00:00:12.700 Scotiabank. You're richer than you think.

00:00:15.020 Well, the unions are going nuts over President Trump's executive order to cut the DOE funding.

00:00:21.980 But why are our children so far behind in reading and math to the point that Harvard

00:00:27.400 is having to add remedial math? That system doesn't work. What are they really fighting for?

00:00:35.480 Also, we have Dave Yost on. He's talking about new technology. He's the Attorney General in

00:00:40.940 Ohio. He's talking about this new technology that works really, really well to catch killers.

00:00:49.560 Unfortunately, it's going to the Supreme Court. I'm not sure where I stand on this technology

00:00:55.320 because we need to have clear plans and fences around it. Also, swatting.

00:01:02.860 It is happening everywhere. And now they're doxing Tesla owners and saying, here's their address.

00:01:11.120 Could this happen to you? What is it? And how do you prepare and build protection so it doesn't

00:01:16.720 happen to you? My sheriff from Tarrant County, Bill Wayborn, is coming in and he's a straight

00:01:22.880 talking guy. You'll understand it and what to do. Coming up.

00:01:26.260 There is a certain quality of self-reliance in the American soul. I know. Sometimes it seems like

00:01:31.460 we've forgotten it. And maybe that's one of the biggest parts of what's wrong with today's

00:01:36.680 society. We're weak. We expect everything to be done for us, handed to us. I can't do that.

00:01:42.620 I'm a third responder. No, you're the first responder. Underneath all of the layers of fat,

00:01:49.840 there is one thing. A strong heart that beats in all of us. The resilient old America that we've

00:01:58.800 always known and what made us who we are. You and I are part of it. It's why we feel pride when we can

00:02:04.860 solve our problems ourselves. We take care of our own. The Jace case is all about empowering you to

00:02:10.860 solve a problem on your own, whether there's a doctor or a pharmacy available nearby or not,

00:02:16.300 whether it's in the middle of the night or it's in the middle of the day. It's a pack of five

00:02:22.740 life-saving antibiotics approved by board-certified doctors. It includes a manual describing when and

00:02:29.520 how you are to use them. But because you're the first responder here, you'll have all of the tools

00:02:34.920 when your son or daughter in the middle of the night has a high fever. You can wait until the

00:02:40.960 morning because you'll have the Jace case. Use B-E-C-K as your promo code. Use Beck. Go to

00:02:51.920 You're listening to the best of the Glenn Beck program. Well, hello, Stu. How are you?

00:03:05.200 I'm wonderful, Glenn. You said it's Friday. It is Friday. It's good news. It is. I don't know how

00:03:12.120 people just do it, you know, because I hear some people work more than 15 hours a week.

00:03:17.700 Not at difficult jobs like ours. Right. Right. Yeah. Okay. Thank you for putting it into

00:03:23.300 perspective. Let's make sure we're known as the heroes here.

00:03:28.840 No, come on. We do work longer than 15 hours a week, sometimes 17. Anyway, here's the thing that

00:03:35.340 I want to talk about. I want to talk about the DOE, the Department of Education, and what happened

00:03:42.260 yesterday, and, you know, how good it is. By the way, Karen Bass, she announced yesterday that they

00:03:51.340 have a budget deficit that predated the Palisades fire, and it's all in education. Now, this is Los

00:04:00.340 Angeles. Los Angeles, they had just a short $1 billion shortfall for the education budget in Los

00:04:11.320 Angeles. $1 billion. And they're not the only city that is going through this massive shortfall

00:04:20.660 for education in Colorado. Now, what jumps to mind to me are, aren't those both sanctuary cities

00:04:26.700 where they're just piling in new citizens that just need to be protected and screwing everybody

00:04:34.080 else? So, yesterday, Donald Trump, thank you, thank you, President Trump, signed an executive order

00:04:40.920 to pretty much start to dismantle the Department of Education, and everybody is going mad. They're

00:04:48.420 going crazy. They're just going to leave poor children behind. Behind? How far behind? How can

00:04:54.360 they fall farther behind? How could they fall farther behind? They can't read. Well, I shouldn't,

00:05:01.500 I shouldn't say that. Some graduates of high school and college can read at a third grade level,

00:05:06.420 so I don't mean to besmirch the educational system in our country. How could you possibly

00:05:13.760 leave them further behind? You can't. Since the Department of Education got involved, we have

00:05:21.200 degraded our educational system year after year after year. It has gotten worse and worse and worse.

00:05:28.580 And look, do you hear me complain about the Department of Defense? Okay, yeah. Don't answer

00:05:37.420 that. Yes, you do. Constantly, yeah. Okay, all right. You don't need to rub it in. Here, let me rephrase

00:05:42.180 that. Here's what I say about the Department of Defense. There is waste like crazy in the Department

00:05:50.920 of Defense. There is also, I am sure, dirty things going on with these, you know, in the industrial

00:05:59.280 complex, the defense industrial complex. I know there's deals being made. There's things that are

00:06:05.100 so far over budget that don't even work. We all know that. But you have not heard me say,

00:06:11.840 we just got to shut this thing down. Now, why? Because I love war? No, because it's, I think the

00:06:20.660 only thing our federal government does that we're still number one at. Okay, I look at the Department

00:06:29.280 of Defense and go, well, A, I don't want this in private hands, okay, because I don't want private

00:06:38.100 armies. I think that's a really bad idea. So that's one reason. Two, when you look at the Department of

00:06:45.940 Defense, we are the best in the world. Yes, we are spending way too much money, but at least we're the

00:06:53.260 best in the world. Look at our Department of Education. We're one of the worst in the world,

00:07:00.140 and yet we're spending like we're the best in the world. So show me the evidence that this is doing

00:07:06.840 anything but crippling our children. And, you know, and they say, well, you know, it's all local

00:07:12.140 control. It is all local control. And I guess you're right. I mean, you know, COVID, those were all

00:07:17.560 local decisions pushed by the teachers unions and the Department of Education. And what did the

00:07:23.780 Department of Education, you make your own decisions. Of course, you're not going to get

00:07:26.640 any money if you do that. So that's, that's not letting the states and the local communities decide.

00:07:34.960 That is saying, oh, you do whatever you, whatever you want, whatever you want.

00:07:39.440 Yeah, it's, it's, I love their, their combination argument here. We're just like, oh, well, the local

00:07:45.700 in states are doing all the decision making here, but Donald Trump is gutting education.

00:07:51.800 Yeah. Well, wait a minute. That's going to shut everything down. How is he gutting education? If

00:07:56.320 you guys are the ones doing everything? I don't understand. How does he have any power to do that?

00:08:01.920 Of course, he does have tons of power to do that because the Department of Education does have

00:08:06.020 massive influence on these decisions and these structures. Massive influence. You know, I read

00:08:14.640 to you the, one of the founding documents, section 103, Stu, of course, you know, section 103. It's my

00:08:19.600 favorite section, yeah. Of the federal state relationship with the Department of Education,

00:08:25.400 section 103, as outlined in the Department of Education Organization Act that was passed by Congress.

00:08:32.600 Yeah, I know. Why are you? Okay, I'm just, I just, I'm sorry. It was just, you're just,

00:08:37.860 you're saying that for other people. I was talking down to people who don't spend a full 12 hours a

00:08:43.240 week, you know, worrying about this stuff. So in that, it says the intention of the Congress in the

00:08:51.080 establishment of the department, now this is the law that established the Department of Education.

00:08:56.900 The intention of the Congress in establishment of the Department of Education is to protect the rights

00:09:02.300 of state and local governments and public and private educational institutions in the areas of

00:09:09.880 educational policies and administration of programs and to strengthen and improve the control of such

00:09:16.440 governments and institutions over their own educational programs and policies. That's just the

00:09:22.760 first half. Does that, is that what our Department of Education is doing? Because that's the stated

00:09:28.680 intent of Congress. If they were doing that, I don't think I'd have a problem with it. I mean,

00:09:35.280 I still wouldn't want the feds involved in it, but if you were saying, no, no, no, no, hands off,

00:09:41.240 this is a local decision. Stay away. They'll make the decision. I wouldn't have a problem with it,

00:09:46.260 but that's not what they're doing. No. Okay. The second part of it is,

00:09:49.820 the establishment of the Department of Education shall not, do you remember we getting lectured

00:09:54.660 between shall not and may not? May not. Shall not is legal for never, ever, ever, ever. Okay.

00:10:06.360 The establishment of the Department of Education shall not increase the authority of the federal

00:10:11.620 government over education or diminish the responsibility for education, which is reserved

00:10:18.300 to the states and the local school systems and to other instrumentalities of the states.

00:10:26.460 That's not what our Department of Education does. They are so far off their original charter

00:10:31.660 as passed by Congress. I am not an attorney. I would suggest that we take it to court and just

00:10:39.700 shut the whole damn thing down. Take it to the Supreme Court. They're not doing that. 0.99

00:10:42.960 They're not doing any of that. They're not doing that. And by the way, every liberal,

00:10:47.120 I mean, ask Elizabeth Warren, if you just passed a bill right now and said, you know what? 0.96

00:10:51.240 We're going to reform the Department of Education instead. We're going to have it do these things.

00:10:55.640 They'd all be for it.

00:10:56.120 And you'd give that description?

00:10:58.200 No, they wouldn't do it.

00:10:59.100 None of them would vote for it.

00:11:00.400 But if you said, okay, we're not going to abolish, we're going to just reform.

00:11:03.660 We're still going to spend all the money. They would be all for it because they would see it as an

00:11:07.520 opportunity to dig their claws in even deeper on the local and state level.

00:11:13.960 That's why they're freaking out. Did you, by the way, see the rally that was held in Tempe,

00:11:22.200 Arizona yesterday with Bernie Sanders and AOC? 11,000 people show up for those two?

00:11:30.300 I did hear they were on tour. Is this...

00:11:33.680 Yeah, the fight oligarchy tour.

00:11:39.940 11,000 people took time out of their day to go see Bernie Sanders and AOC.

00:11:46.800 Now, that says something to you.

00:11:48.740 That means every communist in Arizona was in one place last night.

00:11:55.380 Okay, that's what that means.

00:11:57.220 Or this is all astroturf.

00:12:01.720 This is what they always do.

00:12:04.740 This is what they always do.

00:12:05.640 They take the money that they raised for their last election.

00:12:09.380 I don't know because of Doge, but it would have been every organization that was being paid

00:12:14.740 by the government for NGO stuff.

00:12:19.000 That money would have been funneled into this tour, etc., etc.

00:12:22.100 They have no problem with tours, and they have no problem organizing things.

00:12:26.360 The union was involved. UAW was involved in this.

00:12:28.940 Now, there's nothing yet that will show us that this was an astroturf thing.

00:12:37.800 But when was the last time you saw 11,000...

00:12:42.660 Not in an election year.

00:12:44.340 Not even in an off election year.

00:12:47.900 But in a year where there is no election.

00:12:51.600 11,500 people in one town decided to get together and listen to the...

00:12:57.540 Well, the father time and a bartender.

00:13:00.660 That's interesting.

00:13:03.640 It's an interesting point.

00:13:04.640 I can't think of any examples, so I don't have a great piece of evidence to push back

00:13:09.040 on you.

00:13:09.320 But I do feel like this is the place where the energy is on the left, right?

00:13:17.580 It is the far left is, I think, energized.

00:13:22.200 This is who the left, you know...

00:13:24.940 Right, that's why I said every communist in the area was in that.

00:13:29.620 I think it's bigger than just, you know, we would joke about 11,000 communists.

00:13:33.980 I think this is really who they are.

00:13:36.460 I mean, remember, they're winning 47%, 48% of the vote.

00:13:40.260 And I think a good chunk of that vote really adores this approach from AOC.

00:13:46.720 They want socialism.

00:13:48.000 They're burning, yeah, and burning Teslas in the streets and all of that.

00:13:51.900 That's the worst news I've heard.

00:13:55.900 That's the worst news I've heard.

00:13:57.400 I hope you're right.

00:13:58.140 Because, I mean, an astroturf effort, those things always exist.

00:14:01.360 Always exist.

00:14:02.740 But this is radical.

00:14:04.340 If this is who they are, and you are this upset at the destruction, not even a destruction,

00:14:11.580 the cutting in half, the size of the Department of Education, when there is no evidence that

00:14:20.620 this...

00:14:20.940 Give me the evidence that it works.

00:14:23.860 Give me any evidence that this works.

00:14:27.720 It doesn't.

00:14:28.740 They complain about it all the time.

00:14:29.960 All the time.

00:14:30.800 We have to pour more money into it.

00:14:32.520 Here's an idea.

00:14:33.880 Let's stop with this bad idea and try something new.

00:14:38.580 Because you've been saying that my entire life.

00:14:43.860 Since I was in grade school, you've been saying, you know, the education system just doesn't

00:14:51.460 work.

00:14:51.800 We need to pour more federal money into it. 0.96

00:14:54.140 And now we pay more for each student than anyone in the world by far.

00:14:59.580 And we've gone from the top five to, what are we, 49th now in the world?

00:15:04.840 Did you hear that Harvard, Harvard is now offering remedial math?

00:15:14.900 Harvard.

00:15:15.920 I swear to you, at this point, I could have gone to Harvard and halfway through my first

00:15:22.140 freshman year, they would have said, professor, here, you just take the chalk.

00:15:25.220 Go ahead.

00:15:25.660 You're...

00:15:26.240 I don't even get it.

00:15:27.340 I mean, that's how low the standards are to get into Harvard.

00:15:31.680 Third, remedial math, wow, it seems to be working.

00:15:39.600 And if anybody cares about your kids and your grandkids, and everybody does, everybody does.

00:15:44.280 Everybody was worried about, what about the kids?

00:15:46.440 What about the kids?

00:15:47.200 What about the kids?

00:15:48.020 Yes.

00:15:49.140 Tell me about the kids.

00:15:50.820 Show me the evidence that this has worked at all.

00:15:54.340 Show me the evidence that as the teachers' unions have grown in strength, that it has helped

00:16:01.180 our children.

00:16:02.060 I know it has helped the teachers' unions.

00:16:04.180 I don't even know if it has helped the actual teachers.

00:16:07.340 But it hasn't helped our kids.

00:16:10.000 As you grow the size of the federal government, we spend more and more and more money on each

00:16:15.620 pupil.

00:16:16.780 Show me where it has gotten better.

00:16:18.640 I mean, other than the beautiful palaces that we're building called schools today.

00:16:24.140 My God.

00:16:25.740 Saddam Hussein would come and go, I'm embarrassed at that building. 1.00

00:16:29.080 I couldn't send my kids to that.

00:16:30.900 That's like a palace.

00:16:33.240 And the education system, they're coming out and they're not able to read?

00:16:38.220 They don't know anything about history?

00:16:40.680 They are getting remedial math at Harvard?

00:16:44.260 Come on.

00:16:48.220 You're just living a lie.

00:16:51.280 If you don't want that examined, cut back, and say, we got to try something new, congratulations.

00:17:00.800 Welcome to North Korea. 0.98

00:17:02.180 I mean, without the starvation and the actual communism.

00:17:06.940 This is the best of the Glenn Beck program.

00:17:10.320 All right.

00:17:10.920 Let me tell you about American financing.

00:17:12.340 Remember when you're saving up for that first house?

00:17:14.600 Remember all the late night talks with your spouse back in that cramped little apartment

00:17:17.940 where the two of you just started your own family?

00:17:20.400 Remember, you weren't going to make any mistakes.

00:17:22.260 You weren't ever going to use your credit cards.

00:17:23.680 You weren't going to rack up high interest debts.

00:17:25.500 Remember how everything was going to go exactly as planned?

00:17:30.820 Yeah.

00:17:31.560 Remember the night you woke up and you and your wife and you were like,

00:17:35.660 good God, nothing has gone as planned.

00:17:38.280 Remember, when you realize that, you are capable of getting into debt and being overwhelmed by it,

00:17:45.440 and you can also not be overwhelmed and get out of it.

00:17:49.680 Take a deep breath.

00:17:51.340 I want you to call the salary-based mortgage consultants at American Financing and let them help you.

00:17:56.900 Just take a couple of minutes.

00:17:58.380 You just share.

00:17:58.880 You're going to be surprised at how many things they can do.

00:18:00.760 They can literally help you save $1,000 a month.

00:18:05.520 On average, most of the people who call from this audience, because we track it,

00:18:09.300 are saving just over $800 a month.

00:18:12.080 That would help you, wouldn't it?

00:18:13.620 They never charge any upfront or hidden fees.

00:18:15.960 They work for you, not the banks.

00:18:17.960 800-906-2440.

00:18:37.940 Hello, you sick, twisted freak. 1.00

00:18:39.780 Welcome to the program. 0.99

00:18:40.640 Coming up in a minute, I'm going to talk to you about this oligarch rally that AOC and Bernie Sanders did in Tempe, Arizona.

00:18:51.400 It's interesting that they're now talking about oligarchs, because right after Joe Biden took the oath of office,

00:19:01.340 we did a show that you have to watch, and I'll give you more on this in a little while,

00:19:04.940 but I just want to give you the open of that particular story.

00:19:08.660 I will always level with you.

00:19:15.940 I will defend the Constitution.

00:19:19.680 I'll defend our democracy.

00:19:22.140 I'll defend America.

00:19:24.880 Thinking not of power, but of possibilities.

00:19:28.300 Not of personal interest, but of public good.

00:19:30.340 And together, we shall write an American story of hope, not fear.

00:19:41.480 Yeah, I don't buy it.

00:19:44.880 The Biden administration has already been busy creating a lot of possibilities,

00:19:50.760 but they're all motivated by power.

00:19:54.240 And tonight, I'll show you how.

00:19:56.140 I'll show you how Team Biden is well on its way to conducting a monumental shift in our nation that will change it forever.

00:20:05.540 No longer will our most powerful leaders in government be beholden to you, the voter.

00:20:11.220 But instead, be beholden to a group of elite businesses, corporations, and international interests

00:20:18.000 in a way from which we may never recover.

00:20:22.160 Welcome to your new stakeholder government.

00:20:26.140 Biden's cabinets, advisors, and closest allies now all sit on this country's board of directors.

00:20:33.400 And they'll make decisions regardless of what you, the American citizen, desires.

00:20:38.780 So what was that, Joe?

00:20:41.400 Not a personal interest, but the public good.

00:20:43.720 Yeah.

00:20:44.800 Still not buying it.

00:20:46.560 And after this episode, you won't either.

00:20:49.780 Tonight, the Biden oligarchs, secretly running America.

00:20:54.380 Okay, that was an episode in the first month that he was in office, and we had the goods on it.

00:21:00.140 And I'd actually like to—could we please post that at glenbeck.com so people can watch it if they want?

00:21:05.480 That's like a four- or five-year-old episode.

00:21:07.060 But I would like to do a new episode showing that evidence and then showing the evidence that the Democrats say they have.

00:21:19.400 They don't have the evidence.

00:21:21.200 This is stakeholder capitalism, which was a country run by oligarchs.

00:21:25.960 We'll give you more on that coming up.

00:21:28.000 I am thrilled to have the Ohio Attorney General, Dave Yost, on with us.

00:21:34.040 He served as the auditor of Ohio for a long time, like eight years, and then he became Attorney General.

00:21:44.600 I think he won with more votes than anybody else in the history of Ohio has.

00:21:50.000 And he is defending and fighting for something called Clearview.

00:21:57.300 Now, I like Dave, but I am against Clearview, and maybe he knows something that I don't know.

00:22:03.480 So I want to have a conversation with him about what is happening in Ohio and what's being heard now in the courts.

00:22:10.180 Dave, welcome to the program.

00:22:12.300 It's good to hear your voice.

00:22:13.460 Thank you, sir.

00:22:14.120 Thank you.

00:22:14.720 Thanks for—by the way, thanks for everything that you've done.

00:22:16.720 You're really making a difference.

00:22:17.880 You're very kind.

00:22:20.040 Thank you.

00:22:20.580 Talk to me about the case now of Clearview, which is an AI facial recognition, and it is a great tool for law enforcement, but it frightens me a great deal.

00:22:35.680 Talk to me about the case.

00:22:38.740 Sure.

00:22:39.600 So let's start with the facts of the crime.

00:22:43.240 A fellow is walking down the street, minding his own business.

00:22:46.460 And mind you, this guy's got no criminal background.

00:22:50.160 I mean, he's just—he's a good guy, pays his taxes, goes to work.

00:22:53.560 He's walking down the street on February 14th, Valentine's Day, Day of Love.

00:22:59.320 And the bad guy—I'm not going to use his name—comes up behind him, robs him on the street, shoots him twice in the back, and runs off.

00:23:08.100 Now, some surveillance cameras see him, that are just on the street, see him going into a particular apartment.

00:23:19.660 Well, fast forward a week, police are doing their investigation, trying to figure out what happened.

00:23:23.980 And he goes to a convenience store, and the surveillance camera there over the cash register picks up his face, and he goes back the same kind of route to the same apartment.

00:23:40.980 And so they go, hmm, wonder who lives there?

00:23:43.640 And they run the probation website or the parole website from the Department of Corrections.

00:23:51.280 And lo and behold, there's a felon there.

00:23:53.080 Then they run that guy against the—excuse me.

00:23:59.480 They grab a facial freeze frame off of the convenience store footage and run it through Clearview AI, and it's a match.

00:24:08.140 So they say, aha, they go in and get a search warrant from the judge.

00:24:14.940 During the search, they come up with the gun, the murder weapon, and so they arrest the guy.

00:24:21.500 They've got a pretty good case at that point.

00:24:24.100 The guy goes to court and complains and says, hey, that facial recognition stuff is not reliable.

00:24:30.700 They say right on there that you can't rely on it and don't use it in court, and the judge tosses the results of the search, which means this guy's going to walk if we don't have the murder weapon or evidence.

00:24:48.900 And he tosses that because the Clearview evidence is what got you the warrant.

00:24:56.160 So anything is fruit of a poison tree, correct?

00:24:59.040 Well, that's what the argument is.

00:25:01.660 Right, right, right, right.

00:25:02.640 But the law says that there's a longstanding, decades-long good faith exception, and you're only supposed to use the fruit of the poisonous tree if there's bad faith and there's no other option to do it.

00:25:18.700 There was no bad faith here.

00:25:20.240 And, in fact, there's other useful evidence, provative evidence, including seeing the guy going into that apartment that is useful and supporting the probable cause for the search warrant.

00:25:32.720 It also reminds me a little bit of, if the glove doesn't fit, you must acquit, the use of DNA evidence during O.J. Simpson.

00:25:41.220 Everybody said the same thing.

00:25:42.460 That's unreliable.

00:25:43.200 We don't even know what that is.

00:25:44.360 It could be one out of every hundred have the same kind of DNA.

00:25:47.680 They made all kinds of crazy things.

00:25:49.840 And so that was tossed out because people didn't understand how accurate that was.

00:25:56.060 So I don't disagree with you at all.

00:25:59.720 This is a great thing to get the bad guys.

00:26:02.200 However, Clearview, what they have done is they have scraped billions of images, without anybody's consent, off of the Internet.

00:26:13.000 And I believe it is very, very accurate.

00:26:15.980 And the argument would be, well, I'm not doing anything bad or wrong, so I don't have to worry about it.

00:26:21.140 But I don't, you know, in a time where we're headed towards A.I. the way we are and what's happening in China, this is exactly the kind of technology that is used for governments to track everybody.

00:26:34.980 How do you balance that the crazy world that we live in to make sure it doesn't become a tool like China? 0.98

00:26:43.840 Well, you know, Glenn, I worry about that, too.

00:26:46.040 And I think that the solution is the regulation of the use of the thing.

00:26:51.880 For example, we do not permit here in Ohio the use of facial recognition without any more to support an arrest warrant.

00:27:03.620 It can only be used as a lead.

00:27:06.880 Then you have to go out and do the shoe leather to actually prove that the guy you think it is actually is the guy you're looking for.

00:27:14.580 Which is what you did, right?

00:27:16.120 You use that and you didn't arrest him because we had the A.I.

00:27:19.140 You arrested him because you had that, got you a warrant.

00:27:22.380 You got in, you found the gun, right?

00:27:24.740 Yeah, well, it was a search warrant that got suppressed.

00:27:26.900 Right, right, right.

00:27:27.500 But what I mean is that what you're saying you want it to be used like is exactly what you did.

00:27:34.460 You didn't go get the guy because he was on Clearview.

00:27:38.740 Exactly right.

00:27:39.720 And I think that here's the rubric.

00:27:42.740 I know you're a fact guy, but you love how do we think about this.

00:27:48.740 We have public spaces everywhere.

00:27:51.540 So a cop can stand on the corner and observe all day long.

00:27:55.440 I mean, they can sit there for an eight-hour shift and just watch.

00:27:58.500 And anything he sees is fair game.

00:28:00.640 They're allowed to react right there.

00:28:02.980 And that's not improper surveillance because it's a public place.

00:28:07.140 When does it stop becoming a public place or a proper, when it becomes a private place?

00:28:13.420 If it's your home, if it's in some circumstances your business, you've got to have probable cause

00:28:19.140 and get a judge to sign off on that. 0.70

00:28:21.580 I think when we're talking about these technological things, the question is, what is the government

00:28:27.720 allowed to do with it and what, and did it occur in public or in private?

00:28:35.640 When we're talking about Facebook, you know, I'm sorry, that's, it's electronic, but that's

00:28:40.340 kind of a public place.

00:28:41.780 That's more like the cop standing on the street corner.

00:28:44.440 On the other hand, a cop standing on the outside, and we just had a Supreme Court case about

00:28:49.900 this a couple of years ago, a cop standing on the street, but using sensitive ultraviolet

00:28:55.520 thermal imaging to look for marijuana grows, they're looking at what's going on inside your

00:29:01.200 private residence.

00:29:02.160 Yeah, they are.

00:29:02.540 That needs, that's a Fourth Amendment violation.

00:29:05.520 So I think that this principle of public versus private spheres goes a long way to helping

00:29:12.920 us think through this.

00:29:14.000 So Dave, I want you to know, I mean, I hope this hasn't felt like a hostile interview,

00:29:18.560 but I want you to know that I'm a fan of yours, but I am very, very concerned of this

00:29:24.560 slippery, almost straight down slope to the cage that AI could build for people.

00:29:32.560 And we can have all of the best intentions, but it falls into the wrong hands.

00:29:37.080 We lose several elections in a row, and it could be, I mean, it'll be a prison, it'll be a

00:29:45.540 panopticon, like it is in China.

00:29:48.920 And so that's why I'm concerned about it.

00:29:50.600 So this is in front of the Supreme Court, oral argument, I mean, closing arguments haven't

00:29:54.480 happened yet.

00:29:55.020 How do you think this is, the court's going to look at this, and what do you think is

00:30:00.840 going to happen?

00:30:03.780 Well, it's a case of first impression, right?

00:30:05.860 I mean, we haven't had a lot of cases challenging the intersection of the Fourth Amendment, protecting

00:30:13.160 our privacy in our homes and papers, and this new technology.

00:30:18.800 So we're arguing for a narrow reading of it, but that it should be positive, that it should

00:30:25.560 be an available tool.

00:30:29.020 To your point earlier, I couldn't agree with you more.

00:30:31.680 It scares me what the government can do about this.

00:30:34.000 If you think about back to the Biden administration and social media and what they were doing,

00:30:39.560 multiply that, make that geometrically larger, and that's the potential.

00:30:44.920 We've got to be vigilant.

00:30:46.180 What is the difference between this and, like, for instance, in Texas, you can't clock

00:30:52.000 me speeding with a camera.

00:30:55.260 A cop has to be there to stop me, and even though they can take a picture of me driving

00:31:00.580 the car, et cetera, et cetera, they cannot ticket me for speeding.

00:31:04.040 It has to be a physical police officer.

00:31:07.120 What is the difference between this, do you think?

00:31:10.120 Well, and that's a great, that's the same law we have in Ohio, and that's a great example

00:31:15.160 of how the government can restrain technology to prevent it from going too far.

00:31:21.360 That's not a constitutional issue.

00:31:23.420 That's a statute that the General Assembly passed and said, we're not going to let you do this.

00:31:29.080 Yes, you've got the technology.

00:31:30.620 We're not going to let you do it.

00:31:32.360 That's just too far.

00:31:33.500 Dave, I mean, I appreciate that at least you and others are thinking deeply about this

00:31:41.900 because we're on the verge of a whole brave new world, and I honestly don't know what

00:31:47.340 the right answer is.

00:31:48.420 I mean, the law-abiding citizen in me is like, the guy clearly, you got the gun in his house.

00:31:55.280 He clearly did it, but the person that is concerned about this new technology and things like

00:32:01.500 China, I just don't know how to balance it yet, but I appreciate the conversation.

00:32:05.640 Thank you so much.

00:32:07.140 Thanks for having me on.

00:32:08.260 You bet.

00:32:08.900 That's Dave Yost.

00:32:09.780 He's the Ohio Attorney General, and that is happening in Ohio right now.

00:32:14.520 If you have any doubt on which side in the country is dangerous, both sides could be

00:32:23.920 dangerous, but there is one side of the political debate that has an actual active revolutionary

00:32:31.120 army, and that is the left, and we are seeing it.

00:32:34.700 Earlier, I played in the podcast the words of Chuck Schumer, who I guess he's trying to

00:32:41.600 prove that he's manly or something, but he is talking about, we are targeting Republicans

00:32:47.180 in their own areas, which goes to some, he might just mean, like Sarah Palin meant, we're

00:32:53.220 targeting, you know, through political process, but there's too many people on the left that

00:32:58.360 are actually targeting, and let me give you this.

00:33:01.980 A website called DogeQuest has published the personal information of Tesla owners nationwide

00:33:10.320 in an apparent bid to shame and also intimidate them because they're saying, you're a supporter

00:33:18.300 of Doge, and because you bought a car, maybe you bought it because, you know, you believed

00:33:24.340 in global warming.

00:33:26.000 I don't think you were probably on the Trump train, but okay.

00:33:29.960 The site called DogeQuest reveals all of this information.

00:33:34.540 The operators, who also posted the exact locations of Tesla dealerships, said they will remove

00:33:41.900 identifying information about Tesla drivers only if they provide proof that they sold their

00:33:48.820 electric vehicles.

00:33:50.780 Now, I don't know about you, but that sounds like the very definition of terrorism.

00:33:55.900 People have been doxxed, and there's something else that is happening, and that is people

00:34:04.260 sending in SWAT teams.

00:34:06.860 It's called SWATing.

00:34:09.220 Let me just show you a montage here of some of the people that are being SWATed.

00:34:15.300 Look.

00:34:16.140 SWATing against conservatives.

00:34:18.020 We told you yesterday about Texas radio host Joe Paggs being SWATed.

00:34:22.800 This morning, a growing number of conservative influencers are getting targeted by SWATers.

00:34:27.860 They were so urgent in getting the police to break down my door and possibly kill me

00:34:32.220 in my doorway, they told them, I heard this on the scanner traffic, that he's bleeding out

00:34:36.460 upstairs, please hurry and get inside.

00:34:38.580 When I walked up to the door, he was pointing a gun at me, you know?

00:34:42.300 We did just get SWATed.

00:34:43.560 The officers said they received a phone call that somebody murdered somebody in the house

00:34:50.460 and was planning a suicide by cop.

00:34:52.420 Conservative podcaster Nick Sorter also posted, both my dad and my sister were SWATed tonight,

00:34:57.440 a dozen cops attempting to kick my dad's door in at gunpoint.

00:35:01.960 Have you ever seen a phone call here?

00:35:05.320 Yes, sir.

00:35:06.500 Just a few hours ago, InfoWars reporter and anchor Owen Schroyer was SWATed at his home.

00:35:12.480 And then most recently, Juanita Broderick posted, well, I just got SWATed.

00:35:17.080 About 10 police and SWAT teams showed up.

00:35:19.000 They said the caller said there were two masked men and people inside that had been shot.

00:35:23.380 This is terrorism.

00:35:28.900 And those people who are making these calls should go to prison for a very, very, very long time.

00:35:37.840 Luckily, I know my sheriff in Fort Worth County.

00:35:41.840 I know the guy who is protecting me and my neighbors.

00:35:46.920 I know who he is and he knows who I am, which Sheriff Wayborn, welcome to the program.

00:35:53.540 That is the first key, is it not?

00:35:55.760 That is the first key.

00:35:56.740 Relationships are always very, very helpful in these situations.

00:35:59.260 So, as we are sitting here, and I didn't mean Fort Worth, Tarrant County, when we are sitting here and you're seeing things like this happening, what does that mean to you and how you have to behave and what you're walking into?

00:36:19.840 Right.

00:36:20.280 Is that, you know, when they get these urgent calls, they have got to respond.

00:36:25.000 They got to be ready to go as far as law enforcement in case it is real.

00:36:27.860 Now, I will tell you that, especially in the greater Fort Worth area and the surrounding suburbs, we're very well aware of it.

00:36:35.020 And there's been several of these.

00:36:36.940 In this area?

00:36:37.860 In this area.

00:36:38.660 Over the last year, there's probably been, you know, 15 or 16 cases.

00:36:42.500 You're kidding me.

00:36:43.580 No.

00:36:44.180 And I will tell you, they all turned out good, you know, as far as law enforcement's in a reaction.

00:36:49.100 Nothing went wrong where somebody got hurt, because I think we've got some great law enforcement.

00:36:53.920 But when they're rolling toward that, I mean, the intel starts at the moment that the 911 phone is listening and the dispatchers are trying to listen for different clues about what might be going on there, and they're passing it on.

00:37:08.520 And then we have other intelligence, which I won't make public.

00:37:11.740 Yeah, sure.

00:37:12.020 But we're trying to do that.

00:37:14.880 Now, you know, there's some preventative things that we need help from the homeowner.

00:37:18.600 Okay.

00:37:19.140 Like?

00:37:19.680 Well, one is, let's hide your information, because a lot of this is coming over the gaming systems is really big.

00:37:26.420 That's like 95% of the gaming systems where you don't know who you're gaming with, but they know who you are.

00:37:32.740 So we've got to protect your identity, we've got to protect your privacy, and try to block all things that show who you are.

00:37:40.800 And maybe some double stuff where you have code words or stuff so you know who you're dealing with.

00:37:49.620 Yes.

00:37:49.940 I tell you, the gaming systems are terrifying.

00:37:52.820 My son, he was being groomed for this pedophile, and luckily we found out about it, and the FBI came into the house, and they took the gaming system, and they said, it's all happening through the gaming system.

00:38:08.240 That's right.

00:38:08.720 Luckily, the gaming system has a record, and so it's recording everything.

00:38:15.060 Can you, have you found, or can we find these people?

00:38:19.140 How come we can't find, does it triangulate the phone if you're on a cell phone and you're someplace and you're calling it in to 911?

00:38:27.620 Can we find these people?

00:38:29.360 Sometimes we can find these people.

00:38:31.480 We're finding, some of these people are overseas.

00:38:33.720 They're not even here in the United States.

00:38:36.400 But we go after them, if you'll pardon the term, with the gust of a hound dog, using all resources, both federal, state, and local resources, to try to locate them and find out who they are.

00:38:45.660 And when we get our hands on them, we're going to prosecute them for the felony that they've committed.

00:38:49.140 And what are you hearing from Pam Bondi and the federal?

00:38:54.620 Well, ironically, I talked to her this morning, but we didn't get to discuss this, but she is absolutely on board of prosecuting people federally, if at all possible.

00:39:06.080 That's just the temperament of who our attorney general is.

00:39:09.280 I want to ask you, because I don't know Pam.

00:39:11.340 I mean, I've met Pam, but I don't know her.

00:39:14.680 And I'm a little concerned that, you know, like the Epstein thing, I'm hoping, and maybe you can help me on this.

00:39:23.540 I'm hoping that she said, wait, we're not releasing these things right now because we have internal cleanup to do, and we're also building cases against these people.

00:39:35.820 And we want to release it when we can say, and we're prosecuting.

00:39:40.820 Do you think that's her approach?

00:39:42.180 I think that's absolutely probably her approach.

00:39:45.140 She is a very, very smart woman and a great prosecutor. 0.98

00:39:49.020 And so she's doing the cleanup, as you say. 0.69

00:39:52.180 And I think that she is watching very carefully what she can and can't do.

00:39:56.820 What is the difference between the last administration and this administration?

00:40:00.220 Well.

00:40:00.660 In your position.

00:40:01.420 In my position is, is that the cartel is being shut down.

00:40:06.380 And, you know, I visited with the director of DPS last week, and they're averaging a little less than 200 crossings a day on the entire Texas border.

00:40:16.720 And, you know, we're last year at this time, you know, we were talking 15,000 a day.

00:40:20.460 Yes, yes.

00:40:20.860 So that's absolutely the first thing that I would say is that is happening.

00:40:25.380 But also that the administration is coming alongside of us in some other areas like, you know, THC, the THC products that are such a threat to our kids these days.

00:40:36.120 Is they're coming alongside of us as Texas is trying to pass laws, and we're trying to absolutely curb that issue.

00:40:43.760 You know, I look at what's happening in Mexico with these cartels.

00:40:50.280 And I would think, putting myself in the shoes of a Mexican, I would think to myself, I can't say anything about these cartels.

00:41:00.920 I know people who have run against and said they're going to clean it up, and they're dead, and their family is dead.

00:41:06.540 I want this to happen, but I can't really say anything.

00:41:09.880 And my government is in bed with it. 0.99

00:41:12.320 I think the Mexican people, the average Mexican person, if we go in and say, okay, Mexico, you didn't do anything about it, and we're killing them all. 1.00

00:41:24.960 I think they will turn and say, you know what, let's go concentrate on some other market, not in America, because they're serious about it.

00:41:36.100 And I think the Mexican people would be happy.

00:41:39.120 I know I would be thrilled.

00:41:42.620 Is that your take?

00:41:43.520 That is absolutely my take.

00:41:45.320 And I know just last week, unfortunately, they lost five Mexican National Guardsmen who were ambushed and killed by the cartel just a few days ago.

00:41:52.920 So they're fighting back, and they're trying to do some things.

00:41:57.220 But as we know, that government, you know, I've said this publicly, is I don't trust them.

00:42:03.980 I'd like them.

00:42:04.420 You know, we need to see what they're trying to do.

00:42:07.040 And hopefully they'll stand up, because the cartel has done so much damage to this country.

00:42:11.900 Are they capable?

00:42:13.000 Every time somebody stands up, they're dead.

00:42:15.340 They're dead.

00:42:15.840 So are they capable of standing up as, you know, politicians or even a group of politicians?

00:42:23.820 Because that's a death sentence for them.

00:42:25.460 It is a death sentence.

00:42:26.560 You know, I agree with you, is that I've said over a year ago, says, what would you like to happen when a conservative president comes in?

00:42:33.000 I said on about day 15 or 20 that the cartel's woken up by the 82nd Airborne.

00:42:37.580 And I think that we go in and clean them out would be best for everybody.

00:42:42.580 You think that's coming?

00:42:44.020 I don't know, because our president is unpredictable.

00:42:47.800 Yeah, I know.

00:42:48.300 But he has labeled them terrorists, so they're on notice, and I think anything is possible.

00:42:55.160 And if I was a cartel leader, I might say, okay, guys, we're closing shop, and we're moving, and where are we going?

00:43:03.540 Yeah.

00:43:03.780 That's what –

00:43:04.600 I think, you know, the pushback on sending somebody in is that, well, they're just going to retaliate in our cities.

00:43:12.860 You retaliate in our cities, and then it gets much worse for you.

00:43:18.340 I think if we just take out a few families, the kingpins, and it all happens overnight so fast, everybody wakes up and goes, oh, my gosh, I really do think they won't retaliate.

00:43:32.100 They will turn their attention someplace else.

00:43:34.240 Why risk that?

00:43:35.720 Absolutely.

00:43:36.420 America's serious.

00:43:37.280 Yeah.

00:43:38.480 I agree with you 100%, because cartel isn't in the business to be at war with America.

00:43:42.680 Right.

00:43:43.280 They're in business to sell things.

00:43:44.980 Right.

00:43:45.360 And if it's not working out, you go to a different place.

00:43:47.660 So I agree with you.

00:43:48.520 I think that if we hit – you know, took out a few of the kingpins, a few of the leadership, I think that would do it.

00:43:54.040 Are you concerned – we were just talking about swatting.

00:43:55.780 Are you concerned about – have we had any Tesla attacks or anything?

00:44:00.720 We haven't had none that I know of in Tarrant County.

00:44:03.440 Yeah.

00:44:04.000 Well, that's the – I mean, used to be the conservative county in Texas, but it certainly isn't anymore.

00:44:11.280 Boy, we're on a razor's edge.

00:44:12.960 I'm really, truly worried, especially with Hollywood coming in.

00:44:17.140 I'm very worried that we could lose Texas.

00:44:19.620 People in Texas who grew up here in Texas, spent their whole life in Texas, and are not paying attention, they think Texas will always be Texas.

00:44:29.060 It's on a knife's edge.

00:44:32.140 We need to always be on our game.

00:44:34.520 We need to always be working in spreading our conservative values and educating the public as best we can.

00:44:41.060 Sheriff, always good to see you.

00:44:43.060 It's good to see you, my friend.

00:44:44.040 Best to your family.

00:44:44.720 Thank you so much.

00:44:45.100 Thank you.

00:44:45.560 You bet.

00:44:46.200 Sheriff Bill Wayborn.

00:44:48.280 Na-na-na-na.

00:44:51.420 Claudia was leaving for her pickleball tournament.

00:44:53.700 I've been visualizing my match all week.

00:44:56.240 She was so focused on visualizing that she didn't see the column behind her car on her backhand side.

00:45:02.260 Good thing Claudia's with Intact, the insurer with the largest network of auto service centers in the country.

00:45:07.600 Everything was taken care of under one roof, and she was on her way in a rental car in no time.

00:45:12.400 I made it to my tournament and lost in the first round.

00:45:15.880 But you got there on time.

00:45:17.720 Intact Insurance, your auto service ace.

00:45:20.340 Certain conditions apply.
