00:03:40.200 How would the founders have looked at the situation in Iran?
00:03:48.060 Well, they would not have looked kindly upon it.
00:03:51.020 You know, the framers divided the power over war between Congress and the president.
00:03:59.480 And so under Article 2, Section 2, the president has declared the commander-in-chief.
00:04:05.940 But under Article 1, Section 8, Congress alone may declare war.
00:04:11.640 So the framers wanted to make it difficult to go to war.
00:04:15.840 They didn't like foreign entanglements.
00:04:17.620 And they divided the power accordingly.
00:04:21.080 The problem is that we haven't had a declared war since World War II.
00:04:26.820 And the Congress has largely evaded its responsibility by passing resolutions, the authorization of the use of force.
00:04:36.080 And the courts have largely deferred to the political branches.
00:04:41.360 So in looking at this issue, you know, part of the question is, is the president acting according to established authority?
00:04:50.280 The answer is, yeah.
00:04:52.420 I mean, in the sense of the interpretation, the modern interpretation of the Constitution, not quite if you look at the original intent.
00:05:00.980 But there's no question that he is using the authority used by past Democratic presidents, including President Barack Obama.
00:05:12.820 I mean, I've actually been somewhat amazed by the comments of people like Nancy Pelosi, Senator Blumenthal.
00:05:23.120 I represented members of Congress opposing the Libyan war, unilaterally launched by Barack Obama.
00:05:31.180 There was no claim of a threat against the United States, imminent or otherwise.
00:05:36.180 It was a regime change attack on the capital city, on the Libyan military.
00:05:42.200 We lost that case.
00:05:44.040 But at the time, Pelosi said no authorization is required for President Obama.
00:05:49.260 And Blumenthal actually praised the unilateral attack.
00:05:53.680 Both of them have come out this week expressing horror at the thought that a president can commit this type of attack.
00:06:02.180 So here's what I want to ask you.
00:06:05.460 You know, it's my understanding.
00:06:06.720 I know I'm oversimplifying this, but it is my understanding under current the current reading of war powers.
00:06:13.020 The president has to file the paperwork and say to Congress, I've notified you early.
00:06:19.400 I'm filing this paperwork.
00:06:21.160 We are engaged now in hostilities.
00:06:24.620 And he has 60 days, right?
00:06:27.260 But he can then say at the end of 60 days, I need another 30.
00:06:32.120 So he can actually go 90 days before they actually have to do anything.
00:06:35.940 But the problem has been not a single president has ever filed the paperwork, and Congress doesn't insist on the filing of the paperwork.
00:06:43.760 So the clock never starts, correct?
00:06:48.100 Well, that is a part of the problem.
00:06:50.180 The War Powers Act has always been contested by both Democratic and Republican presidents.
00:06:55.020 Some of the restrictions on a president in carrying out these types of initial combat operations has run against the grain of Article 2.
00:07:07.540 And presidents have said, you cannot require us to go through these steps.
00:07:11.120 You have the right to declare war.
00:07:13.060 But presidents have always asserted the right to respond to what they consider to be threats to the national security.
00:07:21.460 And courts have largely deferred to presidents in that sense and deferred to Congress in taking steps.
00:07:29.680 But taking the War Powers Act at its face, 60 days is ample, very likely, for this operation.
00:07:39.080 And that's the reason why today you have Senator Kaine and others putting forward a War Powers resolution to cut that period down
00:07:49.740 and to say, we hereby order you to stop all combat operations in Iran.
00:07:56.960 The problem with that is it's a tough-sounding resolution until you get to the final line.
00:08:04.420 And the final line says nothing in this section restricts you in dealing with imminent attacks.
00:08:12.040 Well, every attack now is imminent.
00:08:14.800 Every attack we launch is preemptive.
00:08:17.300 I mean, the Iranian government is firing missiles randomly at other countries.
00:08:23.220 So the question is, what does this resolution even do?
00:08:26.760 And can't the president veto this anyway?
00:08:30.340 I mean, he could pass both the House and the Senate and then get to his desk and he can veto it, can't he?
00:08:35.240 Right.
00:08:35.700 And the other thing is that it just – I don't even think it will pass.
00:08:39.340 I think the interesting dynamic here on the Hill is to see how many of these members are willing in the middle of combat operations to say, even symbolically, even though it's sort of a paper tiger, you better stop now.
00:08:56.260 But the other combination with that, the sort of companion to that, is that there's also a vote this week scheduled to fund Homeland Security and TSA.
00:09:07.520 So it'll be very interesting how many of these Democrats – we've already had some of them come forward, like Murphy and Durbin and others, saying, no, we're not going to fund Homeland Security, the Coast Guard, TSA until you give us compromises on ICE.
00:09:26.460 Because that is going to be breathtaking if the Democrats maintain that position in the middle of this conflict.
00:09:36.280 So – it's so weird because I am – you know, I don't like the Patriot Act.
00:09:42.520 I don't like any of this stuff.
00:09:44.940 However, two things.
00:09:46.440 The War Powers Act.
00:09:47.540 If you want to actually say and make a statement, the president must act with Congress and it has to be declared every time, the time to do that was two months ago or in two months, hopefully, if this thing is over.
00:10:02.540 You do it when you're not at war.
00:10:04.440 It's completely irresponsible to do it right now.
00:10:09.440 Just the messages it sends to our enemies, the idea that you're just going to turn this thing off is insane.
00:10:19.180 The same thing with Department of Homeland Security.
00:10:21.920 You can't just do that at the most critical time of Homeland Security because that's how we're – our security is geared now.
00:10:30.200 You want to dismantle it.
00:10:31.320 I'm all for it.

00:10:36.160 That's a fascinating thing.
00:10:37.260 Well, I think that's a fascinating thing, Glenn.
00:10:38.960 And you're a student of history and you know this as well as I do, that from the very beginning, from Thomas Jefferson, presidents have been able to box in Congress on this power because they have the inherent power to dedicate U.S. armed forces.
00:10:54.000 So presidents have the right to initiate a fight.
00:10:57.400 They simply do.
00:10:58.700 If they judge someone threatening the country, they don't have to wait for anyone.
00:11:02.880 But once that fight has started, it's very difficult for Congress to throw a flag on the plate and say, okay, walk away when you're literally in the grips of an opponent.
00:11:14.640 And so what these – what Cain is suggesting in this resolution is that as hundreds of ballistic missiles are flying, as attacks are occurring around the world, the U.S. military is supposed to disengage.
00:11:29.720 And basically, it's a choice between fight or flight, and it says, choose flight.

00:16:08.260 Everybody was arguing about whether we should go into Iran or not and what this means for Iran, blah, blah, blah, blah, blah.
00:16:13.780 And I said, the Iranian part of it is very important.
00:16:17.580 But if you don't understand crink, China, Russia, Iran, North Korea, that axis power is called crink.
00:16:27.860 If you don't understand that and what this is going to do to crink and that axis power, you don't understand the big vision of what Donald Trump is doing.

00:16:40.380 Over the span of two months, Trump administration has removed the leaders of two countries that both shared China as one of their most important crude oil customers.
00:16:48.780 Although China buys oil from all nations across the Middle East, Iran was second only to Saudi Arabia as its supplier last year.
00:16:58.720 Almost all of Iran's exported oil and more than half of Venezuela's went to China last year,
00:17:06.380 which remained one of the only purchasers of goods from the too heavily sanctioned nation.
00:17:11.180 The two countries combined represent, listen to this, 17% of China's overall oil purchases, a meaningful share for the world's largest importer of crude oil.

00:17:31.080 Between Venezuela, which I told you when we went into Venezuela, this is all about Russia and China.

00:20:12.020 Because Iran is saying we're going to shut down the Straits of Hormuz.

00:20:18.940 If you're China, you cannot afford that because you just lost 17% of your oil.
00:20:24.840 If you shut down the Straits of Hormuz, you lose all the oil from Saudi Arabia and the UAE and Oman.

00:20:32.640 And they cannot afford to have that happen.
00:20:37.620 That's why China is not going to get involved as we take out the Iranian Navy because we want it to be open as well.
00:20:48.120 So China, strangely, China is on the same side of the United States when it comes to Russia.
00:20:55.500 I'm sorry, when it comes to Iran, closing down the Straits of Hormuz.
00:20:59.780 This is a remarkable, remarkable thing.
00:21:04.740 Brent crude oil began trading opening on Sunday, $81 a barrel.
00:21:10.860 That's a 12% jump from last week's closing price.
00:21:16.980 OPEC says they're going to boost oil production starting in April by 206,000 barrels a day.
00:21:23.520 I wrote down, yeah, so you know, they're going to increase 2,006 barrels a day.
00:21:31.160 Five billion barrels, five billion barrels a day are coming from Iraq, UAE, Oman, and Saudi Arabia to China through the Straits of Hormuz.

00:21:52.200 So when they say we're going to increase by 206,000 barrels a day, that's nothing.
00:22:00.760 That is absolutely nothing.

00:22:40.480 And it hasn't stopped all traffic coming out of the Straits of Hormuz.
00:22:43.260 But this has always been Iran's big ace in the hole.
00:22:46.700 And you can see what they're doing specifically with China, as you're pointing out.
00:22:50.600 Because the strategy is to shut the Straits down.
00:22:54.380 And whatever conflict is happening, that will get enough international support to say,

00:27:52.740 Not a professional singer to somebody who has done some professional singing, all the whole range and Roger, you are going to be able to, I mean, you're going to, you're going to change somebody's life when they're finished with you and they're singing there.

00:29:50.360 I don't know, but they all say the minute I heard this song, it connected with me so deeply that it's just, it's part of me.

00:30:26.240 I think we're getting more people who speak French because people don't always like to compete and, and, and they're, they have special skill sets.

00:30:39.700 But we're, yes, looking for someone that speaks French, but not just that we're really looking for someone who has a passion to sing and wants to showcase it.
00:30:48.700 It's really weird because the ones that I think the songs that I thought would be the easiest are the, is the song that is more contemporary.
00:30:58.460 You know, they came for the hope and it's very contemporary, almost a, almost a, in some ways, almost a Phineas kind of sound.
00:31:06.560 Um, and, uh, and it's weird because that's the one, especially with men, we're not getting as many submissions and you can hear all of the songs, um, and, and then record them.
