dire,

01:23:10.320The Sixth Amendment of the United States Constitution guarantees trial by jury.
01:23:15.100Fundamental to that guarantee is the promise that the jury will be comprised of 12 dispassionate individuals who will fairly and impartially decide
01:23:24.820based on the evidence or lack of evidence and not on their personal pre-elections and biases,
01:23:31.740whether the government has proved its case beyond a reasonable doubt,
01:23:35.180voir dire plays an essential role in this process to jury selection,
01:23:38.960and it depends on potential jurors to truthfully answer material questions put to them by the court and the parties.
01:23:48.860Juror number 50 did not truthfully respond to perhaps the most important question put to potential jurors about their personal experiences,
01:23:56.080a question that pertained directly to the court allegations against Ms. Maxwell.
01:24:00.820Whether they had been a victim of sexual assault or abuse,
01:24:05.260juror number 50's false answer undermined voir dire resulted in a jury that was not fair and impartial
01:24:11.460and deprived Ms. Maxwell of her constitutional right to trial by jury.

01:24:27.420For them to put that money together, go to trial for a fucking month, fly those witnesses in, house those witnesses, prepare those witnesses,

01:26:03.300This includes actual or attempted sexual assault or other unwanted sexual advances, including by a stranger, acquaintance, supervisor, teacher, or immediate family member?
01:26:10.760The questionnaire offered three answers.
01:26:12.000Yes, yes, friend or family member, and no.
01:26:39.820Yes, juror 50, number 50, could decide the case based solely on the evidence or a lack of evidence and not based on bias, sympathy, or prejudice.
01:27:03.660No, there was nothing about the nature of the allegations against Ms. Maxwell that might make this difficult, make it difficult for juror 50 to be fair and impartial.
01:27:30.240Did not have any views about the laws governing sex trafficking and sex crimes against minors that would affect his ability to be fair and impartial.
01:27:43.460Would not have any difficulty assessing the credibility of alleged victims of sexual assault or abuse just as he would assess the credibility of any other witness.
01:27:51.760Finally, and most importantly, juror number 50 answered no when asked in question 48 if he had ever been the victim of sexual harassment, sexual abuse, or sexual assault, including actual or attempted sexual assault or other unwanted sexual advance, including by a stranger, acquaintance, supervisor, teacher, or family member.

01:28:34.100But, um, what we're going to do is we're going to go through their evidence on why they, uh, they're, man, they're coming at this guy's neck.

01:29:18.440This questionnaire is designed to help simplify ensuring the jury selection process.
01:29:22.400The purpose of the questionnaire is to determine whether prospective jurors can decide this case impartially based on the evidence presented at the trial and the legal instructions given by the presiding judge.

01:55:54.740He also appears to have deleted his Facebook and LinkedIn accounts.
01:55:57.480A second juror admits to disclosing during deliberations that they were a victim of sexual assault.
01:56:08.640During his press tour, Juror 50 revealed in interviews that he was not alone in revealing to jurors that he was a victim of sexual assault.
01:56:16.180Describing to a reporter that a second juror also disclosed that they were a victim of sexual abuse.
01:56:22.220On January 5th, the New York Times published an article confirming Juror 50's statement reporting that a second juror described in an interview having been sexually abused as a child.
01:56:32.240This juror, who requested anonymity, said they, too, had discussed the experience during deliberations and that the revelation had appeared to help shape the jury's discussions.
01:56:43.080To date, this juror has not publicly revealed their identity and Ms. Maxwell does not know who it is.
