00:01:31.140 let me give you the story before i get into the what people are saying right now first of all
00:01:35.440 let's start with the important thing cora was five dawson was three callen was eight months old
00:01:42.400 and they died in a house in massachusetts january 24th 2023 their mother has never disputed that
00:01:49.780 she was the one who did it. The trial ends this week in Plymouth, Mass. Superior Court is hearing
00:01:58.260 this case, but it's not about what happened. It's about one question. Is she responsible
00:02:04.180 for doing it, even though she claims she did it? Is she responsible? Now, I want to make this
00:02:09.700 really clear. I am not in that jury box. I have not heard testimony for four weeks. I have not
00:02:15.900 been following every word that's happening. I haven't watched the witnesses. I am not going to
00:02:20.320 sit here and tell you what I think the verdict should be. I've watched all of what's happening
00:02:24.440 from the outside of the courtroom, and that's what I want to talk to you about because I don't hear
00:02:28.660 anybody saying these things. So let's start with something almost nobody in America knows because
00:02:34.420 it changes how you read every headline that you see on this case. Massachusetts does not use the
00:02:40.880 word insanity. The doctrine is called lack of criminal responsibility, and the test has two
00:02:48.120 doors to it. Door one, because of a mental disease, she couldn't appreciate what she was 0.91
00:02:55.500 doing wrong. That's the first one. Door two, she could appreciate it perfectly well, but she lacked
00:03:03.140 the substantial capacity to stop herself.
00:03:06.820 Either one of those doors is enough, okay?
00:03:10.640 And here's the crazy part.
00:03:13.240 Might surprise you.
00:03:15.340 She doesn't have to prove any of it.
00:03:17.720 Once the defense raises it with credible evidence,
00:03:20.980 the burden flips entirely to the state, okay?
00:03:24.580 So the Commonwealth now has to prove 0.99
00:03:27.200 that those two doors don't work for her.
00:03:30.580 The prosecution does not have to prove
00:03:32.720 that she was criminally responsible beyond a reasonable doubt. 0.81

00:03:54.060 So how did this happen?
00:03:57.740 Let me go back, 1843, Scottish woodturner named Daniel McNaughton.
00:04:02.160 He walks up behind a man in a street in London.
00:04:05.800 He assumes that he is the prime minister and he shoots him in the back.
00:04:10.540 But he didn't shoot the prime minister.
00:04:12.160 He shoots the prime minister's secretary, a man named Edward Drummond, dies five days later.
00:04:17.540 At the trial, the medical witnesses testified that McNaughton was living inside of delusion that the government was hunting him.
00:04:24.580 And so the jury acquitted him.
00:04:26.880 Now, see if this doesn't sound familiar.
00:04:29.360 England lost its mind, and so did the Queen,
00:04:32.060 because Queen Victoria had been shot three times in the last three years at that time.
00:04:38.380 One of those men had been acquitted on insanity as well.
00:04:41.880 And so she writes to Robert Peel to say,
00:04:44.800 every time this law gets tested, it seems to be of no use to anybody.
00:04:49.060 So the House of Lords, they reach back, they dusted off a medieval power,
00:04:53.420 the right to summon the judges of England and make them answer questions.
00:04:59.100 So on June 19th, 1843, the judges came, they gave their answers,
00:05:03.120 and those answers, the McNaughton rules, became the test for insanity
00:05:07.440 across the entire English-speaking world for the next 150 years.
00:05:12.280 Did he know the nature of the act?
00:05:14.160 And if he did, did he know it was wrong?
00:05:17.500 Two things you should know about how that turned out.
00:05:20.240 First, McNaughton didn't go home.
00:05:22.100 He went to Bedlam for 20 years.
00:05:24.340 He died in Broadmoor in 1865.
00:05:27.660 Not guilty by reason of insanity has never meant not guilty and out the door.

00:05:34.020 Second, the rules written to punish him would have convicted him.

00:05:52.100 gets acquitted in 1982, the country erupts, Congress narrows the federal test in 1984,
00:05:57.920 strips out that second door, the one whether or not you could control yourself,
00:06:02.100 and leaves the question of, did you know?
00:06:07.120 Massachusetts never followed, okay?
00:06:09.600 Both doors are still open in Plymouth this week.
00:06:12.200 So here's the hard part.
00:06:14.020 If Lindsay Clancy was so ill that she could not know what she was doing,
00:06:19.260 then somebody has to explain the file because this was not a woman that nobody was watching
00:06:25.880 in the three months before the children she killed the children she was seeing a psychiatrist
00:06:31.420 she was also seeing a psychiatric nurse practitioner she was seeing therapist she
00:06:36.460 was in an outpatient program she had been to an emergency room she spent five days at an
00:06:42.540 inpatient at mclean this is one of the finest psychiatric hospitals in the world and she was
00:06:48.740 discharged with a diagnosis major depressive disorder severe without psychotic features
00:06:55.820 prosecutors wheeled prescription bottles into the courtroom as evidence she was taking everything
00:07:02.540 and her treating psychiatrist testified at their last appointment on january 23rd the day before
00:07:09.300 she kills her children she had no thoughts of hurting herself no thoughts of hurting anyone else
00:07:14.220 and that she never in any session ever expressed any plan to harm her children or anybody.
00:07:20.800 So which is it?
00:07:23.620 If the experts are right that she couldn't know, why didn't the experts know?
00:07:30.540 I think there's two answers to this, and neither one lets us off.
00:07:34.760 The first one is it's invisible.
00:07:37.060 She hid it.
00:07:38.040 Or that it came to her in hours that no clinician on earth could have ever seen.
00:07:42.660 and that helps her defense enormously.
00:07:46.320 And frankly, it's the most terrifying version
00:07:48.440 because it means there's no warning to miss, okay?
00:07:51.600 The second is that it was visible, but only in pieces
00:07:55.160 and nobody ever held all the pieces.
00:07:58.300 Her psychiatrist has testified she never went
00:08:00.940 and got the records from the other practices.
00:08:03.120 The nurse practitioner at the other practice testified
00:08:05.520 she never spoke to the Rhode Island hospital.
00:08:08.360 She didn't even have the records from McLean.
00:08:10.620 A rebuttal witness this month noted that there were no records that anyone ever ran on her blood to see how she was metabolizing all of the medications she was on.
00:08:22.920 She was adjusting her own doses over a patient portal.
00:08:28.240 The McLean psychiatrist, who said she saw no psychosis, acknowledged on cross-examination, she had never in her career treated a case of postpartum psychosis.
00:08:38.120 so it only happens in one or two thousand one or two in a thousand births so most physicians never
00:08:45.860 see one so she had six providers eight or ten medications and nobody had the whole file
00:08:53.120 now the law is going to disappoint anyone who wants a villain in a white coat
00:08:59.960 massachusetts like most states only imposes a duty to warn when a patient names a threat against an
00:09:06.540 an identifiable person, or has a violent history.
00:09:10.380 She told every one of them the opposite every time.
00:09:13.520 So legally, that's the end of it.

00:10:32.620 been so overwhelmed that you've had thoughts about killing your own children then put the
00:10:38.280 phone down and call some help because that's a medical emergency that is insanity
00:10:45.920 there are lawyers already saying they'll pull those videos into custody fights and whatever
00:10:53.960 you meant by it that's where it goes and then there's the other thing because a certain part
00:11:01.040 of the internet can't tolerate a tragedy without a villain so let me give you a couple of these
00:11:05.860 highlights from what we're seeing now uh online here's one defender cut 15 tiktoker says she'll
00:11:13.920 never hate lindsey clancy listen to this you are never going to make me hate lindsey clancy
00:11:19.120 you're just not i know better than anyone that the government would rather prosecute mothers
00:11:24.180 than ensure they're adequately supported what where does that come from where does that come
00:11:30.260 from what kind of mental illness is that where is your evidence of that first of all you shouldn't
00:11:37.700 hate lindsey clancy i'm not asking you to hate her you shouldn't hate her you should have empathy
00:11:42.940 even if she knowingly did it and is going to prison for murder you should still have empathy
00:11:48.780 for what what good is hate on her but she's saying you're never gonna let me because she won't even 0.99
00:11:55.120 go there because she's convinced that the government wants to put women in jail and would
00:12:00.960 much rather jail them than help them that's mental illness okay here's the next one cut 14 1.00
00:12:10.560 but what does happen every single day is women are failed by the system over and over and over
00:12:17.580 again and i'm not just talking about the medical system i'm talking about the systems that exist
00:12:21.860 and fail women so i'm talking about her family system obviously her family system
00:12:27.740 failed her her husband failed her her in-laws failed her her parents failed her i'm also
00:12:34.680 talking about the medical system it is very stop stop insanity again the medical system failed her
00:12:43.920 her husband failed her her her whole case is no one knew this no one knew this there was no way
00:12:52.880 to spot this that's her case how did her husband fail her see this is where you know when you can't
00:13:01.600 find a villain, you just go look for the nearest person, okay? And that's her husband, Patrick.
00:13:07.880 There's security footage showing exactly where he was. He was the one who came home. He's the
00:13:13.820 one who made the call. He's the one who publicly has forgiven her. This is the man who lost all
00:13:20.720 three of his children and his wife, his whole world in one moment. And then strangers looking
00:13:29.980 for a victim, looking for a villain, decide on the internet that he arranged it. 0.96
00:13:36.860 That's mental illness.
00:13:39.920 But this is what happens to a society when we get uncomfortable with the idea that a
00:13:45.360 person can be responsible for something.
00:13:48.520 Blame doesn't evaporate.
00:13:49.920 It just has to relocate.
00:13:51.820 It goes to the system.
00:13:53.740 When the system won't hold it, it goes to whoever is standing closest.
00:13:59.980 So here's where I land. And I say this as somebody whose own family has walked through mental illness, through suicide, through multiple attempts of suicide, through that long, dark hallway.
00:14:15.520 I have real sympathy. I am not a guy who thinks postpartum psychosis is a story women make up. It's real and it is savage and it is missed constantly.
00:14:28.480 as is most mental illness.
00:14:33.440 But the standard has to stay high anyway.
00:14:36.700 It has to stay high precisely because it is real.
00:14:41.540 Because a defense that can be reached from ordinary depression and exhaustion
00:14:46.120 is a defense that will eventually be used by people who have neither.
00:14:52.640 High standards are how we keep mercy meaningful.
00:14:57.940 Twelve juries have to decide whether the Commonwealth cleared that bar.
00:15:03.180 And I certainly trust them more than I trust the people on the sidewalk.
00:15:08.540 And somebody has to say the last part.

00:15:43.980 But we are just lather, rinse, repeat on victimhood and who to blame.

00:25:40.400 Let me tell you about a slave and his freedom. When a Roman freed a slave, the ceremony was very
00:25:47.500 short. A judge took a stick, a rod, and laid it on the man's head. They shaved his head and they
00:25:55.320 put a cap on him. It was a plain felt cap. It was undyed. It was brimless. It was a cheap hat.
00:26:03.180 It was a working man's hat.
00:26:05.120 You could buy one in every market in any empire.
00:26:08.620 But the meaning was this.
00:26:11.260 This man is free.
00:26:14.840 So what did the cap actually get him?

00:40:12.500 a Mexico U.S. can each veto each other if they want to do a deal with China or other non-market
00:40:18.400 economies. So that has been in the deal for eight years. Last week, Mark Carney says it's an outrage.
00:40:25.500 Trump wants to take away our sovereignty and our right to do free trade with people around the
00:40:29.300 world. Who does he think he is? Well, I don't know. All three countries signed the treaty because
