00:00:36.980 very safe, easy rule. Don't make decisions based on skin color. I thought we all agreed on that,
00:00:41.180 but apparently not. The three justices in the minority had a differing view. If you have any

00:02:11.260 Very good. Alan, I've got one question for you at the end that I have to ask you before
00:02:16.200 you go away, because Stu and I were asking when we hung up, and I really want some advice
00:02:23.860 from you on something. But let's start with Hunter Biden. Hunter Biden is testifying on what today?
00:02:31.860 Well, it depends on what they want to ask him. The first question I would ask him is,
00:02:35.880 was President Biden sitting next to you? He wasn't president at the time, but
00:02:39.920 former Vice President Biden sitting next to you when you tweeted to the Chinese businessman
00:02:46.000 saying, my father is sitting next to me, and if you don't pay the money,
00:02:50.220 my father will go after you. Did your father
00:02:53.820 know about that WhatsApp? Was he sitting next to you?
00:02:57.760 Were you lying? That's the first question I would ask him.
00:03:02.280 And if you were his attorney,
00:03:04.140 how would you advise him to answer?
00:03:06.880 Well, I think I would try to take the Fifth Amendment, but he's not going to be able to
00:03:10.400 because his lawyers said that the plea bargain ends the investigation against him. I'm not sure
00:03:16.540 that's true, though, because the judge has to accept the plea bargain. And if this judge does
00:03:22.560 his or her duty, they won't accept the plea bargain. The judge should say, look, Merrick Garland
00:03:30.420 says he gave Weiss, the U.S. attorney, all the authority to investigate the cases against him in the
00:03:37.260 District of Columbia, in Los Angeles, etc. That's what Garland says. Says it under oath and says it
00:03:44.400 on television. Now, Weiss has said, apparently, to six people, no, I didn't have that authority.
00:03:49.920 When I tried to investigate him, the U.S. attorney shut me down. Now, was that just a
00:03:55.580 misunderstanding, or did somebody not tell the truth? Those are the kinds of questions that
00:04:02.560 that have to be asked. Is Biden going to plead? Now, is Weiss going, is Weiss going under oath,
00:04:11.220 too? I would hope so. I would hope that the judge would put the two of them under oath.
00:04:19.320 This could be a massive turning point today. If, if all of these people are put under oath,
00:04:27.200 and they say under oath what they've already said, at least the whistleblowers, this cracks this case
00:04:35.020 wide open. Well, I wouldn't go that far. They have to prove that what the whistleblowers are saying
00:04:40.760 is true. People lie under oath on both sides, on all sides. So, what we have right now is probable
00:04:46.360 cause. We have enough to go forward, enough to investigate, enough to subpoena, enough to,
00:04:52.740 if you need a search warrant, get a search warrant. There's enough for all of that.
00:04:55.700 There's not enough to prosecute, to impeach. That needs to turn what is hearsay testimony
00:05:02.740 into actual testimony. In some cases, there may be documentary proof. In other cases,
00:05:08.460 there may be other kinds of unassailable truths or corroboration. The quality of the evidence matters
00:05:16.020 a great deal. The problem that, you know, the Trump team has is that it has provided the evidence that
00:05:24.380 the other side needs because Trump talks too much. You know, he made that statement to the writer and
00:05:30.920 to the publisher, and that's on tape, etc. The Bidens have been much more careful, not enough,
00:05:37.400 certainly not under Biden, but President Biden has been fairly careful. He hasn't made any of the kinds
00:05:44.060 of statements that Trump has made that have gotten Trump in trouble. You know, the famous plaque that
00:05:49.520 some fishermen have in their houses with the stuffed fish that says, I'd still be swimming if I had kept
00:05:54.480 my mouth shut. And Trump should have put that in his house, because I think he has created most of
00:06:00.080 his own problems.
00:06:02.820 So, but you have Hunter Biden now coming, and does the judge have to go into all of the new evidence,
00:06:14.240 where he doesn't, or is it just he should? He should. And here's the problem. Here's the
00:06:20.080 problem. Neither side wants him to do that. Hunter Biden's thrilled with the plea bargain. No trail
00:06:26.960 time. His lawyers did a phenomenal, phenomenal job. No jail time. Not even a conviction on the issue of
00:06:34.960 the gun license, gun application, just a diversion program. Fantastic deal from their point of view.
00:06:41.680 So they're not going to want to challenge it. And the government agreed, and they're probably not
00:06:46.640 going to challenge it. So what we need is a neutral organization like Judicial Watch, going into court
00:06:53.120 and seeking to file an amicus application, amicus friend of the court brief, saying, look, we represent
00:06:59.920 the people of the United States. We want to know the truth. Neither party here wants the truth to come out.
00:07:05.740 But we do judge, and we want you to hold this hearing. That's what I would do if I were Judicial Watch.
00:07:10.800 And why haven't they done it yet? Do you know?
00:07:14.760 I don't know. I don't know. I don't know. They should. Maybe they have. Maybe they're thinking about it.
00:07:20.580 But somebody should be intervening in that case, and not just to let the plea bargain go by as if there's
00:07:26.620 no public interest here. Judges have the right to deny a plea bargain if the plea bargain is not in the
00:07:33.060 public interest or not in the interest of justice. They rarely do it, but they have the power to do it.
00:07:37.840 Wouldn't this be a case where, unless you were a partisan hack, you would be very tempted to do it
00:07:48.280 because you would see this will just sweep everything under the rug?
00:07:53.960 I agree, but this is a Delaware judge. And Delaware is a small-town community with a lot of home cooking.
00:08:04.860 And it's not the legal system that I put the most faith in. Among all the legal systems, I've been in.
00:08:10.480 I've been in Delaware in the legal system, and it's not. It doesn't have a high standard of justice.
00:08:17.320 So I don't have any complete faith or certainty that this judge will do the right thing. I hope the judge does.
00:08:25.180 Is this going to be televised?

00:08:31.580 Of course, everything should be televised. The trial of Donald Trump in New York should be
00:08:36.680 televised. The trial of Donald Trump in Florida should be televised. The hearing that they had
00:08:41.800 just when he pleaded not guilty should have been televised. You know, when you watched
00:08:46.220 the left-wing media, they described Donald Trump as sitting, slouching, looking defeated.
00:08:53.960 And the conservative media described the same scene, saying he was bold, his chest was out,
00:08:59.400 he looked defiant. We can't even... And the courtroom artist who drew him got criticized for
00:09:06.100 making him look too young and too thin and too handsome. And so if you can't even believe the
00:09:12.280 courtroom artist, everything is so biased and divided in the United States. There's no such
00:09:17.640 thing as truth anymore. There's one side's version and the other side's version, both of which claim
00:09:23.380 to be true. And often neither of them are. So tell me what happens if this judge just decides
00:09:31.200 to take the plea bargain. Is it all over? That's really the end of the case, yeah. I don't think
00:09:36.940 anybody has a standing to appeal it. So that would be the end of the matter. And then the question comes
00:09:42.640 up, what if they come up with new material outside of Delaware? Does the plea bargain cover
00:09:48.500 any alleged crimes that took place outside of Delaware? His lawyers have said no. But the law
00:09:55.140 generally says, yes, you can investigate. Jeffrey Epstein had that. Remember, he made a plea bargain.
00:10:01.160 I was part of it in Florida. And we thought the plea bargain ended the whole case. And then,
00:10:07.320 of course, they arrested him in Teterboro Airport and the rest we know. So the law is very uncertain.
00:10:14.480 And it sometimes depends on the exact words of the plea bargain.
00:10:18.940 So if you're making a plea, if I'm, you know, the president's people and Hunter's people,
00:10:26.360 I'm pushing this plea bargain and I'm trying to find a judge that will hear it that is most
00:10:33.040 likely just to close it. So what are you expecting today?
00:10:37.620 Well, I don't think we get that today. I think we get that in a few weeks. Today,
00:10:43.460 I think we hear questions and I don't know the exact scope of what the questions can be. But,
00:10:51.620 you know, Congress has plenary authority, just unlimited authority as part of our system as
00:10:57.920 checks and balances to question anybody about anything involving the judiciary or the executive
00:11:04.960 branch. And so if you have congressional hearings in front of the Judiciary Committee controlled by
00:11:10.180 the Republicans today, they can ask him all these questions and he can't refuse to submit to a
00:11:15.560 subpoena. He can try to plead the fifth, but then they can give him immunity. Even if he pleads the
00:11:20.300 fifth, they can give him what's called use immunity. You got to testify. And what you tell us can't be
00:11:25.280 used against you, but it can be used against other people. And then ask him questions about his father,
00:11:30.300 about family members, and try to see whether there's any truth to these very, very serious claims of
00:11:37.100 enrichment. But we have to find out whether it's true. So, but that's not double jeopardy?
00:11:44.120 No, it's not double jeopardy. And it depends on the nature of the plea bargain. Look, in my book,
00:11:52.140 which you talked about before, Get Trump, I go through how extensive this basic conspiracy has been
00:12:01.180 to try to do everything possible to determine the outcome of the next election by preventing Donald
00:12:08.040 Trump from running for re-election. And in my book, Get Trump, I go through every one of the charges
00:12:13.860 against him in New York and Florida and Georgia and in Washington, D.C. And I also talk about the
00:12:22.940 cases against the Bidens. And the question that's raised in my book, Get Trump, is there a single
00:12:29.640 standard of justice? Or is there a special standard that seems to operate against Donald
00:12:35.780 Trump and perhaps in favor of the Biden family? That's the hard question that every American should
00:12:40.840 be asking.
00:12:44.260 We should know the questions today. Anything in particular we should look for to be able to
00:12:51.660 see which way the judge might be leaning?
00:12:54.140 I don't like to ever read tea leaves. Let's find out. Let's see.
00:13:00.040 Okay.
00:13:00.200 And we'll know the answer. But I've been doing this too long to try to predict what judges will do.
00:13:06.000 Okay. So, Alan, the one thing that I was talking to my producer when you were on last, I said,
00:13:13.620 if I were ever in trouble, the first guy I would call is Alan Dershowitz.
00:13:19.500 God forbid. Don't get in trouble. I don't like to get in trouble.
00:13:22.620 I know, God forbid.
00:13:23.620 From friends, yeah.
00:13:24.520 I know, God forbid. But we're entering a time where people like me could be charged with anything
00:13:30.480 because we're, you know, we're just entering those times.
00:13:36.140 I've already been charged. There's an organization called the 65 Project, which announced that it was
00:13:42.700 going to seek bar discipline against any lawyer who had anything to do with Donald Trump.
00:13:47.740 And so I announced in an op-ed, if they do that, I will defend free any lawyer who is
00:13:53.840 attacked by Project 65 simply for defending Trump. So what do you think they did? They
00:13:58.740 filed a bar charge against me because I defended Donald Trump as well. And so now I have to spend
00:14:05.400 money and time trying to respond to an absurd bar charge, but I have to spend the time and energy.
00:14:14.180 And that's their goal. Their goal is to deter people from defending people, people who they don't like.
00:14:24.140 So what I wanted to know, Alan, is, you know, hopefully this is a long, long, long, long, long time
00:14:29.040 from now that if I ran into trouble, who is it that you trust? Who is it that you say
00:14:34.800 this person is actually honorable and will be John Adams?
00:14:42.420 Well, that's the hard question today. There are fewer and fewer people who are John Adams,
00:14:48.440 who are willing to incur the wrath of the community around them the way I've incurred the wrath of
00:14:53.200 Martha's Vineyard community and other communities that I was part of, the liberal Democrat community
00:14:58.760 who won't talk to me anymore or allow me to speak. That's hard. There are still a few left. And,
00:15:05.560 you know, I could give you a list of names, but I don't want to leave people off the list. But I
00:15:11.540 would say there are a handful of lawyers today that you can really trust to do justice without regard
00:15:18.240 to partisan consideration. And that's too few.

00:15:45.120 So you announced yesterday that you had found an email and it had Joe Biden's phone number on it.
00:15:52.480 Tell me, in what context was this email?
00:15:55.580 Yeah. So it was something that before the laptop became public, even before the FBI had the laptop,
00:16:02.040 there had been some earlier records seized during the investigation of Devin Archer. These are,
00:16:06.760 Devin Archer was Hunter Biden's business partner and he was convicted of fleecing a tribe. He may
00:16:11.620 become a very important witness soon to Congressman James Comer's investigation, the House Oversight
00:16:16.760 Committee investigation of the Bidens. And so there are these records that show phone numbers that
00:16:23.120 were associated with Hunter Biden that were gathered during the search warrants and subpoenas and things,
00:16:28.180 and they end up in the court records. And so as I was starting my reporting right after I wrote the
00:16:32.740 famous story about Joe Biden threatening the Ukraine president, saying, if you don't fire the prosecutor,
00:16:38.800 who, by the way, was investigating his son, I'm going to take your billion dollars and aid away.
00:16:42.720 So about a month into that, and I'm trying to get fair comment from Hunter Biden. I really care about
00:16:47.540 his side of the story too, right? I don't want a one-sided story. And so he hasn't, through his
00:16:51.680 lawyers, engaged me in any constructive way. And so I'm going through these records and I see this
00:16:55.840 phone number that's associated with Hunter Biden that's a different number than the one I have.
00:16:59.900 It appeared to be a bill, a credit card that he was paying through his, you know, his businesses.
00:17:06.720 And so I called the phone number. This is probably in the, I can't remember, it's May, June, sometime in
00:17:11.700 the spring of 2019 when I was at the Hill. And I was hoping Hunter Biden would pick up. They got
00:17:17.040 answered. I got excited. Then I heard the voice. I'm like, wait a second, that's not Hunter Biden's
00:17:20.240 voice. That's Joe Biden. And then I said, Mr. Vice President. And he said, I can't talk right now.
00:17:25.740 And he hung up the phone on me. And that's really all it was. Is it a gigantic moment? No. Later,
00:17:31.860 we found out through the laptop when we did get it, we authenticated the laptop that there was a
00:17:37.540 cell phone that Hunter Biden paid for that, you know, is described as a Joe Biden cell phone.
00:17:41.860 I think that's the one that probably Peter Schweitzer and others talk about. Is it a major
00:17:45.480 scandal? No. Does it show that the finances and the lifestyles of Hunter Biden and Joe Biden are
00:17:50.960 intertwined? Absolutely. And it's something that the president keeps trying to deny that is, you know,
00:17:56.620 obviously true. Joe Biden owed his son money. How do we know that? There's an email from
00:18:01.680 Eric Schwerin that says, your dad owes you so much money, he wants to sign over his Delaware tax
00:18:07.360 refund to you. That occurred in 2010 when Joe Biden was the vice president. He owed his son money. That
00:18:13.280 means his son and his businesses were underwriting the vice president. We know of bills that were
00:18:17.840 identified in email. So the phone call and him picking up just accentuates the story that we now
00:18:23.040 have been able to corroborate that the finances, the business interests of Hunter Biden and Joe Biden did
00:18:28.200 intersect. They are sometimes commingled. And no matter how many times Joe Biden denies it, it isn't
00:18:32.960 true. So what does that mean? Is it illegal for a son of the president to pay for the phone and the
00:18:44.480 housing and some of the house bills if you're president United States? It's a great question,
00:18:50.580 right? Obviously, I'm sure every family has people who help other family members from time to time.
00:18:56.520 It isn't always considered income. At the time I called Joe Biden, he wasn't vice president or
00:19:01.500 president. He was in his diaspora period, the first time he'd been out of political office.
00:19:05.680 So even if given that he was in office, it wouldn't really matter that much that he had a phone that
00:19:09.600 his son paid for. Where it becomes so concerning and where James Comer and where the bank records are
00:19:15.600 all leading is there is a question of whether Joe Biden was doing favorable things as vice president
00:19:21.380 because he had so much sway over the Obama foreign policy that it was helping his son's clients.
00:19:26.660 And therefore, if he was helping his son's clients and then his son took some of that revenue
00:19:30.260 to pay the bills of Joe Biden, the idea that a Russia or Ukraine or a China was underwriting Joe
00:19:38.700 Biden's lifestyle becomes real, becomes compromising. And I think that that's the question that among many
00:19:45.000 that James Comer has to answer for the American people, Joe Biden has not given us many honest
00:19:49.880 answers about his relationship with Hunter Biden and his business associates. Nearly every
00:19:55.680 statement he's made to us has been debunked over the years, including the famous laptop and so many
00:20:01.000 others. So I hope that we can get these answers for the American people before the next election.
00:20:06.460 And I think James Comer is determined based on what I've seen from his work to do that. And I think
00:20:11.100 one of the big people that we were going to if we hear from Devin Archer, the longtime business
00:20:16.340 partner of Hunter Biden, there are negotiations. Yeah, he's about to go to jail. He hasn't gone yet.
00:20:22.820 He's been sentenced to jail. He hasn't gone yet. But if if he can cooperate along with the FBI informant
00:20:29.160 and all the other things that we're getting, we're going to get answers. We're going to get the truth
00:20:32.820 and get to the bottom of this. And I think we're at that moment. My understanding is that Devin Archer
00:20:36.980 could testify or be interviewed as early as next month. Wow. So the information that you had,
00:20:45.420 did the did the Hill kill the story? Did you not try to write the story? What happened?
00:20:51.660 Yeah, listen, for my at the time, at the time, it was just an effort by me to be a good journalist
00:20:57.020 and try to get fair comment from the Biden's. I cared about their side of the story, just like I care
00:21:00.660 about everyone's. It never it didn't become more important until later when we realized that there
00:21:06.640 are these cell phone bills in the laptop where they're being identified as Hunter Biden's paying
00:21:12.740 a cell phone bill for his dad. And therefore, you start this question of, well, we're foreigners
00:21:17.180 through Hunter Biden subsidizing Joe Biden's lifestyle. We don't have a complete answer.
00:21:21.480 We certainly have some good indications of that that may have been going on. So it's more relevant
00:21:26.960 now. At the time, it was just an effort to get fair comment. And Joe Biden picked up the phone. And
00:21:31.200 at that time, Hunter Biden was living with his father. We knew that because I had staked out the home.
00:21:35.580 So I knew Hunter Biden was living in the cottage. That's the very cottage that the IRS wanted to
00:21:40.280 raid. They met probable cause for a search warrant. And the U.S. Justice Department under Joe Biden
00:21:44.860 turned them down. I'm sorry, under Donald Trump turned them down in 2020. But the at the time,
00:21:51.380 it just was an effort of fair comment. It has a little more meaning today. But there are far more
00:21:56.160 serious things that we should be worried about in the public domain right now about Joe Biden,
00:22:00.320 starting with Joe Biden still says, I didn't meet with any Hunter Biden's business partners,
00:22:04.740 despite all we know. But one of Joe Biden's best friends, one of the family's closest associates,
00:22:10.860 a guy named Rob Walker, he told the FBI and an FBI 302 is a story I just wrote a few days ago.
00:22:17.020 Yes, Joe Biden did meet with the Chinese. No matter what he said, he met with him. I attended the
00:22:21.820 meeting. He was there. He sat with Hunter Biden and in these Chinese business people in 2017 at a time
00:22:28.240 when the Biden family was squeezing these Chinese businessmen to pay them money. So at some point,
00:22:34.300 Joe Biden is going to run out of people accusing of lying. And the people that are now affirming this
00:22:38.440 are business associates and family friends. Joe Biden just hasn't been able to give us the truth.
00:22:43.820 He had problems back when he ran for president decades ago, plagiarizing and doing things.
00:22:48.400 And today, he isn't telling us the truth about what the evidence shows
00:22:52.140 about his relationship with his son's business partners.
00:22:55.880 So, John, most people, they'll say they don't care. And I think what they mean when they say that
00:23:02.660 is, I'm not listening to it. I'm not paying attention because nothing's going to be done.
00:23:07.280 So why should I worry about any of this or learn about any of this? Do you see the tides changing on
00:23:13.800 this? I do.
00:23:15.800 As far as consequences?
00:23:16.720 Yeah. Let's start with something I just see personally to myself. When I wrote the original
00:23:22.320 Hunter Biden stories in 2019, shortly after, you know, we really started to get traction on these
00:23:27.060 stories, I was suddenly derided as a conspiracy theorist. I had a 30-year history of almost every
00:23:32.460 major journalism or you could think of. Certainly a lot of them worked for all the mainstream media,
00:23:37.020 Washington Post, AP, had a sterling record. And suddenly I was a conspiracy theorist and nobody knew
00:23:44.200 where I got my information from. The truth of the matter is the Justice Department knows where I
00:23:47.880 got my information from because they have my notes now. And they learned that I got it from
00:23:52.020 the FBI. They know that now. I wish my profession would go look at that because they'd realize I was
00:23:56.700 really solid back in 19. But now all those members of the media are coming to me. Mainstream news
00:24:02.220 organizations day in and day out are coming to me and saying, hey, we didn't get this right. Can you
00:24:06.720 help us get on the track? I think that's a good sign. And I've been willing to do that if I sense that
00:24:10.960 they're honest in their pursuit. I worked with CBS News on the IRS whistleblower story. We kind of
00:24:15.960 broke that together. It was kind of a quiet partnership. But we're doing those sort of
00:24:20.140 things. I think the fact that the mainstream media is starting to treat this seriously is a good sign
00:24:27.640 that maybe people in general realize there was something more serious here that we got bamboozled
00:24:32.560 into not believing, the 51 intelligence analysts and others. So if people are willing to learn the facts,
00:24:39.280 then they can make a more informed decision. Do I think we're going to have a prosecution of Joe
00:24:43.300 Biden? No, no one thinks that, right? But we went into 2020 thinking that all these things about, well,
00:24:48.880 not we, but many people went into 2020 because Joe Biden told them, saying there's nothing here,
00:24:53.020 there. This is a Republican conspiracy theory. And we now learn we were lied to. We can make a more
00:24:58.900 informed decision for every American voter. The judge and jury for the accountability for Joe Biden,
00:25:04.500 I think will be the American people on how they vote in 2024.
00:25:09.080 Okay. So John, last question. What do you expect today from the testimony of, uh, of Hunter Biden?
