00:16:41.500 The federal government recently told a Catholic hospital in Oklahoma to either blow out its small candle or stop serving the elderly, disabled, and low-income patients.
00:16:55.640 St. Francis Health System is the 12th largest hospital in the nation.
00:17:02.680 The health system cares for 400,000 patients a year.
00:17:05.960 It has given away more than $650 million in free medical care in the past five years alone.
00:17:13.460 It employs 11,000 Oklahomans.
00:17:17.340 St. Francis' mission is to extend the presence and healing ministry of Christ in addition to providing compassionate and top-notch care to its patients.
00:17:26.420 St. Francis lives out its religious mission by maintaining multiple chapels throughout the hospital.
00:17:32.260 Each has been blessed by the local bishop.
00:17:34.660 So, what is the problem?
00:17:37.640 If you're a Catholic, you will understand this right away.
00:17:41.380 If you are not, let me educate just a little bit.
00:17:44.960 1960, they open their doors, and they have a sanctuary candle.
00:17:49.340 If you walk into any Catholic church, there is always one either hanging from the ceiling or on a pillar somewhere near the altar,
00:17:57.280 and it is in double glass, and it is a giant candle that burns constantly.
00:18:05.460 The candle is never out.
00:18:08.500 This is something that Catholics, it is the ever-present representation of the living Christ, that he is always with us.
00:18:21.140 So, this is a really big deal to Catholics.
00:18:26.120 Well, the government has come in and decided that they have to get rid of that open flame.
00:18:32.740 It's been there since 1960.
00:18:34.360 They've got to get rid of that open flame because it poses a danger.
00:18:40.480 Let me explain.
00:18:42.320 The flame is not near medical equipment and patients.
00:18:46.660 It's shielded by two glass holders.
00:18:48.820 It sits on a brass basin, is affixed to the wall, has a brass top covering it, and sprinkler heads just above it.
00:18:59.700 But the federal government said, we're going to shut you down unless you put the flame out.
00:19:06.460 Well, unfortunately, there is an attorney that didn't like that too much.
00:19:15.140 And she just wrote, Secretary Becerra, and said,
00:19:19.600 In 25 days, you will cripple the operation of one of the premier hospitals in the state of Oklahoma,
00:19:26.240 simply because they keep a candle in the hospital chapel.
00:19:29.840 If you refuse to accredit St. Francis Hospital South,
00:19:33.360 it will result in such unreasonable financial losses to the St. Francis health system
00:19:38.040 that it would abruptly and immediately jeopardize its services to the elderly,
00:19:42.900 disabled, low-income patients that rely on Medicare, Medicaid, Children's Health Insurance Program,
00:19:48.540 yada, yada, yada.
00:19:50.200 If you go to court, you will lose.
00:19:54.180 I write in the hopes that you will see reason, or at least the law,
00:19:59.480 and we can skip to the easy part.
00:20:01.820 But that attorney is with us now.

00:20:24.080 So this isn't about, I mean, the hospital has pilot lights.
00:20:31.100 They have flames that are all over the hospital that if you extinguish this one,
00:20:36.940 you would have to turn off all of the pilot lights, but they're not asking for that.
00:20:41.240 This is clearly an attack on the religion.
00:20:46.360 You know, I have been doing religious liberty work for many years now at Beckett.
00:20:50.540 That's all we do.
00:20:51.760 And this one shocked even me.
00:20:53.340 I'm not easily shocked anymore, but the idea that a federal agency is going to come after your ability
00:21:00.980 to serve the poor, the elderly, and the disabled just over a sanctuary candle
00:21:06.580 when they're willing to make waivers for all these other things.
00:21:10.500 This is not how any of this is supposed to work.
00:21:13.260 So, I mean, I like your confidence that you're going to lose, and you would lose with this Supreme Court.
00:21:25.280 But how open and shut is it locally in circuit courts?
00:21:31.840 How open and shut is this?
00:21:35.880 It is open and shut because we have, first, the Constitution,
00:21:39.600 which our federal agencies ought to be paying attention to.
00:21:42.820 And we also have laws in the books, like the Religious Restoration Act,
00:21:47.700 that make it clear that if the government is going to restrict your religious exercise,
00:21:51.820 it has to have a very good reason.
00:21:54.660 This is a textbook case of not having a good reason.
00:21:58.860 But I want to tell you, this is breaking right now.
00:22:02.100 We just got a letter from CMS saying that they have seen the light.
00:22:06.560 And in fact, they are going to allow the candle to continue to glow and to light the chapel.
00:22:13.420 Now, see, this is even a happier ending than I thought we had.
00:22:18.080 Thank you for breaking that news.
00:22:20.900 So this is over because you guys stood up.
00:22:26.640 That's exactly right, and that's what's so important to know.
00:22:29.900 You know, you get these letters from these federal bureaucrats,
00:22:33.280 and they think that if they just tell the religious people,
00:22:36.160 you know, you don't really have to do this.
00:22:37.860 No, you're going to pay, you know, this unbelievable amount of money
00:22:41.760 if you don't give in, that people are just going to give in.
00:22:45.400 And it shows the power of a single candle.
00:22:48.720 It shows the power of someone who's willing to stand up and say,
00:22:52.400 no, this is my faith, and I'm going to fight for it.

00:22:56.220 I think that, Lori, we have more religious freedom now

00:23:08.480 I mean, people are putting the Ten Commandments back in front of courthouses
00:23:14.220 and in front of, you know, the city or county buildings
00:23:17.040 because you have the right to do it.

00:23:24.000 people don't realize you've won this now.

00:23:59.320 And so I think that right now those who are opposed to religious freedom
