00:50:51.800 Now, they're talking about this is so much money that he's going to have to put up probably real estate and sell some real estate to be able to pay for this.

00:52:28.800 And it's like, well, we think if he didn't defraud these banks, then the banks would have made more money.

00:52:37.800 Now, of course, the banks could have gone to him and just requested a higher interest rate, which they didn't do.

00:52:42.800 But because they found him a good risk because they'd done business with him before.

00:52:48.800 Before. And they all knew he had lots of money and they all knew he had a successful business and they all knew he would pay back the loans.

00:52:54.800 They all knew this would occur.

00:52:56.800 So they went down this road. Now, of course, their case in New York is, hey, you defrauded all these banks.

00:53:03.800 You screwed all these banks out of money.

00:53:05.800 So you have to pay three hundred and fifty million dollars to us.

00:53:11.800 Right. The state of New York.

00:53:13.800 Because the banks get none of it.

00:53:15.800 The banks didn't file this.

00:53:16.800 There was no complaint. None.

00:53:19.800 Even if you think there was no complaint, if you're saying they were defrauded, you'd think they would get the money.

00:53:26.800 But no, no, it goes directly to the state of New York, which is just another comical layer to this.

00:53:32.800 But listen to this breakdown of this particular rule, this law and how it's been used in the past, because as you point out, there's no victims here.

00:53:42.800 No one is coming. No bank is being, hey, by the way, he lied about this and this didn't work out for us.

00:53:49.800 In fact, the banks testified on his behalf, on his behalf, saying there's no victim.

00:53:54.800 We knew this. We take that into account with everybody we loaned.

00:53:58.800 That's why we have a whole division that goes out and does the estimates for us.

00:54:04.800 We know we're not stupid. Right. Right.

00:54:06.800 So this law has been around for 70 years. OK, and it is.

00:54:13.800 There is multiple facets of this. There's the big fine, which is kind of the headline, but also the fact that they might take his business away.

00:54:20.800 They're saying he can't run his business. They're saying his kids can't run the business anymore.

00:54:24.800 They're trying to turn this essentially into a death penalty for this company.

00:54:28.800 They are. So it is the only big business that was threatened with a shutdown.

00:54:35.800 Without showing obvious victims or major losses in 70 years. The only one. OK.

00:54:42.800 The AP went through one hundred and fifty cases since New York's repeated fraud statute was passed in 1956.

00:54:49.800 And it showed that nearly every previous time a company was taken away, victims and losses were key factors.

00:54:56.800 You'd think, right? Customers lose money because they bought defective products or never received services ordered, leaving them cheated and angry.

00:55:05.800 What's more, businesses were taken over almost always as a last resort to stop a fraud in progress to protect potential victims.

00:55:13.800 So let's look back at this now, because there is one case where they try to take a company, which is what they're threatening here with with the Trump corporate, the Trump corporation.

00:55:22.800 Do we have that? Hang on. Do we have that clip of of the AG saying that they're going to take it?

00:55:29.800 Here it is. Four days after a judge ordered Donald Trump to pay three hundred fifty five million dollars for a decade of fraud.

00:55:36.800 New York Attorney General Letitia James says she's prepared to do everything she can to make sure the former president pays his fine, including, she told us, seizing the buildings that bear his name.

00:55:48.800 If he does not have funds to pay off the judgment, then we will seek, you know, judgment enforcement mechanisms in court and we will ask the judge to seize his assets.

01:09:01.580 He's just put together an ESG bill that has the potential to be the strongest or the second strongest law in the country.

01:09:10.140 It's a really good law, and it goes up in committee on Tuesday, and I wanted you to know about it.

01:09:25.240 So tell me about the bill and the battle for passing this thing.

01:09:33.260 Yeah, well, to start out last year, we took the first ESG step with the treasurer of our state.

01:09:39.640 Thankfully, we have one of the best treasurers in the country, very conservative.

01:09:42.820 He and I began to discuss ESG and the problems that we were seeing with BlackRock in the state of Tennessee.

01:09:49.720 We divested ourselves from all the BlackRock investments.

01:09:52.620 He and I were having this conversation.

01:09:54.200 He said, I'm never going to allow these standards to be utilized, but we have to take legislative steps to ensure those behind me don't take those steps.

01:10:01.420 So last year, I was able to pass a bill with our Senate Majority Leader, Jack Johnson, to prohibit ESG standards from being used on the governmental state level.

01:10:10.640 And so, obviously, the next step, as you've talked about, was the fair access bill, which Florida has.

01:10:15.740 I talked to the DeSantis team.

01:10:17.300 They've been very helpful.

01:10:18.600 But, man, really, Glenn, the team at Wall Builders, Audria, Betty, Justin Haskins, they have been invaluable in providing.

01:10:27.360 I literally have pages of resources here to be able to combat the pushback from the Tennessee Bankers Association, which is obviously pushing back on the bill.

01:10:36.740 But to your point, I feel like we have the home run.

01:10:39.400 We've included all the best parts.

01:10:42.720 It protects religious liberty of institutions, political views, whether you want a firearm.

01:10:48.080 I mean, we hit just about every aspect.

01:10:50.000 And then we actually, versus just saying ESG, we actually list out the individual tenets of ESG to ensure that the big banks cannot debank Tennesseans.

01:11:01.820 So what's the pushback been like?

01:11:06.440 So we started out as the team at Alliance for Defending Freedom.

01:11:09.720 They've been working hand-in-hand with wall builders.

01:11:11.940 And so they came to us and said, listen, the Tennessee charter banks are not your problem.

01:11:17.180 You're $3 billion, $4 billion banks.

01:11:18.900 I mean, they're serving Tennessee, and they're doing a great job.

01:11:22.200 It's Bank of America.

01:11:23.380 It's JPMorgan Chase.

01:11:25.200 It's Wells Fargo.

01:11:26.100 It's the big guys.

01:11:27.140 So they suggested putting an amendment on that was $100 billion that only hit the 28 largest banks in the country because that's the problem.

01:11:36.840 And so kind of thinking that that would back the Bankers Association off.

01:11:40.140 Well, the Bankers Association represents the large banks as well.

01:11:43.520 And so they were in my office last week pushing back, saying they weren't comfortable with the bill.

01:11:48.080 And, Glenn, I just looked at them and said, listen, if you're uncomfortable with what's in this, then that's the problem.

01:11:53.160 That's why we have to run it.

01:11:54.240 But if you guys aren't doing these things, then you won't have a problem.

01:11:57.640 Because they like to say in a conservative state like Tennessee, they immediately say, well, guys, we're opposed to ESG.

01:12:03.840 And then here comes the but.

01:12:05.500 And then you've got these 15 different things they list out.

01:12:08.360 And so I've already worked the committee.

01:12:11.720 We're a supermajority in Tennessee, 75 Republicans in the House out of 99.

01:12:18.780 The Republicans are with us.

01:12:20.020 We've only got one Democrat on the committee.

01:12:22.060 So I feel really confident.

01:12:24.060 Wall Builders and ADF have pulled some resources together.

01:12:29.820 ADF, some of the guys at Wall Builders are going to be there.

01:12:33.820 We've got an awesome team coming in because we've got this up in committee on Tuesday.

01:12:38.320 So it goes through committee.

01:12:39.960 If it makes it through, and it sounds like it will, then what's the next step?

01:12:43.420 When will this actually be in front of the legislature to vote?

01:12:48.940 Yeah, good question.

01:12:49.720 And it's important for you.

01:12:51.460 Unlike Washington, that's the focus.

01:12:53.620 They don't read bills.

01:12:54.540 They don't go through committee.

01:12:55.800 And leadership makes decisions.

01:12:57.000 In most states, like Tennessee, every bill is heard.

01:13:00.300 So it starts out in subcommittee.

01:13:01.780 It'll be in the banking subcommittee.

01:13:03.480 After it passes there, it would go to the full commerce committee, which is a much larger committee.

01:13:08.020 Then it goes to the House floor.

01:13:09.940 And Glenn, you talk about this all the time, but it's important for your listeners, especially your Tennesseans, to know.

01:13:15.500 They need to call the members of the banking committee.

01:13:18.440 You don't need to worry about the full House right now because we've got a couple of weeks until we get there.

01:13:22.180 But this next week, you call the banking committee and email them and say, hey, guys, we need this.

01:13:27.420 This is something we need to pass to protect us.

01:13:29.860 And then the following week, you need to call the Commerce Committee.

01:13:32.700 Tennesseans do.

01:13:33.740 And then three weeks from now, that's when you start emailing the whole House.

01:13:37.100 So it's very different than Congress, and most people don't understand that.

01:13:40.220 And so you focus on one committee at a time because that's the most important.

01:13:44.140 We'll pass it in the House.

01:13:45.480 And Senate Majority Leader Jack Johnson, he's been right with me on this.

01:13:49.200 He'll then move it on the Senate side.

01:13:51.260 And then hopefully in probably four weeks or so, we could have this before the governor to sign for a signature.

01:14:56.360 So, if it were to pass, which I don't think it will, we've already gotten it rolled to the last calendar.

01:15:08.260 Statewide, zero coverage, nobody's talking about it.

01:16:03.760 So, the UCC bill, we got that rolled to the last calendar.

01:16:07.780 And as most people know, we're part-time legislators.

01:16:10.760 We go from January to April.

01:16:11.960 So, we got it pushed to the last calendar, hoping the sponsor will take it off.

01:16:16.200 I mean, it's a cold breeze blowing in that committee right now just because there's so much uncertainty around it.

01:16:20.760 But I have a standalone bill to change the definition of deposit accounts to make it very difficult to implement a central bank digital currency.

01:16:29.520 Because what happens, the federal government can roll it out.

01:16:32.940 People can use it.

01:16:34.200 There's only so much the states can do.

01:16:36.340 But like Florida's done in Alabama, North Dakota, we as Tennessee need to take that step to ensure that it's not – that banks can't use it as collateral within their deposit accounts.

01:16:45.980 So, then they push back on the federal government and say, listen, you can't implement this because our 90 to 10 ratios, we can't maintain those if we can't count central bank digital currency as a collateral.

01:16:56.540 And so, I mean, man, again, these are all factors.

01:16:59.460 And some of those – all these things we're talking about are so critically important.

01:17:03.800 But most people just know it from a surface level and don't think much can be done.

01:17:08.800 But, Glenn, I'm five terms in serving in the House.

01:17:11.680 It's been the honor of my life to serve.

01:17:13.860 And under Governor Haslam, who was our previous governor, a Republican, he used to say that the federal government had become an unreliable partner.

01:17:21.440 Well, over the last five years under Governor Lee, who's our current governor, man, they've become an adversarial partner.

01:17:27.020 I mean, literally, Joe Biden has called Governor Lee twice asking to dump illegals in our state.

01:17:31.400 He says, no, they do it anyway.

01:17:33.960 Everything that we do, the federal government is pushing back on us.

01:17:38.220 And so we were the first state in the nation.

01:17:41.360 We passed a block grant for Medicaid.

01:17:43.420 We got it in right before Trump left office.

01:17:46.200 He signed off on it.

01:17:47.460 And we have been able to save about $350 million a year with our Medicaid program because we get to keep those shared savings.

01:17:54.340 But we're the only state that was able to do that because we got it under the gun.

01:17:57.540 And so, man, our conversation among our supermajority GOP has been we have to do everything we can to firewall our state from these adversarial policies of the federal government.
