00:04:39.880 We have a bunch of big decisions that are going to come down in the next couple of weeks.
00:04:45.060 Obviously, the Dobbs case with abortion has been kind of the marquee one that everyone's been talking about.
00:04:51.500 But can you kind of walk us through maybe a little bit on that one and what else we expect over the next couple of weeks?
00:04:57.320 Sure.
00:04:57.840 So with the Dobbs opinion itself, we're dealing with the question of abortion.
00:05:01.260 And we're dealing with whether or not it is a matter of federal constitutional law that the states may not regulate or restrict abortions in most circumstances.
00:05:12.020 This has been the case more or less since 1973.
00:05:14.700 The Supreme Court has stepped in and said this is a matter for federal judges to decide because federal judges, seven out of nine Supreme Court justices sitting in 1973 decided that it was.
00:05:28.060 The Supreme Court, based on the draft majority opinion that was leaked from Justice Alito, it appears that the court is poised to undo the Dobbs ruling and undo this this 49 year aberration from the constitutional norm in which the Supreme Court has made this a question for Supreme Court justices rather than lawmakers.
00:05:50.400 So that's a big one.
00:06:20.380 You see, the state of New York has in some ways relegated the use of the Second Amendment right to an individual's own home.
00:06:32.560 And the plaintiffs in that case are challenging them.
00:06:36.580 So those could both be big blockbuster cases.
00:06:39.760 And I suspect they might come right down to the wire because typically the way it works at the Supreme Court is that the cases that are most hotly disputed are reserved to the end, partly because the way the justices draft opinions and negotiate their release.
00:06:56.320 So, Mike, hello and welcome to the program.
00:06:59.920 Thanks for joining us today.
00:07:00.900 There is also a fight over the EPA's power to redistrict greenhouse gases.
00:07:13.300 And we've got a few things.
00:07:15.240 Let me just let me just play this for you.
00:07:17.060 Here's Gina McCarthy from the Biden White House.
00:07:22.480 She's a climate advisor.
00:07:24.360 Listen to what she said during an interview yesterday.
00:07:26.460 And so the challenge is now that we're moving from denial to actually just trying to to disengage the public from understanding the values of solar energy, the values of wind energy, the benefits of clean energy.
00:07:43.020 We have to get tighter.
00:07:44.020 We have to get tighter.
00:07:45.080 We have to get better at communicating.
00:07:47.920 And frankly, the tech companies have to stop allowing specific individuals over and over again to spread disinformation.
00:07:57.020 That's what the fossil fuel companies pay for.
00:07:59.920 That's what folks who make money out of fossil fuels and don't make money and don't care about saving consumers costs.
00:08:08.640 That's what they do.
00:08:12.660 I can't believe this is coming from the administration, but also the Justice Department is taking a series of actions to secure environmental justice for all Americans.
00:08:25.240 They now have an office of environmental justice.
00:08:30.320 Mike, this is everywhere and it's all being done just by the stroke of a pen in the administration.
00:08:37.960 Tell me about this next case and will it stop things like this?
00:08:41.840 All right. So it's not going to stop the inclination of the left and of people on the left who hold high office in the executive branch from wishing that they could silence anyone who disagrees with them.
00:08:56.660 But I think we can get to the heart of the issue.
00:09:01.360 I think there is some potential that one or more of these cases pending before the Supreme Court involving the EPA's vast sweeping authority could help rein in their power.
00:09:14.200 Part of what breeds this kind of attitude, Glenn, is that over time, in part because of the way we've accumulated power in the federal government, we have allowed Congress to essentially delegate lawmaking power over to unelected, unaccountable bureaucrats at agencies like the EPA.
00:09:32.040 And once that happens, they start behaving as if judge, jury and executioner, as if they have the power to make and interpret and enforce the laws within their own little fiefdoms, which they actually kind of do.
00:09:47.120 And so these these issues present constitutional questions and those constitutional questions have reached a boiling point.
00:09:54.420 And that's why I'm guardedly optimistic the court might rein in some of their power here.
00:10:02.040 I'm guardedly optimistic.
00:10:05.800 Yeah, look, these things move.
00:10:07.880 I mean, it feels like we could.
00:10:12.380 Right.
00:10:13.340 But it feels like this could be an incredible summer for people who believe in the Constitution.
00:10:23.320 Yes.
00:10:23.960 And that's a brilliant thing.
00:10:26.120 That's a wonderful thing.
00:10:27.360 You see, because it's one of the things that the founding fathers agreed upon is that the lawmaking power is not delegable.
00:10:36.840 You can't elect someone to be a lawmaker and then have that person delegate the task over to someone else.
00:10:44.200 Charles de Montesquieu, one of the most influential political philosophers on the founding generation, had explained that that is a non-delegable duty.
00:10:52.900 We've gradually drifted away from that.
00:10:55.800 And this is actually something I talk about a little bit in my book, Saving Nine, that once we once FDR threatened to pack the court, then the court changed its approach to interpreting the Constitution.
00:11:06.860 That opened the floodgates.
00:11:08.680 And all of a sudden, the twin structural protections of the Constitution, federalism and separation of powers, meant less and less.
00:11:16.860 That's how we get these almighty czars within these executive branch agencies who just think they have the power to do anything and everything, which they kind of do.
00:11:26.200 And the Supreme Court has the potential to reign that in.
00:11:29.640 And I hope and pray that they do this year.

00:13:53.400 We have the gun case, the abortion case, the environmental case.
00:14:00.380 What else is out there that we should be looking for that could be extraordinarily good or bad?
00:14:06.600 Yeah.
00:14:07.160 So I think you've covered the big ones that remain.
00:14:10.000 You've got the administrative law cases, some involving the EPA, others involving the Securities and Exchange Commission,
00:14:17.700 both dealing with different questions about the delegation of lawmaking power and the extent to which these major legal questions,
00:14:25.240 major policy questions can be decided by unelected, unaccountable bureaucrats.
00:14:31.780 So that's is the SEC is the SEC question the same.
00:14:37.340 Does that fall under the same umbrella as the one we just talked about with environmental EPA?
00:14:44.460 Yeah, it's a different dispute, but it potentially raises some similar questions on administrative law
00:14:53.760 and on the appropriateness of major legal questions being decided by unelected, unaccountable bureaucrats
00:15:02.180 rather than by Congress itself.
00:15:05.660 It at least presents the potential opportunity for the court to address those issues.
00:15:10.300 And so you've got those two.
00:15:13.500 You've got the abortion case, Dobbs.
00:15:15.500 You've got the gun case, New York Rifle and Pistol Association, which I continue to think is a very important one,
00:15:23.360 because remember, the Supreme Court about, you know, 15 years ago finally recognized the Second Amendment
00:15:33.640 as providing an individual right.
00:15:36.300 But there are some parts of the country, including the state of New York, that have have tried to relegate that into nothingness
00:15:44.400 by saying, OK, what that means is you can have a gun on your own property.
00:15:49.880 But it can't mean much more than that because you're going to have to get a permit if you want to actually take it outside of your home.
00:15:56.880 And so that could be a very significant moment.
00:15:59.940 I've got a very good feeling that the Supreme Court there is not going to say it's OK for a state to relegate the Second Amendment into nothingness
00:16:08.840 by telling you that you've got to possess that gun only on your own home.
00:16:15.240 So what does that mean for the red laws that have just been or look like they're they're going to become law?
00:16:23.060 Well, the red flag laws, the red flag laws, yeah, red flag laws raise a different set of questions.
00:16:30.880 Red flag laws have the potential to eliminate someone's due process rights.
00:16:37.840 Remember, the Second Amendment provides a substantive constitutional right to having a firearm.
00:16:45.320 In the case of a red flag law, you have the ability of the state to take away someone's gun right based on accusations that they think someone might be unstable.
00:16:56.540 And in some cases, they allow for your gun rights or your guns themselves to be taken away before you've had your day in court,
00:17:05.220 before you've had any opportunity to present evidence, any opportunity to cross-examine witnesses hostile to you,
00:17:12.700 or otherwise to to address the accusations against you.
00:17:16.720 And so that's as much of a due process issue as it is a Second Amendment issue.
00:17:22.580 And those questions aren't squarely presented in the New York rifle case.
00:17:28.960 OK, the the the red flag laws scare the dickens out of me, just because if you just look at divorces,
00:17:37.100 how many how many people own guns, how many guys own guns, the wife, you know, just kind of tolerates it.
00:17:44.900 She's not anti-gun or whatever, but she's anti her husband.
00:17:48.560 She goes to court and says, you know, he's threatened me before or he's done this.
00:17:53.560 She can so easily say prior to and it could the world's could be reversed, but so could easily say, look, you drop, you know, drop this or give me what I want or whatever.
00:18:07.720 Otherwise, I'm going to tell him a red flag and you'll lose all your guns.
00:18:12.400 And that will happen.
00:18:13.780 Things like that in many different ways will happen.
00:18:18.700 Yes, they will happen and they do happen.
00:18:24.100 This is the way these sorts of things work.
00:18:26.780 And, you know, we don't take away other fundamental rights that we acknowledge are fundamental based on whether we think someone needs it,
00:18:35.940 based on whether we think the person is deserving, at least not without due process.
00:18:40.900 You wouldn't see that in other areas and you shouldn't see that here before you deprive someone of life, liberty or property.
00:18:49.740 You've got to give them due process.
00:18:52.260 Now, there will be those who will say, well, they are given due process because they can have a hearing under these red flags, under these red flag laws.
00:19:00.300 Well, under some of them, one could argue all of them.
00:19:03.160 And in effect, right now, they do have a hearing, but very often it's after the deprivation has occurred, after it's already been stripped from them.
00:19:13.920 One thing about due process, Glenn, is that it's got to occur before you take away someone's right, because the Fifth Amendment says that you can't deprive someone of life, liberty or property without due process of law.
00:19:25.200 So that protects you against federal action, federal deprivation of due process.
00:19:30.520 You've got a corresponding protection against the states in the 14th Amendment.
00:19:35.560 And so due process means review within court in a meaningful time when it matters.
00:19:46.080 So, Mike, help me out on help me out on Joe Kennedy's case.
00:19:52.080 How much of a difference will this make in our schools and in the public square?
00:19:59.720 Here's a guy who was fired because he was spraying on the field.
00:20:04.180 He wasn't trying to indoctrinate any of the kids or whatever.
00:20:07.620 I mean, he wasn't doing anything that the transgender teachers are trying to do to our kids.
00:20:12.900 How much of an impact will this make?
00:20:16.240 What are the ramifications?
00:20:17.180 OK, so they're big for him and they're big for anyone who who wants to exercise his or her First Amendment right to pray, to pray, not in a coercive way, not to make anyone feel left out because but because it's what they want to do.
00:20:38.740 He wasn't discriminating, discriminating against any player who didn't want to join in.
00:20:43.740 This is something important.
00:20:45.640 And, you know, a team very often feels a lot of anxiety before a game, a lot of gratitude or sorrow after a game.
00:20:54.080 It's not unreasonable for that person to want to pray and for members of the team to want to pray.
00:20:59.740 So this shows a certain intolerance on the part of the left and intolerance toward those who have religious beliefs.
00:21:10.400 It's not something that we can tolerate.
00:21:13.300 Intolerance is one thing that we as Americans don't tolerate very well, and we shouldn't.
00:21:17.640 And when it comes to intolerance of religious belief, this is something so deeply rooted in our nation's history and tradition and culture that it would be a huge mistake to try to to get rid of it.

00:25:01.520 Um, so first of all, let me, let me ask you, Mike, on, um, the, the bipartisan agreement that has happened on gun control.
00:25:15.060 This seems, um, you know, it seems like common sense, some of it, but I'm, uh, I, I subscribe to the slippery slope thing.
00:25:27.120 Uh, and especially with this administration, because they are using all levers of the administration and they have no intention of letting the American people have guns.
00:25:38.940 So tell me where we are on, on this.
00:25:42.240 Well, look, we don't have legislative text yet.
00:25:47.080 We've had some general principles outlined and the general principles have been outlined differently, depending on which member of the coalition you're talking to.
00:25:56.640 They've been outlined in terms by some of the Republican members of the coalition that make it sound like it, it does very little and been outlined by some of the Democrats in terms that make it sound very different than that.
00:26:08.220 So I'm waiting to see legislative text.
00:26:12.240 I, it is imperative when you're passing law or being asked to support the passage of law that you see the actual legal text, uh, before you decide what you're going to do on it.
00:26:23.540 Uh, it's concerning to me that you've got people jumping onto this thing, even members of the coalition jumping onto it, who are signing onto the agreement in principle.
00:26:32.260 And therefore to, to what they imagined to be the eventual bill without ever having seen it, that's a big problem.
00:26:41.820 And they're saying that they're not going to force any States, but they're tying money to this, correct?
00:26:48.120 For States.
00:26:48.760 Yes.
00:26:49.120 And that is a concern that I have even outside the gun context.
00:26:53.900 It worries me when we start to tie, we give money to States and we are trying to achieve a particular federal policy outcome.
00:27:03.140 And we therefore tie the receipt of those state funds to the implementation of whatever Congress's preferred policy is.
00:27:12.720 And so, uh, we have yet to see how that one's going to work, how it's going to be phrased.
00:27:17.460 That could be of concern independently.
00:27:19.280 How is the, um, uh, how's the January 6th hearing playing inside the Capitol?
00:27:31.980 Well, look, it's all the rage on the house side.
00:27:35.220 It's all the rage among Democrats.
00:27:37.320 They love talking about it.
00:27:38.540 They love thinking about it.
00:27:39.660 They love thinking about talking about thinking about, and it's all they can get into their head.
00:27:46.580 And I literally can't get enough of this stuff, but you know, the truth is, uh, according to the polls that I've seen, very, very few Americans are focused on that.
00:27:58.520 You know what they're concerned about?
00:28:00.040 Uh, they're worried about three things, inflation, uh, and then inflation.
00:28:05.500 And then the next thing after that is, is inflation.
00:28:09.580 They're terrified about what this is doing to them.
00:28:13.000 You know, Glenn, the average family in my state in Utah shells out an additional $800.
00:28:18.420 This is up just from last week, $800 a month, every month, relative to what they were paying at the beginning of 2021, just for their basic monthly household expenses.
00:28:29.300 They're not getting anything new for that.
00:28:32.100 That's almost 10 grand a year, $9,600 a year that the average Utah family is paying for that.
00:28:37.720 And we've got slightly different numbers all across the states.
00:28:40.760 That's, that's, uh, roughly the number in Utah.
00:28:43.480 People were concerned about that.
00:28:45.360 And so look, this is the Democrats effort.
00:28:47.460 Don't be deceived.
00:28:48.320 This is what the Democrats are doing to try to distract.
00:28:51.700 This is their shiny object that they're waving wildly while they try to get you to think about anything other than the inflation brought about by Joe Biden's reckless spending.
00:29:05.080 Well, there's a couple of things I want you to, I want you to hear.

00:33:44.040 Joe Biden wants to become known as the modern living reincarnation of Franklin D. Roosevelt.

00:33:55.300 And so because they don't like what they saw in Justice Salido's masterfully written opinion in the Dobbs case, they're trying to do that to the court to prepare to pack the court so that they can continue to use the court as their way of getting around those pesky provisions of the Constitution they don't like and reinventing others that don't exist.
00:34:19.460 What is the difference between what has been going on in the streets with our Supreme Court and terrorism?
00:34:30.460 Isn't terrorism, can it be defined as people who are trying to incite violence, or I shouldn't say incite, people who are bringing violence and threatening lives with an intent to carry those things out, and safety is the exchange for doing things their way?
00:34:56.820 Yeah, that's basically it.
00:34:58.260 There's usually also an element of ideology-driven desire and aspiration to influence opinion or force people to succumb.
00:35:10.380 But yeah, that's it in a nutshell.

00:35:16.520 And the fact that it also serves their purpose of allowing them to get headlines, allowing them to bring about negative headlines on the Supreme Court from the mainstream news media outlets who dutifully repeat everything they say without question on these topics.

00:35:38.600 The only problem is, as I explained in Saving 9, all of these things ultimately endure to the detriment of everyone in society.

00:35:51.760 We must have, Glenn, I can't emphasize this enough, the Supreme Court, not the most important branch, not the most powerful branch of government, but it is the linchpin of everything else.

00:36:04.600 If we don't have an independent federal judiciary headed by an independent Supreme Court, we lose our Constitution.

00:50:59.960 You go fight that because I just read in the paper that the DA's office, the county attorney's office, is cutting deals.

00:51:11.040 Now, 24 out of the 31 attorneys that work in the Utah County Attorney's Office, 24 have now left because this county attorney is so horrible.

00:51:39.740 Prior to his tenure, it was rare for more than two attorneys to leave every year.
00:51:47.560 Now, 24 prosecutors have left and this guy is running for reelection.

00:52:04.060 And one of the things he wanted to change is get rid of the special.

00:53:03.960 And the sword is she will defend it and she will prosecute.
00:53:09.080 She will make sure if you are guilty that you pay the price.

00:53:21.120 But it's important that she's also blindfolded.
00:53:24.420 This has been all over our courthouses forever.
00:53:30.200 And it's a reminder that our court system was designed to be a refuge for the proceedings of impartial justice.

00:53:50.080 Well, unfortunately, its people have become blind.
00:53:55.580 In the name of equity and at the behest of members of an activist judiciary,
00:54:02.260 the blindfold of lady justice has been ripped off and innocent people now suffer the consequences.

00:54:12.180 The police are quitting in New York in record numbers.
00:54:15.340 And you know what the new mayor just said?
00:54:18.180 This is great. Provides a new opportunity, a great opportunity to reimagine the police department.
00:54:24.040 Bring some new blood in who who's going to work for New York.
00:54:31.360 Social justice is rearing its ugly head in historically red areas.
00:54:37.440 Now, I'm going to use this as an example.
00:54:40.800 Utah County, a Republican county attorney who, if you didn't know any better.
00:54:48.640 And you were actually seeing what was going on, not listening to the political rhetoric bullcrap, because a bullcrap will always say, no, we are making great progress.
00:54:59.100 No, we are moving to to enhance everything.
00:55:03.500 We're we're here making things better.
00:55:07.240 Twenty four attorneys have left office since he came.
00:55:10.280 Six of them went as far to publish a letter of no confidence saying, and I quote,
00:55:15.180 We declare that Mr. Levitt has vacated his responsibilities to provide you safety and protection in your person and property by failing to enforce criminal laws against offenders and by prioritizing the protection of criminals from the lawful consequences of their misconduct.
00:55:35.420 They go on to write that he disbanded the SVU unit, which was staffed by attorneys that were trained to prosecute sexual offenses.
00:55:46.740 It had a backlog of a thousand criminal cases.
00:55:53.160 Where's the justice for the victims?
00:55:57.100 They write about the abuse of his discretion by willfully ignoring statutory sentencing enhancements, diminishing the importance of criminal histories in charging decisions.
00:56:10.580 So those who have prior felony convictions, those on felony probation, those on parole from state prison can be referred to to the Utah County Justice Court for misdemeanor prosecution.
00:56:27.200 He has moved felonies to misdemeanors.
00:56:32.180 He also increased the yearly budget by five point five million dollars.
00:56:37.480 Oh, and law enforcement, I know, because I've talked to a few of them, don't trust him.

00:56:56.400 We have to understand that radical ideas are not confined to San Francisco.
00:57:01.600 They're not confined now just to our schools and not to somebody else's school.

00:57:43.320 And when you are in a county like Utah County, one of the most conservative counties in the country, you just expect things to go well.

01:09:46.280 In between that time, she made $7.2 million giving economic speeches.
01:09:52.960 And this woman comes out and says, oh, you know, I didn't really realize inflation was going to happen.
01:09:58.600 Oh, I didn't realize that turning off the economy and trying to turn it back on, like your power cycling a modem, was going to have effects on, you know, supply chains and labor markets and things like that.
01:10:08.400 Why are we giving people like this the keys to the kingdom?
01:10:14.500 Why is she getting paid millions of dollars for something, you know, economic speeches when anybody off the street could have told you that?

01:10:25.240 I will tell you, Carol, that I think what's scary is the scariest thing is once people get past the anger and they're into the bargaining, they're going to be bargaining with people like her.

01:11:58.960 But if we had not had ESG, if we had not had push from the green lobby to move capital away from investment in fossil fuels, we were on a trajectory where we could have helped fill this gap for the world.

01:12:18.520 We could have helped our friends out in Europe instead of made them beholden to Russia.
01:12:23.020 And the entire farce of this is now we have this president who is going around and they're begging countries like Venezuela, folks in the Middle East who do not get fossil fuels out of the ground and process them in the same clean way that we have the ability to.
01:12:41.780 So they have shifted the dirty fossil fuels to the other side of the globe, which I'm pretty sure shares the same atmosphere as us and saying, oh, look at us.

01:15:16.640 The U.S. government is quietly encouraging agricultural and shipping companies to buy and carry more Russian fertilizer, according to people familiar with the efforts, as sanctioned fears have led to sharp drops in supply, fueling, spiraling global food costs.
01:15:34.880 The EU and the U.S. has built exemptions into their restrictions on doing business with Russia to allow trade in fertilizer, of which Moscow is a key global supplier.
01:15:49.860 But many shippers, banks and insurers have been staying away from the trade out of fear that they could inadvertently fall afoul of the rules from the U.S. government.
01:16:00.540 Russian fertilizer exports are down 24 percent this year.
01:16:03.780 U.S. officials were surprised by the extent of the caution are in the seemingly paradoxical position of looking for ways to boost them.
