00:27:34.000 constitution gets in our way uh we're going to pack the court and and do an end run around the
00:27:39.760 constitution so it goes back to this basic thing we discussed is that whatever their ends they feel
00:27:46.700 justify any means i i i tell you you know we're seeing it with guns we're seeing it with roe we're
00:27:52.960 seeing it with energy education where the the administrative state is now making all the rules
00:28:01.440 i.e laws because congress has abandoned their responsibility um are you disturbed by any of
00:28:09.920 this is any way to stop this bill legally well through uh you know i i think this supreme court
00:28:17.400 majority we have could roll back on the administrative state as you just said the basic problem we have is
00:28:24.780 congress is not doing its job it's essentially you know holding hearings and making statements and stuff

00:28:38.820 address any of the problems they have the legislative power and they don't use it um and uh the other
00:28:46.420 thing is they use the legislative process to make statements so i expect the democrats are going to come
00:28:51.780 in with sort of an you know everything but the kitchen sink gun control legislation that's meant as a
00:28:57.680 political statement and is not really designed to make incremental progress yeah toward common sense
00:29:03.880 goals right um bill let me switch to um uh durham we spoke about it last week before the verdict came
00:29:11.720 in um and i've heard you speak about it um this week but a lot of people were you know as we we spoke
00:29:21.480 given up hope on anyone ever paying for a crime i i don't think you know what's what durham is pursuing
00:29:30.300 but does this end this does the do the revelations that came out does that help him for the future
00:29:38.860 well what should we take from that well i think there's a you know there's a there are two different goals
00:29:45.620 i think one goal is to get to the truth lay the facts bare and and to some extent achieve
00:29:52.500 accountability by the reaction of the american people by getting the truth out of what happened
00:29:57.120 the other goal obviously would be to punish people to the extent you can achieve convictions
00:30:02.640 uh that latter goal is is more difficult because of the way the system operates the high standard of
00:30:08.980 proof you need admissible evidence and uh you know dc juries are not the most favorable
00:30:15.320 forum for these cases by a long stretch and i think everyone recognized that that didn't inhibit
00:30:21.340 durham uh because uh the fact that he knew there would be a tough jury because i think the rule in
00:30:29.220 the department is that you bring a case if you think you can prove to an unbiased jury uh the case and so
00:30:38.580 i think he felt he had the duty to bring this case he knew that it was a difficult jury but
00:30:44.860 but i think the and and i'm disappointed uh in the outcome but i am actually happy that he brought
00:30:54.860 the case because i think it actually achieved a lot of progress on the issue of getting at the truth
00:31:00.360 he shed a lot of light and and demonstrated the central role played by hillary clinton's campaign
00:31:08.320 and also the very troubling behavior of the fbi leadership that that duped its own agents about the source of this
00:31:15.920 information and that's a lot of progress and i think there's going to be more progress on this front with
00:31:20.460 danchenko and ultimately i think he's going to write a very illuminating report about how all this went down
00:31:28.060 now if i can just say you know one of the things that's always frustrated me about the frustration
00:31:34.700 of of trump's allies and i include myself in that on this issue uh it is this idea that uh just because
00:31:44.560 we think we know what happened it should be easy to throw people in jail and this case sort of illustrates
00:31:49.020 that in this sense we knew or thought we knew that hillary clinton in july had had given the green light
00:31:58.280 on on on this thing and on the idea of putting out a story to tie trump to putin but the reason we knew
00:32:05.800 that is because the cia gave a report saying that they had some indications of this and then immediately
00:32:12.480 won't say so well throw them in jail that's not admissible evidence correct and you could never
00:32:18.740 have built a case on that the hard work had to be done to actually get evidence of not hearsay but
00:32:25.940 direct evidence that that happened and through a lot of hard work that people were trying to bring people
00:32:31.780 to justice they were able to tell that story with direct evidence as to the role of the campaign
00:32:38.560 and that's the kind of hard work that's required to actually present a case in court and to achieve
00:32:46.560 a to achieve a conviction but i think the public has been conditioned that just because you know
00:32:51.920 there's information out there in the ether that suggests something that that should be enough and
00:32:57.760 it's not enough no it's we talked about this in the podcast i i think we're both for um a an open
00:33:06.820 and honest hearing of all of the evidence on the 2022 campaign but you can't do that during the the
00:33:16.060 time in a in a five-week period you the the clock is ticking constitutionally but it absolutely should
00:33:24.160 be done we should decide and hear all of the evidence i just don't know who could possibly present
00:33:31.420 it to us that both sides would listen to and trust anymore about the election yeah or about the
00:33:38.800 yeah their election um yeah i mean i i think that's true i think we're at a point where where there is
00:33:47.660 no authoritative entity that hasn't you know that that can command you know everyone's uh ascent but
00:33:55.340 i as i said to you you know i am all for exploring all the potential theories about uh you know and we
00:34:04.820 should if it's true we need to fix it and it doesn't matter if it could change the election or not
00:34:11.140 if it's one vote we should fix the problem that caused that vote to be counted if it's a you know a
00:34:19.420 million votes it to me it makes no difference i want to know what happened and there's no reason in
00:34:26.200 today's technological age that we can't have secure elections but i don't think either party is actually
