00:07:15.760 Investigators writing Kassip in messages with someone said he planned to use a drone in the attack that would drop a bomb with nuts, bolts, needles, and then flee to Ukraine.

00:07:26.420 The affidavit stating Kassip had paid for, at least in part, a drone and explosives and was communicating with someone with a Ukrainian number.

00:07:35.960 It did not say where or when he allegedly planned to target the president.

00:07:45.920 This after, back in late February, local authorities during a welfare check found the teen's parents shot to death in the family home.

00:07:53.580 The affidavit saying the couple had been dead for roughly two weeks and Kassip living in the home with their bodies, then fleeing before he was arrested in Kansas.

00:09:54.080 Here he is entering the courtroom in a protective vest in Waukesha, which is about a half hour from Milwaukee.

00:09:59.780 Right now, he is charged with operating a vehicle without consent for allegedly taking his stepfather's VW Atlas without permission as well.

00:10:09.500 This dude's in a state court, but he's being charged, but you saw a federal warrant.

00:12:12.600 The mom of Kassop's stepdad, Don Meyer, called police in Wisconsin from her home in Massachusetts, and she asked deputies to do a wellness check at her son's house.

00:12:20.820 She said that she and Meyer's sister received text messages from Donald that they found odd that week.

00:12:25.800 Meyer lived in Waukesha with his wife, Tatiana, and Nikita Kassop.

00:12:29.200 That's Tatiana's 17-year-old son.

00:12:34.320 When police entered the house, they found Don Meyer dead.

00:12:36.820 He had a gunshot wound to the back of his head, and Tatiana, Nikita's mom, was also dead.

00:12:41.220 She had a gunshot wound to her torso and one from close range in her neck, which killed her.

00:12:45.420 Who they didn't find in the house, though, was Nikita.

00:12:47.400 The 17-year-old school was also concerned because he hadn't shown up to class for roughly two weeks,

00:12:51.480 and a school resource officer also had asked for a wellness check.

00:12:54.840 According to this criminal complaint, that officer cited that Nikita had perfect attendance at that point in the year.

00:12:59.500 He also, Nikita, appeared to be a good student.

00:13:01.280 In December of 2022, he was Student of the Month at Waukesha West High School for the Health Department.

00:13:06.320 A teacher back then said, quote,

00:13:07.780 Nick has a great work ethic and does not hesitate to find clarity when needed.

00:13:10.920 He's a strong advocate for his success and works diligently to maintain a high level of rigor.

00:13:15.180 He is very polite and works well both in small and large group settings.

00:13:18.180 So the question at that point for investigators was, where was Nikita?

00:13:21.580 A neighbor told them they had seen Nikita driving away in his stepdad's car.

00:13:25.440 That is a 2018 VW Atlas.

00:13:27.800 It's important to note that Nikita doesn't have a driver's license.

00:13:30.900 Deputies then pinged Tatiana and Don's cell phones, and that showed a location of Cheyenne, Wyoming.

00:13:36.200 That's more than 14 hours away from Waukesha and 984 miles.

00:13:40.640 Eventually, Nikita was arrested all the way in Waukini, Kansas.

00:13:44.360 Police say he was driving his stepdad's Atlas, also had the family's dog in the car.

00:13:48.540 And inside the vehicle as well, police say they saw a Smith & Wesson handgun in plain sight.

00:14:33.780 And during that court appearance, prosecutors laid out some new information as we pieced together the timeline of what they believe happened.

00:14:40.360 And at the time of this recording, remember, Kassop is only charged with taking a car and a gun without permission.

00:14:46.180 At this point, he is not charged with murder.

00:14:47.600 And at this time, I would be making an oral motion to dismiss based on my review of the criminal complaint.

00:14:51.580 I do not believe that there is sufficient information within the four corners to support the two charges, specifically with respect to the portion of both counts where there is an allegation that these things happen without consent.

00:15:02.180 There is nothing that I can see other than one sentence at the end that says, based upon information and belief, victim A did not give the defendant permission to operate the VW Atlas, nor did he give consent to remove the Smith & Wesson 357 Magnum.

00:15:15.480 So based on that, I would move to dismiss at this time.

00:15:17.480 The defense asked for this case to be dismissed, with a key part of it being there's no way to tell whether or not Kassop had permission to take the car and the gun because Don Meyer's dead.

00:15:26.720 Here's how the prosecution responded.

00:15:28.280 We'd asked the court to deny that motion.

00:15:30.380 In this case, what's alleged to have occurred is that the police went to the house the defendant formally resided at.

00:15:35.300 He is no longer welcome at that residence.

00:15:37.460 And his stepfather and mother were found.

00:15:41.100 We believe it's them.

00:15:41.920 They now have been positively identified as his stepfather and mother were found deceased, shot.

00:15:46.200 The stepfather was shot in the back of the head, and the mother had three gunshot wounds, one close up to the neck of them, two others that were non-fatal.

00:15:58.380 Obviously, a dead person cannot give consent.

00:16:00.400 We believe that the date of violation, although it's not in here, the date of death is on or about February 11, 2025, which means that the defendant was living in the house with his deceased mother and stepfather, a period of time up to February 23rd, based upon the fact that the, and I believe there was a neighbor who said that

00:16:16.200 I don't even think the defendant had driver's license to be able to drive a car, so based upon that and the fact that he was underage, I believe the difference is that he did not have consent to either take the firearm of the house or the car.

00:16:27.260 Obviously, the person that would have had to give him consent is dead, and we believe forthcoming charges will be brought accusing this defendant of causing that death.

00:16:35.680 So, at least for this hearing, we do believe that the motion should be denied, the four quarters of the complaint, adequately established problem clause, to believe a crime has been committed and that the defendant committed that crime.

00:16:44.140 What you just heard, there was new information when it comes to this timeline that prosecutors have.

00:16:48.540 They say that Nikita's stepdad and mom were killed on February 11th, their bodies not found until the 28th, and prosecutors say they believe Nikita lived in that house until February 23rd, nearly two weeks.

00:16:59.460 I want to go back to something also that was noted in the criminal complaint related to text messages that Don Meyer allegedly sent family and even his boss at work.

00:17:07.180 Deputies say that Don's sister received a text on February 18th, which is seven days after prosecutors believe he died, saying that he had been sick and he was going to take some time off social media.

00:17:16.380 His family also said that he had sent text messages that they found weird on February 23rd, also after the day that authorities believe that Don Meyer died.

00:17:24.320 The complaint also shows that Meyer's manager at work said that they were in text communication from February 13th through the 25th, saying that he was sick and he couldn't talk on the phone.

00:17:32.120 All these dates after when prosecutors say Don Meyer and Tatiana Kossop were killed.

00:17:36.160 The judge denied the defense's motion to dismiss this case, and the hearing then moves on to bail.

00:24:42.060 J.M. stated they were unable to contact the family and learn Nikita Kasp, remember, guys,

00:49:34.460 One of the most important things as a prosecutor you want to make sure you're doing

00:49:37.720 is you're adequately and accurately charging the individual.

00:49:40.940 So you don't want to overcharge them with evidence that you can't prove at a trial,

00:49:45.040 but also you don't want to undercharge the individual.

00:49:46.980 Now, here we can expect that there are going to be some murder charges that are added.

00:49:50.460 Statutorily, which murder charges or which homicide offenses will he be charged with?

00:49:54.240 We don't know that at this point.

00:49:55.820 But what I think the prosecutor is trying to do is just ensure that she has enough evidence

00:49:59.220 and information as she adds these additional charges to make sure that everything that

00:50:03.000 she's charging is sufficient and appropriate.

00:50:06.200 How does that work where he was found with a gun that is presumed to be the murder weapon

00:50:11.700 and it feels like there are just cases, and this is where you can tell me I'm wrong because

00:50:15.040 you're the attorney and I'm not, but it feels like people get charged with murder for a lot

00:50:21.360 Why not charge him with murder and then add those additional pieces of evidence later?

00:50:25.480 Is that something that they can do or is it just not how that works?

00:50:33.760 It seems that during the arraignment for these charges that the prosecutor had enough

00:50:38.240 information to indicate that the murder charges would be forthcoming, and she added information

00:50:43.760 in the opposition of the bail application to indicate and reflect that he was responsible

00:50:48.280 for those murders or he's alleged to be responsible for those murders.

00:50:51.600 So I can't say for certain why she would have waited.

00:50:54.240 I expect that they're going to have a preliminary hearing within nine to ten days,

00:50:57.240 and so it's expected that she's going to file them or amend the complaint against him to

00:51:01.660 add those additional charges once that time comes.

00:51:04.280 I do believe that they're getting search warrants for phones and devices and things like that,

00:51:08.040 or that they have done that.

00:51:09.300 And so I expect that that information will solidify and confirm, you know, what charges

00:51:13.240 she's looking to go forward with.

00:51:14.500 And it could have just been a matter of timing.

00:51:16.620 Sometimes what happens is, with respect to, you know, charges and evidence that prosecutors

00:51:20.700 have at the moment, whatever they find necessary to establish at least some basis of a charge,

00:51:26.160 they will use that to go forward and at least get the individual held in custody and then

00:51:31.220 add those additional charges later.

00:51:33.440 How common is it to in court say that this person is eventually going to be charged with

00:51:36.980 a more serious crime and try to factor that into whether they would be held on a higher

00:51:40.320 bail, even though at this point he has not been charged with murder?

00:51:43.200 Yeah, so of course the prosecution is going to try to do that, and I see both sides of

00:51:48.080 the coin here.

00:51:48.960 You know, if there's evidence that is sufficient to prove or show that he is alleged to commit

00:51:52.540 the homicides, you don't want to risk him getting out and re-offending and murdering

00:51:56.460 somebody else.

00:51:56.980 So that's the most important thing, is protecting the public.

00:51:59.480 But at the same time...

00:52:00.540 Yeah, there's no way he's going to get out on bond.

00:52:02.540 Killed both of his parents and premeditated, you know, saying that he has allegiance to a

00:52:09.180 terrorist organization, no way, cooked, no way he's getting bond.

00:52:14.320 You know, there is an argument to be made that he is not charged with the murders, and

00:52:17.200 I think that his defense attorney made these arguments during their bail application and

00:52:20.880 during the arraignment, but he has not been charged with the murder.

00:52:23.220 At this point in time, he's simply charged with stealing or using the motor vehicle or

00:52:27.300 unauthorized use of the motor vehicle and for having that firearm.

00:52:30.540 And so those are the charges that they have now.

00:52:32.620 How fair is it to, you know, set such a high bail and treat this individual as if he has been

00:52:38.180 charged with murder when he has not?

00:52:40.700 You know, there's arguments to be made on both sides, but I think the interest of the

00:52:43.480 public is why the prosecutor made those arguments for such a high bail, referenced the homicides,

00:52:48.340 and why the judge went along with setting that $250,000 bail.

00:52:51.540 And in your experience, being both a criminal defense attorney and a former prosecutor, how

00:52:56.740 much of that is on the judge and just the particular judge that you get and how they typically

00:53:01.020 handle those proceedings?

00:53:02.940 It certainly does depend on the judge that you get.

00:53:05.220 You get some judges that are more liberal, some judges that are more defense-friendly.

00:53:08.540 You get some judges that are more conservative.

00:53:10.700 And one of the things that the judges will always consider is, if I let this person out

01:04:10.720 is trying to get this case dismissed altogether? The defense attorney did exactly what she should

01:04:15.040 have done and what she was supposed to have done. Um, one of the things that's important...

01:04:18.480 I mean, it doesn't matter. They're going to charge his ass with murder. They got him dead

01:04:20.960 to rights on the murder. They got in the phones, legally. They got the, you know,

01:04:24.800 they got the search warrants, et cetera. Like, it doesn't really matter. And the prosecution

01:04:30.240 probably let them have it. Oh yeah, you can't prove that he actually stole the money

01:04:36.800 the fact that he killed him. As you know, the accusatory instrument that's filed in court,

01:04:41.280 and that's a charging document for the, for the defendant. It alleges that the defendant

01:04:44.960 committed XYZ. One of the things that happens is there's a four corners challenge, which...

01:04:49.280 Bro is cooked. Essentially says, you know, judge,

01:04:51.680 we're challenging what is written within the four corners of this accusatory instrument,

01:04:55.040 because based on our position and our belief and review of this accusatory instrument,

01:04:59.120 there is not a sufficient basis to charge this individual with this crime.

01:05:02.800 His attorney during the arraignment noted that the consent factor is in question. There's nothing

01:05:07.760 to indicate that, you know, that the deceased or the decedent did not consent to the use of the

01:05:12.640 firearm or to taking of the firearm or the vehicle. And so that's one of the things that should be

01:05:17.360 challenging in the legal world or in the legal realm of this. You know, one of the things the

01:05:21.120 prosecutor has to show is that he did not have consent. Now, the court in reviewing the four corners

01:05:26.480 of the accusatory instrument can infer that consent was not had. But later down the line,

01:05:31.200 that inference and that standard at the arraignment is not going to be the same when it gets time to

01:05:35.520 a trial and the prosecutor has to prove lack of consent beyond a reasonable doubt.

01:05:39.200 The defense attorney did what she should have done in this case. There was a great argument

01:05:42.880 against the prosecution indicating that there's no proof of the lack of consent. The individuals,

01:05:47.680 unfortunately, aren't able to consent or not consent. And so that was the argument that was made.

01:05:52.320 I think there's a good point to be made there. But the judge determined that,

01:05:55.280 based on his ability to infer, he was going to maintain that the accusatory would stand.

01:05:59.360 And to your point, kind of seeing both sides of it, just because as someone who's not a lawyer,

01:06:03.920 just kind of watching this case, a member of the public, anybody who would be accused,

01:06:07.040 even in the court of public opinion of committing murder this way,

01:06:10.240 you wouldn't want them out on the streets. But then from the other side,

01:06:13.120 I do see the defense saying there's nothing in here that shows that he actually stole the car.

01:06:16.480 Who knows if the stepdad said, you know, take the vehicle, go for it, drive to Kansas,

01:06:21.520 and then someone else came into the home and did it, you know, that that argument could actually

01:06:25.280 hold some water. And it, I guess I could see that if you were a defense attorney,

01:06:29.040 you feel like you're fighting an uphill battle because of these charges

01:06:31.680 that haven't even been filed yet for, for a much more serious case.

01:06:34.800 Yeah, most definitely. And so that, that's a question. And, and I give credit to the prosecution

01:06:39.840 as well, because of course you can infer, well, they weren't able to consent because they weren't

01:06:44.160 alive. But again, those things have to be proven beyond a reasonable doubt later down the line.

01:06:49.280 Now I expect that once the murder charges come in, these charges that he was arraigned on as of

01:06:53.360 yesterday are going to be the least of his problems. Exactly. And that's all that,

01:53:32.080 is when he attacked at the residence, broke in, and set the fires. So that was all playing out over

01:55:56.240 Police was approached outside department headquarters located on Elmerton Avenue by a male identified as

01:56:01.840 Cody Balmer. Balmer informed the trooper he was responsible for the fire in the governor's residence

01:56:06.240 and wished to turn himself in. Balmer was then transported to PSP Harrisburg, where he was

01:56:10.720 interviewed in relation to the investigation. Now, police say they advised Balmer of his rights

01:56:14.960 and that he confessed to the attack on the governor's mansion. The affidavit states,

01:56:19.680 Balmer admitted to harboring hatred toward Governor Shapiro. He advised on the date in question,

01:56:24.400 he removed gasoline from a lawnmower and poured it into Heineken bottles he found at his residence.

01:56:28.720 What the fuck? Balmer advised he walked for approximately one hour from his residence to the governor's

01:56:34.480 residence with the intention of throwing his homemade Molotov cocktails into the residence.

01:56:39.040 Balmer admitted that, once at the residence, he scaled the perimeter fence, broke two windows with
