00:02:17.840 One, a positive learning environment for all students by prohibiting certain speech or expression of viewpoints that are offensive and biased against certain groups or people.

00:02:34.900 Two, an open learning environment where students are exposed to all types of speech and viewpoints,

00:20:51.080 saying that there's going to come a time when they can manipulate video that you won't believe your eyes,

00:20:59.480 And the more we are educated on deep fakes, the better chance of survival we have.

01:33:51.180 now that's huge because the

01:33:54.520 supreme court only hears about

01:33:55.900 one-tenth of one percent of

01:33:57.220 all federal cases in a year so

01:33:59.240 your circuit courts your court

01:34:01.000 of appeals they're essentially

01:34:02.700 the supreme court over those

01:34:04.200 states because 95 percent of

01:34:06.080 cases never go past the circuit

01:34:07.400 court of appeals so the fact

01:34:09.760 that he is going to have 30

01:34:12.480 appointed in those courts of

01:34:14.240 appeals by the end of the

01:34:15.340 year that's that's mad as a

01:34:46.100 switched fifth circuit was

01:34:47.220 liberal it's come come back to

01:34:48.720 conservative uh if you look at

01:34:50.500 even the ninth circus i don't

01:34:51.860 call them a circuit i call them

01:34:52.900 a circus um right now it's 16 to

01:34:56.020 six democrat judges versus

01:34:57.760 republican judges there are seven

01:35:00.000 pending open slots in the ninth

01:35:01.920 circuit he feels oh seven you're

01:35:04.020 now looking at 16 to 13 as

01:35:05.860 opposed to 16 to six which are

01:35:07.800 more likely to get some

01:35:08.800 reasonable decisions less stupid

01:42:52.000 now uh trump has nominated trump still

01:42:54.960 has about 80 nominees he needs to make he's

01:42:57.540 already nominated 82 nominees um and so

01:43:00.700 we've got 40 i know it's more than that

01:43:02.540 he's nominated 128 128 judicial nominees

01:43:06.340 there's 139 vacancies and 30 more announced

01:43:09.500 he's going to have to make about 80 more

01:43:11.640 judicial appointments just to get

01:43:13.180 those empty slots filled give me some idea

01:43:15.560 if that's a lot more than regular it's a lot

01:43:17.840 more than regular um what will happen is

01:43:20.240 over the course of four years a a president

01:43:22.760 if a president has two terms he will appoint

01:43:25.740 about 40 percent of the judiciary 874 judicial

01:43:29.180 slots so if he's in for eight years he will

01:43:31.900 get about 40 percent of those judges so at

01:43:34.700 this point in time we're you know again

01:43:36.740 almost 30 percent with court of appeals

01:43:38.820 judges in two years not eight years but in

01:43:42.160 two years and so you look at the number

01:43:44.500 slots uh it could be at the end of four

01:43:46.380 years if we can get all these nominees

01:43:47.800 done we're going to be looking at at in

01:43:50.640 that time at about 35 percent in in two

01:43:53.200 years i'm completely oblivious to how this

01:43:55.760 actually works so i'm asking honestly like

01:43:58.080 is this because i think what the the process

01:44:00.860 behind from what i understand of how trump

01:44:03.060 is doing this is it it means he's picking

01:44:04.900 good judges for these roles but what is

01:44:08.780 there anything that trump is doing to make

01:44:10.400 it so he's getting to more of them than

01:44:12.560 before or they're just more people retiring

01:44:14.040 no there are more people retiring and at

01:44:16.720 the end of the obama administration the

01:44:18.300 senate held off on on appointing any

01:44:20.240 confirming any judges so there was about

01:44:22.040 the last year of obama that nobody got

01:44:24.360 confirmed on the courts so trump inherited

01:44:27.000 over 100 open slots at that point in time

01:44:29.740 you've got a lot of judges that go out

01:44:31.920 anyway there's 30 announced vacancies now

01:44:34.020 they haven't retired but they're going

01:44:35.260 to retire so you have a pretty high

01:44:38.020 turnover anyway so it's not necessarily

01:44:40.180 what he's doing as far as getting to more

01:44:42.320 of them it's the fact that he's there was

01:44:44.260 a big backlog and the ones he's naming are

01:44:46.340 quality that's right and his selected by

01:44:48.640 ted cruz and and mike lee i mean this is

01:44:50.860 really been very few to object to there's

01:44:52.660 there's a few that we say not great i mean

01:44:55.340 there's one going california in the

01:44:56.920 ninth circuit that certainly wouldn't fly

01:44:58.760 in texas but you know it's california and

01:45:02.100 so you have to make selections from the

01:45:04.380 states where there's quotas you have to

01:45:06.560 have in the states i think california has

01:45:08.180 to have so many and you know hawaii gets

01:45:10.140 whatever and so there's seven there's

01:45:12.200 seven states in the ninth circuit and so

01:45:14.060 each one has to contribute some and so

01:45:16.300 he's limited some geographically and where

01:45:18.280 he chooses from but overall i mean the

01:45:20.080 quality of judges is just unbelievable so

01:45:21.860 talk to me about the laws that are

01:45:23.460 actually being passed because those are

01:45:24.920 things that the president you know the

01:45:26.360 incoming president whoever he might be

01:45:28.140 either in two years or in six years

01:45:30.380 he can he can reverse he can't reverse the

01:45:34.180 judges but he can reverse any kind of

01:45:37.080 executive order so talk talk to me about

01:45:38.860 the things that are not really easily

01:45:41.060 reversible what's happened is obama used

01:45:43.760 a lot of executive orders he had a phone

01:45:45.380 and a pen and he used it very aggressively

01:45:47.320 in the first six months of the trump

01:45:50.260 administration 46 substantive laws were

01:45:53.200 signed substantive laws were passed by

01:45:54.920 congress signed by the president that's

01:45:56.920 more than any congress in 30 years of

01:45:59.500 those 14 were permanent repeals of

01:46:02.660 executive orders by obama so under the

01:46:05.660 congressional review act of 1996 of a if

01:46:08.520 a executive order goes through congress

01:46:10.300 can override that order and once you do it

01:46:12.280 it's going to take a federal law to set it 0.99

01:46:14.500 back in place so it becomes very hard to

01:46:17.580 go back which ones those were oh i don't

01:46:19.420 i have a list of them but i don't recall

01:46:20.780 what they were but it's going to become

01:46:22.620 hard for a president to issue an executive

01:46:24.500 order and get back to where obama was

01:46:26.240 because now you got federal laws it's a

01:46:27.980 gingrich era reform right that really had

01:46:30.980 never been used that's right until until

01:46:33.060 this administration and they're using it

01:46:35.140 aggressively and you know we hear that

01:46:37.120 congress not getting things passed and

01:46:38.500 it's true on signature stuff they didn't

01:46:39.980 get obamacare yeah but you know they got

01:46:41.980 the individual mandate moves though but

01:46:43.920 the the stuff they are passing is not

01:46:46.160 small stuff uh and and they measure a

01:46:49.220 substantive act by you're not naming a

01:46:51.260 post office you know you're actually

01:46:52.880 doing something real and so 14 of those

01:46:55.740 were permanent repeals of executive

01:46:58.520 orders under the obama administration

01:47:00.780 that can't come back again so that that's

01:47:03.000 good uh other things that are happening

01:47:05.160 is what particularly trump is doing with

01:47:07.380 religious liberties it's going to be

01:47:09.560 really hard for the next president to

01:47:11.640 actually reverse that because for

01:47:13.400 example one of the things that that

01:47:14.800 happened we saw with harvey hurricane

01:47:16.620 harvey is fema is not allowed to serve 1.00

01:47:19.820 churches and others that get hit by

01:47:21.860 harvey well trump reversed that it's

01:47:24.320 going to be hard for president to come

01:47:25.580 back in and say oh yeah we're going to

01:47:27.180 exclude churches from from disaster

01:47:29.440 relief that's i mean just pr wise you

01:47:31.940 can't do that this is right to try uh

01:47:34.520 act the right the right to try was huge

01:47:36.920 yeah that's right they've been i mean

01:47:38.180 republicans have been trying to get that

01:47:39.180 done for a long time yeah nate mcmill

01:47:44.000 done it it's a state thing it's just the

01:47:45.860 feds haven't got on board of right to

01:47:47.780 try so can i ask you don't know what

01:48:31.940 first class airfare and he had spent too

01:48:41.980 pointless optics optics mistakes right like

01:48:44.620 there's no reason you know you shouldn't
