00:04:19.660I think, I think yesterday, all, everything that could be said about this trial, I'm skipping to the end because there's a lot in between, but let me skip to the end.

00:04:37.340Why would you think that that made it okay for you without any advance notice to bring this matter before the jury?
00:04:45.520You are already, you were, I was astonished when you began your examination by commenting on the defendant's post-arrest silence.
00:04:56.080Because that's basic law. It's been basic law in this country for 40 years, 50 years.
00:05:01.560I have no idea why you would do something like that.
00:05:03.940And it gives, well, I'll, I'll leave it at that.
00:05:10.080He goes on and on. It's several times the judge yesterday read him the riot act, the prosecutor, and said to the prosecutor, one more time and we're done here.
00:05:24.160And I think the prosecutor is going for a mistrial.
00:05:57.880Meaning they cannot come back because the idea when I, when a prosecution tries to blow a trial intentionally, the idea is they're so far behind.
00:06:11.480So, but if the judge senses they're doing it intentionally, they can say, they can dismiss it with prejudice and say, you, we do not have another opportunity here.
00:06:20.400You don't get another chance at the plate.
00:06:21.880So what they're going to do is they're going to blame it on the judge and say the prosecution was trying to do their job.
00:06:30.820Now here's where they have the crazy zealot judge thing to use the media.
00:06:36.980Yesterday, during the trial, a phone went off.
00:06:39.880They say that it was the judge's phone, but they don't know for sure whose phone it was.
00:06:45.000But everybody in the, on the mainstream media were immediately saying, oh my gosh, the judge, he's got a ringtone on his phone, which is God bless the USA.
00:07:31.220And they think that you're in the, now, I mean, again, this is generalizing.
00:07:34.920Not everybody on that side is like that, but I mean, they, they immediately went as they do with all things to Donald Trump, who apparently played this at rallies.

00:13:25.160I've got several things to play for you and I think you have the list so you can, you can call these things out on the things you want to comment on.
00:13:33.540Um, but also I'd like to hear just your, have you ever seen anything like this trial before ever?
00:13:44.580Uh, you know, I went into this trial expecting, um, kind of a standard approach by the prosecutor and, and the defense.
00:13:52.740And we've seen just some weird plays by both of them, uh, which is, uh, the prosecutor is blowing my mind here because he opened up kind of strong with a decent opening statement.
00:14:06.740But as the days went on, it, you could see his narrative crumble.
00:14:10.720And I think the, the big problem for him is that he has to know that the facts on this are on the side of Kyle Rittenhouse and they always have been.
00:14:18.720Right. So, I mean, he is the guy who decides whether or not this moves forward.
00:14:25.600Was it all just political or mob pressure?
00:14:30.600Uh, I think the political environment plays a big part, a big part in why this, this case was brought, but to give Binger a little bit, Binger being the lead prosecutor on the case, he is an assistant district attorney.
00:14:43.920So this is delegated down, um, from the district attorney of the County, but he, I mean, he can refuse it.
00:15:23.360You, you have to write, uh, we've watched the, we've watched the videos and when these videos first came out, you know, I looked at them personally and I said, that looks, that looks a lot like self-defense.
00:15:34.400That looks like a really good case of self-defense.
00:15:36.600And then when you read the complaint that they filed and you realize that they're there, the, the first part of the complaint was written based on the eyewitness account of Richie McGinnis, who works for a daily caller.
00:15:50.300And you read it and it's like, this looks like this was written by a defense attorney making a self-defense case.
00:15:56.240And then we're all just baffled at what, why would you bring this?
00:15:59.940Because you're going to have to call Richie McGinnis.
00:16:03.100You're going to have to call Ryan Balch.
00:16:05.160You're going to have to call these guys who are out there, uh, either on Kyle's side or politically disposed to him.
00:16:11.220And their narrative of the case screams self-defense.
00:21:01.120But you understand how dangerous it is to point a gun at someone, don't you?
00:21:06.940I pointed at him because he kept running at me and I didn't want him to chase me.
00:21:11.320This is an amazing thing because, you know, if you've taken any classes on shooting, you never point a gun to some at somebody unless you intend on shooting and killing them.
00:21:22.300However, I've always found that to be counterintuitive because if you don't want to shoot somebody, you do want to show them that you might, you know, you want them to feel like he could shoot me.
00:22:03.560But most people don't want to ever pull the trigger.
00:22:06.740I mean, one, even if you're a cold, you know, just rationale based person, you're going to say, if I pull this trigger, I'm going to have to go through what Kyle's going through.

00:24:48.420We're talking about the the Rittenhouse trial.
00:24:53.020And before we went to break, I said that at least I felt there was multiple, multiple times that Rittenhouse credibly said,
00:25:03.740Well, no, I I didn't shoot him at that point because he wasn't threatening me as hands up or he was, you know, they backed off, which I thought showed that he was not out just to kill people.
00:25:17.820He was only shooting at people who were a threat to him.
00:25:23.980Yeah, Glenn, that's I mean, it's a great point.
00:25:26.860And it's ironically a point the prosecution has made several times throughout the case, pointing out, pointing out all these times that this kid showed remarkable restraint.
00:25:39.640And and even with the very first encounter with Joseph Rosenbaum, who has thrown a bag at him and that the prosecution is trying really hard to make sure, you know, there was definitely nothing deadly in the bag.
00:25:52.720As if Kyle would know this at this point and that actually matters, he's he's thrown a bag at him.
00:26:11.120Kyle, instead of just shooting, which he may have even been justified in doing at that point, he turns around and runs until he can run no further.
00:26:26.180And he said even when he was surrounded by the crowd and some of them were advancing, he held up his gun.
00:26:31.760And if they put their hands up and stopped, he didn't shoot.
00:26:35.300I mean, it shows that he was thinking all the way through, which, you know, he talked about almost tunnel vision at the end.
00:26:42.440And that guy was under incredible stress.
00:26:45.700And yet he was still functioning, you know, and and doing the right thing.
00:26:52.820Nick, there was there was a back and forth I wanted to get your thoughts on, because I didn't even understand a couple of times where the prosecution was even going with some of these lines of questioning.
00:27:00.960At one point, they asked Rittenhouse, do you think the protesters were hostile to you?
00:27:06.300And he says, no, they generally weren't.
00:27:08.400Then he said, why did you bring your gun then?
00:27:10.820And he said, well, I mean, I wanted to protect myself in case someone was going to attack me.
00:27:53.280Well, I think there's a couple angles here.
00:27:56.960And one of them, it goes back to the bad facts for the prosecution.
00:28:01.300I think you might be the race thing could be in there for sure.
00:28:06.020Just general politicizing, polarizing statements would would maybe prejudice Kyle in the eyes of some of the jury members.
00:28:14.440From a legal perspective of what they're trying and you have to put yourself in the mind of a dishonest person.
00:28:23.180Thank God I'm a lawyer and can do this.
00:28:24.960But you have to you have to be able to to do this under Wisconsin self-defense law.
00:28:32.100And generally speaking, this is kind of a rule in self-defense.
00:28:35.700But if you provoke the encounter and use that as an excuse to use self-defense, then it'll defeat your ability to to invoke that.
00:28:45.360So what I think Binger is trying to do here is get Kyle to say, I knew the crowd was hostile and then paint the narrative that he wanted to go out there knowing they would attack him.
00:29:37.720If you're looking at political and not necessarily if you're looking for social justice and not actual justice, you don't like this guy, which is which is right.
00:29:48.260Is he a hard ass that just has a, you know, a point of view or is he really towing the line on the law?
00:29:56.400He's he's been pretty fair and consistent.
00:29:59.060And for me, when I think about a judge, what I want is someone who is fair and consistent.
00:30:06.560You know, even even if they're consistently bad in this case, I think this judge is phenomenal.
00:30:16.660He's he's pulled out commentary books and read them to make sure he gets his rulings right.
00:30:21.140This guy is being very, very careful on his on his rulings and how he manages his courtroom.
00:30:27.720And if anybody thinks he's being biased in a particular way, it's because the attorney on that side has been acting in a particularly egregious manner.
00:30:39.400I think you played a clip right at the beginning of the show where the judge was dressing down for flagrantly violating Kyle's constitutional rights.
00:30:49.320No, the his Fifth Amendment right to not speak.
00:30:53.960One of the first things Binger did when he got Kyle on cross-examination is that he stood up and said, you know, you had the opportunity to speak before this.
00:31:05.760Every prosecutor knows you cannot go down this line because you cannot draw any inference from a person exercising their constitutional right to remain silent.
00:31:17.500And him trying to elicit that in front of the jury bordered on having the case thrown out immediately.
00:31:24.200And he also tried to introduce things that the judge said he couldn't introduce, right?
00:31:36.380And they excluded these two incidents that Kyle was involved in prior to the event and one meeting at a bar that Kyle was photographed at after the event.
00:31:50.220The latter one, because it has no relevance on what Kyle's state of mind was at the time, because it was four months later.
00:31:56.940The other two on similar grounds, but the judge didn't want those two acts, which are not directly related to prejudice, the jury's opinion of Kyle.
00:32:08.080And he ruled that they could not bring them in.
00:32:09.940Now, the prosecutor claims that he thought that they had opened the door to that with other testimony.
00:32:16.540And the judge said, I've ruled on this.
00:32:18.640If you wanted to bring it up, you needed to come to me and ask the court for permission before trying to prejudice him in front in front of the jury.
00:32:32.860You know, it can either go all the way to the jury decision or the judge can make a ruling on the case.
00:32:40.080The defense is in the process of filing a motion to dismiss and or a motion for a mistrial and asking for a dismissal with prejudice.
00:32:49.960I believe they will also file a motion to dismiss at the close of the case based on the fact that the prosecution simply hasn't made the case for any of the any of the major charges.
00:33:03.020So if the judge rules on it and dismisses it with prejudice, it's gone.
00:33:08.960Kyle cannot be brought back into court for these charges.
00:33:11.780If the jury goes, they can either render one of basically one of three verdicts.
00:33:17.080You've either got not guilty, which is a unanimous decision, or you've got guilty, which is unanimous, or you have a mix of votes which will result in a mistrial.
00:33:27.080And in that case, theoretically, the state could bring the charges back against them.
00:33:31.460So if he is if the judge dismisses it, it's done.
00:33:35.760But can't they dismiss it with prejudice?

00:39:58.920It doesn't matter how much we can know the fact that we have everything on video, the fact that we have prosecution witnesses.
00:40:07.740Confirming the story of Kyle Rittenhouse, the fact that we can all look at all of the details and it is blatantly clear to anyone who is honest and observing it that he was defending himself in those moments.
00:40:20.220But they locked into this narrative at the very beginning and they will do anything, including saying, well, the judge had a patriotic song as his ringtone.
00:40:28.640They will do anything so they do not have to abandon that dumb, ill-informed position they took in minute one.

00:40:39.440I think Tucker said it right when he said, when he said about the child molester that Rittenhouse shot, he went out the way he lived his life.

01:06:13.420It said in that one, ethnically motivated violent extremists and anti-government, anti-authority violent extremists remain a national threat priority for the United States.

01:08:15.040If a new COVID-19 variant emerges and new restrictions are imposed,
01:08:19.560anti-government violent extremists could potentially use the new restrictions as rationale to target government or public health facilities.

01:09:27.280Now, I know what racists are going to do or they're going to connect these two stories, but there is no connection to these stories.
01:09:35.480I just wanted to let you know that the new mayor of New York, he wants to go back to actual, you know, time proven law enforcement kind of rules.
01:09:51.720And the Black Lives Matter people and the leader met with him because he'd like to he said, let's have a sit down.
01:09:59.380Let's talk. And they had a debate and they were going back and forth on police reform.
01:10:04.400And it was kind of contentious. And he even found, you know, some common ground with the activists.
01:10:12.740But he's like, I'm bringing the anti-crime unit back.
01:10:16.560And the co-founder of the New York BLM said, if you think you're going to bring back the old ways of policing, then we're going to take to the streets again.
01:10:26.560And I'm quoting, there will be riots, there will be fire, and there will be bloodshed.
01:14:36.540If you have your vice president and an old man who is not the picture of health with another three years to go, what is your plan in case something goes wrong?
01:16:00.360The only president that he is more popular at at this point in his presidency is Donald Trump.
01:16:05.860And Trump, of course, came in as a divisive guy and never really excelled with approval rating.
01:16:12.360However, this Susquehanna poll you just discussed would put him below Donald Trump.
01:16:16.400It's just his average because he's got a couple of polls that have him in the mid-40s.

01:16:26.080And of course, as you might know, with Donald Trump, he has the entire media saying he's Hitler on their news broadcasts every day.

01:16:46.300If you would total all that up against Donald Trump.
01:16:49.900But Kamala or Kamala, she is she's unpopular for a whole new set of reasons.

01:33:04.460I lost my leg because when I escaped out of the top of the vehicle, I jumped off and couldn't see anything around me because my face was on fire.
01:33:14.060So when I landed, 10-foot jump, I couldn't brace myself for the landing.
01:34:42.420He goes all over the United States and helps us because he wants to help the next family and the next hero that, you know, has paid a big price for our freedom.
01:35:25.600As God is my judge, any family that serves our country and you die and you leave behind a young family, we're going to take care of your family that's left behind.
